Abstract

Crime and drug crimes are a form of victimless crime. These victimless crimes tend to increase in scale when specific agencies or groups are involved, such as the police, prosecutor's office, courts, customs, immigration, and special agencies. Abuse of drugs and illegal substances is on the rise and is a long-standing phenomenon. This will cause enormous damage to generations of citizens. The research method used in this research is a normative legal approach and an empirical approach. Secondary data is data obtained through library research, such as literature and scientific works related to research problems. Secondary data consists of 3 (three) legal materials, primary, secondary and tertiary legal materials. The research results obtained by the factors that cause cases of narcotics abuse that occur in Gedong Tataan are mostly due to work factors such as drivers which require them not to fall asleep to meet the target delivery time, therefore many narcotics are abused, such as crystal methamphetamine, and abuse often occurs due to environmental factors. Then the application and consequences of the application of the court decision based on decision number: 52/Pid.Sus/2023/PN.Gdt and Law number 35 of 2009 concerning narcotics as the application of the law carried out by the Gedong Tataan District Court against the defendant. Declare the defendant I Ridho Priyanto bin Atip Sumantri and the Defendant, Dedi Firmansyah bin Muhaimin, have been legally and convincingly proven to have committed the criminal act of "Misusing Class 1 Narcotics for Yourself, Done Together" as in the indictment for violating Article 127 paragraph (1) letter a of Republic of Indonesia Law Number 35 In 2009 regarding narcotics junto Article 55 of the Criminal Code, as well as the amount of narcotics influenced the judge's decision in applying the law in deciding the charges against the defendant.

Abstract

Crimes committed by a criminal will have a risk that must be borne by a criminal, this risk may result in the perpetrator of the crime having to account for his actions in the form of confinement which of course is based on the provisions stated in positive Indonesian law, namely according to what is stated in the law. In the Criminal Code, accountability is one of the forms of crime that must be accounted for by the perpetrator of the crime, in committing the crime it is known that there are several factors that cause the perpetrator to commit a crime, the result of a crime committed by the perpetrator has an impact on the victim, resulting in the victim the condition of his health became bad, due to the persecution in the form of beatings by the perpetrators.

Abstract

The procurement of goods and services encompasses several stakeholders, necessitating the establishment of ethical standards, norms, and principles to effectively control and inform the policy-making process in this domain. The objective of this study is to examine, comprehend, and analyze the execution of Article 38 in Presidential Regulation Number 12 of 2021, which pertains to the procurement of goods and services by the government through E-Purchasing. Additionally, this research aims to identify the issues that impede the effective implementation of these provisions. This study employs normative and empirical legal methodologies. The execution of Article 38 of Presidential Regulation Number 12 of 2021, which pertains to the government's procurement of goods and services through E-Purchasing, has been partially implemented but not fully optimized due to various challenges. These challenges include insufficient capacity among civil servants to meet the demands of their tasks and workload, inadequate comprehension of the primary responsibilities and functions of electronic application services, limited understanding of human resources, and insufficient supervision and guidance in the implementation of Article 38 of Presidential Regulation Number 12 of 2021.

Abstract

Beauty products that are illegal without a distribution license from the Food and Drug Administration may contain ingredients that are very harmful to the skin. Cosmetics according to the Minister of Health Regulation are materials used on the outside of the human body. One of the legal events regarding illegal beauty products without BPOM supervision as stipulated in the Tanjung Karang Class IA District Court Decision Number 418/Pid.Sus/2023/PN.Tjk. The problems in this study are what are the causal factors and reasons for the perpetrators to commit the crime of distribution of illegal beauty products without the Food and Drug Supervisory Agency and how the criminal liability of the perpetrators of the crime of distribution of illegal beauty products without the Food and Drug Supervisory Agency (Based on Decision Number 418/Pid.Sus/2023/PN Tjk). The research method used in this research is through normative juridical and empirical juridical approaches using secondary and primary data. Data collection is done by literature study and field study. The results of this thesis research can be concluded that the factors that cause the perpetrators to commit the crime of distributing illegal beauty products without the Food and Drug Administration are basically 2 factors. Namely the profit factor and the opportunity factor so that these circumstances force the defendant to commit the criminal act of distributing illegal beauty products. Then criminal liability for the perpetrator of distribution of illegal beauty products without the Food and Drug Administration (Based on decision number 418/Pid.Sus/2023/PN.Tjk), namely the defendant was secured by members of the BBPOM Bandar Lampung PPNS and then sentenced to imprisonment for 2 (Two) months minus the period of arrest and / or detention that has been served, and a fine of Rp. 10,000,000,00, - (ten million rupiah) subsidized by 1 (One) month of confinement as stated in decision number 418/Pid.Sus/2023 / PN.Tjk. Suggestions addressed by the author to law enforcement officials are expected to be able to improve their performance to overcome cases of illegal sales of beauty products containing hazardous ingredients quickly, and consider the use of legal instruments in the form of laws in accordance with the conditions of the case being handled and be more consistent and firm in applying legal provisions regarding cosmetics that do not have a distribution permit so that the application of sanctions is not different and not too light so that it can provide a deterrent effect to cosmetic business actors who do not have a distribution permit. Then the government should coordinate and cooperate with each other in eradicating the circulation of cosmetics without a distribution permit by applying the principles of coordination, integration and synchronization, especially the Food and Drug Supervisory Agency. In addition, it is expected that the public, especially women, should be more careful in choosing cosmetic products. Before buying a product, it would be nice to check the brand, expiration date, content, indications, and have been registered with BPOM.

Abstract

Sexual harassment is behavior or attention of a sexual nature that is unwelcome and undesirable and has the effect of disturbing the recipient of the harassment. Sexual harassment includes, but is not limited to: sexual payment for wanting something, coercion to carry out sexual activities, derogatory statements about sexual orientation or sexuality, requests to perform sexual acts that the Child likes, speech or behavior that has a sexual connotation; all can be classified as sexual harassment. This action can be conveyed directly or implicitly. The problem in this research is what are the factors that cause children to commit the crime of persuading victims to commit sexual intercourse based on Decision Number 40/Pid.Sus-Anak/2023/PN. Tjk? and What is the criminal responsibility for children committing the crime of persuading the victim to commit sexual intercourse based on Decision Number 40/Pid.Sus-Anak/2023/PN. Tjk? The research method used in this thesis research is a normative juridical approach and an empirical approach. Secondary data is data obtained through library research, such as literature books and scientific works related to research problems. Secondary data consists of 3 (three) legal materials, namely, primary, secondary and tertiary legal materials. Prime data is data obtained from research results in the field directly on the research object (field research) which is carried out by means of direct observation and interviews regarding the object in writing this thesis. Based on the research results obtained, it can be concluded that the factors causing a father to commit a criminal act of deception and persuading a child to have sexual intercourse are due to several factors such as internal factors in the form of the defendant's lack of understanding of religion. The defendant's mental condition was also a contributing factor, as well as the defendant's sexual disorder such as pedophilia, where the defendant preferred small children to someone his own age. Apart from internal factors, there are external factors that also influence the defendant in committing the crime, such as environmental conditions and the condition of the defendant's place of residence which support the commission of the crime, being unable to give vent to his sexual desires because his wife is not at home, the defendant's low education, and the media. and technological advances were also part of the external factors that caused the defendant to commit this act. Criminal Responsibility for Children Committing the Crime of Inducing the Victim to Commit Sexual Intercourse Based on Decision Number 40/Pid.Sus-Anak/2023/PN. Tjk with the punishment of institutional development for 2 (two) years at the Bandar Lampung Class II Special Child Development Institution (LPKA) in Masgar Pesawaran and job training for 3 (three) months at the Social Welfare Organization (LPKS) in Hurun Pesawaran Village. The suggestions that can be conveyed in this writing are suggestions for the community, especially parents, to provide sex education in the family environment in order to minimize the occurrence of free sex among the next generation of the nation as it is known that free sex can cause dangerous sexually transmitted diseases, otherwise done correctly and precisely. and Suggestions for the Government. There needs to be a law that emphasizes the protection of women and children and socializes it within the community so that people know the consequences of the act of rape.

Abstract

The problem of narcotics abuse in Indonesia is currently very worrying. This is due, among other things, to Indonesia being located between two continents and considering the development of science and technology, the influence of globalization and very advanced transportation and a shift in materialistic values with the dynamics of the target market for illicit trafficking. Narcotics are drugs or substances that are useful in the fields of medicine, health services and scientific development. However, on the other hand, it can cause dependency which is very detrimental if it is used without control and supervision by certain individuals. Then, to make it easier to pronounce it, it can be abbreviated to the term Narcotics, namely Narcotics and dangerous addictive drugs. The problem in this research is what are the factors that cause perpetrators to abuse class I narcotics for themselves and how accountable perpetrators of class I narcotics abuse are for themselves based on Decision Number: 103/Pid.Sus/PN Kot. The research method used in this research is a normative juridical approach and an empirical approach. This normative approach is carried out by viewing legal issues as rules that are considered appropriate to normative juridical research. Normative juridical research is carried out by means of literature studies on matters of a theoretical nature, namely an approach carried out by examining legal sources, legal principles and opinions of scholars as well as applicable laws and regulations. The Empirical Approach is an approach carried out through direct research on the research object by means of observation and interviews related to the research problem. The results of this research show that the factors that cause perpetrators to abuse class I narcotics for themselves are based on internal and external factors. The internal factors that exist in himself are due to problems in his family or at home where he is looking for an escape to calm himself down, while external factors occur due to the influence of bad social interactions and the curiosity of young people. Then, the responsibility of the perpetrator of the crime of narcotics abuse of class I is for himself, which can have a detrimental impact on individuals and society, especially the younger generation, and can even cause a greater danger to the life and cultural values of the nation. In this case the defendant has been detained by members of the Tanggamus Police. The prosecutor as public prosecutor imposed charges against the defendant in the form of imprisonment for 1 (one) year and 4 (four) months, which the judge then sentenced to imprisonment for 1 (one) year as stated in Decision Number 103/Pid.Sus/ 2023/PN City. The author's suggestion is for the public to be careful and more aware of narcotics abuse in their environment by taking approaches so as not to cause division and providing support to stop using narcotics and not ostracizing narcotics abusers. For the government/officials to further improve the quality of training for convicts who abuse narcotics and be more active in implementing the eradication of narcotics abusers.

Abstract

This research examines the regulations surrounding Public Information Disclosure, which mandates that public institutions in Indonesia furnish and manage public information as part of their governmental duties. The purpose of this study is to analyze the normative aspects and practices of implementing public body obligations that are the object of Article 7 Paragraphs (1) and (3) in providing and managing public information. The research method used is normative juridical. From the results of the study, it can be concluded that Article 7 paragraphs 1 and 3 of the KIP Law have normative aspects and implementation of public body obligations. The results of the study indicate a gap between the legal norms regulated in the KIP Law and their implementation in the field. The juridical analysis identified several inhibiting factors, including diverse legal interpretations, limited supporting legal infrastructure, and lack of harmonization between the KIP Law and other sectoral regulations. The conclusion of the study is that effective implementation of Article 7 of the KIP Law requires a comprehensive approach involving legal reform, institutional strengthening, and increasing legal awareness of government officials and the public towards more transparent and accountable governance.

Abstract

AbstrakTujuan dari penulisan ini adalah untuk mengetahui, memahami dan menganalisis faktor penyebab pelaku melakukan bisnis narkotika tanaman jenis ganja dan menganalisis pertimbangan hakim terhadap pelaku bisnis narkotika dalam bentuk paket secara terorganisir di Pelabuhan Bekauheni berdasarkan Putusan Nomor : 149/PID.SUS/2022/PN.Kla). Metode penelitian yang digunakan dalam penulisan ini yaitu hukum normative. Tindak Pidana Narkotika diatur didalam Undang-Undang Nomor 35  Tahun   2009, pada hakikatnya hukum itu mengatur masyarakat secara patut dan bermanfaat dengan menetapkan apa yang diharuskan ataupun yang dibolehkan dan sebaliknya. Hukum dapat mengkualifikasi sesuatu perbuatan sesuai dengan hukum atau mendiskusikannya sebagai melawan hukum. Perbuatan yang sesuai dengan hukum tidak merupakan masalah dan tidak perlu dipersoalkan; yang menjadi masalah ialah perbuatan yang melawan hukum, bahkan yang diperhatikan dan digarap oleh hukum ialah justru perbuatan yang disebut terakhir ini, baik perbuatan melawan hukum yang sungguh-sungguh terjadi maupun perbuatan melawan hukum yang  mungkin akan terjadi. Perhatian dan penggarapan perbuatan itulah yang merupakan  penegakan hukum. Terhadap perbuatan yang melawan hukum tersedia sanksi.

Abstract

Abstrak Penelitian ini bertujuan untuk menjelaskan peraturan hukum di Indonesia mengenai perjudian online dan peraturan khusus yang digunakan oleh otoritas terkait untuk mengatur perjudian online. Artikel ini menggunakan penelitian hukum normatif dan menyimpulkan bahwa arbitrase online sama dengan arbitrase konvensional. Penggunaan Sistem Elektronik (komputer, internet, telekomunikasi) adalah salah satu perbedaannya. KUHP dan UU No. 11 tahun 2008 tentang Informasi dan Transaksi Elektronik, memuat ketentuan-ketentuan yang disebutkan di atas. Pengadilan yang akan memutuskan nasib penipuan yang sulit. Ketentuan ini dapat dibandingkan dengan Pasal 378 KUHP atau Pasal 28 ayat (1) UU ITE, yang mengatur tentang iklan yang menyesatkan dan perlindungan konsumen. Secara terpisah, atau dalam hubungannya dengan pasal kedua, 378 KUHP jo Pasal 28 ayat (1) jo Pasal 45 ayat (1) UU No. 11 Tahun 2008 tentang ITE. Kata Kunci: Penipuan, Internet, Jual-beli online. Abstract This study aims to shed light on the legal regulations in Indonesia regarding online gambling and the specific regulations used by the relevant authorities to regulate online gambling. This article uses normative legal research to conclude that online arbitration is equivalent to conventional arbitration. Use of Electronic Systems (computers, internet, telecommunications) is one of the differences. The KUHP and UU No. 11, 2008, on Electronic Information and Transactions, contain the aforementioned provisions. A court of law will decide the fate of the sulit penipuan. This provision can be compared to Article 378 KUHP or Article 28 ayat (1) UU ITE, which deals with misleading advertising and consumer protection. Separately, or in conjunction with the second of these passages, 378 KUHP jo Pasal 28 ayat (1) jo Pasal 45 ayat (1) UU No. 11 Tahun 2008 concerning the payment and nonpayment of ITE. Penelitian ini Prosedur pengajuan gugatan perdata terhadap Pers yang memberikan   berita tidak benar  bisa dilakukan dengan mengajukan gugatan ke pengadilan negeri setempat dengan mekanisme sebagai berikut : Pendaftaran Gugatan, Membayar Panjar Biaya Perkara, Registrasi Perkara, Pelimpahan Berkas Perkara Kepada Ketua Pengadilan Negeri, Penetapan Majelis Hakim Oleh Ketua Pengadilan Negeri dan Tanggungjawaban Pers terhadap pihak yang dirugikan akibat pemberitaan yang tidak benar Pada Perusahaan Pers Tribun Lampung yaiu Berkaitan dengan masalah pencemaran nama baik tersebut tidak dapat diselesaikan melalui jalur jurnalistik maupun dengan UU pers, melainkan dapat diselesaikan melalui jalur pengadilan, segala kerugian dan ganti rugi baik materiil maupun immateriil dibebankan pada perusahaan pers terdapat pada Pasal 1376KUHPdt yaitu: sebagai akibat hukum tuntutan perdata dalam hal penghinaan adalah bertujuan untuk mendapat penggantian kerugian serta pemulihan nama baik. Sedangkan di dalam UU Pers No. 40 tahun 1999 bentuk dari tanggung jawab keperdataan dalam hal terjadinya pemberitaan adalah dengan melalui Hak Jawab seperti pada Pasal 5 ayat (2) UU No. 40 tahun 1999 tentang pers, Hak jawab dapat disampaikan dengan cara tertulis maupun secara lisan.
