Abstract

This article discusses the legal protection for lands right holder designated as abandoned lands. Abandoned land in Indonesia poses serious challenges, not only for the rights holders but also for the development of society and the states. This research employs a normative legal research method to analyzes applicable legal provision and implications of the regulations of abandoned land on rights holders and the wider community. The findings indicate that land rights holders have an obligation to manage and utilize their land in accordance with the prevailing regulations. Failure to do so may result in the designation of their land as abandoned, subsequently transferring its status to that controlled by the state. Additionally, this article recommends measures to enhance legal protection for rights holders, including the application of good governance principles in addressing abandoned land issues. These findings provide important insights into the need for more effective regulations and actions in managing abandoned land for the welfare of the communition and the states.

Abstract

Misuse of social media users and lack of knowledge can lead to crime in cyberspace. With the harassment via electronic media carried out by the perpetrator against the victim, the victim feels fear in itself. This research aims to find out how legal protection is for LGBT people from bullying comments via social media. The method used in this research is the normative juridical method with a conceptual approach and a statutory regulatory approach. The results of this research are that bullying comments made via social media towards LGBT people is a serious problem that must be addressed immediately. LGBT people in Indonesia do not have special protection from bullying. However, there are several provisions that can be used to protect LGBT people from bullying comments via social media, namely Article 436 of Law no. 1/2023 and Article 27 letter a of Law no. 1/2024. The lack of reporting and the still closed nature of our society regarding these criminal acts, makes every case of defamation through electronic media difficult to uncover. Therefore, it is necessary to study the legal protection for LGBT regarding bullying comments via social media as a form of criminal act which is the cause of bullying crimes which violate human rights.

Abstract

The police are an institution responsible for carrying out law enforcement and protecting the community. In carrying out their security duties during demonstrations, many of them became victims of anarchy. The issue of legal protection for demonstrators has been widely discussed in previous studies, while there is still very little research on forms of protection for police when faced with demonstrations. The aim of this research is to find out what kind of protection is given to the police when implementing coercive measures against demonstrations that are taking place in anarchy. The type of research used is normative and the approach used is a statutory approach and a conceptual approach. So the results of this research can be concluded that forms of legal protection can be provided in the form of consultations and assistance at trials, legal regulations and state obligations can be developed for demonstrations that result in fatalities from the police as well as clear law enforcement instructions for the authorities. to ensure legal protection.

Abstract

Di dalam perkembangan negara yang semakin modern maka pengurusan segala sesuatu memperoleh kemudahan. Kemudahan akan memberikan dampak bagi masyarakat dalam mencapai apa yang diinginkan. Dalam kegiatan penyuluhan hukum ini berfokus pada implikasi kemudahan dalam pendaftaran hak cipta. Kegiatan ini dilaksanakan pada 17 Desember 2024 secara online berjudul Focus Group Discussion (FGD) Perlindungan Kekayaan Intelektual. Sebelum kegiatan, penulis telah melakukan kajian mendalam dalam proses pendaftaran hak cipta yaitu melakukan pendaftaran sebanyak 32 (tiga puluh dua) hak cipta. Hasil kegiatan pada akhirnya memberikan pemahaman pentingnya hak cipta dalam perspektif hukum. Pendaftaran hak cipta ini bisa memberikan peningkatan ekonomi bagi pelaku UMK-M sehingga ada diversifikasi usaha selain produk atau jasa yang ditawarkan.

Abstract

The research objective is to find out how criminal law against the environment accommodates criminal acts committed by corporations and to find out the practice of settlement through criminal law instruments in terms of corporate criminal liability in the environmental sector. The research method used is a normative juridical research method. There is the existence of criminal law as a part of 3 law enforcement regimes (state administrative law and civil law). then the involvement of criminal law in the settlement in the environmental sector regulates the existence of corporate criminal liability (business entity) as a subject of criminal law. The corporate criminal responsibility used by the UUPPLH is strict liability according to the law.

Abstract

Vaccination implementation became mandatory after the issuance of Presidential Regulation no. 14 of 2021 concerning amendments to Presidential Regulation no. 99 of 2020 concerning Procurement of Vaccines and Implementation of Vaccinations in the Context of Combating the 2019 Coroiva Virus Dtsease (Covid-19) Pandemic. 14 of 2021 concerning amendments to Presidential Regulation no. 99 of 2020 concerning Procurement of Vaccines and Implementation of Vaccinations in the Context of Overcoming the Covid-19 Pandemic. this is contrary to Law No. 33 of 2014 concerning Halal Produce in Article 4. The results of the research show that the Implementation of Vaccinations is mandatory. Conflict of regulations regarding Vaccine obligations based on Presidential Regulation. In this case the Regulations President No. 14 of 2021 concerning amendments to Presidential Regulation no. 99 of 2020 concerning Procurement of Vaccines and Implementation of Vaccinations in the Context of Handling the 2019 Coroiva Virus Disease (Covid-19) Pandemic, it is the opposite, however, due to the massive spread of the Covid 19 virus plus the declaration of a health emergency, it is based on the principle of Salus populi suprema est where the safety of the people is more important. What is meant in this case is that under the threat of situations and emergencies, the safety of the people must be the most important goal, including if the rule of law must be set aside.

Abstract

Hak setiap orang untuk mengumpulkan informasi yang diperlukan untuk menyampaikan pendapat adalah bagian dari kebebasan berpendapat. Oleh karena itu, setiap orang harus dijamin hak untuk mencari, mendapatkan, memiliki, menyimpan, memproses, dan menyampaikan pendapat mereka baik secara langsung maupun melalui media sosial. Sebaliknya, kebebasan berpendapat didefinisikan sebagai hak setiap orang untuk mengumpulkan, menerima, dan menyebarkan ide dan informasi dalam bentuk apa pun. Ekspresi lisan, tercetak, dan audiovisual serta ekspresi budaya, publik, dan politik termasuk dalam kategori ini. Selain itu, hak-hak ini berkaitan dengan kebebasan berserikat, yang mencakup hak untuk berkumpul secara damai, seperti mengikuti demonstrasi damai atau pertemuan publik, serta hak untuk bergabung dengan kelompok, perkumpulan, serikat pekerja, atau partai politik.

Abstract

Penelitian ini bertujuan untuk mengetahui bagaimana status statuta yang dimiliki oleh suatu Asosiasi Sepak Bola Indonesia yang merupakan organisasi non-pemerintah (PSSI) tentang bagaimana sebenarnya status statut PSSI dalam sistem hukum nasional. Pasal dalam Statuta FIFA yang melarang apapun intervensi, termasuk intervensi dari suatu negara melalui pemerintah, terhadap permasalahan yang ada dihadapi oleh anggota FIFA dan apabila hal itu terjadi maka akan ada sanksi yang diberikan kepada asosiasi sepak bola negara. Permasalahan dalam skripsi ini adalah bagaimana sebenarnya status hukum statuta PSSI ini karena terbukti PSSI dan FIFA saling mengikat satu sama lain dan PSSI pun tunduk pada FIFA dan bagaimana bentuk tanggung jawab PSSI kepada negara jika berkaca pada kasus kanjuruhan. Adapun metode analisis data yang digunakan dalam penelitian ini adalah metode deskriptif kualitatif dan metode penarikan kesimpulan yang digunakan adalah metode deduktif.masalah terkait. Hasil penelitian disajikan secara deskriptif sehingga diperoleh gambaran penjelasan mengenai permasalahan yang dibahas. Hasil penelitian menunjukkan bahwa bagaimana status Statuta PSSI yang bersifat Lex Sportiva dalam sistem hukum nasional.

Abstract

This paper discusses the legal advantages of using blockchain technology for notary protocol archives in Indonesia. This research is normative legal research. It uses primary and secondary legal materials to analyze the blockchain technology for notary protocol archives. With the development of information technology, notary services are inevitably shifting to electronic services, known as cyber notaries. The Notary Protocol is considered a state document and must be treated as such, stored, and kept authentic according to Law of Republic of Indonesia Number 30 of 2004 concerning Notary. Even if the notary who owns the protocol is on leave or dies, the protocol is categorized as a State Archive and is subject to Law of Republic of Indonesia Number 43 of 2009 concerning Archives. Blockchain technology offers a decentralized way of digital archiving.

Abstract

Normatively, the act of euthanasia in Indonesia is prohibited because in the Criminal Code it’s classified as a criminal offence as it means deprivation of the patient's life. The Indonesian medical code of ethics confirms the same thing that doctors are not allowed to perform euthanasia because it’s very contrary to their morality, which should protect the patient's life. However, Permenkes No. 37/2014 confirms that doctors can actually perform euthanasia on patients with certain procedures. The purpose of this study is to determine the suitability of the application of euthanasia to terminal condition patients with family consent in Indonesian positive law. The type of research used is normative legal research using a statute approach; conceptual approach; and comparative approach. The results obtained in this study are that the act of euthanasia cannot be classified as a criminal offence if the doctor does it for patients with certain conditions and according to procedures. Thus, if reviewed in positive law, the application of euthanasia in terminal patients with family consent is considered appropriate. Belgium and Luxembourg have legitimised euthanasia in their respective laws and regulations. Indonesia should be able to follow in the footsteps of Belgium and Luxembourg in legitimising euthanasia. The contradiction between the Indonesian Criminal Code and Code of Medical Ethics with Permenkes No. 37/2014 should be harmonised by updating the legislation that more specifically and firmly regulates euthanasia by including the determination of the patient's condition and certain possible procedures in applying for euthanasia, and providing criminal sanctions for doctors who perform euthanasia not in accordance with procedures. This aims to provide legal certainty for doctors and the patient's family when performing euthanasia, and minimise misinterpretation of euthanasia as in the Indonesian Criminal Code.
