Abstract

Rehabilitation is one of the government's efforts to tackle narcotics abuse. This effort is an alternative effort or action, because the perpetrators of narcotics abuse are also victims of narcotics addiction that requires treatment or care. This treatment or treatment is carried out through rehabilitation facilities. The research problem that will be discussed in this research is how the procedure of implementing medical rehabilitation for narcotics abuse victims, the method of using Normative Juridical Approach and Empirical Approach, the source of data is obtained from the field and library. Types of data obtained secondary data and primary data Data collection is done by means of library studies and subsequent studies were analyzed quantitatively. Based on the results of research and discussion, it is known that the procedure for implementing medical rehabilitation for narcotics abuse victims based on PERBER / 01/111/2014 / BNN, namely narcotics addicts who have received a court decision to undergo treatment or treatment through rehabilitation, is submitted by the prosecutor's office to a medical rehabilitation facility the appointed narcotics convict is accompanied by the minutes of the court decision and signed by the patient and family / guardian. Suggestions that can be delivered It is hoped that for law enforcement, in this case the judge is brave to decide a heavy sentence in accordance with the law. And the Provincial Narcotics Agency is making more serious efforts in preventing narcotics abuse by involving all law enforcement authorities.

Abstract

Illicit drug trafficking undermine governance, institutions and societal cohesion. Drug traffickers typically seek the path where the rule of law is weak. In turn, drug-related crime deepens vulnerability to instability and poverty. In the period of the past two decades, Indonesia has become one of the countries that serve major markets from narcotics syndicate of international dimension for commercial purposes. For drug trafficking network in Asian countries, Indonesia is considered as the market (market- state) is the most prospective commercial for the International syndicates operating in developing countries.

Abstract

Act number 35 in 2009 provides severe criminal sanction for narcotic abuser in forms of imprisonment and fine sanctions. However, the narcotic abusers are in fact increasing. This is caused by criminal sentencing that does not provide deterrent effect for the narcotic abusers. The problems in this research were how did the effectiveness of imprisonment for the narcotic abusers. This research used normative and empirical jurisdiction approaches. Data were collected with literary and field studies. Data were analyzed qualitatively. The results showed that: effectiveness of imprisoning sentence for narcotic abuser so far was not effective. The researcher suggests the Indonesian Minister of Law and Human Right to provide enough structure and infrastructure, to build new facilities of Department of Corrections, department of Correction should prepare its officers with trainings related to narcotics and cooperate with National Narcotics Agency

Abstract

ABSTRAK The imposition of capital punishment on narcotics and psychotropic criminals in Indonesia in the perspective of human rights based on the 1945 Constitution needs to be reviewed to understand whether capital punishment is a way of law enforcement that is contrary to human rights. The main problem being the object of research, is the imposition of capital punishment against narcotics and psychotropic criminals violating human rights based on the 1945 Constitution. This research is a normative legal research through a legislative approach, conceptual, case. The data used is secondary data with qualitative data analysis. The results of the study show that the imposition of capital punishment on narcotics and psychotropic criminals does not violate human rights because it does not conflict with the provisions of Article 28A, Article 28I paragraph (1) and Article 28J paragraph (2) of the 1945 Constitution and does not violate Indonesia's international legal obligations that were born from international agreements on the eradication of illicit trafficking in narcotics and psychotropic substances. As a suggestion, law enforcement needs to be improved, because crime / narcotics and psychotropic crimes are transnational types of crime by using high modus operandi.

Abstract

Problem penegakan hukum pidana mati dalam tindak pidana narkotika dan psikotropika di Indonesia masih saja banyak menghadapi kendala berkaitan dengan perkembangan masyarakat yang terjadi. Masalah dalam penelitian ini adalah bagaimanakah penjatuhan pidana mati terhadap pelaku tindak pidana narkotika dan psikotropika dalam praktik peradilan pidana di Indonesia. Penelitian ini merupakan penelitian hukum normatif melalui pendekatan perundang-undangan, konseptual. Hasil penelitian menunjukkan penjatuhan pidana mati terhadap pelaku tindak pidana narkotika dan psikotropika tidak melanggar hak asasi manusia karena tidak bertentangan dengan ketentuan Pasal 28A, Pasal 28I ayat (1) dan Pasal 28J ayat (2) UUD 1945 dan tidak melanggar kewajiban hukum internasional Indonesia yang lahir dari perjanjian internasional tentang pemberantasan peredaran gelap narkotika dan psikotropika sehingga penegakan hukumnya perlu ditingkatkan. Saran perlu adanya perubahan aturan yang tegas tentang eksekusi putusan pidana mati bagi terpidana mati agar pelaksanaan nya tidak terlalu lama.

Abstract

Drug abuse problem, it is already very alarming, this was due to the development of scienceand technology, as well as the impact of globalization, the current transportation is very advanced. The problem in this research is how the legal considerations of the Military Court of the Military Members who abuse Narcotic Drugs and Psychotropic? Normative juridical approach and empirical, data analysis used is qualitative. The result is the legal considerations Military Court. Although this criminal act is a special type of criminal offense, but the presumption of innocence remains to be upheld in view of the defendant are also human beings who have rights. Based on Military Justice Putuasan Number: PUT / 17-K / PM 1-04 / AD / I / 2014 which involves Yuli Basuki Rahmat sergeant demanded prison for four (4) years for the accused detained temporarily reduced and a fine of Rp 800,000,000, - ., subsidiary 2 months in jail as well as additional criminal fired from military service. Saran, the Military Court Judge is expected to be able to apply the death penalty because of the impact of this extraordinary crime that can damage the physical and mental youth.

Abstract

Prosecutors as law enforcement institutions carry out execution of state loot in various ways, one of which is auctioned for the country. One of the loot state executed by the state attorney of Bandar Lampung by means of auction is a unit of vehicle twowheeled vehicles as contained in the quote treatise Number: 908/2016 issued by the State Wealth Service office and auction of Bandar Lampung. The results of this study showed: (1) The protection of the law against the auction winners of the state booty in the form of two-wheeled vehicles executed by way of auction by the attorney in quotation treatise number: 908/2016 can be realized by enforcing legislation or special policies in order to fulfill the right of auction winners to manage and possess vehicle ownership documents both STNK and BPKB. (2) The legal certainty of the winner of the state Booty auction in the form of a two-wheeled vehicle executed by way of auction by the Prosecutor has not materialized because the auction winner cannot take care of and have the vehicle ownership documents both in the form of STNK The winner of the auction in this case only accepts auction treatise quotes number: 908/2016 which serves as a buy and sell deed.

Abstract

AbstractThis research aims to find out and understand the meaning of crime and criminal acts and how is the accountability of the perpetrators of criminal acts spreading fake news through social media. The conclusion of the research is that a criminal act or a criminal act is an act that is incompatible with or violates a legal rule or an act that is prohibited by a legal rule accompanied by a criminal sanction where the rule is aimed at the act while the threat or criminal sanction is aimed at the person who commits or the person. that caused the incident and the perpetrators of the crime of spreading fake news through social media can be held accountable if they violate Article 28 paragraph (1) of the ITE Law, which is an act intentionally, and without the right to spread false and misleading news that results in consumer losses in Electronic Transactions, at where the perpetrator can be sentenced to imprisonment of up to 6 (six) years and/or a maximum fine of Rp 1,000,000,000.00 (one billion rupiah). Research suggestions are to prevent participating in spreading fake news, we should eliminate the habit of sharing content without reading the contents thoroughly. then we should not easily believe or be tempted by certain news or offers through social media so that we do not become victims of fake news or offers through social media.Keywords: Criminal Liability; Fake News; Social Media.AbstrakPenelitian ini bertujuan untuk mengetahui dan memahami pengertian tindak pidana dan tindak pidana serta bagaimana pertanggungjawaban pelaku tindak pidana menyebarkan berita palsu melalui media sosial. Kesimpulan dari penelitian ini adalah bahwa perbuatan pidana atau tindak pidana merupakan suatu perbuatan yang tidak sesuai atau melanggar suatu aturan hukum atau perbuatan yang dilarang oleh aturan hukum yang disertai dengan sanksi pidana yang mana aturan tersebut ditujukan kepada perbuatan sedangkan ancamannya atau sanksi pidananya ditujukan kepada orang yang melakukan atau orang yang menimbulkan kejadian tersebut. Kemudian pelaku tindak pidana penyebaran berita bohong melalui media sosial dapat dimintakan pertanggungjawabannya apabila melanggar Pasal 28 ayat (1) UU ITE yaitu suatu perbuatan dengan sengaja, dan tanpa hak menyebarkan berita bohong dan menyesatkan yang mengakibatkan kerugian konsumen dalam Transaksi Elektronik, di mana terhadap pelaku dapat dipidana dengan pidana penjara paling lama 6 (enam) tahun dan/atau denda paling banyak Rp1.000.000.000,00 (satu miliar rupiah). Saran penelitian adalah untuk mencegah turut serta menjadi penyebar berita bohong, maka hendaknya kita menghilangkan kebiasaan membagikan konten tanpa membaca isinya secara menyeluruh. Kemudian hendaknya kita jangan mudah percaya atau tergiur dengan adanya berita atau penawaran tertentu melalui media sosial sehingga kita tidak menjadi korban berita atau penawaran bohong melalui media sosial.Kata kunci: Tanggung Jawab Pidana; Berita Bohong; Media sosial.

Abstract

The resolution of a criminal offence does not have to be carried out through legal channels. Still, it can be done in the spirit of restorative justice, one of which uses the principle of ADR (Alternative Dispute Resolution) or (win-win solution) through the Rembuk Pekon which means through consensus agreement. This study aims to determine what crimes can be resolved with the Pekon consultation, how the process is resolved, and what the legal consequences are. This study uses an empirical normative method by examining the methods, norms, rules and primary data through observation and interviews, the results of the study indicate that the types of criminal acts that can be resolved with Rembuk Pekon include minor criminal offences Article 302, Article 352 paragraph (1), Article 364, Article 373, Article 379, Article 482, Article 315, Article 407 paragraph 1, and the criminal offence of complaint Article 284 of the Criminal Code. So in this study will discuss how the process of resolving minor criminal cases through the Rembuk Pekon and the authors have a suggestion that the police should implement the Rembuk Pekon to prioritize the principles of professional, modern and reliable, this so that the implementation of the Rembuk Pekon can run optimally.
