Abstract

The practice of borrowed-name agreements in land transactions in Indonesia raises significant concerns regarding contractual validity and legal certainty, particularly when such arrangements are employed to circumvent statutory prohibitions on land ownership. The core issue lies in the discrepancy between the formal structure of the agreement and its substantive purpose, which contravenes agrarian law. This study examines the legal implications of failing to satisfy the requirement of a lawful cause in borrowed-name agreements, formulates a juridical–conceptual framework for assessing their validity through an integration of the doctrine of lawful cause and mandatory principles of agrarian law, and delineates the limits of contractual freedom in land ownership. Employing normative legal research methods, including conceptual analysis, statutory interpretation, and case law review, the study finds that borrowed-name agreements are legally invalid when their purpose is to evade agrarian restrictions, notwithstanding their formal compliance with contractual requirements. The study concludes that the doctrine of lawful cause remains a crucial evaluative instrument for safeguarding the balance between freedom of contract, legal certainty, justice, and public order within the national legal system.

Abstract

This paper examines the legal stance of the Professional Disciplinary Council in the medical dispute resolution system based on Law Number 17 of 2023 on Healthcare and its derivative regulations. This study employs a normative juridical research method with a critical analysis of the provisions of Article 308 paragraphs (5) and (6) of the Healthcare Law, and compares them with the concept of quasi-judicial bodies in the legal literature. The main focus of this study is to understand in depth the role, authority, and legal implications of the existence of the Professional Disciplinary Council as part of the medical dispute resolution mechanism, especially in the context of the relationship between health worker professionalism and the criminal justice system. The results of the study indicate that the Professional Disciplinary Council has an important role as a quasi-investigative institution, namely conducting ethical and professional assessments of alleged disciplinary violations by health workers, and providing recommendations before the criminal investigation process is carried out. However, these recommendations is yet to have any legally binding force, thus creating legal ambiguity and potentially triggering tensions between professional institutions and law enforcement officials. To address these problems, this study offers an ideal model for medical dispute resolution that upholds professional justice and legal justice in a balanced manner. The need for normative recognition of the Council's role in the Bill of Criminal Procedure Code (RUU KUHAP) is emphasised, as well as improvements to the institutional design to ensure clarity in mechanisms, boundaries of authority, and synergy between institutions. This is expected to ensure the resolution of medical disputes is fair and accountable, guarantees the protection of the dignity of healthcare workers, and provides legal certainty for patients.

Abstract

Constitutional Court (MK) “Decision Number 60/PUU-XXII/2024 marks an important shift in the practice of judicial review, whereby the Constitutional Court not only invalidates legal norms, but also establishes new substantive norms in cases involving open legal policy. This action reflects the tendency of positive legislature, which theoretically expands the scope of judicial authority beyond the limits of negative legislature. This study aims to analyse the implications of this ruling on the legislative function of Indonesia Parliament (DPR), particularly in the context of its constitutional responsibility to respond to and accommodate new norms established through court rulings. Using normative legal research methods and a conceptual approach, this study finds that the DPR's suboptimal institutional response to the substance of the ruling indicates serious challenges in harmonising the constitutional system that guarantees the effectiveness of norms, legal certainty, and the principle of checks and balances. This study contributes to proposing a model of inter-institutional coordination or parameters for the judicialisation of norms to ensure the balance of power, as well as criticising and clarifying the boundaries of the roles of each state institution in the context of corrective legislation based on judicial decisions.

Abstract

Penelitian ini bertujuan untuk menganalisis Pembatasan Konstitusional terhadap Hak Prerogatif Presiden dalam Penyusunan kabinet di Indonesia. Penelitian dilakukan dengan metode penelitian hukum normatif melalui pendekatan perudang-undangan dan konseptual dengan menggunakan teknik analisis deskriptif untuk menganalisis bahan hukum primer dan sekunder. Hasil penelitian menunjukkan bahwa kewenangan Presiden untuk membentuk memilih menteri dan menentukan jumlah kementerian tidak mutlak. Presiden harus tetap tunduk pada batasan konstitusional, mekanisme checks and balances dan ketentuan undang-undang, seperti UU No. 39 Tahun 2008 dan UU No. 61 Tahun 2024. Adanya pembatasan ini untuk mencegah terjadinya kesewenang-wenangan serta menjaga efisiensi birokrasi pemerintahan. Penelitian ini menegaskan bahwa pelaksanaan hak prerogatif Presiden harus tetap dalam koridor hukum tata negara sehingga tidak menjadi kekuasaan yang absolut. Penelitian ini memberikan pemahaman mengenai keseimbangan antara diskresi eksekutif dan pembatasan hukum dan implikasinya dalam penyelenggaraan negara. Dengan demikian, Pembatasan Konstitusional terhadap hak prerogatif dalam penyusunan kabinet di Indonesia sangat diperlukan untuk menjamin penyelenggaraan pemerintahan yang akuntabel dan berorientasi pada kepentingan publik.

Abstract

This study examines the any quality policy in government paddy procurement as a state response to the need to maintain national rice availability, while raising concerns regarding the protection of food quality as an integral component of the right to food. The core issue lies in the tension between flexibility in absorbing paddy from farmers and the state’s legal obligation to provide food that is safe, suitable, and of adequate quality in accordance with the relevant regulatory framework. The research employs a doctrinal method using primary and secondary legal materials, combined with statutory, conceptual, and comparative approaches that include policy practices in India, China, and Thailand, in order to assess the alignment of the policy with the principles of the right to food and proportionality. The findings indicate that the any quality policy can meet constitutional obligations only when supported by adequate quality control mechanisms. Price instruments such as rafaksi are insufficient to preserve quality and therefore must be complemented by strengthened post harvest facilities, technical standards for drying and sorting, consistent quality monitoring, and enhanced administrative capacity at both national and regional levels. The study concludes that an integrated policy design linking price instruments with technical instruments is essential to ensure that the state can effectively safeguard food quality and fully uphold the right to food.
