Abstract

Kegiatan Sosialisasi Lelang sebagai instrumen jual beli berkarakter khusus dan pencegahan cyber crimed di Desa Cikalahang Kabupaten Cirebon. Kegiatan ini dilatarbelakangi dengan potensi desa dimana perikanan, dan pariwisata yang berkembang sebagai sentral produk olahan ikan dan wisata kuliner ikan bakar air tawar. Pandemi Covid-19 telah berdampak pada ekonomi, menyebabkan penurunan aktivitas bisnis. Fokus pemerintah desa pada tanggung jawab sosial dapat mendorong generasi muda untuk menjadi pemilik bisnis yang bertanggung jawab dan mempromosikan produk lokal. Di era digital, strategi pemasaran dan metode komunikasi harus disesuaikan untuk memastikan pertumbuhan ekonomi dan partisipasi. Metode kegiatan pengabdian ini yakni community development yang dipadukan dengan service learning. Lelang sebagai salah satu instrumen jual beli yang berkarakter khusus yang dapat meningkatkan pendapatan dari penjualan produk dan bahaya kejahatan cyber crime dibalik penggunaan media sosial untuk memasarkan produk. Hasil pengabdian kini adalah tumbuhnya semangat warga masyarakat, pelaku usaha untuk menggunakan lelang sebagai salah satu cara memasarkan dan meningkatkan penjualan produk mereka, serta adanya sikap waspada masyarakat dalam penggunaan media sosial.

Abstract

Kekerasan anak di Indonesia adalah kekerasan yang terdiri dari segala usia, yang berbeda dalam konteks sosial, budaya, dan hukum. Kekerasan anak tercakup berbagai bentuk, seperti kekerasan fisik, kekerasan verbal, kekerasan emosional, pelecehan seksual, dan penelantaran. United Nations Convention on the Rights of the Child menegaskan hak anak untuk dilindungi dari segala bentuk kekerasan dan menekankan perlunya perlindungan khusus untuk anak-anak yang berisiko lebih tinggi. Pusat Informasi Kriminal Nasional (Pusiknas) Bareskrim Polri menghimpun data kejahatan dan kekerasan anak sepanjang Januari-Juli 2023. Pusiknas Polri, anak perempuan lebih banyak menjadi korban kekerasan dan kejahatan. UNICEF tahun 2015 menunjukkan bahwa 40% anak berusia antara 13 dan 15 tahun melaporkan pernah diserang secara fisik sekali setahun, 26% melaporkan pernah mendapat hukuman fisik dari orang tua atau pengasuh mereka di rumah, dan 50% anak melaporkan bully di sekolah. Bullying merupakan salah satu tindakan kekerasan yang dilakukan secara berulang dan melibatkan adanya kekuatan fisik antara korban dan pelaku. Perilaku bullying di Indonesia tercatat sebesar 43,7% untuk tingkat SMA dengan kategori tertinggi berupa kekerasan psikologis (pengucilan). Pentingnya literasi hukum adalah proses penyampaian pengetahuan dan pemahaman tentang sistem hukum, norma, aturan, dan prinsip hukum kepada masyarakat, bertujuan meningkatkan kesadaran hukum dan pemahaman tentang hak dan kewajiban dalam suatu masyarakat.

Abstract

Presidential threshold is the threshold of vote acquisition that must be obtained by political parties in an election to be able to nominate a presidential candidate. General elections for president and vice president are submitted by political parties or a combination of political parties that have at least 20% of the seats in the DPR or 25% of the national valid votes in legislative elections. The type of research used is library research. The approach used is a normative approach. The data collection technique is through literature study. And analyzed by qualitative data analysis method. The presidential threshold setting as determined by the Constitutional Court through decision Number 53/PUU-XV/2017 states Article 222 of Law Number 7 of 2017 concerning Elections which regulates the Presidential threshold requirements have an impact on political parties, due to restrictions on the constitutional rights of political parties that has a small number of seats in the DPR. Then the high threshold number will cause only political parties to nominate their president and vice president so that the implementation of the Presidential threshold is more likely to benefit the authorities and harm the people and negate the people's right to be able to choose alternative figures in the 2024 Presidential Election.Keywords: Presidential Threshold, Presidential Election, 2024 Presidential Election, President.

Abstract

Political parties hold a strategic position and serve as a primary pillar in Indonesia's democratic system, acting as a bridge between government policies and the aspirations of the people. However, personal-oligarchic leadership and an inadequate cadre system have resulted in party decision-making being frequently dominated by the interests of individual chairpersons, thereby threatening the future of democracy. An inclusive, transparent, and tiered cadre system is essential to uphold democratic principles in political recruitment and the nomination of public officials. The phenomena of factionalism and internal patronage within parties further exacerbate the political landscape, evidenced by conflict cases in several major parties. The process of electing regional heads, as a key component of democracy, is also influenced by the failures in recruitment. The Constitutional Court's Decision Number 60/PUU-XXII/2024 abolished the discriminatory nomination threshold for regional head candidates that previously disadvantaged smaller parties and independent candidates, thereby broadening opportunities for inclusive political participation. A community-based method is employed in community service within political parties in Tegal Regency to enhance legal literacy regarding this decision, involving party cadres and community leaders through workshops and interactive socialisation. This initiative aims to promote healthy and democratic political participation at the local level, strengthen inclusive democracy, and foster legal awareness among the populace. This study provides a comprehensive overview of the political dynamics and changes in the electoral system within the context of contemporary Indonesian democracy.

Abstract

In this digital era, technology has changed many aspects of life. Land purchase agreements in Indonesia, which were previously carried out conventionally, have begun to shift to digital platforms. Digitalization in land purchase agreements offers various opportunities, but this process also has a number of challenges that need to be overcome to ensure that land purchase transactions can be carried out efficiently and safely, providing legal protection to buyers. The formulation of the problem in this study is how the challenges and opportunities of land purchase agreement transactions in the digital era in Indonesia and how legal protection is provided for buyers in digital land purchase transactions in Indonesia. This type of research is library research. Library research is research conducted using references in the form of books, journals, newspapers, magazines or reports of previous research results. Data collection techniques use secondary data, either using primary materials, secondary materials or tertiary materials. Data analysis in this study uses interactive analysis. The results of the study show that the opportunities with the presence of digitalization in land purchase agreement transactions in Indonesia can provide acceleration in accessing information about land, such as location, price, and legal status by prospective sellers and buyers. Transactions can be carried out without having to meet in person. Another opportunity from digitalization in land sale and purchase agreement transactions is the ease of recording and archiving documents. This digitalization also opens up opportunities for the government to eradicate corruption and extortion practices that still often occur in conventional land sale and purchase processes. One of the main challenges faced by buyers is fraud. In digital transactions, fraud can occur through various modes of operation, such as the sale of land with unclear ownership, falsification of documents, or presentation of inaccurate information. Legal protection must be provided to buyers in digital land sale and purchase agreements. The application of digital technology in land sale and purchase agreements must use a blockchain system and e-signatures to verify land ownership. This is done to overcome the problems of duplication and forgery, as well as to increase security and transparency.
