Abstract

This study aims to examine and analyze efforts to solve terrorism crimes using approaches outside criminal law. Through a non-penal approach, it is necessary to take alternative precautions for criminal acts of terrorism. The research method used is normative juridical with a statutory approach, concepts, and comparisons. The results of the discussion of this study concluded that non-penal policies outside the criminal law in tackling terrorism among young people and students can be done by student participation in extra-campus organizations such as HMI. Tujuan penelitian ini adalah untuk mengkaji dan menganalisis upaya penyelesaian perkara kejahatan terorisme dengan menggunakan pendekatan di luar hukum pidana. Penelitian ini urgen untuk mengatasi tindak pidana terorisme yang menjadi musuh dunia. Melalui pendekatan non penal, perlu ditempuh alternatif pencegahan tindak pidana terorisme. Metode penelitian yang digunakan adalah yuridis normatif dengan pendekatan perundang-undangan, konsep, dan perbandingan. Hasil pembahasan penelitian ini menyimpulkan bahwa kebijakan non penal di luar hukum pidana dalam menanggulangi terorisme di kalangan muda dan mahasiswa dapat dilakukan dengan keikutsertaan mahasiswa dalam organisasi ekstra kampus seperti HMI.

Abstract

This study analyzed the resolution of specific criminal cases within the indigenous peoples of Kuantan Singingi, Riau. The shift in customary laws towards a modern legal system has caused various problems, including accumulating case files and overcapacity in prisons. This occurred because the community has also lost its grip on solving problems with the existing customary laws. Therefore, this study involved interviews with chairpersons, secondary leaders, customs on conflict resolution among indigenous peoples, and the use of primary data. The results highlighted that the customary settlement of criminal cases can sufficiently resolve conflicts in the community. Furthermore, it overcame the accumulation of case files in the courts and overcapacity in penitentiary institutions.

Abstract

The fundamental aim of criminal law is to shield society from potential victimization, allowing for the prosecution of wrongdoers, including the offenders engaged in negligent acts. This objective leads to a legal dilemma when negligence originates from the victim, sparking a debate within law enforcement about the entity to bear the criminal responsibility. Therefore, this study aimed to explore the juridical feasibility of designating victims as suspects in the same case where the offender has been victimized. Real cases were used in this study, accompanied by secondary data and interviews with crucial policymakers. The findings show that designating victims of negligence in traffic accidents as a suspect should not be pursued. Consequently, the investigation process should be suspended when the victim is found to be responsible for the accident, as the incident does not meet the criteria for a criminal act.

Abstract

Corruptions in Indonesia have been very widespread, and have even beenconsidered normal. Various efforts have been made by the state to eradicate thiscorruption, although it is still far from perfect. Law enforcement officials are noexception, which are institutions or institutions whose job is to implement the law,maintain security and order, and protect the rights and interests of the community,instead committing acts of corruption. This can cause problems from various aspects,and also to our country, which is a rule of law country. Not a few people view that thedecision on criminal sanctions for corruption is considered too light as well as casesof criminal acts of corruption by law enforcement officials.The type of research is normative research using literature studies in datasearch. This research is descriptive by using the method of synchronizing existingrules. In this study using qualitative methods in analyzing the data that has beencollected. The data used is secondary data in the form of codified rules.The results of this study explain how judges consider in deciding cases ofcorruption committed by law enforcement officials, which are considered unfair ingiving decisions, and the importance of increasing criminal sanctions against this.Because a law enforcement official is someone who really understands the law bothin theory and in practice. In this case, the additional of sanctions against lawenforcement officials can be an appropriate preventive solution so that no more lawenforcement officers commit acts of corruption.Keyword : Corruption, Law Officer, Penal Addition

Abstract

Article 76 E of Law Number 35 of 2014 concerning Amendments to LawNumber 23 of 2002 concerning Child Protection states that the criminal act ofmolesting a child which is punishable by a minimum sentence of 5 (five) years in prisonis a serious crime, but in reality in the Police Pekanbaru City Resort has several casesof fornication that have not been resolved because the police have stopped investigatingthe cases because mediation has been carried out. This type of research is sociologicallegal research, namely an attempt to see the influence of the enactment of positive lawon people's lives.This research is also descriptive in nature, namely the author tries to describelaw as a form of social control related to the establishment and maintenance of socialrules, with a basic view of the law's ability to control human behavior and createconformity in these behaviors.This research aims to find out how law enforcement is carried out by thePekanbaru City Resort Police, especially Women and Child Protection UnitInvestigators, what obstacles are faced in law enforcement and what efforts can bemade to overcome obstacles to law enforcement at the Pekanbaru City Resort Police.The results of this research explain that law enforcement carried out by thePekanbaru City Police, especially the Women and Children Protection UnitInvestigators, has not been optimal in cases of criminal sexual abuse of children. Theobstacles faced by the Police are the lack of quality and quantity of Women andChildren Unit Investigators, lack of cooperation from the victim or the victim's family inproviding information related to the case being processed, and a lack of public legalawareness. The efforts that the author offers in this research are to improve the qualityand quantity of investigators in the women's and children's unit at the Pekanbaru CityPolice Department, increasing public insight regarding the importance of legalawareness in order to create justice, benefit and public welfare.Keywords: Law Enforcement - Crime - Sexual Abuse - Children.

Abstract

Children who are in conflict with the law, even though they are suspectedof having committed a criminal act, still have the right to protection by the state,especially regarding their identity. The Supreme Court Decision Directory as asite that contains information about Supreme Court decisions, including asummary of decisions, legal considerations, and links to complete decisionsshould pay attention to the importance of not publishing the identity of children inconflict with the law when uploading copies of decisions. Publication of theidentity of children in conflict with the law can have a very bad impact onchildren, such as stigmatization and discrimination which can affect their future.The type of research used in this research is normative juridical legalresearch or can also be called doctrinal legal research. Normative juridical legalresearch is library legal research. The research uses qualitative analysis whichproduces descriptive data.From the results of this research, there are several main things that can beconcluded. First, the Law on the Juvenile Justice System stipulates that theidentity of children in conflict with the law must be kept confidential, both in printand electronic media, but in reality there are still many decisions that do notobscure the child's identity before being uploaded to the Supreme Court DecisionDirectory website. such as decision Number 18/Pid.Sus-Anak/2021/Pn Srg whichexplicitly shows the identity of the child as the perpetrator, the name of theparents, and the place of residence where the decision can be accessed by thepublic. Second, the Supreme Court Directory's information officer's mistake inpublishing a copy of the child's decision may result in administrative sanctions,but in enforcing these sanctions it does not provide a deterrent effect so thatcriminal regulations as an ultimum remedium or as a final resort in lawenforcement are expected to provide a deterrent effect for Directory officers. Abstract

Presidential Regulation Number 13 of 2018 concerning the Principle of RecognizingBeneficial Owners of Corporations in the Context of Preventing Crimes of MoneyLaundering and Terrorism Financing is the highest legal umbrella for implementing theprinciple of recognizing beneficial ownership in Indonesia today. Reporting data onbeneficial owners of a corporation is mandatory, so data validation is a very crucial thing todo. In this presidential regulation, only matters of an administrative nature are regulated andno threat sanctions have been regulated as a means of prevention and providing a deterrenteffect to every perpetrator of violations in terms of validating data on the beneficial ownersof a corporation.This research is normative legal research supported by secondary data,carried out by using library materials as the main focus. Also called doctrinal legal research,namely legal research that uses data based on library research by taking quotations fromreading books, or supporting books that are related to the problem to be researched. Thus,this research uses secondary data sources consisting of primary, secondary and tertiary legalmaterials. This research also uses qualitative data analysis and produces descriptive data.From the results of the discussions and research carried out, several conclusionswere obtained, namely: First, the regulation regarding Reporting of Beneficial Owners of aCorporation is regulated by Presidential Regulation Number 13 of 2018. In terms of law-making procedures, a Presidential Regulation is not justified in containing criminalprovisions , because there is a principle of No Punishment Without Representatives, criminalprovisions are only included if the Regulation is issued by the Legislative Body. Second,criminalization must be created through legality which will be included later in a new law,raising the level of the Presidential Regulation to a law which contains provisions forimprisonment and fines which are prepared taking into account the outlook on life,awareness and legal ideals, as well as philosophy. the Indonesian nation which originatesfrom Pancasila and the Preamble to the 1945 Constitution of the Republic of Indonesia.Keywords: Criminalization - Corporation – Beneficial Owner

Abstract

Children with disabilities are children who have physical, mental, intellectual or sensorylimitations for a long period of time who, in interacting with their environment and societalattitudes, may encounter obstacles that make it difficult to participate fully and effectively basedon equal rights. Sexual violence against children is regulated in Law Number 35 of 2014concerning Amendments to Law Number 23 of 2002 concerning Child Protection. This rule iscontained in Article 76 D. Article 81 of Law Number 35 of 2014 concerning Child Protectionregulates sanctions for criminal acts of sexual violence (obscene) against children. Althoughthere are regulations governing the protection of children, there is no specific protection forchildren with disabilities. Therefore, if children with disabilities experience sexual violence,they are always at a disadvantage.The objectives to be achieved in this research are firstly to find out the weaknesses ofthe existing criminal sanction arrangements against perpetrators of sexual crimes for childrenwith disabilities in Indonesian positive law and their implementation. The second is to formulatethe ideal punishment to be imposed on perpetrators of sexual crimes for children withdisabilities.The author conducted research using normative juridical methods or literaturestudies in order to obtain secondary data which was divided into 3 (three), namely primary,secondary and tertiary legal materials. In this study, researchers used a statutory approach thatwould examine law, namely the principle of openness which has a relationship to the problemsstudied.From the research results, there are two main things that can be concluded. The firstis related to the weaknesses in the existing criminal sanctions arrangements againstperpetrators of sexual crimes for children with disabilities in Indonesian positive law and how itis currently implemented in Indonesia. The second is the ideal punishment to be imposed onperpetrators of sexual crimes for children with disabilities, because children with disabilitiesare always disadvantaged and there is no special protection for them.The author's suggestion is that the state must update or reformulate laws related tosanctions against sexual crimes against children with disabilities. So that the crime rate ofsexual crimes against children with disabilities in Indonesia can be reduced. Suggesting that theimposition of sanctions on perpetrators of sexual crimes against children with disabilities begiven severe sanctions, namely a minimum of 20 years in prison or in accordance with theweight that should be imposed, namely plus one-third of the maximum sentence and it is hopedthat with this, justice will be achieved, and suggesting that the state should improve educationmore morals and character to all generations of the nation.Keywords : Children-Persons-Disabilities-Sexual-Violence-Reformulation

Abstract

Advances in technology and communication have become increasinglyrapid, affecting every access to human life, In this day and age, crime in thevirtual world (cyber crime). One of the crimes that is currently developing isonline gambling crime. Therefore, the aim of this thesis research is first, to findout the factors that cause the rise of online gambling in the Riau Regional Policearea. Second, to find out the role of the Special Criminal InvestigationDirectorate in dealing with online gambling crimes in the Riau Regional Policearea. Third, to find out the obstacles for the Directorate of Criminal Investigationin tackling online gambling in the Riau Riau Regional Police area.This type of research can be classified as a type of sociological research.This research took place at the Riau Regional Police, where researchersdetermined that the population and sample were all parties related to the problembeing studied. This research uses data sources in the form of primary data andsecondary data, and data collection techniques are carried out by means ofinterviews.From the results of the research and discussions carried out, it can beconcluded that the crime of online gambling in the Riau Regional Police is still sowidespread that it requires maximum efforts, which is caused by various factors,including: First, a preemptive effort in the form of an appeal to online gamblingplayers by conducting outreach in the field of public order. Second, preventiveefforts in the form of blocking sites carried out in collaboration with the Ministryof Communication and Information. Third, repressive efforts can be interpreted ascountermeasures, namely efforts shown to someone who has become evil to helphim return to the right path, by arresting online gambling suspects.Keywords: Law Enforcement – Online Gambling Crime.
