Abstract

Indonesia's economy is driven by various sectors, with the banking sector playing a very important role. Indonesian banking has been operating since colonial times until today, functioning as a liaison between capital owners and capital managers. Capital owners often do not have sufficient skills to manage funds professionally, while banks have these abilities, so they can manage funds optimally and foster trust. In management, banks place the use of funds as assets and the source of funds as liabilities, which is in accordance with macro monetary policy in a country's asset management. The main purpose of this management is to monitor the financial position, which is important for planning, organizing, and supervising, as well as for capital, fund raising, fund use, and financing in liquidity management. Interest rates greatly affect liquidity management, because they have a difference or difference to sensitive assets and liabilities. Good liquidity management maintains a balance between assets and liabilities to meet various financial obligations, including debt repayments and employee salaries. The case of Silicon Valley Bank, which collapsed in March 2023, shows the importance of healthy liquidity ratios. A rapid rise in interest rates lowers the value of bonds in the portfolio and increases the cost of credit, which creates a GAP in profit returns. In contrast to conventional banking, Islamic banking uses a profit-sharing system that is more flexible in profit returns. This phenomenon attracts the author's attention to further discuss liquidity management and GAP management in Islamic banking listed on the Indonesia Stock Exchange for the 2019-2022 period, where there are four Islamic banks that have been listed on the Islamic stock exchange.

Abstract

An asset management system cannot do without liability management. These two systems are like two sides of a coin, connected to each other. The reason is that most sources of bank assets are obtained from deposits, even though the bank has its own capital, its liabilities are more profitable than its own capital. Therefore, the development of assets is influenced by the increase in liabilities. Judging from the composition of the bank's balance sheet, the left side is the assets owned, and the right side is the liabilities to stakeholders. To balance these two aspects, banks need an effective and efficient management system. Therefore, banks implement ALMA (Asset Liability Management). This writing uses a type/approach method in the form of library research. ALMA is a series of actions and procedures designed to control financial positions. Asset and Liability Management is also to manage risks that may arise in daily business activities which are then specifically designed so that they can optimize income while limiting asset and liability risks by complying with monetary policy and bank supervision. The implementation of asset and liability management in banking institutions, both Islamic and conventional banks, must go through the stages of budget assessment, making income plans, assessing past investment performance, monitoring the distribution of bank assets and liabilities and implementing asset and liability strategies. Abstract

This study aims to determine the synergy that can be implemented between Islamic Bank and Village Owned Enterprises (BUMDes) to strengthen unbankable business capital and to assess the application of sharia contracts toward some products provided by BUMDes. The research methodology used qualitative analysis, primary data obtained from informants, namely one branch manager of Islamic Bank of Indonesian (BSI), Pekanbaru branch and 14 BUMDes leaders in Tambang District, Kampar. The results show that first: two forms of synergy can be implemented between BSI and BUMDes to strengthen unbankable business capital, namely BSI finances through BUMDes then distributed to the unbankable micro-entrepreneurs and BSI distributes directly to the unbankable micro-entrepreneurs based on BUMDes recommendation then BSI provides a fee after BUMDes gives the guarantee, second: the application of sharia contracts toward some products supplied by BUMDes currently could use wadi`ah, mudharobah, musyarokah, murobahah, salam, istisna, ijaroh and wakalah.

Abstract

This writing discusses the health assessment of Sharia Banks. The legal basis for regulating the health assessment of Sharia Banks (BUS and BPRS) refers to the regulations of the Law, PP, PBI, POJK, and BI, as well as OJK circulars. The article explains the RGEC assessment of Sharia Banks, using a qualitative approach with a literature study research design. This writing presents a literature review of various sources related to assessing the health of Sharia Banks, the legal basis of BUS and BPRS, and RGEC. The discussion explains that bank health assessment reflects the bank's performance and is the result of assessing the bank's condition to overcome risks and improve performance. The logical structure and causal connections between statements ensure a clear and balanced presentation of the topic. The health assessment of Sharia Commercial Banks (BUS) is regulated by Law Number 21 of 2008 concerning Sharia Banking. According to this law, banks are required to maintain their level of soundness. Article 1, paragraph 6 of POJK No. 8 of 2014 pertains to the evaluation of the soundness level of sharia commercial banks and sharia units. The health assessment of Sharia Rural Banks (BPRS) is regulated by Bank Indonesia Regulation No.9/17/PBI/2007, which is based on the Health Assessment System Rural Credit Bank using Sharia Principles. The RGEC method is an advancement of the CAMELS method. The RGEC method involves inherent risks, and quality risk management is applied to bank operations across eight factors: credit risk, market risk, liquidity risk, operational risk, legal risk, strategic risk, compliance risk, and reputation risk.

Abstract

Syariah banking as an important component of banking law in Indonesia is currently experiencing rapid growth. The existence of Shariah banking is expected to help solve various problems in Indonesia, especially poverty. In the midst of its development, Shariah banking has not been able to handle the market share where the majority of the market share comes from people from the middle class. In addition, the education and socialization of Shariah banking is insufficient, so there is a diversity of public perceptions regarding Shariah banking. Pros and cons occur in society regarding the establishment of Sharia banks, where the benefits of Sharia banking are enormous, both in the economic world and in the future. This research uses literature review. Review using a qualitative approach. Primary data sources in this research were obtained from observations or research observations on problems that occur with Sharia banking management. Meanwhile, secondary data was obtained from good literature and books, journals and other sources related to current materials.

Abstract

The pattern in resolving problematic financing at Islamic banks occurs by: 1. Restructuring. Financing restructuring is one of the efforts made by the Bank in its financing disbursement business activities so that the Customer can fulfill its obligations to the Bank. Restructuring that can be done is Rescheduling, Reconditioning, Restructuring, Rescheduling 2. Settlement through guarantee Settlement through guarantee can be done by non-litigation and litigation means. 3.Collection Agent, carried out using the services of third parties such as agents / law offices or lawyers and 4. Write off: an administrative action to delete the Customer's book that has a bad collectibility from the balance sheet amounting to the Customer's total arrears without removing the Customer's billing rights. The research method used is literature research, and also the author uses qualitative research methodology. The source of data used is taken through literature related to the object of research, and then will be analyzed descriptively with deductive analysis methods with general data that has been collected and conclusions drawn.

Abstract

Tambang District has one of the sharia financial villages, namely Kualu Nenas village, so the BUMDes of this village and other villages need to adapt their BUMDes management based on the sharia financial agreement. This service aims to identify the type of business in each BUMDes, increase the knowledge and understanding of BUMDes managers regarding sharia financial contracts, motivate them to convert to using sharia financial contracts and be able to implement sharia financial contracts in their respective BUMDes. The service method is semi participation action research (semi PAR). The service activity begins by identifying the type of business in BUMDes, providing education and literacy about sharia financial contracts, then asking participants to carry out a simulation of adjusting the appropriate contract for each type of business product in their respective BUMDes. The final stage is that the service team and participants jointly evaluate the results of the simulation whether they are in accordance with the principles of sharia financial contracts or whether they still need to be improved. The results of the service can be seen that, first: the business sectors carried out are savings and loans using a conventional financial system, rental of rice production facilities (saprodi), waserda, mini markets, electronic and motorbike credit, and gas stations. secondly, the level of understanding of BUMdes managers regarding sharia financial contracts has increased but further assistance is still needed over a longer period of time and the majority of participants strongly agree and support the implementation of sharia financial contracts in the BUMDes they manage. Third: the ability of BUMDes managers to apply sharia financial contracts to the products in their respective BUMDes is good but further guidance is still needed. Abstract

Tujuan - Penelitian ini membahas tentang hierarki hukum pada perbankan syariah. Permasalahan yang sering terjadi yakni efektifitas peran hierarki hukum dalam tatanan hukum perbankan syariah yang terkadang belum berjalan signifikan, sehingga akan berdampak pada efektifitas hukum di perbankan syariah, kajian atas permasalahan regulasi perbankan syariah menjadi sebuah diskursus yang harus ditemukan solusinya. Metode - Peneliti menggunakan penelitian kepustakaan (library research) untuk mengkaji lebih dalam mengenai hirarki hukum pada perbankan syariah dengan metode tematik. Hasil - Hasil penelitian ini menemukan Perbankan Syariah di Indonesia memiliki dua landasan hukum, sumber hukum Islam dan sumber hukum positif yang didukung oleh regulasi pemerintah, hal ini diperkuat oleh Undang-Undang No. 21 Tahun 2008 Tentang Perbankan  Syariah. Hierarki hukum perbankan syariah terdiri dari berbagai bentuk yakni Undang-undang, Peraturan Bank Indonesia, Peraturan Otoritas Jasa Keuangan (OJK), dan Fatwa Dewan Syariah Nasional (DSN). Keberadaan hukum perbankan syariah mempertegas pentingnya kedudukan hukum Islam dalam sistem hukum nasional. Terakhir, keberadaan hirearki regulasi ini memperkuat eksistensi perbankan syariah dalam menjalankan aktivitas oprasional dan bisnis. Originalitas - Penelitian ini mengungkapkan permasalahan efektifitas peran hierarki hukum dalam tatanan hukum perbankan syariah yang belum berjalan dengan baik yang secara signifikan berdampak pada efektifitas hukum di perbankan syariah. Implikasi - Hirarki hukum dalam perbankan syariah akan mempermudah pihak bank dalam membuat roadmap program-program pengembangan terpadu perbankan syariah.

Abstract

Tujuan - Penelitian ini bertujuan untuk menganalisa faktor eksternal dan internal yang mempengaruhi perkembangan perbankan syariah di Indonesia. Metode - Dalam membahas dinamika dan permasalahan perbankan syariah di era globalisasi ini penulis menggunakan jenis dan sumber data yang didapat dari riset perpustakaan (Library Research) dengan mengadopsi pemikiran dan pendapat para ahli yang memiliki keterkaitan secara langsung atau tidak langsung dengan topik yang sedang dibahas. Hasil - Perbankan syariah ada untuk menjadi alternatif bagi masyarakat yang menginginkan bertransaksi dengan sistem syariah, ada beberapa faktor yang menjadi keunggulan bank syariah jika dibandingkan dengan bank konvensional yakni: menyertakan nilai-nilai ketuhanan dalam setiap transaksi, adanya keterikatan emosional secara religi antara bank dan nasabah, adanya keadilan dalam bagi hasil simpanan dan pembiayaan. Di sisi lain, perbankan syariah dihadapkan pada problematika yang menghambat perkembangan perbankan syariah. Originalitas - Penelitian ini mengungkapkan dinamika dan permasalahan yang terjadi di dalam perbankan syariah, serta mebahas mengenai harapan perkembangan perbankansyariah pada saat ini. Implikasi - Bank syariah harus mampu bersaing dengan bank konvensional dengan mengkombinasikan kekuatan korelasi antara pemerintah, institusi pendidikan serta inovasi dari pihak bank syariah itu sendiri. Bank syariah juga dituntut untuk lebih adaptif dan inovatif terhadap kebutuhan pangsa pasar.

Abstract

Tujuan – Tujuan dari penulisan ini untuk memahami penyelesaian sengketa pada perbankan syariah, dan Bagaimana cara mengatasinya. Permasalahan yang sering terjadi yakni perselisihan atau sengketa pada bank syariah yang terkadang belum berjalan dengan baik. Rumusan masalah dalam penelitian ini yaitu tindak pidana dan penyelesaian sengketa perbankan syariah. Metode – Penelitian ini menggunakan pendekatan kulaitatif dengan pendekatan penelitian keperputakaan (library research). Hasil - Perbankan syariah di Indonesia merupakan salah satu sektor yang mempunyai peranan penting diberbagai bidang, antara lain dalam kegiatan masyarakat khususnya dibidang financial, serta kegiatan ekonomi untuk memenuhi kebutuhan pribadi seseorang. Dalam menjalankan kegiatan perbankan khususnya perbankan syariah, tidak menutup kemungkinan terjadinya suatu perselisihan atau sengketa didalamnya. Perselisihan yang terjadi ini pada akhirnya harus diselesaikan oleh kedua belah pihak yaitu pihak bank dan pihak nasabah karena kedua belah pihak ini memiliki kedudukan yang sama sebagai pihak-pihak yang berkepentingan. Ada dua metode penyelesaian sengketa yang terjadi pada perbankan syariah, yaitu: penyelesaian sengketa melalui jalur litigasi (jalur pengadilan) dan penyelesaian sengketa melalui jalur non litigasi (jalur di luar pengadilan). Originalitas - Penelitian ini mengungkapkan permasalahan yang terjadi pada perbankan syariah di Indonesia dan bagaimana cara menyelesaikannya. Implikasi - Dua metode penyelesaian sengketa perbankan syariah yang disarankan oleh peneliti dapat digunakan untuk menyelesaikan permasalahn dalam perbankan syariah, walaupun kedua metode tersebut memiliki kelemahan serta kelebihan masing-masing.
