Abstract

Sesuai isi Pasal 25 A UUD NRI 1945, bahwa Negara Kesatuan Republik Indonesia adalah sebuah negara kepulauan yang berciri Nusantara dengan wilayah yang batas-batas dan hak-haknya dengan undang-undang. Setidaknya terdapat 8 lembaga pemerintah yang diberikan wewenang di wilayah perairan Indonesia. Pada UU No. 6 Tahun 1996 Tentang Perairan Indonesia. Pengaturan wewenang di bidang kelautan diatur dalam undang-undang yang sektoral dan saling bersinggungan antara satu sama lain sehingga menimbulkan overlapping wewenang dalam menangani tindak pidana IUU fishing di wilayah perairan Indonesia. Selain kerugian ekonomi karena pencurian ikan oleh nelayan asing maka sektor kelestarian sumber daya maupun sosial Indonesia juga dirugikan. Kepastian penegakan hukum di wilayah perairan Indonesia bertujuan agar tercapainya kedaulatan, keamanan dan kenyamanan bagi seluruh masyarakat. Rekonseptualisasi penegakan hukum di wilayah perairan Indonesia yang memenuhi unsur keabsahan hukum secara filosofis, sosiologis, dan yuridis, diharapkan mampu menjadi solusi yang memberikan manfaat bagi semua pihak dalam upaya penegakan hukum perikanan di wilayah perairan Indonesia.

Abstract

The application of restorative justice at the investigation level based on the Circular Letter of the Chief of the Indonesian National Police Number: SE/8/VII/2018 concerning the Application of Restorative Justice (Restorative Justice) has been widely SE. 08/2018 concerning the Application of Restorative Justice in the context of accelerating the realization of justice, using a comparative study of criminal cases in the Bantul Regional Police; in this study used normative research methods. The application of the Chief of Police's Circular on Restorative Justice in the case of the crime of theft which is an example/case study in the Bantul Police Region in fact cannot be carried out in general (generalization), this is seen from the factor, namely the losses suffered by the victims. Comparison of cases in BP/…/VIII/2020/RESKRIM and BP/…/III/2020/RESKRIM, both efforts were made to resolve restorative justice but some were completed and some were continued, because essentially a case (case) is not necessarily the same exactly. There is also a disparity in the application of restorative justice based on S.E. National Police Chief with Supreme Court Regulation 2 of 2012.

Abstract

At this time the Republic of Indonesia is preparing to carry out a democratic party to welcome the 2024 general election, currently various problems have occurred along with the preparation for the election itself. The first problem is the readiness of the political party information system which is still problematic, coupled with the problem of party verification which had reaped polemics as well as bad rumors about the KPU leadership itself that appeared in media reports. Serious studies and good integrity are needed to make the KPU an institution that is trusted by the public. Considering that our nation has been independent for more than 77 years, we need to be serious about running the 2024 democratic party.

Abstract

Sociology cannot be used directly in the context of distorting the scope of legal science in its independent substance, legal sociology is a middle way with its various slices. The complex reality in society provides many distortions as to whether law can be independent or a truly substantially open system, in the midst of our legal development position which was previously the perspective of Dutch scientists and is currently required to accommodate "laws that live in society", let alone coincide with the current social conditions of people who are trying to become survivors amid the Covid-19 pandemic and the new normal era, in this case social reality requires the role of law. So the role of the sociology of law in law enforcement in society is urgently needed, in this study law is not an autonomous institution but is interdisciplinary in dealing with social phenomena to realize people's welfare. Law enforcement in society is an effort to realize respect for social norms, through legal reform must include preventive and repressive stages of improvement, improvement of morality, behavior of law enforcement officials, and as the most important element is community involvement.

Abstract

The ITE Law as a legal framework for law enforcement for every crime arising from electronic information and transactions does not cover victim protection in the form of compensation (refund). This research was conducted normatively. The legal issues discussed in this study are: First, what kind of legal protection do victims of online buying and selling scams have? The aims of this study are: First, to analyze forms relating to the protection of fraud victims in online transactions. Amendments to the ITE Law are needed to include restitution as an additional offense so that restitution is not only an option proposed but an obligation that must be fulfilled.

Abstract

The problem of environmental pollution is increasingly in the spotlight and global. The system adopted in criminal law on environmental pollution is a system of criminal responsibility based on mistakes. Corporate crime can emerge along with the advancement of economic development. Corporate crime is not new, but something that has happened frequently and alternated from time to time. Currently, corporations are included in the category of legal subjects so that they can be subject to criminal and civil sanctions. The doctrinal legal research used has the aim of analyzing environmental regulations associated with corporations that pollute. UU no. 32/2009 Protection and Management of the Environment as a legal umbrella mentions the environment as a unitary space with all objects, styles, conditions, and organisms, including humans and their behavior that affect nature itself, survival, livelihoods and welfare of humans and other living things. Losses from environmental pollution are not only in one area but can spread to the surrounding area with a fantastic total value of losses. environment for sustainable development. Abstract

AbstractCommunication, social, economics, and science are currently synergizing with technology (internet) to create a new world in Indonesia and all countries in the world. In Indonesia, the problem of technology using the internet besides the positive side, is also a negative side that creates new problems in social relations. Restorative justice appears to be a new term in the world of law, and emerged when 3 law enforcement institutions each issued rules regarding the use of this approach, but if one looks closely the spirit of restorative justice has existed since ancient times in the values of the Indonesian people, namely deliberation to reach consensus, as the embodiment of part of the nation's ideological values, namely Pancasila. There is always debate about information and electronic transactions. This indirectly shows the public's need for this law. If you look closely at the issues that often arise are defamation and hate speech, especially during campaigns (related to politicians) and in the entertainment sector (celebrities). So this research is about legal aspects both in terms of the applicable laws and regulations regarding the criminal responsibility of perpetrators who distribute and transmit information, generally related to defamation of social media and examines the application and implementation of these regulations in relation to ITE law with a restorative approach to justice. The application of restorative justice for now is quite good, and accommodates local wisdom values. But in the future it still requires the professionalism of law enforcement (human resources) in its implementation.AbstrakKomunikasi, sosial, ekonomi, dan ilmu pengetahuan saat ini bersinergi dengan teknologi (internet) menjadikan dunia baru di Indonesia maupun seluruh negara di dunia. Di Indonesia permasalahan teknologi yang menggunakan internet ini selain sisi positif, juga sisi negatif yang menimbulkan permasalahan baru dalam relasi sosial. Restorative justice tampak sebagai istilah baru dalam dunia hukum, dan muncul ketika tiga institusi penegak hukum masing-masing menerbitkan aturan tentang penggunaan pendekatan ini, namun jika dicermati semangat restorative justice telah ada sejak kuno dalam nilai-nilai bangsa Indonesia, yaitu musyawarah untuk mencapai mufakat, sebagai perwujudan dari bagian dari nilai ideologi bangsa yaitu Pancasila. Perdebatan soal informasi dan transaksi elektronik selalu ada, secara tidak langsung ini menunjukkan kebutuhan masyarakat atas undang-undang ini. Jika dicermati isu yang sering muncul adalah pencemaran nama baik maupun ujaran kebencian, terutama pada masa kampanye (terkait politisi) maupun bidang entertainment (selebritas). Maka penelitian ini tentang aspek hukum baik dari sisi peraturan perundang-undangan yang berlaku mengenai pertanggungjawaban pidana pelaku yang mendistribusikan maupun mentransmisikan informasi, pada umumnya terkait pencemaran nama baik media sosial dan menelaah penerapan dan pelaksanaan peraturan-peraturan tersebut dalam hubungannya dengan hukum ITE dengan pendekatan restorative justice. Penerapan  restorative justice untuk saat ini sudah cukup baik, dan mengakomodir nilai kearifan lokal. Namun kedepan tetap membutuhkan profesionalisme penegak hukum (sumber daya manusia) dalam pelaksanaannya.

Abstract

The internet is a sophisticated tool for exchanging information, various fields from law to medical sciences (medicine) have also used the internet on a large scale. The use of wireless fidelity is also quite attractive for those who need free internet access. But it is undeniable that in addition to some people hoping to use the free internet, it will also cause the desire of people who want to use it as a means of other crimes. The purpose of this study is to examine cases of internet data theft through wireless fidelity within the scope of criminal law. Our criminal law as  the backbone, namely the Criminal Code, was used to study this problem (historical interpretation) and today there is a Telecommunications Law and an Electronic Information and Transaction Law. While using internet access without someone else's permission, is a violation of the law. Before entering into the study of how much loss quota (intangible objects) were stolen, the perpetrators had actually been able to be suspected by illegal access.

Abstract

The embodiment of people's democracy, namely the regional head elections from 2017 to 2020, has revealed various problems, which can be considered to have reduced the quality of this political event. Debates continue to occur regarding regional head candidates, even DPR/DPRD member candidates who have committed corruption, and the low level of public trust in political parties. There appears to be a correlation with corruption due to the need for campaign funds related to the choice of regional heads. The scope of corruption in regional head candidates needs to be of concern to all parties, so that the prevalence of corruption in the implementation of regional elections actually increases, and undermines the goals of democracy as a means of realizing people's welfare. On the other hand, political parties as the first door to recruiting regional head candidates have an early detection role, in tracking the track record of the regional head candidates they will nominate. The formulation of the problem that will be studied is how the phenomenon/"shadow of corruption" in the 2024 Simultaneous Pilkada reflects the previous Pilkada, this political behavior is also similar to when there are legislative choices. The method used is normative juridical, then examines secondary data for the 2020 simultaneous regional elections, as a view of the potential that will occur in the 2024 simultaneous regional elections. Regional head candidates who commit corruption or are related to criminal acts of corruption do not have the legitimacy to nominate or be elected regional head.
