Abstract

Public transportation business is currently growing rapidly combined with the development of toll road infrastructure that is increasingly developing, the Government and Society currently demand an increase in services in the field of public transportation, so the performance of terminal management services needs to be combined with improving effective and efficient services, so that the terminal can provide quality and professional services. The quality of Human Resources needs to be improved, especially the discipline and work motivation of employees of the Pakupatan Serang Banten Type A Terminal Service Unit. The improvement of the quality and performance of government officials is expected to be seen in the form of service, role models and protection to the community in a good way, the method used in this study is a quantitative survey method with a correlational model. Based on the results of the calculation of the job satisfaction variable, a regression coefficient of 0.629 was obtained. The significance test of the regression coefficient with the t test obtained t count = 7.710 with a significance of 0.000, this means that the job satisfaction variable (X1) has a significant effect on work motivation (Y). The form of this influence is if job satisfaction increases by 1 (one) point while the work environment is considered constant, it will cause an increase in work motivation of 0.629 points. Then the results of the calculation of the work environment variable obtained a regression coefficient of 0.142. The significance test of the regression coefficient with the t-test obtained t count = 2.017 with a significance of 0.046, this means that the work environment variable (X2) has a significant effect on work motivation (Y). The form of this influence is if the work environment increases by 1 (one) point while job satisfaction is considered constant, it will cause an increase in work motivation of 0.142 points. Furthermore, there is a simultaneous influence of the variables of job satisfaction and work environment of: 0.590 or 59.0% on the work motivation of PPNPN employees in the Type A Terminal Environment Pakupatan Serang Banten. While the remaining 41.0% is influenced by other factors that were not studied, such as supervision, work culture, and others, meaning that there is a positive and significant partial influence of the variables of job satisfaction and work environment of PPNPN employees in the Type A Terminal Environment Pakupatan Serang Banten, at t count: 7.710 at Significance (Sig.): 0.000. On the other hand, there is a positive and significant partial influence of the work environment variable on the work motivation of PPNPN employees in the Pakupatan Serang Banten Type A Terminal Environment, at t count: 2.017 at Significance (Sig.): 0.46. Abstract

In Law Number 5 of 2014 concerning State Civil Apparatus, ASN Employees must have a profession and ASN management based on a merit system that emphasizes employee qualifications, competencies, and performance. The government's seriousness in overcoming the problem of apparatus development is proven through PP No. 17 of 2020 concerning Civil Servant Management, which explains that all civil servants in 1 year have the opportunity for at least 20 hours of lessons to develop their competencies. The entry of the 4.0 era industry is the rapid development of technology in the world. Like it or not, of course this has an impact on technological progress in Indonesia. Starting from the Covid-19 pandemic and for the effectiveness of apparatus development activities, a policy was issued by the Tangerang City Government regarding apparatus development through the Learning Management System. However, seeing the conditions of virtual learning which have obstacles in their implementation, it creates a problem related to the process of apparatus development in the Tangerang City Government. Objective: Based on the background, the author compiled this study with the aim of knowing how the implementation of Apparatus Development through Learning Management System in Tangerang City, knowing what supporting and inhibiting factors are in the implementation of apparatus development through LMS in Tangerang City. Method: The research method uses a descriptive qualitative method with data sources in the form of interview results, observations and supporting documents and proven by documentation. Results/Findings: The results of the study indicate that in the development of apparatus through LMS in Tangerang City has been running according to the objectives, but there are still technical obstacles, namely the transition conditions from classical learning to virtual learning, such as the condition of LMS management human resources which are still lacking and learning support features have not been optimally used, as well as the lack of active role of the apparatus for self-learning. Abstract

This study examines the urgency of bankruptcy law reform within the framework of mitigating systemic risks that threaten macroeconomic stability. As theoretical research, this article analyzes the correlation between the efficiency of insolvency regimes and macroeconomic variables such as investment, banking sector health, and resource allocation. The findings indicate that a rigid bankruptcy law, which is merely oriented toward formal-legalistic aspects, can trigger the "zombie firms" phenomenon, which hinders national productivity and exacerbates financial contagion during crises. Legal reform is necessary to shift the paradigm from a private debt-settlement mechanism to an economic policy instrument capable of distinguishing between temporary liquidity shocks and fundamental insolvency. In conclusion, strengthening debt restructuring mechanisms and synchronizing judicial authorities with macroprudential policies are crucial for building economic resilience. Legal uncertainty in bankruptcy proceedings not only harms the parties involved but also escalates systemic risks that can destabilize overall national economic growth.

Abstract

Pengelolaan daerah aliran sungai (DAS) masih menghadapi tantangan serius akibat pendekatan sektoral, lemahnya koordinasi kelembagaan, dan minimnya pelibatan masyarakat di tingkat tapak. Mikro DAS yang berada di wilayah perdesaan memiliki peran strategis karena berinteraksi langsung dengan aktivitas sosial dan ekonomi masyarakat. Penelitian ini bertujuan menganalisis peran FKPDAS Jawa Barat Wilayah Ciamis dalam mendorong tata kelola mikro DAS berbasis desa serta mengidentifikasi faktor pendukung, hambatan, dan keterbatasan pendekatan yang diterapkan. Penelitian menggunakan pendekatan kualitatif dengan metode studi kasus di Desa Golat, Sukajaya, dan Sukamaju. Data diperoleh melalui wawancara mendalam, observasi nonpartisipatif, dan analisis dokumen kebijakan, yang dianalisis menggunakan analisis tematik dengan validasi melalui triangulasi sumber, metode, dan teoritik. Hasil penelitian menunjukkan bahwa FKPDAS berperan strategis sebagai bridging institution yang memfasilitasi kolaborasi lintas aktor dan mengintegrasikan isu konservasi DAS ke dalam perencanaan pembangunan desa. Namun demikian, implementasi pengelolaan mikro DAS berbasis desa masih menghadapi kendala berupa keterbatasan kapasitas teknis aparatur desa, lemahnya daya ikat kelembagaan FKPDAS, serta belum sinkronnya perencanaan antara wilayah ekologis DAS dan batas administratif desa. Penelitian ini menegaskan pentingnya penguatan kelembagaan kolaboratif dan integrasi kebijakan lintas sektor untuk mewujudkan tata kelola mikro DAS berbasis desa yang berkelanjutan.Kata Kunci : FKPDAS, Mikro DAS Berbasis Desa, Tata Kelola Lingkungan, Kolaborasi Lintas Actor, Pengelolaan Sumber Daya Alam.

Abstract

Penelitian ini mengkaji perlindungan hukum nasabah penyimpan pada bank yang dinyatakan pailit dalam kerangka UU Kepailitan dan UU Lembaga Penjamin Simpanan (LPS). Menggunakan metode penelitian hukum normatif dengan pendekatan kajian literatur, penelitian ini mengidentifikasi adanya konflik norma terkait status nasabah. Dalam UU Kepailitan, nasabah diklasifikasikan sebagai kreditur konkuren, yang menempatkan mereka pada risiko tinggi dalam distribusi aset. Sebaliknya, UU LPS memberikan perlindungan eksplisit melalui skema penjaminan dengan batas nominal tertentu. Namun, ketidakpastian hukum tetap terjadi bagi simpanan yang melebihi limit penjaminan serta simpanan yang dikategorikan "tidak layak bayar." Temuan penelitian menunjukkan bahwa perlindungan saat ini lebih bersifat administratif ketimbang prioritas yuridis. Untuk menjamin stabilitas perbankan dan kepastian hukum, paper ini mengusulkan pengadopsian konsep depository preference guna mengangkat posisi nasabah menjadi kreditur preferen, serta sinkronisasi peran yang lebih baik antara OJK, LPS, dan Pengadilan Niaga.

Abstract

This study aims to examine in depth the concept of directors’ personal liability in the bankruptcy of Limited Liability Companies (PT), focusing on the application of the Business Judgment Rule principle and the doctrine of gross negligence within the framework of Indonesian corporate law. The issue of directors’ liability in bankruptcy situations is crucial, as the boundary between managerial error and acceptable business risk is often difficult to define. This research employs a normative juridical method using statutory, conceptual, and case approaches by analyzing relevant legislation, commercial court decisions, and corporate law literature. The results of this study indicate that the Business Judgment Rule serves as a legal safeguard for directors who act in good faith, with due care, and in the best interests of the company. However, this principle cannot be used as a defense when gross negligence is proven — that is, the failure of directors to perform their managerial duties reasonably, resulting in losses or the company’s bankruptcy. In such circumstances, directors may be held personally liable under Article 97 paragraphs (3) and (5) of Law Number 40 of 2007 concerning Limited Liability Companies. Therefore, this study emphasizes the importance of prudence, professional conduct, and accountability among directors in business decision-making to prevent abuse of authority and minimize the risk of personal liability in bankruptcy situations.

Abstract

The development of digital assets, particularly crypto assets, presents new challenges for the bankruptcy legal system in Indonesia. The technical characteristics of digital assets, which are decentralized, cryptography-based, and difficult to access without private keys, have the potential to disrupt the application of the principles of justice, particularly the principles of Pari passu, transparency, and accountability in determining bankruptcy estates. The problem is further complicated by the transition of crypto asset supervision from BAPPEBTI to the Financial Services Authority (OJK) under the P2SK, which has created a technical regulatory vacuum in the bankruptcy context. This study aims to analyze how the characteristics of digital assets challenge the concept of bankruptcy estates, identify the legal and technical challenges faced by curators, and evaluate the implications of regulatory changes for legal certainty. The study uses a normative juridical method through an analysis of laws and regulations, scientific literature, and a comparison of international practices. The results show that digital assets, normatively, fulfill the elements of assets, but in practice, they pose serious obstacles for curators in the identification, safeguarding, and liquidation processes. Furthermore, the transition of authority to the OJK creates an urgent need for technical regulations to ensure the upholding of the principles of justice in bankruptcy cases involving digital assets. Abstract

This study aims to analyze regional tax policies to increase the potential for Regional Original Income (PAD) using a case study of the Tangerang City Regional Financial Management Agency (BPKD). The study employed a descriptive qualitative approach, with data collection techniques including observation, interviews, and documentation. Data analysis was conducted using the Miles and Huberman interactive model, encompassing data reduction, data presentation, and conclusion drawing. The theoretical basis of this research draws on William N. Dunn's (2003) theory of public policy evaluation, which encompasses effectiveness, efficiency, adequacy, equity, responsiveness, and accuracy as criteria for policy analysis. Furthermore, the concept of public administration proposed by George J. Gordon and the public management theory of Shafritz & Russell are used to understand the role of public organizations in regional tax management. The definition of regional taxes refers to Mardiasmo (2011) and the provisions of Law Number 1 of 2022 concerning Central and Regional Financial Relations. The results of the study indicate that regional tax policies play a strategic role in strengthening regional fiscal capacity, particularly in the restaurant, hotel, and street lighting tax sectors. However, its implementation still faces obstacles such as low taxpayer compliance, limited human resources, and suboptimal technology utilization. Therefore, strengthening fiscal policy, modernizing tax administration, and synergy between stakeholders are needed to increase the effectiveness of local revenue (PAD) collection. This research is expected to provide theoretical contributions to the development of regional fiscal policy studies and practical recommendations for local governments in formulating more sustainable tax management strategies. Abstract

This study aims to thoroughly examine the efforts to enhance reading interest and visitor satisfaction at the Modern Library of Southeast Sulawesi. Employing a qualitative descriptive approach, this research explores the perceptions and experiences of informants, including the library head as the key informant, library staff as main informants, and visitors as supporting informants. Data were collected through in-depth interviews, direct field observations, and documentation of the library’s facilities and activities. The data were analyzed using the Miles and Huberman model, encompassing data reduction, data display, and systematic verification of conclusions. The findings reveal that the modernization of library facilities, including the provision of comfortable reading spaces and technological amenities such as free Wi-Fi access, are dominant factors encouraging increased reading interest, particularly among students and university attendees. Furthermore, professional and friendly staff services contribute positively to visitor satisfaction. Nevertheless, this study identifies challenges such as the limited availability of the latest book collections and suboptimal promotion of literacy programs, which impact the library’s ability to reach a broader audience. The study recommends that library management regularly update the collection, enhance human resource capacity through training, and strengthen communication and promotion strategies to maximize the library’s impact on the literacy culture in Southeast Sulawesi. Abstract

High employee turnover is a strategic issue in the hospitality sector, particularly at MaxOne Hotel & Resort Makassar. This study aims to analyze the effect of guidance from the government, the Indonesian Hotel and Restaurant Association (PHRI), and other stakeholders on employee retention, with training as an intervening variable. A quantitative approach was used by distributing questionnaires to 118 respondents, then processed using SPSS software. The results show that the guidance from the government and PHRI has a direct, positive, and significant effect on employee retention. Stakeholder guidance does not have a direct significant effect, but it has a significant indirect effect through training. Simultaneously, all three forms of guidance positively contribute to retention. Training was found not to mediate the effect of government and PHRI guidance, but it fully mediates the effect of stakeholder guidance. This concludes that training is a crucial path in the effectiveness of external guidance. Thus, an integrated guidance strategy involving the active role of stakeholders needs to be developed to enhance employee loyalty and continuity of employment in the hotel sector.
