Abstract

Crime in general and sexual violence are deviations from a person's good and bad morals. The author examines the factors that influence the occurrence, as well as the causes of sexual coercion and/or sexual violence in society. Sexual violence/harassment is an iceberg phenomenon, this is allegedly due to the lack of comprehensive handling from the government, the existence of unequal power relations, the lack of education about sex and social ethics in the current era of promiscuity. Sexual violence that often occurs in the society is detected in several forms/modes including threats (non-physical) to rape (physical). The study in writing this scientific paper is about the treatment and prevention in the study of sexual violence and sexual coercion in the community based on the TPKS Law. Study uses descriptive normative method, then a statutory approach, and conceptual. In the past, before the TPKS Law, sexual crimes were still very limited in terms of terminology, but now it has become wider/religious to adapt to the development of the societies sense of justice. The normative perspective of this law is quite good, so it is hoped that its implementation in the society can actually fulfill a sense of justice. In the perspective of Islamic law, through “takzir” which is seen as a punishment in Islamic criminal law, the perpetrator can be punished and the matter is handed over to the ruler or judge who has the right to decide a matter to obtain justice.

Abstract

Social media platform very a lot, writer interested research about TikTok as a platform that is quite trending with utilise take niche market, namely duration videos short , and Indonesia is ranked as the second most TikTok user in the world. Social media is quite influential in the social development of society, but the rules on each platform are often still normative and not applied regularly, such as the features for reporting violations of community rules. The positive side of social media is that it triggers people's creativity (especially teenagers), but it cannot be denied that there are also negative sides, ranging from consumerism to ethical degradation and can even develop into criminal acts, even though there are many positive legal instruments that regulate it, one of which is the information law and electronic transactions, and juvenile criminal justice system laws. In closing, the author believes that the government's role is not limited to creating regulations, but must actively monitor the development of social media in collaboration with electronic organizers so that the negative impact on the younger generation can be controlled.

Abstract

The rapid use of the internet in Indonesia as part of the world community has created dynamics and problems, in the field of information law and electronic transactions as well as human rights, and also related to one's privacy. The government holds the power to regulate the new world, namely cyberspace for internet users in Indonesia. The right to be forgotten is a person's right that must be protected by the state. In this case, through Law No. 19 of 2019 concerning Electronic Transactions and Information. The right to be forgotten in relation to those who are reported on or whose data is stored in public institutions in relation to perpetrators of criminal acts, victims of criminal acts, or related to news of criminal acts can be both positive and negative if it is misused. Someone who is published in the public space that he was once a victim or perpetrator of a crime certainly has the right to be forgotten so that he can improve himself without the shadow of a dark past. On the other hand, public transparency still requires information to be accessed for certain news. For example, criminal acts of corruption. Bearing in mind human rights and public transparency regarding the classification of who is allowed and who is not allowed to use this right, it must be strictly regulated, for example, criminal acts of corruption.

Abstract

Indonesia is a country of law that recognizes the existence of customary and religious law as a source of law. The daily practice of menusia is to communicate (naturally) but in this opinion and / communication often occurs speech that violates the rights of others or hurts other parties, then the potential for this conflict penetrates using spoken language on social media (internet). The regulation that regulates criminal acts related to defamation is Law No. 19 of 2016 concerning Electronic Information and Transactions, while the more general nature is the criminal code, which has "bridged" customary and religious law as living law into the criminal justice system as positive law. Currently, all law enforcement institutions have accommodated modern law by issuing rules on the use of restorative justice, in line with the nature of criminal law which is ultimum remedium. On the one hand, the old pradigma considered that legal certainty must be criminal proceedings and lead to imprisonment, but modern society with the aim of law yearns for peace and social harmony, which is also contained in Pancasila. The research cites several opinions of international and local figures; The results of this study show that the application of restorative justice is full of values and philosophical, so it is necessary to educate and legal awareness to solve this problem by involving the community, victims and perpetrators of crimes with the aim of achieving justice for all parties, because the essence of the law is the "property" of society.

Abstract

Article 33 (3) of the 1945 Constitution of the Republic of Indonesia, is clear that the welfare of the people must be prioritized, however, the problem of mineral and coal mining, at the conceptual level, has not shown an impact on the welfare of the Indonesian people; The author appreciates this change in law. Currently, corruption related to mining has emerged again, namely a loss of IDR 271 trillion, which according to Bambang Hero S. is still an environmental loss or a loss to the country's economy. When compared to BLBI of 138 trillion and Asabri of around 22 trillion, this means that the trading system of tin as one of the mining commodities is the biggest corruption, which was unexpected by the public, but suddenly emerged after the election. Departing from the 1945 Constitution which uses the principle of managing oil and gas resources for the benefit of society and the state. So the problem formulation is how problematic occurs in changes to the regulations of Law no. 4 of 2009 until now it has become Law no. 3 of 2020. At the norm level, changes to the law have accommodated the principles of sustainability and legal certainty, even though implementing regulations do not yet exist. Returning to legal problems in Indonesia, problems often arise in the application of the law, not at the normative level.

Abstract

Netizens/netizens in Indonesia have a role in the disclosure of several legal cases. Therefore, this study aims to capture how the opinions and aspirations (Opinions) of netizens related to the positive law enforcement process in the criminal case of theft of cocoa beans charged to Grandma Minah (Case No. 247/Pid.B/2009/PN. PWT). The case of Grandma Minah is considered a case that disturbs the community's sense of justice. Netizens assessed that dragging Grandma Minah into the legal process just because of the theft of 3 cocoa grains was an irony and contrary to conscience. Netizens contrast the disparity between the firmness of law enforcement in the Grandma Minah case and the firmness of law enforcement in corruption cases or cases involving the rulers and the powerful. The spirit of Law 40/2007 on the Company directs the existence of corporate social responsibility (CSR) which can also be used as a benchmark to view this case. In this study, the opinions of netizens are classified as positive because they hope that the law can be more just, humane and conscientious. However, in the future, the potential for the opinions of netizens, which is sometimes also based on minimal data/facts, has the potential to distort the independence of judges.

Abstract

Konstitusi kita UUD 1945 harus dipahami sebagai sumber hukum dan sumber etika, korupsi yang selama ini terjadi secara masif dan meluas, tidak sebatas merugikan keuangan/perekonomian negara, tetapi pelanggaran terhadap hak-hak sosial, ekonomi masyarakat, dan HAM. Banyaknya kepala daerah berprestasi dari deretan pejabat yang tertangkap tangan oleh KPK merupakan fenomena masalah yang memprihatinkan. Kejahatan dari struktur sosial berikut dampaknya merupakan penyimpangan perilaku karena alasan ekonomi maupun struktur masyarakat.  Perilaku koruptif (korupsi atau kejahatan terkait korupsi) akan semakin rumit dan terselubung ketika pelaku telah terbungkus/terselubungi berbagai predikat sosial, bahkan pada saat ini banyak kepala daerah yang berpretasi masuk dalam deretan pelaku korupsi. Kualifikasi masyarakat tradisional sekaligus memenuhi masyarakat moderen (transisi) ini sesuai untuk menggambarkan kondisi Indonesia saat ini. Hukum represif yang diterapkan belum dapat memecahkan masalah,  dalam prakteknya namun mengarah formalisme hukum. Maka permasalahannya adalah bagaimana (korelasi) ketidaksesuaian kepala daerah berprestasi yang justru melakukan tindak pidana korupsi. Penelitian ini mendapat kesimpulan bahwa Struktur sosial yang cukup tinggi ternyata tidak menjamin seseorang terbebas dari perilaku koruptif (korupsi), bahkan background apapun tetap berpotensi jusatru mengaburkan/menyelubungi perilaku koruptif yang mereka lakukan, dimana masyarakat acapkali toleran/permisif terhadap perlaku koruptif yang dilakukan orang dengan berbagai predikat sosial yang tinggi; kemudian memerlukan upaya pengajian ulang (redesign) dalam hal memberikan predikat berprestasi kepada kepala daerah,  dengan menghimpun informasi catatan tertentu dari pihak aparat penegak hukum di daerah yang dipimpinnya, penegak hukum dalam hal ini adalah penegak hukum eksternal hakim, jaksa, maupun kepolisian. Redisign ini untuk menghindari keadaan bahwa seorang kepala daerah dinyatakn berprestasi namun kemudian diketahui melakukan korupsi.

Abstract

Hate speech is an issue that is still interesting to study, because each country's Criminal Code regulates this matter. Hate speech can also be found in various media, including through activity speeches, pamphlets or social media, public speeches (demonstrations), religious lectures, printed mass media, and pamphlets. factors, such as education, culture, and social. Based on the description above, the authors chose the title of comparative legal research on hate speech according to Indonesian criminal law (KUHP), Malaysian criminal law and Norwegian criminal law. This type of research is normative juridical research by examining literature or secondary materials by referring to legal norms contained in statutory regulations, as well as other legal literature. The approach used is comparative, to then be analyzed and concluded. From the results of the data analysis, it can be concluded that the provisions on hate speech in the Indonesian, Malaysian and Norwegian Criminal Codes have similarities in terms of the concept of hate speech, although they are not exactly the same, while the difference is in the implementation and legal sanctions.

Abstract

Kenakalan remaja (anak) merupakan masalah sosial sekaligus masalah hukum yang sering kita jumpai di masyarakat dan cukup meresahkan seiring perkembangan jaman di era internet, bahkan telah menybar dari kota-kota besar hingga ke desa-desa. Masalah ini merupakan masalah yang perlu diatasi agar dapat memberikan dampak positif bagi remaja. Karena remaja merupakan aset masa depan suatu bangsa maka diperlukan penanganan yang serius untuk mencegah terjadinya kenakalan remaja. Kenakalan remaja adalah perilaku remaja yang tidak sesuai dengan norma-norma yang berlaku di masyarakat. Dalam pandangan hukum kenakalan remaja dapat dianggap kejahatan jika dilakukan oleh orang dewasa, namun dalam hal ini pelakunya adalah remaja (anak) maka hal tersbut dianggap sebatas kenakalan. Kenakalan remaja mencakup semua perilaku yang menyimpang dari norma yang dilakukan oleh remaja. Ada beberapa faktor yang mempengaruhi kenakalan remaja, yaitu faktor internal dan eksternal. Akibat dari kenakalan remaja akan berdampak pada remaja itu sendiri, keluarganya dan masyarakat. Dalam mengatasi kenakalan remaja diperlukan pembinaan dari orang tua dan peran lingkungan terdekat. Daris sisi hukum sistem peradilan anak telah memadai dalam konteks terobosan adanya diversi. Kata kunci: Kenakalan Remaja, Kriminologi, Remaja, Anak, internet

Abstract

Korupsi merupakan perilaku tercela atau tidak bermoral yang terjadi hampir diseluruh dunia, apalagi di negara-negara miskin/ berkembang, bahkan meskipun koruptor sering disebut orang yang cacat secara agama, namun faktanya korupsi tetap ada, baik korupsi secara murni merupakan perbuatan pidana korupsi maupun perbuatan pidana lain terkait korupsi. Eksistensi hukum pidana perlu ditekankan, agar para pelaku korupsi tidak berdalih bahwa perbuatannya tidak masuk ke dalam kategori tindak pidana korupsi. Bahkan ditengah bangsa Indonesia dan seluruh dunia berduka karena pandemi Covid-19, masih saja ada korupsi justru terhadap dana bantuan sosial.
