Abstract

Dalam era digital, dokumen elektronik menjadi bagian penting dalam proses pembuktian persidangan perkara perdata. Namun, keabsahan dan keaslian dokumen elektronik tersebut harus diverifikasi dan diotentikasi untuk memastikan kepercayaan dan integritasnya. Penelitian ini bertujuan untuk menganalisis metode autentikasi dan verifikasi dokumen elektronik dalam pembuktian persidangan perkara perdata. Hasil penelitian menunjukkan bahwa metode autentikasi dan verifikasi yang efektif dapat meningkatkan kepercayaan dan integritas dokumen elektronik, serta memfasilitasi proses pembuktian yang lebih efisien dan akurat. Penelitian ini juga mengidentifikasi beberapa tantangan dan kelemahan dalam implementasi metode autentikasi dan verifikasi dokumen elektronik, serta memberikan rekomendasi untuk perbaikan dan pengembangan sistem yang lebih efektif.

Abstract

Penelitian ini mengkaji perbandingan perlindungan hukum terhadap merek terkenal di Indonesia dan Filipina. Metode yang digunakan adalah yuridis normatif dengan pendekatan komparatif, melalui analisis undang-undang, regulasi administratif, dan putusan pengadilan. Hasil penelitian menunjukkan bahwa Indonesia menegaskan status well-known mark melalui mekanisme yudisial ex post berdasarkan UU No. 20 Tahun 2016 dan Permenkumham No. 67 Tahun 2016. Sebaliknya, Filipina menyediakan mekanisme administratif ex ante melalui RA 8293 dan IPOPHL Memorandum Circular No. 2025-009. Perbedaan ini membuat perlindungan di Indonesia cenderung kasuistik dan berbasis sengketa, sementara di Filipina lebih preventif dan terstruktur. Perbedaan ini menunjukkan bahwa perlindungan di Indonesia cenderung kasuistik, memakan waktu dan biaya litigasi, sedangkan di Filipina lebih cepat, terstruktur, dan memberikan kepastian ex-ante bagi pemilik merek. Penelitian ini menyimpulkan bahwa meskipun keduanya telah mengadopsi standar Paris Convention dan TRIPS, efektivitas perlindungan masih memerlukan penguatan regulasi dan konsistensi implementasi, terutama dalam menghadapi tantangan perdagangan digital dan lintas negara.

Abstract

Agrarian reform is one of the strategic programs of the Indonesian government to create social justice and improve people's welfare, especially in the agricultural sector. The issuance of Presidential Regulation Number 62 of 2023 concerning the Acceleration of the Implementation of Agrarian Reform is an important momentum in this effort. This study aims to analyze the impact of this regulation on the implementation of agrarian reform in Indonesia, as well as to identify the challenges and opportunities that arise after its implementation. The research method used is a qualitative approach with data collection through literature studies, interviews with relevant stakeholders, and analysis of official documents. The data obtained will be analyzed descriptively to provide a comprehensive picture of the implementation of agrarian reform after the issuance of this regulation. This study also involves statistical analysis of the area of land that has been successfully distributed and the number of people who have access to agricultural land. The results of the study show that Presidential Regulation No. 62 of 2023 has provided a significant boost to the acceleration of land distribution, with a 25% increase in the number of beneficiaries compared to the previous year.

Abstract

The curriculum serves as a guideline for the teaching and learning process in schools. In Indonesia, the curriculum continues to evolve in line with changes in time and societal needs. These changes aim to adapt to advancements in science and technology, address challenges within the education system, and achieve more effective learning outcomes. This research adopts a qualitative approach with a literature study method, drawing data from journal articles, books, research reports, and other documents. The findings illustrate the evolution of the national primary education curriculum from 1945 to the Merdeka Curriculum of 2022, depicting a lengthy journey of curriculum adaptation to Indonesia's educational dynamics. The implications of this research emphasize the importance of developing a curriculum that is responsive to both global and local developments, as well as the necessity for an adaptive education system to meet the needs of modern society.

Abstract

Illegal parking attendants in South Jakarta have developed into a complex legal and social problem. There are two categories of licensed and unlicensed illegal parking attendants. With the increasing number of vehicles in Indonesia, illegal parking attendants take advantage of this situation to earn money illegally, breaking the law and often accompanied by acts of thuggery, which creates fear in the community. The formulation of the problem in this study is how the legal culture surrounding illegal parking attendants in South Jakarta? The research method used is socio-legal by interviewing illegal parking attendants, local landowners, riders at the local location, and the South Jakarta Transportation Department. Then, this data is analyzed to find the factors that encourage the existence of illegal parking attendants and the legal culture that surrounds illegal parking attendants. The results show that many people are forced to become illegal parking attendants due to economic factors and pressure from certain individuals. The result revealed that this condition is exacerbated by the lack of supervision from law enforcement. Controlling illegal parking attendants needs to be done in stages by involving the local community to create a safer and more orderly environment.Keywords : Economic Factors, Illegal Parking Attendants, Law Enforcement, Legal Culture.

Abstract

Indonesia's economic growth is still centered on the island of Java, thus demanding the Government to conduct development outside Java. PT Hutama Karya (Persero) received a mandate from the Government to develop and build the Trans Sumatra Toll Road through Presidential Regulation No. 100/2014 was then amended through Presidential Regulation No. 117/2015. With the construction of toll roads on the island of Sumatra, economic growth there is hoped to increase. With the Trans Sumatra Toll Road, a rest area is needed to support road users when traveling. PT Hutama Karya entered into a lease agreement with tenants in the managed Toll Road rest area to rent out rental space in the rest area. This study aims to determine whether the laws and regulations regarding the PT Hutama Karya (Persero) OPT Division Rest Area Agreement have fulfilled the Legal Aspects of the Agreement and the Legal Aspects of Justice.
