Abstract

Pembagian kewarisan dengan hukum waris Islam untuk yang beragama Islam sesuai Q.S. An-Nisaa’ (4): 13-14. Penelitian bertujuan untuk mengkaji pemahaman masyarakat muslim Desa Mangkai Baru tentang hukum pembagian kewarisan dan pelaksanaan pembagian kewarisan masyarakat muslim Desa Mangkai Baru. Metode penelitian kualitatif dengan pendekatan etnografi. Sampel random sederhana. Sampelnya mewawancarai 19 orang ahli waris dari Desember 2019 hingga Mei 2020. Hasil penelitian: (1) Hanya 48% yang paham pembagian kewarisan dengan hukum waris Islam. Sisanya 52% dijelaskan dengan hukum waris lain; (2) Pelaksanaan pembagian kewarisan, praktinya beragam. Dengan hukum waris Islam sekiranya ahli waris paham dan mengetahui manfaatnya. Dengan hukum adat membagi rata kewarisan tanpa adanya perbedaan jenis kelamin timbul “makno rukun” bahwa tali silaturrahim tidak terputus, kewarisan didapat bermanfaat dan berkah. Dengan musyawarah mufakat. Kesemuanya ahli waris menentukan masing-masing bagian kewarisannya yang diharapkan tidak munculnya sengketa di kemudian hari. Namun, tidak sedikit pula pewaris yang melakukan pembagian kewarisan sebelum pewaris wafat.Kata Kunci: Hukum Waris, Pembagian Kewarisan, Warisan.

Abstract

AbstractCivet coffee is safe to consume. Although the coffee beans come out in the process through the civet anus in the form of feces. Keep the coffee intact. Qualitative research methods with a normative legal approach. In fact, normative legal research to examine law is conceptualized as a rule that applies in society and is the basis for one's behavior, such as legal provisions for buying and selling civet coffee. Therefore, this research aims to examine the legal provisions for buying and selling civet coffee “permissible” based on: (1) Fatwa Decree of the MUI Fatwa Commission Number 07 of 2010 which concerning Fatwa on Civet Coffee; and (2) Fatwa MPU Aceh Number 07 of 2011 which concerning Fatwa on Civet Coffee Law. Abstract

This study examines the practice of money arisan with an auction-based drawing system in Nagori Perlanaan through the lens of Islamic economic law. Money arisan, a form of social financial gathering popular in Indonesia, has evolved into various systems, including auction-based mechanisms. This research explores its unique practices and compliance with Islamic legal principles. Utilizing an empirical legal approach, the study analyzes data collected through field observations and interviews with participants of the money arisan. The legal framework is evaluated based on Islamic jurisprudence (fiqh), supported by Quranic verses and Hadith. The mechanism involves members bidding with the highest monetary offer to win the arisan in each period, starting from the second cycle of 38 total cycles. Winners in earlier cycles receive less money due to bid deductions, while those in later cycles benefit from accumulated funds. The arisan structure includes privileges for the chairman and administrative penalties for withdrawal. While the practice fosters financial cooperation, it introduces elements akin to riba due to unequal benefits and the presence of profit-oriented borrowing among members. This contravenes Islamic principles, which emphasize fairness and mutual benefit in financial transactions. The practice of money arisan with an auction-based system in Nagori Perlanaan, though innovative, is deemed non-compliant with Islamic economic law as it involves elements of riba.
