Abstract

Tujuan dari penelitian ini adalah untuk menentukan pola perkembangan hukum adat di Bima dan keberadaannya setelah reformasi, sehingga kecenderungan dikenal. Jenis penelitian ini adalah non-doktrinal, atau sosial hukum (kualitatif), dengan pendekatan historis, data yang digunakan terdiri dari data primer dan data sekunder. Hasil dari penelitian ini adalah; (1) pola perkembangan hukum adat Bima ada, a) hukum Sintesis, yaitu ketika hukum adat dan hukum Islam bertemu dan saling melengkapi, dan tidak ada konfrontasi antara mereka, b) hukum Transplantasi, terjadi ketika sistem hukum kolonial didorong ke pengaturan lokal dengan batas kewenangan peradilan Islam, yang menyebabkan kekosongan hukum, c) Integrasi hukum, ketika pemerintah pusat untuk membangun keseragaman politik hukum melalui kodifikasi dan unifikasi, d) hukum positif, yaitu pada saat reformasi bertiup, semangat lokal dibentuk melalui peraturan, (2) adanya hukum adat yang ada kerugian lengkap, dan yang masih hidup, yang masih hidup hukum adat ditemukan di masyarakat Donggo, dengan semua fleksibilitas dan berbagai bentuk sanksi.

Abstract

Objective: This article aims to find out the legal accountability of recording transparency in village fund reporting, especially in Gatak Village and Krecek Village, Delanggu District, Klaten Regency, knowing what obstacles are hamper to realizing transparency in recording and reporting village funds.Method: This type of research is empirical or sociological research. Empirical research is a type of research that is used to solve problems by examining secondary data first and then proceeding with conducting primary data research in the field and the application of law in society. The writing method used in this research is descriptive research. Findings: Transparency of Recording and Reporting of Village Funds of Gatak and Krecek Villages, to realize good governance, this has been proven by the accountability reports and the results of interviews that have been carried out by the authors in accordance with existing mechanisms based on Law No. 6 of 2014 concerning Villages, and Minister of Home Affairs number 113 of 2014. About Guidelines for Regional Financial Management. From the interviews, it was found that there were weaknesses in terms of delays in funds coming down from the center, and this would also result in a delay in activities along with existing recording and reporting, in addition to the lack of maximizing technology resources in order to fulfill transparency to the public of existing human resources, but these obstacles are still able to be resolved and do not interfere with the performance of the village government for the better.Purpose: This research is expected to be able to contribute ideas in the development of legal science, especially state administrative law, especially regarding the implementation of good governance at the village level. This research can know the recording and reporting mechanisms to achieve transparency in village fund financial reporting, and can provide the views of readers and writers who have problems with similar problems, also determine the author’s ability to apply the knowledge that has been obtained.Novelty: Different from previous research, this paper has differences that emphasize more on the role of village officials in legal responsibility in the transparency of recording and reporting village funds.

Abstract

ABSTRACTObjective: This study aims to describe the transparency of the 2019 election campaign funds based on the laws and regulations and to find out in depth the legal consequences and sanctions received by election participants in reporting campaign funds.Methodology : The type of research used is empirical juridical, namely, examining everything related to legal provisions, as they have been implemented and how they were implemented in the broader community. The research sites are at the General Election Commission (Komisi Pemilihan Umum) office of Blora Regency, the Office of the Election Supervisory Board, and the Liaison Officer of the participating political parties. In this study, the solution to the problem lies in the transparency of reporting campaign funds for 2019 election participants, which researchers emphasize on the election participants for candidates for members of the Regional People's Representative Council of Blora Regency.Results : Transparency in Law Number 7 of 2017 concerning General Elections and General Election Commission Regulation Number 24 of 2018 as amended by General Election Commission Regulation Number 34 of 2018 concerning General Election Campaign Funds and Implementation of Campaign Fund Reporting for Election Contestants to Realize The 2019 election had been held at the Blora Regency General Election Commission. The General Election Commission of Blora Regency had implemented transparency in campaign finance reports in the 2019 Election. This can be seen from the regulations governing the Blora Regency General Election Commission's strategy in applying the principle of transparency regarding campaign finance reports in the 2019 Election in Blora Regency.Applications of this study: This study is expected to produce a formulation on campaign finance reporting that will be used by the General Elections Commission to develop policies and regulations on campaign finance reporting..  Novelty/ Originality of this study: Election results have had a significant impact on Indonesia's democratic order from year to year. If a regulation is properly implemented, it will have an impact on the general election process's pattern of continuity.
