Abstract

Corruption can be defined as an extraordinary crime. The consequences of corruption crimes can damage democratic values, morals (local wisdom), harm the country's finances and/or economy, and violate the social and economic rights of the community. Agencies responsible for investigating and prosecuting criminal acts of corruption include the police, prosecutor's office, and the Corruption Eradication Commission. Corruption is defined as the actions of those in positions of authority, including politicians and civil servants, who enrich themselves illegally and unfairly, abusing the power entrusted to them by society. Corruption is defined as the misappropriation of state or government funds (including those of companies, organizations, and foundations) for personal or other individuals' interests. It is imperative that law enforcement agencies prioritize focus, prevention, and strengthening. The research method employed is a legal and doctrinal approach, which examines secondary data. The author concludes that corruption persists and that the integrity of law enforcement officers is questionable. To eradicate corruption, it is necessary to re-focus on methods such as "follow the money" and "asset recovery." It is also essential to make legal breakthroughs regarding digital exposure or publication, and to implement prevention and control of criminal acts of corruption, including carrying out prevention and education efforts within political parties. Abstrak Korupsi dapat diakualifikasikan kejahatan luar biasa, akibat kejahatan korupsi dapat merusak nilai-nilai demokrasi, moral (kearifan lokal), merugikan keuangan dan/ perekonomian negara, melanggar hak-hak sosial dan ekonomi masyarakat. Instansi yang berkaitan dengan penuntutan tindak pidana korupsi, yaitu kepolisian, kejaksaan, dan Komisi Pemberantasan Korupsi. Korupsi diartikan sebagai tindakan penguasa, baik politisi (dalam keterkaitan tertentu) maupun pegawai negeri, yang memperkaya diri sendiri secara tidak sah dan/ tidak adil, menyalahgunakan kekuasaan yang dipercayakan masyarakat kepadanya. Korupsi adalah penyelewengan dana negara/pemerintah (perusahaan, organisasi, yayasan, dan lain-lain) untuk kepentingan pribadi atau orang lain. Perlunya fokus dan pencegahan dan penguatan dalam penegakan hukum. Metode penelitian yang digunakan adalah pendekatan undang-undang maupun doktrin, yang mengkaji dari data sekunder. Penulis menyimpulkan bahwa korupsi tetap terjadi dan diwarnai integritas para oknum penegak hukum yang diragukan, pelaksanaan metode pemberantasan korupsi memerlukan pemfokusan kembali (re-focussing) terutama follow the money dan asset recovery, perlu dilakukan terobosan hukum tentang pemaparan atau publikasi digital, dan secara periodik tentang pelaksanaan pencegahan dan penanggulangan tindak pidana korupsi, termasuk melakukan upaya pencegahan dan edukasi di dalam partai politik.

Abstract

At the end of 2019, the world was shocked by the existence of a new condition, namely the Covid-19 pandemic. In almost two years, the Indonesian government has issued various policies during the Covid-19 pandemic. One of these policies is a prohibition on people gathering and doing activities outside the home, and a recommendation to stay at home. This government policy of course also has an impact on wider sectors, one of which is the employment sector. The employment sector is one of the sectors affected by government policies during the pandemic, because employment is closely related to the economy and industry, many entrepreneurs have had their income reduced because people's consumption power has decreased, and this has a more serious impact on their workers. This research aims to find out the impact of the Covid-19 pandemic on employment law in the Yogyakarta area. The subjects of this research are workers who were affected during the Covid-19 pandemic in the Yogyakarta area and resource persons who are experts in labor law. After this research was carried out, we now know the impact of the Covid-19 pandemic on employment law in the Yogyakarta area.

Abstract

Kekerasan yang dilakukan oleh kelompok pemuda terus meningkat di Indonesia dan menjadi topik yang hangat dan menjadi tantangan hukum pidana, bahkan ketika negara sedang melaksanakan pemilihan umum atau dilanda bencana pandemi Covid-19 namun fenomena yang saat ini disebut klitih oleh masyarakat umum, khususnya Daerah Istimewa Yogyakarta dan sekitarnya kerap terjadi. Kaum muda telah dilanda oleh kurangnya Pendidikan moral dan krisis identitas. Salah satu akibatnya, muncul kelompok-kelompok pemuda yang mendirikan komunitas/geng, dan secara khusus dalam tulisan ini timbulnya “klitih”. Tokoh masyarakat maupun agama belum dapat memberikan solusi atas permasalahan ini, bahkan kini pihak Kepolisian masih kesulitan dalam penanggulangan dan pengungkapan, karena para pemuda/ usia pelajar ini memang tidak memiliki identitas seperti halnya kelompok yang dahulu dikenal dengan nama “geng”. Makalah ini menyajikan perspektif pidana dan hak asasi manusia dalam mengkaji permasalahan klitih, tentunya akan menyinggung pula UU tentang perlindungan anak dan sistem peradilan pidana anak. Metode yang digunakan adalah yuridis normatif mengingat berita-berita tentang terjadinya klitih telah banyak menghiasi media. Masalah klitih ini merusak masa depan generasi muda dan mengancam hak asasi manusia

Abstract

Indonesia merupakan negara yang masih berstatus berkembang di ASEAN, namun posisinya masih diatas Myanmar, kemudian Timor Leste dan Kamboja. Pertumbuhan ekonomi merupakan proses berkesinambungan dan diukur dalam kurun waktu tertentu, sedangkan pertumbuhan umumnya disertai masalah pemerataan, lingkungan hidup, SDGs, peran sektor swasta (korporasi), hak-hak tenaga kerja, instrumen hukum, dan kondisi sosial politik negara. Pertumbuhan ekonomi memerlukan dukungan bidang hukum yang disebut dengan istilah hukum ekonomi; Indonesia sedang melakukan hal ini, dengan memegang prinsip sistem ekonomi Pancasila, yang mencerminkan nilai-nilai HAM dan Right to Development (RTD). Pertumbuhan ekonomi suatu negara tidak dapat berdiri sendiri, namun harus melibatkan investasi sebagai bagian dari perdagangan internasional. Penelitian ini mengkaji peran hukum dan HAM dalam pembangunan ekonomi Indonesia, yang beberapa saat lalu juga diwarnai perdebatan yang kompleks diterbitkannya UU Cipta Kerja. Maka para ahli maupun masyarakat tetap mengharapkan upaya-upaya pemerintah untuk memajukan pembangunan ekonomi dengan melibatkan seluruh rakyat Indonesia untuk menikmati kesejahteraan dan keadilan. Abstract

Pelaksanaan penegakan hukum keimigrasian di Yogyakarta melibatkan sejumlah pendekatan dan langkah-langkah guna menjaga ketertiban dalam persoalan keimigrasian, memastikan keamanan nasional terjaga, dan menegakkan peraturan keimigrasian. Berdasarkan beberapa penelitian sebelumnya, terdapat lima kendala utama dalam pelaksanaan penegakan hukum keimigrasian di Kantor Imigrasi Yogyakarta. Fenomena ini mengungkapkan permasalahan mendasar yang berkaitan dengan kerangka hukum, tumpang tindih dalam konsep pengawasan keimigrasian, serta bias dalam tindakan keimigrasian. Dalam penelitian ini, dengan merujuk pada prinsip-prinsip Hukum Administrasi Negara, dilakukan analisis normatif-empiris dengan fokus pada kerangka hukum dan perbedaan perlakuan dalam penegakan hukum keimigrasian di Kantor Imigrasi Yogyakarta. Hasil penelitian menunjukkan bahwa belum ada ketentuan yang menguraikan jenis pelanggaran imigrasi yang akan mengakibatkan Tindakan Administratif Imigrasi (TAK), dan terdapat diskresi bagi petugas Imigrasi dalam menentukan apakah akan menerapkan TAK atau menuntut pidana, sehingga menciptakan perbedaan dalam penegakan hukum imigrasi. Dapat disarankan bahwa perlu ada revisi peraturan perundang-undangan terkait keimigrasian yang memperjelas kriteria pelanggaran keimigrasian dan proses peradilan terhadap orang asing.

Abstract

Perkawinan atau pernikahan berdasarkan atas cinta yang tumbuh alamiah dari semua insan Tuhan Yang Maha Esa, dan budaya maupun relasi sosial ini terjadi sejak jaman purba. Pada kondisi di Indonesia saat ini, peristiwa perkawinan bergeser diatur oleh hukum negara dengan berbagai pertimbangan. Hak private yang dijamin konstitusi dan Pancasila sebagai falsafah bangsa, kembali menarik dikaji terkait terbitnya surat edaran MA No. 2 tahun 2023 yang secara langsung/ tidak langsung beririsan dengan pelaksanaan Undang-undang. Dimana masyarakat dari berbagai belahan dunia memodernisasi hukumnya dengan isu-isu hukum teknologi dan ekonomi pembangunan, kita seolah jalan ditempat. Penelitian ini menggunakan pendekatan yuridis normatif, yang mendasarkan pada konsep, doktrin, maupun peraturan perundang-undangan. Masalah yang dikaji adalah Perkawinan yang merupakan perwujudan dari cinta, yang salah satu tujuanya untuk melahirkan keturunan seolah dibatasi oleh lahirnya Surat Edaran MA. Tentu penulis mempersilahkan segenap peneliti/ahli untuk beropini, karena hakekatnya ini sebatas refleksi penulis atas isu-isu hukum yang relatif stagnan (berputar-putar disitu selalu). Penulis beropini bahwa SEMA No. 2 tahun 2023 ini tidak seiring dengan Pancasila dan Bhinneka Tunggal Ika, yang notabene lahir dari sejarah heterogenitas bangsa Indonesia.

Abstract

The National Police of the Republic of Indonesia is given a very broad authority in carrying out its duties as the main task of the National Police, among others Harkamtibmas, Protecting, Mengayami, Serving the community and Law Enforcement, in which it is also given another authority that is discretionary police an authority to perform actions based on the conscience of police members on duty and supported by the rules that exist in police institutions. The issue that will be discussed is whether the concept of Restorative Justice in accordance with the Circular letter of the Police Chief Number SE/2/II/2021 on Ethical Cultural Awareness to Realize a Clean Digital Space of Indonesia, Healthy, and Productive can be applied in accordance with the Law of the Republic of Indonesia No. 19 of 2016 Amendments to Law No. 11 of 2008 on Information and Electronic Transactions and Criminal Defamation regulated in the Criminal Code as an alternative to suppress cybercrime, but also must be able to as a deterrent effect in order to provide protection for the human rights of others.

Abstract

Crime in general and sexual violence are deviations from a person's good and bad morals. The author examines the factors that influence the occurrence, as well as the causes of sexual coercion and/or sexual violence in society. Sexual violence/harassment is an iceberg phenomenon, this is allegedly due to the lack of comprehensive handling from the government, the existence of unequal power relations, the lack of education about sex and social ethics in the current era of promiscuity. Sexual violence that often occurs in the society is detected in several forms/modes including threats (non-physical) to rape (physical). The study in writing this scientific paper is about the treatment and prevention in the study of sexual violence and sexual coercion in the community based on the TPKS Law. Study uses descriptive normative method, then a statutory approach, and conceptual. In the past, before the TPKS Law, sexual crimes were still very limited in terms of terminology, but now it has become wider/religious to adapt to the development of the societies sense of justice. The normative perspective of this law is quite good, so it is hoped that its implementation in the society can actually fulfill a sense of justice. In the perspective of Islamic law, through “takzir” which is seen as a punishment in Islamic criminal law, the perpetrator can be punished and the matter is handed over to the ruler or judge who has the right to decide a matter to obtain justice.

Abstract

Social media platform very a lot, writer interested research about TikTok as a platform that is quite trending with utilise take niche market, namely duration videos short , and Indonesia is ranked as the second most TikTok user in the world. Social media is quite influential in the social development of society, but the rules on each platform are often still normative and not applied regularly, such as the features for reporting violations of community rules. The positive side of social media is that it triggers people's creativity (especially teenagers), but it cannot be denied that there are also negative sides, ranging from consumerism to ethical degradation and can even develop into criminal acts, even though there are many positive legal instruments that regulate it, one of which is the information law and electronic transactions, and juvenile criminal justice system laws. In closing, the author believes that the government's role is not limited to creating regulations, but must actively monitor the development of social media in collaboration with electronic organizers so that the negative impact on the younger generation can be controlled.

Abstract

The rapid use of the internet in Indonesia as part of the world community has created dynamics and problems, in the field of information law and electronic transactions as well as human rights, and also related to one's privacy. The government holds the power to regulate the new world, namely cyberspace for internet users in Indonesia. The right to be forgotten is a person's right that must be protected by the state. In this case, through Law No. 19 of 2019 concerning Electronic Transactions and Information. The right to be forgotten in relation to those who are reported on or whose data is stored in public institutions in relation to perpetrators of criminal acts, victims of criminal acts, or related to news of criminal acts can be both positive and negative if it is misused. Someone who is published in the public space that he was once a victim or perpetrator of a crime certainly has the right to be forgotten so that he can improve himself without the shadow of a dark past. On the other hand, public transparency still requires information to be accessed for certain news. For example, criminal acts of corruption. Bearing in mind human rights and public transparency regarding the classification of who is allowed and who is not allowed to use this right, it must be strictly regulated, for example, criminal acts of corruption.
