Abstract

Tin mining is found in many major tin-producing areas such as Bangka and Belitung Islands, where this natural resource is one of the mainstays of local economic growth. The application of absolute liability also requires strong regulatory support, especially regarding the mechanism of proof and the determination of sanctions. In the Indonesian justice system, the process of proof is often an obstacle because there is no simple and efficient mechanism in environmental cases. This study uses a normative legal method with a legal analysis approach. This study focuses on the legislative aspect, considering the conceptual dimension and applicable regulations. The results of the study show that one of the steps taken is the Regional Regulation concerning the Coastal Area and Small Island Zoning Plan (RZWP3K), which applies a three-stage approach to supervising the use of marine resources in coastal areas and small islands, namely socialization, implementation, and supervision. In addition, the government is also taking steps to regulate the mining industry and ensure compliance with the law by involving various government agencies such as the Marine and Fisheries Service. By enforcing these regulations, the main objective is to maintain environmental sustainability, protect marine ecosystems, and minimize negative impacts on communities and natural resources.

Abstract

Narcotics are one of the most serious crimes faced by almost every country in the world, including Indonesia. In 2023, the number of drug users in Indonesia reached 3.3 million people, or approximately 1.73% of the total population. The province of DKI Jakarta was recorded as the most vulnerable area, contributing around 12.73% of the total narcoticsrelated crimes that year. This situation requires serious attention, particularly from law enforcement officers as part of the criminal justice system. Preventive actions taken by law enforcement should demonstrate effectiveness through a decrease in prevalence rates in 2024. This study uses a qualitative method through literature review by analyzing various sources such as journals, theses, and other scientific works. The approach used is normative, by examining the implementation of established legal principles. The results of this study show that law enforcement officers have taken several preventive measures to reduce narcotics use, including socialization, education, rehabilitation, and coaching for inmates. The coaching involves vocational training for convicts to prevent recidivism. However, the effectiveness of these efforts has yet to yield positive results, as the number of drug users in 2024 increased by 29.10%.

Abstract

The circulation of counterfeit money in Indonesia poses a serious threat to monetary stability and public trust in the rupiah. This issue can disrupt the financial system, undermine the credibility of legal tender, and weaken the effectiveness of monetary policy. Bank Indonesia, as the central bank, plays a critical role in maintaining the integrity of the national currency and ensuring a smooth payment system. Counterfeit money not only undermines the currency’s value but also creates challenges for economic growth and stability. This study aims to analyze the impact of counterfeit money circulation on Indonesia’s monetary stability and evaluate the role of Bank Indonesia in mitigating its effects. Using a normative juridical method with a qualitative descriptive approach, the research relies on secondary data obtained through literature reviews, legal instruments, policy reports, and publications from relevant institutions such as Bank Indonesia and law enforcement agencies. The data are analyzed by interpreting legal norms, institutional functions, and strategic efforts concerning monetary stability. The findings indicate that Bank Indonesia has implemented multi-faceted mitigation strategies, including enhancing the security design of the rupiah, improving public financial literacy through campaigns like “Love, Proud, Understand Rupiah,” and strengthening cooperation with law enforcement to address counterfeit money circulation. However, challenges remain, particularly with technological advancements used by counterfeiters and insufficient public awareness. The study concludes that Bank Indonesia’s role must be continuously strengthened, not only in legal and technological measures but also in increasing public engagement to safeguard the rupiah and ensure monetary stability.

Abstract

The advancement of information technology has led to new forms of crime, one of which is revenge porn. This crime involves the non-consensual distribution of intimate content, often carried out as retaliation after a failed relationship. Although Indonesian law has addressed this issue, victim protection remains insufficient and fragmented. This research aims to analyze the criminal liability of perpetrators and the legal protection for revenge porn victims in Indonesia under the Electronic Information and Transactions Law and the Sexual Violence Crime Law. The study employs a normative juridical method with a case study approach. Findings indicate that while the Electronic Information and Transactions Law can criminalize perpetrators, it falls short in addressing victims' psychological and social harm. The Sexual Violence Crime Law provides more comprehensive protection, including restitution and recovery services. However, implementation faces challenges such as societal stigma and a lack of gender-sensitive law enforcement. Thus, an integrated approach involving regulation, law enforcement, and public education is crucial to ensure holistic victim protection. In conclusion, the state must strengthen victim-centered legal implementation and consider immaterial impacts, while promoting prevention through legal reform and public awareness.

Abstract

This study examines the influence of differences of opinion among judges on legal certainty in court decisions. In judicial practice, differences of opinion between judges often arise and have the potential to affect consistency and legal certainty, which are one of the main pillars of the legal system. The research method used is qualitative with a juridical-normative approach, utilizing analysis of relevant laws and legal literature. The results of the study indicate that differences of opinion among judges can cause legal uncertainty if not managed properly, thus impacting the credibility of the judicial institution and public trust in the judge's decision. Therefore, it is important to develop clear mechanisms and standards for handling differences of opinion among judges to maintain legal certainty in the judicial system.

Abstract

The phenomenon of domestic violence that results in the death of women by intimate partners shows a gap in the legal protection that should be provided by the state. This study examines how Law Number 23 of 2004 concerning the Elimination of Domestic Violence (UU PKDRT) regulates and qualifies murder in domestic relations, and the extent of its effectiveness in implementation. The issues discussed include aspects of normative regulation and the application of law in the field. The methodology applied is normative legal research, using a legislative approach and a case approach. Data sources were obtained through literature studies from laws and regulations, court decisions, and relevant academic opinions, and analyzed qualitatively. The findings show that although the Law on PKDRT contains legal provisions regarding serious physical violence, including that which causes death, its implementation has not been optimal. The low understanding of law enforcement officers, the influence of patriarchal culture, and the lack of protection for victims are the main obstacles. Therefore, integration between the Criminal Code and the Law on PKDRT is needed, as well as increasing the competence of law enforcement officers so that victim protection becomes more effective and just.

Abstract

This study aims to determine the application of Restorative justice in the form of a judge's pardon for the crime of theft committed by seniors over 70 years of age. The research carried out in this study is empirical juridical research, which is carried out directly in the field to find out the real problems that occur, and then it will be connected with the applicable laws and regulations and existing legal theories. The results of the study show that the application of a new Restorative justice in the form of a judge's apology to the perpetrators who are 70 years old because they are no longer productive is deemed ineffective if imprisoned and also that the country of Indonesia is a country that has eastern customs, which means that the culture of the Indonesian state is making a decision by deliberation to reach a consensus or in other words, Restorative justice provides an opportunity for the perpetrator to become a better person so that he can organize his future life for the better, rather than having to prioritize a retributive justice system that prioritizes the imposition of law on the physical perpetrator by confining him in in detention/prison. Penelitian ini bertujuan untuk mengetahui Penerapan Restorative justice Dalam Bentuk Permaafan Hakim Dalam Tindak Pidana Pencurian Yang Dilakukan Oleh Lansia Diatas 70 Tahun. Penelitian yang dilakukan dalam penelitian ini adalah penelitian Yuridis empiris yang dilakukan secara langsung di lapangan untuk mengetahui permasalahan yang sebenarnya terjadi, kemudian akan dihubungkan dengan peraturan perundang-undangan yang berlaku dan teori hukum yang ada. Hasil penelitian menunjukkan bahwa penerapan baru sebuah Restorative justice dalam bentuk permaafan hakim kepada para pelaku yang berusia 70 tahun karena diusia yang sudah tidak produktif dirasa tidak efektive jika dimasukan di dalam penjara dan juga negara Indonesia merupakan negara yang memiliki adat ketimuran yang artinya budaya negara Indonesia adalah mengambil sebuah keputusan dengan musyawarat untuk mufakat atau dalam kata lain dari Restorative justice memberikan kesempatan kepada pelaku untuk menjadi sosok yang lebih baik agar dapat menata kehidupan kedepannya menjadi lebih baik,  dibandingkan harus mengedepankan system retributive justice yang lebih mengedepankan penjatuhan hukum terhadap fisik pelaku dengan mengurungnya di dalam tahanan/penjara.

Abstract

Cek dan giro merupakan alat pembayaran yang sering digunakan dalam transaksi bisnis. Namun dalam prakteknya terdapat kasus dimana cek atau giro yang diterbitkan tidak mempunyai cukup dana di rekening penariknya sehingga ditolak oleh bank. Inilah yang disebut dengan cek kosong atau giro. Cek atau giro kosong adalah cek atau giro yang diterbitkan oleh penariknya, namun dana pada rekening penarik tidak mencukupi untuk mencairkan nilai yang tertera pada cek atau giro tersebut. Mengeluarkan cek atau giro kosong merupakan perbuatan melawan hukum dan mempunyai akibat yang berat bagi tertariknya. Oleh karena itu, penting bagi setiap orang untuk berhati-hati dalam menggunakan cek dan giro serta memastikan dana di rekeningnya mencukupi sebelum mengeluarkan cek atau giro. Atas perbuatan Tergugat terkait pembayaran iklan yang tidak pernah dibayar oleh Tergugat, maka Pemohon telah melakukan upaya yaitu dengan melakukan penagihan melalui invoice dengan batas waktu 45 (empat puluh lima) hari sejak tagihan ditagih dengan hasil tidak dibayar, penagihan lewat email tidak ada hasil. dibayar, penagihan dengan mengunjungi PT. Atom Media Indonesia dengan akibat tidak terbayar karena kekurangan dana, maka Pemohon mengirimkan Surat Teguran untuk pembayaran tagihan kunjungan/tagihan secara langsung sebanyak 3 (tiga) kali dan hasilnya tidak terbayar. Selanjutnya pemohon menyampaikan Surat Panggilan 1 tanggal 14 Juli 2021, Surat Panggilan 2 tanggal 22 Juli 2021, dan Surat Panggilan 3 tanggal 2 Agustus 2021 yang ditujukan kepada PT. Atom Media Indonesia Naik. Hermanto Irsan, selaku Direktur PT. Atom Media Indonesia sehubungan dengan pembayaran tagihan dan PT. Atom Media Indonesia menanggapinya dengan menawarkan pembayaran secara mencicil sebesar Rp15.000.000 (lima belas juta rupiah) dan Terdakwa Hermanto Irsan menawarkan untuk memberikan jaminan berupa 1 (satu) unit apartemen di BSD Serpong dan 1 (satu) Sertifikat Hak Guna Bangunan untuk tanah senilai Rp. 450.000.000,- (empat ratus lima puluh juta rupiah) yang diperkirakan dengan harga pasaran Rp. 1.000.000.000,- (satu miliar rupiah), dengan total Rp. 2.200.000.000 (dua milyar dua ratus juta rupiah) namun Pemohon menolak dengan alasan jaminan tersebut tidak atas nama Tergugat. Kemudian berdasarkan perbuatannya, Pemohon melaporkan perbuatan terdakwa tersebut ke polisi sektor Kebon Jeruk untuk diproses lebih lanjut. Pemohon mengajukan gugatan ke Pengadilan Negeri Jakarta Barat dalam perkara Nomor 593/Pid.B/2022/PN. Jkt.Brt dimana dalam putusannya hakim menolak permohonan Pemohon, kemudian Pemohon ingin mengajukan kasasi namun ditolak dengan alasan Pemohon diminta untuk segera mengajukan kasasi ke Mahkamah Agung. Akhirnya Pemohon PT. Rajawali Citra Televisi Indonesia mengajukan kasasi ke Mahkamah Agung dalam perkara Nomor 34 K/Pid/2023, dalam hal ini hakim Mahkamah Agung mengabulkan permohonan kasasi Pemohon/Jaksa Penuntut Umum ke Kejaksaan Negeri Jakarta Barat dan membatalkan Pengadilan Negeri Jakarta Barat. . Abstract

This study aims to analyze the form of corporate criminal liability in cases of personal data misuse by online loan debt collectors through the lens of vicarious liability theory. The research contributes by providing a theoretical foundation and legal argumentation to support regulatory efforts and law enforcement against data misuse practices in the digital financial sector. This article falls under qualitative library research. The methodology employed is normative legal analysis. The findings indicate that actions by debt collectors who misuse borrowers' personal data for corporate gain may result in criminal liability for the corporation, particularly when the company fails to prevent or supervise such conduct. The theory of vicarious liability reinforces the principle that corporations cannot escape responsibility for legal violations committed by individuals acting on their behalf or for their benefit.

Abstract

Legal aid is intended for underprivileged people, the poor (low income), the illiterate (those who cannot read or write or have low education), and those who do not have access to their rights due to pressure from those in more power. One type of detention according to Indonesian positive law is placement in a state detention center (remand center) (M Syafi, 2019). Pondok Bambu Class 1 East Jakarta State Detention Center tries to fulfill the rights of its prisoners both while the case examination process is still ongoing until the criminal execution stage. Indonesian formal criminal law has regulated the technicalities and rights of prisoners during the trial examination at the first level, appeal, cassation, and judicial review up to the implementation of the judge's decision, but the ignorance and reluctance of prisoners to exercise their rights can actually be an obstacle in the fulfillment of their rights. The purpose of this research is to increase knowledge and encourage prisoners to be aware of their legal rights and use pro bono legal aid. Community Service (PKM) in Pondok Bambu Class 1 Detention Center East Jakarta was conducted of line with one-way material presentation involving lawyers and paralegals from PKBH FH Untar. To realize the solution, the PKM was carried out with material presentation, questions and answers, free consultation, and followed up with the registration of defendants as pro bono clients of PKBH FH Untar. ABSTRAK: Bantuan hukum diperuntukkan bagi masyarakat kurang mampu, masyarakat miskin (berpenghasilan rendah), buta huruf (mereka yang tidak bisa membaca atau menulis atau berpendidikan rendah), dan mereka yang tidak mendapat akses terhadap hak-haknya karena tekanan dari pihak yang lebih berkuasa. Salah satu jenis penahanan menurut hukum positif Indonesia adalah dengan menempatkan dalam rumah tahanan negara (rutan) (M Syafi, 2019). Rumah Tahanan Negara Pondok Bambu Kelas 1 Jakarta Timur berusaha memenuhi hak-hak warga binaannya baik selagi masih berlangsungnya proses pemeriksaan perkara hingga tahap pelaksanaan pidana. Hukum formil pidana Indonesia telah mengatur teknis dan hak-hak warga binaan selama pemeriksaan persidangan di tingkat pertama, banding, kasasi, dan peninjauan kembali hingga pelaksanaan putusan hakim, namun ketidaktahuan dan keengganan para warga binaan untuk menggunakan hak-hak yang dimilikinya justru dapat menjadi penghambat dalam pemenuhan hak-hak mereka. Tujuan penelitian ini adalah untuk meningkatkan pengetahuan dan mendorong warga binaan untuk mengetahui hak-hak hukumnya dan menggunakan bantuan hukum pro bono. Pengabdian Kepada Masyarakat (PKM) di Rutan Pondok Bambu Kelas 1 Jakarta Timur dilakukan secara luring dengan pemaparan materi searah yang melibatkan pengacara dan paralegal dari PKBH FH Untar. Untuk mewujudkan solusi, maka PKM dilaksanakan dengan pemaparan materi, tanya jawab, konsultasi gratis, serta ditindaklanjuti dengan pendaftaran warga binaan sebagai klien pro bono PKBH FH Untar.
