Abstract

Governing body berfungsi mengawasi dan memiliki otoritas tertinggi secara keseluruhan organisasi. (Winter, 2011). Governing board merupakan personil eksekutif governing body yang berwenang mengangkat pimpinan eksekutif organisasi. (Balarin dkk, 2008). Kebijakan Penyelenggaraan Komite Medik Di Rumah Sakit, menyebutkan; direktur rumah sakit berperan sebagai governing board, dan pada kebijakan Dewan Pengawas Rumah Sakit mengatur; dewan pengawas berfungsi sebagai governing body rumah sakit. Prakteknya direktur adalah pimpinan eksekutif dan dewan pengawas adalah organ non struktural pengawasan internal, sehingga direktur bukanlah tim eksekutif dari dewan pengawas rumah sakit. Pada kebijakan Badan Layanan Umum Daerah (BLUD) mengatur; BLUD dapat tidak memiliki organ dewan pengawas. Tiga kebijakan pemerintah ini berpotensi menimbulkan kebingungan dalam penerapan kebijakan rumah sakit sebagai BLUD. Tujuan penelitian adalah untuk mendalami dan menganalisis narasi kebijakan pemerintah tentang governing board, governing body dan dewan pengawas terhadap penyelenggaran rumah sakit sebagai BLUD. Data utama penelitian diambil dari narasi teks tiga kebijakan pemerintah tersebut untuk dilakukan analisis narasi berdasarkan referensi tentang governing body rumah sakit dan entitas pelayanan umum.  Bentuk penelitian adalah kualitatif dengan pengumpulan data melalui studi dokumen untuk dilakukan analisa narasi kebijakan (narrative policy analysis/ NPA) melalui pemahaman peneliti yang dibimbing oleh para dosen pembimbing sebagai instrumen penelitian. Dari hasil penelitian diketahui ada perbedaan yang signifikan antara narasi kebijakan pemerintah dengan praktek governing board, governing body rumah sakit dan entitas pelayanan umum. Perbedaan ini berpotensi menimbulkan banyak masalah dalam pengelolaan rumah sakit sebagai BLUD. Oleh karenanya penelitian ini merekomendasikan agar dilakukan penetapan kebijakan tentang governing body rumah sakit sebagai BLUD.

Abstract

This study aims to analyze the legal protection of consumers through halal certification, especially in the pharmaceutical industry. By using a qualitative approach and analyzing secondary data, this study tries to understand how halal certification can increase consumer confidence in pharmaceutical products and provide assurance of the safety and quality of the products they consume. However, in implementing halal certification in the pharmaceutical industry, there are several challenges that need to be overcome. From complex regulations to high certification costs, all of these can be barriers for pharmaceutical manufacturers to obtain halal certification for their products. Therefore, it is important to continue to research and improve the halal certification system in order to provide maximum protection for consumers.

Abstract

Biotechnology has become an important tool in improving public health in many countries, including Indonesia. Ethical considerations such as social justice, experimental animal welfare, and individual privacy rights are some of the things that need to be considered in every step of biotechnology development. The impact of legal regulations and ethical considerations on biotechnology development cannot be ignored. This research aims to provide a comprehensive overview of the challenges and opportunities that exist in the utilization of biotechnology in Indonesia. Through case study analysis and statistical data, it is hoped that readers can understand the importance of the role of legal regulations and ethical considerations in optimizing the benefits of biotechnology for public health. This research methodology uses a qualitative approach with document analysis and case studies.

Abstract

This research aims to analyze the implementation of legal protection for patients in the processing of drugs based on doctor's prescriptions by pharmacies, focusing on the case study of Decision Number 2258/PID.SUS/2020/PN MDN. Through a qualitative approach, this research explores the legal aspects that protect patients as well as the challenges faced in the practice of implementing drug prescriptions. The results show that despite clear regulations, there are still loopholes in their implementation that can harm patients. Greater efforts are needed to improve supervision of the drug processing process, including through regular inspections and training related to health law. This research shows that legal protection for patients in the context of drug processing by pharmacies is still a complex issue that requires greater attention from various relevant parties.

Abstract

Appendektomi adalah tindakan bedah untuk mengatasi radang usus buntu yang memerlukan pembiayaan signifikan di rumah sakit. Tarif INA-CBGs digunakan oleh BPJS Kesehatan sebagai standar pembayaran layanan kesehatan, namun seringkali terjadi disparitas dengan biaya riil rumah sakit. Penelitian ini bertujuan untuk menganalisis perbedaan tarif riil rumah sakit dengan tarif INA-CBGs pada kasus appendektomi di RS Pertamina Pangkalan Brandan, guna mengevaluasi efisiensi biaya. Penelitian menggunakan metode kuantitatif dengan menganalisis perbedaan berdasarkan kelas rawatan, lama rawatan (Length of Stay), tingkat keparahan penyakit (Severity Level), jumlah diagnosis, dan jumlah prosedur. Hasil penelitian menunjukkan adanya perbedaan signifikan antara tarif INA-CBGs dan tarif riil rumah sakit. Perbedaan terbesar ditemukan pada kelas rawatan kelas I sebesar -32,8%, Length of Stay >6 hari sebesar -53,2%, tingkat keparahan kategori III sebesar -27,7%, jumlah diagnosis sekunder >2 sebesar -27,7%, dan jumlah prosedur >15 sebesar -47,6%. Seluruh perbedaan bernilai negatif, menunjukkan bahwa biaya pengobatan riil lebih tinggi daripada tarif INA-CBGs yang dibayarkan oleh BPJS Kesehatan. Penelitian ini menyimpulkan bahwa ada kebutuhan mendesak untuk menyesuaikan tarif INA-CBGs agar lebih mencerminkan biaya riil rumah sakit, serta meningkatkan efisiensi biaya layanan kesehatan

Abstract

Abstrak: Penenelitian ini bertujuan untuk melihat hubungan budaya kerja dan beban kerja dengan intention to quit pada perawat di klinik MHDC Jakarta. Metode peneltian ini adalah metode penelitian crossectional dengan jumlah sampel sebanyak 120 orang perawat yang diambil dengan teknic proposive sampling dan uji statistic menggunakan uji statistik chi square. Hasil penelitian ini menunjukkan adanya hubungan antara budaya kerja dengan intention to quit. Selain itu, terdapat juga hubungan antara beban kerja dengan niat untuk intention to quit. Budaya kerja dan beban kerja memengaruhi niat untuk intention to quit pada perawat, sehingga keduanya perlu diperhatikan untuk mencegah niat tersebut serta meningkatkan kualitas layanan di rumah sakit

Abstract

Making a product certainly requires a permit in the process, therefore, to find out the process that needs to be gone through by these business actors, it is necessary to know the systematic flow and the impact if they violate the rules that have been set. Criminal law enforcement by the Food and Drug Supervisory Agency (BPOM) on business actors who market their products will be discussed in more detail. Where many cases occur in Indonesia, business actors do not have distribution permits for food and drugs or are called illegal goods. Government activities in the sector of drug and food distribution supervision in the territory of Indonesia are carried out by BPOM, a non-ministerial central government institution, referring to Presidential Regulation Article 2 Number 80 of 2017. The Center was formed based on the Decree of the Head of BPOM Number 14 of 2014 concerning the Organization of Work Procedures in the BPOM UPT Environment. Every province in Indonesia has a BPOM that helps supervise drugs and food in the region. The purpose of the data collection technique is to find general issues and reliable news. Primary data comes directly from the source, while secondary data is collected through websites, annual reports, and performance reports. This study focuses on the community, BPOM Kepri, and other business actors. The findings of this study are the results of BPOM Kepri's drug and food supervision.

Abstract

International trade disputes have been successfully settled by the London Court of International Arbitration (LCIA), a component of the international arbitration system. The decision of a breach of contract dispute involving an aircraft leasing agreement between Helice Leasing S.A.S (Helice) and Atterissage S.A.S (Atterissage) with PT. Garuda Indonesia Tbk (GI), decided by the LCIA, reflects this. After concluding that GI had violated the agreement, the LCIA ordered it to pay Helice and Atterissage the past-due rent as well as the remaining rent. Analysing the international arbitration procedure for resolving disputes and the award's enforcement is the goal of this research. Using a normative legal methodology, the study analyses case studies and legislation. The results show that arbitration uses a multi-step procedure to resolve disputes, including hearings, mediation or conciliation, the selection of an arbitration panel, the presentation of the parties' arguments and supporting documentation, and the arbitrator's ruling. The LCIA effectively resolved the disagreement, demonstrating the efficacy and efficiency of this approach. The enforcement of the award is permitted in Indonesia under Article 65 and Article 66 of Law No. 30 of 1999 on Arbitration and Alternative Dispute Resolution (AAPS Law), provided that the Central Jakarta District Court has recognised the arbitration award and it does not contravene public order.

Abstract

This research aims to analyze the influence of cryptographic technology and the effectiveness of Anti-Money Laundering (AML) policies on countering Bitcoin transaction-based drug trafficking in Indonesia. Using a normative legal research method with a desk study approach, this study evaluates the contribution of cryptography to transaction security, challenges in monitoring, and weaknesses in AML policies in Indonesia. The results show that cryptographic technology enhances the security and efficiency of transactions through blockchain, but its anonymity is utilized in illegal activities. In addition, AML policies in Indonesia still face implementation challenges, such as low compliance with Know Your Customer (KYC) principles and minimal supervision of cryptocurrencies. This research recommends strengthening regulations and international cooperation as strategic steps in tackling digital crime.

Abstract

This study aims to examine and analyze the acts of gratuities givers in the Central Jakarta District Court Decision Number: 37/Pid.Sus-Tpk/2021/PN.Jkt.Pst related to the application of article 5 paragraph (1) letter a and article 13 of law number 31 of 1999 as amended by law number 20 of 2001 concerning the eradication of corruption. This descriptive research uses a normative legal research method through Study Literature legal research using two approaches, namely the statute approach  and the case approach. The types of data used are primary data and secondary data. The technique used in the collection of primary legal materials in this study is through literature search by analyzing court decisions, while in secondary legal materials through literature studies and document studies. This study uses a descriptive method analysis technique, namely providing an overview or explanation of the subject, object, and research results, however, the results of this research are not justified by the researcher. The results of this study show that the panel of judges acquitted the defendant, the judge's decision in this case stated that one of the considerations is regarding the absence of a criminal article that regulates the existing act of giving gratuities is the action of the recipient of gratuities, the results of this research are intended to contribute to the literature on gratuities for law enforcement and the eradication of corruption,  Unlike the previous research which focused on the application of the article of indictment, this study focuses on the consideration of the Council of Judges about the elements of giving or promising something to a civil servant or state administrator. Using legal political theory and legal findings, this study assesses the legislative policy related to gratuities and the legal interpretation of judges in the condition of legal vacuum. Through a normative and empirical juridical approach, this research produces an in-depth analysis as an academic and practical contribution to the eradication of corruption, especially related to gratuities. The targeted outputs in the form of policy recommendations for regulatory improvement and legal practice guidelines are presented in the form of international journals. The level of research readiness is on an exploratory scale, with the potential for policy implementation.
