Abstract

Perkembangan demokrasi di Indonesia menghadapi tantangan signifikan akibat dinamika politik yang kompleks, khususnya dalam penegakan hukum yang kerap diwarnai intervensi kepentingan politik, ketidakpastian regulasi, dan lemahnya integritas lembaga peradilan. Penelitian ini bertujuan menganalisis realitas dan idealitas penegakan hukum di Indonesia pada era kegundahan politik, dengan fokus pada praktik negotiated justice, intervensi politik, dan penerapan asas equality before the law. Metode penelitian yang digunakan adalah penelitian hukum normatif dengan pendekatan doktrinal melalui analisis literatur, peraturan perundang-undangan, dan putusan pengadilan yang relevan. Hasil penelitian menunjukkan adanya kesenjangan signifikan antara norma hukum positif dan praktik peradilan, ditandai oleh maraknya praktik negotiated justice, intervensi kekuasaan, dan inkonsistensi penerapan prinsip kesetaraan di hadapan hukum. Temuan ini mengindikasikan perlunya reformasi menyeluruh yang meliputi penataan kerangka regulasi, penguatan independensi lembaga peradilan dan Komisi Pemberantasan Korupsi, serta penerapan digitalisasi untuk meningkatkan transparansi dan akuntabilitas.

Abstract

This study examines two critical dimensions of Indonesia’s national legal reform: the urgency of overhauling the National Legislation Program (Prolegnas) following executive interventions during President Joko Widodo’s administration, and the implications of such interventions on judicial morality. Employing a qualitative comparative methodology, the research integrates document analysis of Prolegnas, draft laws, and government regulations, regulatory audits, and in-depth interviews with legislative and judicial stakeholders. Findings reveal that fragmented authority and the omnibus law approach without thorough audits generate legal uncertainty, while abrupt statutory revisions cause ethical dilemmas for judges and inconsistencies in legal interpretation. The study recommends embedding systematic regulatory audits, early involvement of the judicial council, establishing an independent ethics oversight body, and incorporating explicit judicial morality clauses in every legislative amendment. This integrated framework aims to ensure Prolegnas produces laws that are responsive, accountable, and substantively just.

Abstract

This study aims to examine the legal policy of the Indonesian government in determining the COVID-19 vaccination policy and the extent to which its implementation meets the principles of justice, especially in terms of equal access and an educational approach to the community. The research method used is a normative qualitative approach with an analysis of laws and regulations, official government documents, and scientific literature. Data were collected through literature studies and analyzed descriptively-analystically. The results of the study show that although the vaccination policy was designed as a form of protecting the public interest, its implementation still faces challenges in terms of inequality in vaccine distribution, lack of public education, and a legal approach that tends to be coercive. For this reason, the vaccination policy needs to be reviewed to emphasize the principles of social justice, respect for human rights, and public participation as part of a responsive and democratic legal policy.

Abstract

Tingkat kepuasan pasien di Instalasi IGD RSUD Kota Mataram pada lima dimensi mutu layanan (tangible, reliability, safety, empathy, dan responsiveness) adalah sangat memuaskan. Kepuasan ini tercermin karena mutu layanan yang diterima pasien sudah memenuhi harapan mereka. Beberapa atribut layanan yang berkontribusi pada tingkat kepuasan pasien meliputi lokasi rumah sakit yang nyaman dan mudah diakses, ketersediaan dokter spesialis, respon cepat perawat terhadap semua kebutuhan pasien, kesiapan perawat untuk bekerja sama dengan pasien di ruang IGD, serta sikap ramah dan menyenangkan dari tim medis. Strategi untuk mengembangkan mutu layanan di Instalasi IGD RSUD Kota Mataram meliputi mempertahankan kualitas pada dimensi empati dan responsivitas dalam dimensi empati, perhatian harus diberikan pada atribut terkait file dan catatan medis rumah sakit, yang harus akurat dan bebas kesalahan. Sementara itu, dalam dimensi responsivitas, perhatian perlu difokuskan pada atribut yang melibatkan sekuriti, petugas gizi, dan petugas kebersihan yang sangat membantu dan bersimpati terhadap pasien. Ini didasarkan pada fakta bahwa kedua atribut tersebut menunjukkan nilai rata-rata tingkat kepuasan yang terendah.

Abstract

The 2024 election in Indonesia faces significant challenges related to political ambitions and legal defeats, which have impacted the integrity and implementation of the election process. Political ambitions from candidates and political parties often lead to violations of election rules, including the spread of misleading information and manipulation of voting results. Legal defeats, such as violations of campaign rules and the inability of law enforcement to handle these cases, undermine public trust in the democratic system and law enforcement institutions. This article examines the impact of these legal defeats and provides recommendations for reforms in election regulations, increased law enforcement, transparency, and political education. Comprehensive reform efforts are needed to ensure fair elections and increase public trust in the democratic process in the future

Abstract

Criminal crimes in elections in Indonesia pose a serious threat to democracy and nation building. Political, social and economic factors are the main drivers, with weak law enforcement exacerbating the situation. Comprehensive efforts from the government, Bawaslu, Gakkumdu, Polri, Prosecutor's Office, community and civil organizations are needed to take action against perpetrators, improve political education and strengthen coordination between institutions. Further research is needed to analyze the modus operandi, actors involved, and the impact of election crimes on democracy

Abstract

This research examines the role of the amicus curiae in the 2024 Presidential Election Results Dispute (PHPU) trial in Indonesia. Through a qualitative approach, this research analyzes the contribution of the amicus curiae's independent views to the final decision of the Constitutional Court (MK) and public trust in the fairness of the legal process. Data was collected through document analysis, interviews and direct observation of the trial process. The findings show that amicus curiae has an important role in bringing a neutral and in-depth legal perspective, enriching legal discussions in the courtroom, and strengthening the legitimacy of the Constitutional Court's decisions in the eyes of the public. Despite being faced with various challenges, including political pressure and the complexity of legal cases, the amicus curiae remains consistent in maintaining its legal neutrality and independence

Abstract

The 2024 elections in Indonesia will be a crucial moment that will not only determine the direction of government for the next five years, but will also demonstrate complex power dynamics from a legal and political perspective. The power struggle in the 2024 elections will involve various political actors trying to maintain or seize strategic positions in government. From a legal perspective, strict and transparent election regulations are essential to ensure a democratic process that is fair and free from fraud. Apart from that, the role of law enforcement agencies, such as the KPU and Bawaslu, in supervising election implementation is key to maintaining election integrity. From a political perspective, party coalitions, campaign strategies and mass mobilization are important factors that influence election results. Political actors must be able to develop effective strategies to win popular support while maintaining political and social stability. Apart from that, issues such as corruption, the economy and social welfare will be the main topics fought for by the candidates. The 2024 election will not only be an arena for political battles, but also a reflection of the development of democracy in Indonesia. Therefore, integrity, transparency and active community participation are important elements in determining the nation's future

Abstract

This study discusses foreign investment disputes involving Indonesia in international arbitration forums, particularly under the jurisdiction of ICSID (International Centre for Settlement of Investment Disputes). The main focus of this study is on the interpretation of the provisions of Article 2 paragraph (1) in the Indonesia-UK Bilateral Investment Treaty (BIT), which regulates the conditions for the entry of foreign investment in Indonesia. In the Rafat Ali Rizvi case, the arbitration panel decided that the process of entering investment that does not comply with the provisions of the Foreign Investment Law (UU PMA) cannot be included in the scope of the BIT. This study provides important recommendations for Indonesia in re-evaluating the provisions in each BIT involving Indonesia, as well as conducting further studies on ICSID arbitration decisions to understand the interpretation of BIT articles related to jurisdiction and the subject matter. Thus, this study aims to strengthen Indonesia's position in facing investment disputes at the international level

Abstract

Copyright protection plays a vital role in the music industry, which has high economic value. However, the use of songs without permission from the copyright owner still frequently occurs, such as in the dispute between Arie Sapta Hernawan (Arie Bias) and Agnez Mo (Agnes Monica Muljoto). Agnez Mo used Arie's songs in three commercial concerts without permission. This issue focuses on the violation of the creator's economic rights due to the use of works without a license or official permission. The Jakarta Commercial Court Decision Number 92/Pdt.Sus-HKI/Hak Cipta/2024 considered the defendant's actions as copyright infringement, emphasizing the importance of permission from the rights holder before the work is used commercially. This decision provides legal certainty for creators to enjoy their economic rights and strengthens the legal position of the owner of the work. This study uses a normative juridical method with a descriptive approach, focusing on concrete case analysis. The data used comes from secondary legal materials, including primary, secondary, and tertiary materials. Data collection was carried out through literature studies, while analysis was carried out qualitatively with the stages of data verification, reconstruction of legal information, and preparation of systematic conclusions. With this approach, the research aims to examine the existence of exclusive rights of creators and the limits of their use by other parties.
