Abstract

The presence of the Krueng Aceh Watershed Area (DAS) holds significant importance in the ecosystem and community life, particularly in its role as a flood control channel. However, currently, the capacity of the riverbanks and embankments of the Krueng Aceh DAS has declined due to various factors, such as climate change and the exploitation of riverbank land for economic activities by the community. This research aims to identify the processes of DAS normalization policies in the Culinary Tourism Park area of Simpang Intim, Banda Aceh City, and the coordination between the Banda Aceh City Government and the Sumatra I River Basin Agency in utilizing state-owned land. This research employs a qualitative descriptive method with data sources obtained through interviews. Findings from this research indicate that the implementation of DAS normalization policies has not been optimal due to the utilization of DAS land not fully aligning with its intended purpose and not conforming to the planned land use in the Simpang Mesra Culinary Tourism Park area in Banda Aceh City. The government has not adequately monitored the management and utilization of DAS, as evidenced by the construction of permanent buildings by some culinary business owners that do not comply with regional regulations. The lack of firmness from the government towards business actors using the land also results in the non-alignment of land use with applicable regulations.

Abstract

Original Regional Revenue (PAD) originating from zakat actually has great potential to be utilized by the regions if it is managed properly and optimally. This new fiscal resource can help solve regional problems such as poverty and unemployment. This study aims to see concretely how the management of zakat as PAD and tries to explore what factors are the obstacles to managing Zakat as PAD by Baitulmal Aceh based on Qanun Number 10 of 2018. In-depth interviews were conducted with 15 informants in Baitulmal Aceh who were selected using the method purposive sampling. While the data analysis uses the Miles and Huberman interactive model. The results show that there are different views in responding to the implementation of zakat as PAD. The first response is supportive because it is in accordance with the specificities of Aceh Province as regulated in Act no. 11 of 2006 concerning the Government of Aceh. Another response was refused because it could be burdensome for Muslims if two obligations were to pay at once to pay taxes and zakat. The zakat policy as PAD itself still creates multiple interpretations so that it becomes an obstacle in its implementation. Apart from the facts in the field that shows the contribution of zakat in local revenue is still relatively small. (Pendapatan Asli Daerah (PAD) bersumber dari zakat sejatinya memiliki potensi besar untuk dimanfaatkan oleh daerah jika dikelola secara baik dan optimal. Sumber fiskal baru ini dapat membantu menyelesaikan permasalahan daerah seperti kemiskinan dan pengangguran. Studi ini bertujuan melihat secara konkret bagaimana pengelolaan zakat sebagai PAD dan berusaha mengeksplorasi faktor apa saja yang menjadi kendala pengelolaan Zakat sebagai PAD oleh Baitulmal Aceh berdasarkan Qanun Nomor 10 Tahun 2018. In-depth Interview dilakukan terhadap 15 orang informan di Baitulmal Aceh yang dipilih menggunakan metode purposive sampling. Sedangkan analisis data menggunakan model interaktif Miles and Huberman. Hasil menunjukkan ada perbedaan pandangan dalam merespon implementasi zakat sebagai PAD. Tanggapan pertama mendukung karena sesuai dengan kekhususan Provinsi Aceh yang diatur dalam Undang-Undang No. 11 Tahun 2006 Tentang Pemerintahan Aceh. Tanggapan lainnya menolak karena dapat memberatkan umat Islam jika dibebankan dua kewajiban sekaligus untuk membayar pajak dan zakat. Kebijakan zakat sebagai PAD sendiri masih menimbulkan multi tafsir sehingga menjadi kendala dalam pelaksanaannya. Selain fakta lapangan yang menunjukkan kontribusi zakat dalam pendapatan asli daerah masih relative kecil.)

Abstract

This paper aims to clarify the understanding of the conceptual evolution of the adaptive governance framework, followed by an examination of implementation actions in the environmental setting. Since three approaches are recognized to be essential in navigating complex socio-ecological systems, namely adaptive management, adaptive co-management, and adaptive governance. This might lead to confusion and misunderstandings in adaptive concepts and practice. In this study, a systematic literature review was conducted using the Scopus database. A literature search was conducted in Mei 2023 using the keyword "Adaptive Governance" as the search term. As a result, despite sharing the same purpose and philosophy, each approach's work process has distinct features and scales. Adaptive governance emerges as a response to the need for holistic solutions to overcome uncertainty within the framework of complex socio-ecological systems. This is similar to adaptive co-management, although on a larger scale and context. While adaptive management is the conceptual foundation for other approaches.

Abstract

Two contrasting viewpoints emerge over the issue of rad inheritance, notably concerning the events at the Syar'iyah Court. One viewpoint granted Baitul Mal the remaining inheritance, while the other viewpoint maintained that the heirs were entitled to reclaim their remaining assets. This study aims to identify the key elements considered by the justices of the Aceh Syar'iyah Court and the Banda Aceh Syar'iyah Court while making their verdicts in this case, as well as how Islamic law assesses the resolution of inheritance disputes related to property rights. This study scrutinizes the empirical legal research methodologies employed by analyzing them from the perspective of Islamic legal theory. The data is collected by conducting interviews and accessing material in libraries. The findings indicate that the Banda Aceh Sharia Court's Panel of Judges awarded the remaining inheritance to Baitul Mal, in accordance with the book Hasyiyah al-Bajuri, Qanun Number 11 of 2002, and Article 11 paragraph (1), and Article 14 of Aceh Qanun Number 7 of 2004, which pertain to the implementation of Islamic Sharia in the fields of Aqidah, Worship, and Islamic Sharia, and Zakat Management, respectively. Per Article 193 KHI, the justices of the Aceh Syari'yah Court hold a differing opinion regarding the distribution of any leftover inheritance to the heirs of the zawil furudh. According to Islamic family law, Zaid bin Thabit and a few Malikiyah and Syafi'iyah jurists endorse the choice of Baitul Mal to accept the remaining bequest. Furthermore, Uthman bin Affan's viewpoint about the application of rad, which includes marital relations, asserts that all furudhheirs possess the right to rad. This stance is also backed by the ruling of the Panel of Judges of the Aceh Syar'iyah Court.

Abstract

The City of Banda Aceh, the capital of Aceh Province, has been committed to developing a Child-Friendly City Policy since 2013. However, to date, the City of Banda Aceh has still not achieved Child-Friendly City status, as evidenced by the absence of an increase in ranking in 2023 compared to the previous year. This city continued to maintain its Nindya level by the assessment in 2022. This research aims to identify efforts and inhibiting factors in developing Child-Friendly City policies, especially in the institutional cluster aspect. Using Institutional Development Theory by Milton J. Esman (1967), this research applies qualitative methods. Research findings show that Banda Aceh has not achieved Child-Friendly City status because the institutional indicators of a Child-Friendly City are not yet optimal, resulting in the fulfillment of children’s rights not being implemented comprehensively. The obstacles that cause Banda Aceh not to achieve this status involve limited budget resources, the absence of a Regional Action Plan, a lack of understanding of human resources regarding policies, minimal involvement from the business world, and the impact of the COVID-19 pandemic. Suggestions include: (i) Evaluate budget resource allocation for KLA, (ii) Immediately develop RAD-KAL as a guide for program implementation, (iii) Increase understanding of human resources through training, (iv) Encourage formal collaboration with the business world, (v) Designing an adaptive strategy for the disruptive impact of the pandemic for KLA. Abstract

The Covid-19 pandemic forces the education sector to implement distance learning (online). For schools and people who are familiar with Information Technology (IT), online learning is not a problem. However, this condition will be different for schools and people who are unfamiliar with IT, especially for community groups who are living in the outside of urban and rural areas. This study wants to see how online learning is applied in elementary schools. This research uses a qualitative approach, data or information obtained from the process of observation and interviews with people who are undergoing online learning in Aceh Province. There are many obstacles to home learning for low-income economies and people living in rural areas. For this community group, doing online learning is challenging, starting from the problem of facilities, parental support, to children's motivation in this kind of learning. The implementation of online learning in rural and low-class economic communities does not meet expectations, it can even be said to be unsuccessful. This condition is caused by limited access and inadequate learning media.

Abstract

Dalam upaya mengurangi ketimpangan, pemerintah melaksanakan pembangunan rumah layak huni kepada masyarakat yang membutuhkan. Secara nasional, program ini telah berjalan sejak tahun 2015 yang diinisiasikan langsung oleh Presiden Joko Widodo melalui program Sejuta Rumah. Disisi lain, ternyata pemerintah Aceh sudah lebih dulu menginisiasi bantuan perumahan bagi masyarakat kurang mampu ini sejak tahun 2008. Seiring berjalannya waktu, dengan paket kebijakan bantuan sosialnya, ternyata Aceh masih saja terjerambab kedalam lingkaran kemiskinan. Status termiskin di Sumatera masih melabeli propinsi paling barat Indonesia ini. Tujuan dari penelitian ini yaitu untuk mengetahui efektivitas penyaluran rumah layak huni, sekaligus mengevaluasi capain utamanya seperti mengurangi ketimpangan bahkan kemiskinan. Penelitian ini menggunakan metode penelitian deskriptif kualitatif, dengan pisau analisis menggunakan teori efektivitas dari Sutrisno (2013), yaitu 1) pemahaman program 2) tepat sasaran 3) tepat waktu 4) tercapainya tujuan  5) perubahan nyata. Secara keseluruhan, empat indikator telah mampu terpenuhi, hanya variable tepat sasaran yang masih bermasalah. Oleh karena itu. peneliti sangat mengharapkan pemangku kebijakan dapat melakukan evaluasi terhadap efektivitas program rumah layak huni tersebut agar tidak hanya menjadi solusi jangka pendek dalam upaya penanggulangan kemiskinan.

Abstract

Abstract : This article aims to explain the mapping of political and security risks related to the 2024 Indonesian General Election. It is crafted as part of an early warning mechanism. Thus, the research aims to provide a reference framework for anticipating potential disruptions to security stability during the 2024 elections. Text analysis both classical/traditional and modern/non-traditional approaches by Buzan & Hansen (2009) were utilised to map these risks. The article concludes that threats to Indonesia during the 2024 elections may come from both internal and international sources. The global geopolitical situation heating up towards the end of 2023 and the ongoing election stages pose serious potential threats to Indonesia's security. Some highlighted potential threats include the possibility of presidential impeachment, disputes over election results, grassroots polarization, and terrorism threats. The involvement of the military in handling security threats becomes inevitable, as reflected in the government's policy response involving the Indonesian National Army (TNI) in security assistance tasks alongside the police (Polri) during the elections. Limitations of this research include constraints on accessing potentially sensitive data and limitations in time and resources. Future research could broaden its scope by incorporating perspectives from various stakeholders, including civil society, media, and religious groups. Additionally, further research could focus on evaluating the effectiveness of risk mitigation strategies implemented during the 2024 elections. Keywords : 2024 election; politics; security; threats; military. Abstrak : Tulisan ini bertujuan untuk menjelaskan pemetaan risiko politik dan keamanan yang terkait dengan Pemilu 2024 di Indonesia. Dibuat sebagai bagian dari mekanisme kewaspadaan dini. Dengan demikian, penelitian ini bertujuan untuk memberikan kerangka rujukan dalam mengantisipasi potensi gangguan terhadap stabilitas keamanan selama Pemilu 2024. Analisis teks pada pendekatan klasik/tradisional dan modern/non-tradisional dari Buzan & Hansen (2009) digunakan untuk memetakan risiko tersebut. Artikel ini menyimpulkan bahwa ancaman terhadap Indonesia selama Pemilu 2024 dapat berasal dari internal dan internasional. Situasi geopolitik global yang memanas pada akhir tahun 2023, bersamaan dengan tahapan Pemilu yang sedang berlangsung, menimbulkan potensi serius yang dapat mengancam keamanan Indonesia. Beberapa potensi ancaman yang disorot meliputi potensi pemakzulan presiden, perselisihan hasil pilpres, polarisasi di akar rumput, dan ancaman terorisme. Keterlibatan militer dalam penanganan ancaman keamanan menjadi tidak terhindarkan, sebagaimana tercermin dalam respons kebijakan pemerintah yang melibatkan Tentara Nasional Indonesia (TNI) dalam tugas perbantuan keamanan bersama kepolisian (Polri) selama Pemilu. Limitasi penelitian ini termasuk keterbatasan dalam akses terhadap data yang mungkin sensitif, serta keterbatasan waktu dan sumber daya. Penelitian masa depan dapat memperluas cakupan dengan memasukkan perspektif dari berbagai pemangku kepentingan, termasuk masyarakat sipil, media, dan kelompok agama. Selain itu, penelitian lanjutan dapat fokus pada evaluasi efektivitas strategi mitigasi risiko yang diimplementasikan selama Pemilu 2024. Abstract

The impact of pandemic Covid-19 that produces high unemployment, put labor as the issues most often discussed these days. This study aims to analyze issues relating to employment and its policy in Indonesia by using literature review from a Scopus database for the purpose to describe findings on 1) development publication trend and the highest citation on articles, 2) a map or entanglement articles seen from co-authorship, 3) a map or entanglement articles seen from co-occurrence keywords writer, 4) information related to the issue of articles that have been analyzed. Bibliometric analysis and analysis content used in the following analysis of articles with using Microsoft Excel and Vosviewer software as analyzing and visualizing data tools. The analysis shows that a publication highest seen in 2022 with the total number of 12 articles and article with highest citation named Policies, Political-Economy, and Swidden in Southeast Asia with 208 citations. In terms of mapping articles based on co-authorship formed 57 cluster with Indonesia as a country with the highest writers with total 27 publications. As for the analysis of the map in terms of articles co-occurrence based on keywords writer formed 7 clusters. It is apparent that issues such as the system of remuneration, labor migration, and gender is an issue most frequently discussed in employment associated research.

Abstract

Kesadaran dalam melakukan kerjasama internasional harus ditumbuhkan oleh pemerintah pusat terhadap pemerintah daerah. Dinamisnya perkembangan dunia mengharuskan pemerintah pusat menjadi lebih terbuka dalam setiap peluang yang ada demi pembangunan yang lebih merata. Makalah ini menggunakan metode penelitian kualitatif dengan mengembangkan teori dan konsep dalam proses analisis berdasarkan data yang dikumpulkan dari buku, jurnal, dan sumber terbuka lainnya. Adapun tujuan utama dalam tulisan ini adalah untuk mengungkap peluang dan tantangan yang dihadapi pemerintah daerah di Indonesia dalam praktik paradiplomasi, khususnya di kawasan Indo-Pasifik. Berdasarkan hasil kajian, peluang pemerintah daerah dalam ekspansi internasional di kawasan Indo-Pasifik cukup potensial karena negara wilayah di kawasan Indo-Pasifik memiliki banyak kesamaan yang menjadi salah satu indikator krusial dalam praktik paradiplomasi. Kesempatan ini sayangnya belum berjalan secara maksimal karena banyak praktik paradiplomasi yang sejauh ini tengah berjalan hanya sampai pada tahap perjanjian bersama atau MoU saja; kemudian adanya pandemi yang membuat sejumlah hubungan bilateral terpaksa vakum; dan masalah teknis lainnya. Walupun begitu, pemerintah pusat harus terus berperan aktif dalam mendorong pemerintah daerah untuk lebih bertaji dalam kerjasama luar negeri dalam lingkup kawasan.Awareness in conducting international cooperation must be raised by the central government to local governments. The dynamic development of the world requires the central government to be more open in every opportunity that exists for a more equitable development. This paper uses qualitative research methods by developing theories and concepts in the analysis process based on data collected from books, journals, and other open sources. The main objective of this paper is to uncover the opportunities and challenges faced by local governments in Indonesia in the practice of paradiplomacy, especially in the Indo-Pacific region. Based on the results of the study, the opportunities for local governments in international expansion in the Indo-Pacific region are quite potential because regional countries in the Indo-Pacific region have many similarities which are one of the crucial indicators in the practice of paradiplomacy. Unfortunately, this opportunity has not run optimally because many para-diplomacy practices that have been running so far have only reached the stage of a collective agreement or MoU; then there was a pandemic that forced a number of bilateral relations to be vacuumed; and other technical problems. Even so, the central government must continue to play an active role in encouraging local governments to be more ambitious in foreign cooperation within the region.
