Abstract

Human Rights (HAM) are rights given to humans simply because they are human. Not because of positive law, but because of their human dignity; So the great attention to people with disabilities, which is carried out by the DIY government, is motivated by awareness of human rights, for people with disabilities who are included in vulnerable groups. The number of people with disabilities in the Special Region of Yogyakarta (DIY) is also quite large, so this research will analyze how the regulation and implementation of fulfilling the right to health insurance for people with disabilities in DIY is regulated.The push to formulate regional level regulations for people with disabilities was carried out by the central government, the DIY regional government and disability advocates or activists as well as people with disabilities. DIY has 4 districts and 1 city, each of which has a disability regional regulation in order to fulfill the regulations for implementing health services for people with disabilities in their respective regions according to their potential. However, existing regional regulations must not conflict with higher regulations, including the DIY Regional Regulation. The implementation of these arrangements means that activities are carried out well. This can be seen from the efforts made by DIY in collaboration with City Districts in health programs and funding for people with disabilities, including assistance with assistive devices. Although obstacles are still encountered, in general it can be said to be going well. Improvement prioritizes valid data collection, coordination between stakeholders and simplifying requirements for people with disabilities who want to fulfill their rights in the health sector.

Abstract

Perkembangan pesat teknologi informasi memunculkan kompleksitas baru dalam tindak pidana siber yang menuntut adaptasi regulasi dan kapasitas penegakan hukum. Artikel ini menganalisis perubahan regulasi signifikan berdasarkan UU. No. 1 Tahun 2024 sebagai perubahan kedua atas UU No. 11/2008 (UU ITE), serta implikasi perubahan tersebut terhadap praktik penyidikan, perlindungan data, dan batas kebebasan berekspresi. Metode penelitian berupa studi kepustakaan dan analisis yuridis-deskriptif terhadap dokumen hukum, putusan yudisial, dan literatur terkini. Hasil menunjukkan bahwa UU No.1/2024 memperjelas beberapa ketentuan materiil (termasuk pengaturan tentang PSE, perlindungan anak, dan batasan delik tertentu), namun tantangan utama tetap pada kapasitas teknis penegak hukum, yurisdiksi lintas negara, dan mekanisme perlindungan data pribadi. Rekomendasi meliputi: (1) penguatan unit forensik digital dan pelatihan berkelanjutan; (2) harmonisasi prosedur kerja antara PSE dan aparat penegak hukum untuk akses bukti elektronik yang memadai; dan (3) penyusunan pedoman operasional nasional yang memadukan kepastian hukum dan perlindungan hak asasi. Kesimpulannya, penegakan hukum siber efektif menuntut keseimbangan antara inovasi regulasi dan investasi kapasitas teknis serta kerja sama lintas sektor dan negara.

Abstract

This study aims to analyze the legal foundation and urgency of implementing criminal liability for political parties in Indonesia within the framework of good governance and the rule of law. In Indonesia’s democratic system, political parties play a crucial role in articulating public interests and shaping state policies through the selection and nomination of their members for legislative and executive positions. However, this strategic role also raises fundamental questions regarding legal accountability when political parties or their members engage in criminal acts under the party’s name. The study employs a normative juridical method using statutory, doctrinal, and principle-based approaches to examine the applicability of criminal liability principles to political parties as corporate entities. The findings reveal that although Indonesia’s positive law provides a basis for holding political parties criminally liable, its enforcement remains largely theoretical and lacks effective mechanisms. The doctrines of strict liability and vicarious liability have not yet been consistently applied to political organizations. The study concludes that reforming criminal law and strengthening ethical and institutional integrity within political parties are essential steps to ensure both legal and moral accountability in reinforcing democratic governance and realizing the constitutional mandate of a just and law-based state.

Abstract

Political parties and political party wings are organizations that play a role in democracy in Indonesia. Apart from that, there are still community organizations that appear to have no political affiliation but actually play a role in democratic contestation, then sporadically, almost every year before the election, similar community organizations emerge, which generally called volunteers. Political parties and their wing organizations have the same responsibility in building democracy, but we often find that party wing organizations can become an extension of political parties, committing various violations of campaigning rules or breaking the law in general; Here there is an intersection of whether political party wing organizations are subject to Law No. 2 of 2011 concerning political parties, or the law on social organizations. Researchers examine the problems of the existence of OSP in the Indonesian legal system, especially the phenomenon of legal violations. This research uses a normative juridical approach using legal norms that apply in Indonesia. At the end of the research, it was concluded that party wing organizations are more appropriately regulated in the political party law than in the law on social organizations, and violations are the responsibility of the parent political party.Keywords: law, politics, party, wing, underbouw

Abstract

Penelitian ini mengkaji peran kognisi sosial dan risiko bias kognitif dalam proses penegakan hukum pidana di Indonesia dalam kerangka KUHP 2023 dan prinsip hak asasi manusia. Dengan pendekatan yuridis normatif yang diperkaya telaah literatur empiris psikologi forensik, studi ini menelaah bagaimana mekanisme seperti confirmation bias, tunnel vision, halo effect, serta heuristik penilaian memengaruhi penyidikan, pemeriksaan saksi, dan pengambilan keputusan hakim. Hasil analisis menunjukkan bahwa ruang interpretatif yang diberikan KUHP 2023, misalnya dalam penilaian motif, sikap batin, dan keadaan yang memberatkan atau meringankan, berpotensi mengalami distorsi ketika aparat penegak hukum tidak mengendalikan bias kognitif. Dampaknya tidak hanya mengurangi reliabilitas pembuktian tetapi juga berimplikasi pada pelanggaran hak asasi terdakwa, khususnya prinsip peradilan yang adil dan bebas dari diskriminasi. Untuk itu, artikel ini merekomendasikan serangkaian langkah mitigasi berbasis bukti: standardisasi prosedur identifikasi (doubleblind lineup dan pencatatan confidence statement), perekaman audiovisual penuh interogasi, pelatihan antibias untuk penyidik/ jaksa/ hakim, pembatasan teknik interogasi berisiko, serta protokol penulisan pertimbangan putusan yang menuntut evaluasi hipotesis alternatif. Implementasi rekomendasi ini diharapkan memperkuat integritas proses peradilan pidana dan perlindungan HAM di era KUHP 2023

Abstract

The expanding use of social media by public officials has transformed governmental communication into a real-time, direct, and wide-reaching practice, while simultaneously generating new legal tensions concerning criminal defamation and responsibility for reputational harm in digital environments. This paper seeks to propose how a balance between freedom of expression and the public official’s function of disseminating information through media and the constitutional protection of individual honor can be formulated within the framework of criminal liability for defamation on social media under the ITE Law. This study employs a normative legal research method using statutory and conceptual approaches, supplemented by a case approach through the controversy of DN versus AR as a public official in Surabaya as an illustrative instance of the application of Article 27A juncto Article 45(4) of the ITE Law. Primary and secondary legal materials were analyzed prescriptively to examine the role of social media as a medium of communication, the element of intent (dolus), and the positional consequences of public officials in criminal liability. The findings show that the ITE Law does not merely function as a repressive instrument against citizens, but also as an institutional control mechanism that imposes a duty of care on public officials when communicating through social media. The criminal defamation provisions under Article 27A in conjunction with Article 45(4) ITE Law establish constitutional and penal boundaries that restrict public officials’ freedom of expression, requiring accuracy, verification, and proportionality to prevent reputational harm.

Abstract

This study examines the legal protection available to victims of sexual violence within educational institutions, viewed through a victimological perspective in the implementation of Law No. 12 of 2022 on Sexual Violence Crimes (UU TPKS). Sexual violence in educational environments remains a serious issue, with cases like “H.W” tragedy highlighting the inadequacy of institutions in providing safe spaces for students. Victims often suffer from psychological trauma, social stigma, and barriers to justice. This research employs a normative legal approach with qualitative methods to analyze the law’s application. Findings show that UU TPKS includes victimological principles, such as compensation, assistance, and rehabilitation for victims. However, its implementation faces structural and cultural challenges, such as power imbalances and victim-blaming. Effective protection requires institutional commitment, cultural transformation, and active engagement from the academic community to establish comprehensive and sustainable systems of support for victims

Abstract

The use of information and communication technology on the one hand contributes to the improvement of human welfare, but on the other hand, advances in information and communication technology can be used to commit acts that are against the law. Adultery is a social reality that often occurs, this discussion is related to the legal position of victims of adultery who are reported as crimes of decency based on law number 19 of 2016 concerning information and electronic transactions. The discussion uses doctrinal legal research methods and is limited to adding interviews as material to write down the object of the case that occurs. In the discussion section, it will examine the extent of criminal responsibility that can be borne by the perpetrator, while on the other side he is the victim. Abstract

Corruption is a major challenge, especially in developing countries, which has a significant impact on the economy and politics. In Indonesia, this corruption problem has long occurred with one of the important points being the establishment of the Corruption Eradication Commission, and currently the independence of the Corruption Eradication Commission is actually decreasing. This article draws one formulation of the problem, namely how are the dynamics of the economy and politics in the grip of corruption in Indonesia? Through empirical research methods and theoretical approaches. The results of this analysis indicate that corruption has a very negative impact on the Indonesian economy and politics, damaging the economic structure, exacerbating social inequality, and weakening democracy and public trust. To overcome this, laws such as the Corruption Eradication Law, the State Finance Law, and the Election Law are important in creating a transparent and accountable government. Abstract

Background: In the government's efforts to control the spread of the Covid-19 virus, news broke about employees of a corporation using used (recycled) antigens at Kualanamu Airport in Medan. Some people who incidentally are health workers from BUMN abuse their circumstances/authority to the detriment of society and endanger the lives of patients/consumers. This health worker who is an employee of this BUMN has committed a crime, then this act that harms the public is quite broad, indirectly/indirectly related to corporate responsibility (BUMN). Research Methods: This writing uses a statutory approach related to the case of recycling antigen devices. This type of normative legal research examines library materials or secondary data and tertiary legal materials. Secondary data consists of legal materials in the form of journals, scientific documents and expert opinions. This is a juridical-normative research that examines the application of positive legal norms, to seek the truth of coherence, namely whether the rule of law is in accordance with legal norms and legal principles, then also conducts problem solving to provide prescriptions, or descriptions of the formulation of the problem. The laws and regulations used as analysis are Law 40 of 2007 concerning Limited Liability Companies, Perma Number 13 of 2016, the Constitutional Court Decision Number 62/PUU-XI/2013, and the Criminal Code. Findings: Jurisprudence in Indonesia is not necessarily the actions of branch employees of PT. Kimia Farma Diagnostics can be related to the responsibility of the directors/corporations, as long as there is no evidence of negligence from the board of directors for this criminal act, or the negligence of the board of directors in supervising the head of the branch. Conclusion: Criminal acts committed by the perpetrators can be subject to several criminal sanctions in the field of health or consumer protection, but linking them to corporations (BUMN) requires further proof of elements.
