Abstract

The implementation of the 2024 Regional Head Elections in Indonesia generated constitutional and legal debates regarding the interpretation of regional head terms of office. Differences in interpreting the calculation of tenure between statutory provisions, Constitutional Court decisions, and technical electoral regulations created legal uncertainty concerning the eligibility and constitutional status of regional heads participating in the 2024 Regional Elections. This study aims to analyze the implications of multiple interpretations of regional head terms of office on legal certainty within Indonesia’s electoral system and to examine the legal harmonization required to prevent similar constitutional ambiguity in future elections. This research employed a normative legal research method using statutory, conceptual, and case approaches. Primary legal materials consisted of statutory regulations, Constitutional Court decisions, and electoral regulations, while secondary legal materials included legal doctrines, books, and scientific journal articles related to constitutional law, elections, and legal certainty. The findings indicate that inconsistencies between Law Number 23 of 2014 concerning Regional Government and Law Number 10 of 2016 concerning Regional Elections, combined with differing constitutional interpretations, have created multiple interpretations regarding regional head tenure. This condition has affected democratic legitimacy, equal political rights, and legal certainty in the implementation of the 2024 Regional Elections. The study further finds that the absence of harmonized electoral regulations and clear transitional provisions contributes significantly to constitutional ambiguity within Indonesia’s electoral governance. Therefore, legal harmonization, synchronization of electoral regulations, clearer legislative drafting, and stronger institutional coordination among electoral institutions are necessary to ensure constitutional certainty and democratic legitimacy in future regional elections.

Abstract

The neutrality of the State Civil Apparatus (ASN) constitutes an essential principle in ensuring democratic, honest, and fair elections in Indonesia. Nevertheless, violations of ASN neutrality continue to occur during electoral processes, including involvement in practical political activities, misuse of state facilities, and political support expressed through social media platforms. This study aims to analyze the legal effectiveness of the General Election Supervisory Agency’s (Bawaslu) supervision in maintaining ASN neutrality during elections in Garut Regency and to identify the factors influencing the implementation of such supervision. This research employed an empirical juridical qualitative approach. Data were collected through interviews, documentation studies, and literature reviews involving Bawaslu officials, ASN members, and relevant legal documents concerning election supervision and ASN neutrality. The findings indicate that Bawaslu has carried out preventive supervision through socialization programs, direct monitoring, institutional coordination, and handling of alleged neutrality violations. However, the effectiveness of supervision has not yet been fully optimal due to several obstacles, including limited supervisory authority, inadequate human resources, broad supervisory areas, low legal awareness among ASN, and persistent sociopolitical pressures within local bureaucratic structures. The study concludes that the effectiveness of Bawaslu’s supervision is influenced not only by the legal framework but also by institutional capacity, legal culture, and societal compliance with neutrality principles. Strengthening institutional coordination, supervisory authority, and legal awareness is therefore necessary to support democratic elections characterized by fairness, integrity, and bureaucratic professionalism.

In the Sundanese tradition and Islamic teachings there are indeed differences in parental custody, the location of these differences is not substantial. However, to get an understanding of custody of the elderly, a solution must be found first in order to avoid the perception of custody which is always identified with custody of children. The essence of both lies in the race to take care of and respect parents regardless of whether it is a boy or a girl.

Abstract

The sovereignty of God in the state administration of the Kingdom of Indonesia can be seen from the words of Ken Arok attacking the kingdom of Kediri, "O Pastors who adhere to Shiva and Buddhism. Please bless me to have the title Bhatara Guru ”. The study of God's sovereignty can be clearly seen from the history of Ken Arok, who was the king of Tumapel, who succeeded in using God's sovereignty to gain power over Kediri. So the question is the extent to which the existence of the struggle for God's sovereignty in Indonesia which underlies divine values. Ken Arok as the ruler of Tumapel who is a subordinate of Kediri has committed an offense of royal state order. What was done by Ken Arok in terms of International Law as "belligerent". Ken Arok's movement to gain power by committing offenses on the state administration of the kingdom, legalized by the laws of the royal state at that time, as well as international law today. In addition to evidence of the theory of God's sovereignty which was applied by Ken Arok to strengthen his power, in modern times too, the theory of God's sovereignty was practiced by Soekarno during the Old Order. As proof of the theory of God's Sovereignty during the Soekarno era came from the minister of religion of the Republic of Indonesia who at that time was held by Wahid Hasyim, who considered it important to build a magnificent mosque as gratitude for Indonesia's independence in the struggle against the invaders. Keywords: sovereignty, God, struggle, kingdom

Abstract

This article examines the construction of knowledge in the education of state guardians in the Sanghyang Siksakandang Karesian manuscript, focusing on the role of narrative and authority in shaping leadership ethics within the local governance education. Unlike doctrinal normative texts, the manuscript refers to epic and didactic narrative traditions without presenting them explicitly, assigning their interpretation to the dalang as an interpretive authority in Sundanese oral tradition. This study aims to explain how these narrative references, mediated through the dalang, construct a value-based, contextual, and participatory model of state guardian education. The research employs a normative-reflective approach combined with historical hermeneutic analysis to examine the relationship between text, tradition, and epistemic authority. The findings reveal that knowledge is not transmitted through rigid prescriptive rules but through the interpretation of narratives embedded in living tradition. The dalang acts as an intermediary between the text and understanding, enabling ethical values to be interpreted contextually and applied in social life. This model is placed in dialogue with Plato’s conception of narrative as an instrument for educating state guardians. While Plato emphasizes narrative, regulation, and control, the manuscript demonstrates an alternative model grounded in interpretive mediation, highlighting indigenous epistemic traditions as a resource for developing ethical, socially responsible public officials.
