Abstract

Akta warisan tanah yang dibuat oleh notaris memiliki peran penting dalam memberikan kepastian hukum bagi ahli waris dalam proses pewarisan. Sebagai dokumen otentik, akta ini tidak hanya menjadi alat bukti sah, tetapi juga menjadi dasar peralihan hak kepemilikan tanah kepada ahli waris yang berhak, dalam praktiknya sering terjadi berbagai permasalahan, seperti konflik antar ahli waris, ketidaksesuaian data administratif, serta klaim dari pihak lain yang berpotensi memicu sengketa hukum. Penelitian ini bertujuan untuk mengkaji implikasi hukum akta warisan tanah yang dibuat oleh notaris, dengan menyoroti aspek keabsahan hukum, prosedur pembuatannya, serta peran notaris dalam menjamin legalitas dokumen tersebut. Dengan menggunakan pendekatan normatif dan analisis terhadap beberapa kasus sengketa warisan, hasil penelitian menunjukkan bahwa meskipun akta notariil memiliki kekuatan pembuktian yang kuat, kedudukannya tetap dapat dipersoalkan apabila terdapat kesalahan administratif, keberatan dari ahli waris lain, atau indikasi pemalsuan dokumen. Notaris harus menjalankan tugasnya dengan profesionalisme dan prinsip kehati-hatian agar dapat meminimalkan potensi sengketa di masa mendatang. Selain itu, pemahaman hukum bagi ahli waris juga perlu ditingkatkan agar mereka mengetahui hak dan kewajibannya dalam proses pewarisan, sehingga dapat mencegah perselisihan serta memastikan kelancaran proses pewarisan sesuai ketentuan hukum yang berlaku.

Abstract

Hapusnya hak milik atas tanah yang dijadikan objek jaminan Hak Tanggungan tentunya akan menimbulkan permasalahan hukum tersendiri, karena menurut ketentuan Pasal 18 ayat (1) huruf d UUHT, Hak Tanggungan hapus karena hapusnya hak atas tanah yang dibebani Hak Tanggungan. Tujuan penelitian ini untuk mengetahui Prosedur Hukum pembatalan sertifikat hak milik Hak Tanggungan Akibat Hapusnya Hak Milik Atas Tanah Sebagai Objek Jaminan, kedudukan kreditur pemegang hak tanggungan setelah hapusnya hak milik atas tanah yang dijadikan sebagai objek jaminan, serta upaya yang dapat dilakukan oleh kreditur dalam hal pelunasan hutang debitur setelah hapusnya hak milik atas tanah. Penelitian ini bersifat deskriptif dengan pendekatan yuridis normatif, sumber data yang digunakan untuk mendukung penelitian ini adalah sumber data sekunder yang meliputi bahan hukum primer, bahan hukum sekunder dan bahan hukum tersier. Berdasarkan hasil penelitian dan pembahasan dapat diketahui bahwa hapusnya hak milik atas tanah yang dijadikan sebagai objek jaminan hak tanggungan maka Hak tanggungan juga akan ikut hapus. Hapusnya hak tanggungan maka tidak akan ikut menghapuskan perjanjian pokok. Hapusnya Hak Tanggungan sebagai perjanjian kebendaan mempunyai akibat hukum, yaitu berubahnya posisi kreditur, yang semula berkedudukan sebagai kreditur preferen yang mempunyai hak kebendaan kemudian berkedudukan sebagai kreditur konkuren yang mempunyai hak perseorangan.

Abstract

Mortgage rights are born because of the underlying agreement, namely a credit agreement. The existence of a credit agreement results in the debtor being obliged to carry out his performance in the form of debt repayment to the creditor. If the debtor defaults, a legal action is taken in the form of execution, which is generally carried out by auction on Mortgage Rights. This type of research is normative which is descriptive. The data sources used are primary data and secondary data. With literature study data collection techniques. And using qualitative data analysis methods. With the existence of executorial power in the credit agreement, the creditor as the holder of the Mortgage Rights can take action to execute the auction of the land rights charged with the Mortgage Rights. Auction with Mortgage Rights is a class of execution auction, because it is based on a credit agreement. The implementation of the execution auction of Mortgage Rights must be carried out in accordance with the procedures of existing laws and regulations, so that there is a legal certainty, both for debtors, creditors, and auction winners.

Abstract

Transportation business activities are often used by many people, and more and more times there are conflicts between sellers and buyers regarding cooperation in travel agency transactions related to promotions that are carried out online but are not in accordance with reality. To find out the implementation of Law No. 8 of 1999 concerning Consumer Protection (UUPK) related to business. And to find out the factors that influence the effectiveness of UUPK. The research method, namely normative juridical. The research approach is quantitative, data analysis techniques are data reduction, data presentation, and conclusions. The results of the research, that UUPK and UU no. 11 of 2008 concerning electronic information and transactions (UUITE) so that consumers can freely give their opinions. come to the LPKSM office for consultation. If the consumer gives power of attorney to LPKSM, LPKSM then makes a power of attorney which is signed and approved by the LPKSM consumer, an action that is carried out first with family efforts. Factors that influence the effectiveness of UUPK namely; The government is less responsive to community developments in electronic transactions, there are no regulations that technically provide protection to consumers against online transactions, business actors and consumers do not understand their rights and obligations. The conclusion from this study, LPKSM as an extension of the government has been active but there are no policies that technically regulate and protect consumers in electronic transactions, the factors that influence the effectiveness of the UUPK are the government which is less responsive, ignorance of consumers and business actors regarding their rights and obligations.

Abstract

Crimes that are classified as extraordinary crimes are money laundering which can disrupt the economic and structural stability of the country. This offense can be committed by active members of the TNI. The investigation into him is an integral part of the criminal justice system. The aim of this research is regarding the role and position of legal investigators in dealing with TPPU involving the military in Indonesia. The method used in this research is normative by reviewing literature and legal sources, including legal principles, positive law, legal regulations, and legal principles. Research findings show that if there are members of the TNI who commit general offenses (including TPPU), then the investigative authority in money laundering cases involving the Indonesian military can come from the POLRI, TNI, Attorney General's Office, or other agencies that have investigative and prosecutorial authority. All parties must coordinate to ensure that this case is handled carefully and transparently in accordance with applicable law.

Abstract

The development of the economic and monetary sector is now deemed necessary to further enhance the role of credit institutions on the basis of legal guarantees that meet the needs of the community. The government has provided various other credit/loan facilities through PT Pegadaian. The pawn agreement is made by the customer as the debtor providing the pawn and PT Pegadaian as the holder of the pawn. Pawn objects are movable objects with a few exceptions. The procedure for requesting credit until repayment is relatively easy without conditions which will cause new problems for customers. The approach method used is empirical juridical. The results of the research PT Pegadaian carry out its duties to help the community work well. The pawnshop is responsible for the maintenance and storage of the pawned goods by being insured. After the due date but the pawned goods are not taken or not redeemed is a form of default that occurs, the collateral goods will be auctioned with the applicable procedures. PT Pegadaian Tangerang Branch sometimes faces problems but all of them can be overcome by sticking to the company's mission, vision and goals, so that there is no prolonged dispute between customers and PT Pegadaian.

Abstract

Ownership of land rights is an interest for Indonesian that is used for various purposes, one of which is as collateral in a financing agreement. The advantage of being a collateral object is to have a stable value and tend to increase. The purpose of this study is to analyze the legal protection of creditors who experience problems when knowing debtor defaults and their position of creditors who only have SKMHT without APHT due to notary negligence. This research method is qualitative with a normative juridical research type. The results of the research are protection for SKMHT holders enforced despite the negligence of the Notary/PPAT. In addition, the recommendation that the PPAT/Notary should have SKMHT management to avoid legal problems when debtor defaults.

Abstract

This research aims to find out what the status of land ownership is according to the Basic Agrarian Law and how land disputes resulting from unlawful acts are resolved in terms of UUPA No. 5 of 1960, which using normative legal research methods concluded that: 1. Land ownership status is an important thing , because it concerns someone's ownership, we all know that land ownership is an important thing in human life, where we live on land, so land ownership status is really needed by everyone. Ownership of a certificate is evidence that has clear legal force. The Basic Agrarian Law is the basic rule that regulates land in Indonesia. With the development of the times, new rules have been born, either contained in law or government regulations, which have been designed in such a way as to meet needs and have succeeded in perfecting the rules regarding land ownership status. which can be carried out by the Indonesian people. 2. Regarding dispute resolution, it does not have to be resolved in court, but rather deliberation or family or local government to resolve the dispute so that it does not end up in court and becomes a big problem. A dispute occurs, causing many parties to take legal action, even though there is another way, namely by deliberation to reach a consensus, which fails, so they usually take the matter to the sub-district or to the land office, in this case to the village or the head of the Land Office who helps resolve it. In this case they only act as mediators or are often called mediators.

Abstract

The aim of this research is to find out practical steps to determine the default agreement and voluntary statement in Constitutional Court Decision No.18/PUU-XVII/2019 regarding the executorial power of fiduciary guarantees. This type of research is normative legal with a statutory approach and a conceptual approach. Research data was found by means of library research studying primary, secondary and tertiary legal materials. The results of this research indicate that financing companies in carrying out their business activities using credit distribution mechanisms are required to enter into financing agreements with articles of default (stipulations for debtors in default); This means that the finance company as the creditor must include a default article with content material that is required by POJK 35/2018 and in determining whether the customer is in default, they must be given a warning letter with information that all guarantees legal certainty or is in accordance with the existing default agreement; and the form of a voluntary statement to create legal certainty as intended by Constitutional Court Decision No.18/PUU-XVII/2019 is that apart from the voluntary clause contained in the contents of the financing agreement, it can be made with a special statement letter stating that you voluntarily hand over fiduciary guarantees when a default has occurred. previously agreed.

Abstract

ABSTRACTOne of the notary's responsibilities providing solutions for late registration of fiduciary guarantee deeds is by creating a confirmation deed. If one wishes to use this solution, it’s necessary to first understand the legality and responsibility of the notary in issuing such confirmation deed. The research method used is a doctrinal approach, where law is viewed as a set of written norms contained in legislation. The research results explain that the legality of the confirmation deed is valid, however it’s not yet strong due to the absence of a legal framework that governs it, and when viewed from the perspective of responsibility theory, the creation of the fiduciary guarantee confirmation deed represents the notary's responsibility as a result of carrying out their duties and position.Keywords: Confirmation Deed; Responsibility; Fiduciary ABSTRAKTanggungjawab notaris dalam memberikan solusi terhadap peristiwa keterlambatan pendaftaran akta jaminan fidusia salah satunya ialah dengan membuat akta penegasan. Apabila ingin menggunakan solusi tersebut, dengan demikian perlu diketahui terlebih legalitas dan implikasi serta tanggung jawab notaris dalam pengeluarkan akta penegasan tersebut. Metode penelitian yang digunakan adalah pendekatan doktrinal, yang mana hukum dipandang sebagai seperangkat norma tertulis yang terdapat dalam peraturan perundang-undangan. Hasil penelitian menjelaskan bahwa legalitas dari akta penegasan tersebut adalah sah, namun belum begitu kuat dikarenakan belum adanya payung hukum yang menaungi serta jika dilihat dari sisi teori tanggung jawab, maka dibuatnya akta penegasan jaminan fidusia tersebut merupakan bentuk tanggung jawab notaris sebagai akibat dari pelaksanaan tugas dan jabatannya.Kata Kunci: Akta Penegasan; Tanggung Jawab; Fidusia
