Abstract

This study aims to analyze the chronology of cases of forced defense decisions. Normative research methods using statutory research approaches and case approaches and analytical techniques used to process legal materials are legal hermeneutics. The results of this study indicate that the decisions 794/Pid.B/2014/PN.Llg and No.257/Pid.B/2015/PN.Sky has fulfilled the elements of the noodweer requirement, namely that defense is coercive, what is being defended is oneself ), there was a very imminent threat of an imminent attack at that time, and that attack was against the law. has also fulfilled the element of the principle of subsidiarity which is the benchmark for forced defense. Abstract

The purpose of this study is to know and analyze what factors hinder the police in uncovering the crime of disposal of babies in Bone Bolango and to find out what the police are trying to prevent the crime of disposal of babies in the jurisdiction of the Tapa Police. This type of research is empirical research. The results showed that the role of the police in uncovering the crime of disposal of babies in the Tapa Sector Police, the investigation process was still stopped because the police experienced factors that hindered the police in uncovering the crime of disposal of babies. These factors were internal factors consisting of a lack of members and sources. Human Resources, lack of evidence, and difficulty in determining suspects, Then there are also external factors, namely the lack of public awareness. Then, in this case, the police made efforts to prevent the crime of disposal of babies in the jurisdiction of the Tapa Police by conducting patrols, counseling and outreach activities in the community.

Abstract

This study aims to determine and analyze the criminal liability of companies that do not fulfill their obligations to workers in the employment BPJS guarantee. The research method used is sociological juridical research, using a descriptive qualitative research approach and interactive analysis techniques. The results of this study indicate that there are still many companies that neglect to provide fulfillment of workers' obligations in the Employment BPJS guarantee as stipulated in Law No. 24 of 2011 concerning the Social Security Organizing Agency (Law No. 24 of 2011), which protects workers' rights to obtain guarantees for compensation for work accidents. The establishment of the Social Security Organizing Agency (BPJS) is not a new thing in the field of employment, because social security for workers has previously been regulated in Law No. 14 of 1993 concerning Workers' Social Security or better known as Jamsostek. Law No. 40 of 2004 on the National Social Security System was enacted in 2004 with the aim of creating an integrated social security system for all Indonesians, and the social security system was institutionalized in a public legal entity.

Abstract

This study aims to determine the transfer of child custody to a father. The method used in this study is normative research methodology and uses a statutory and shirt approach as well as descriptive analysis techniques. The results of this study indicate that according to the Compilation of Islamic Law, the custody of a child to a father after a divorce is the right of the mother to take care of a child who is not yet mumayyiz or not yet 12 (twelve) years old. But if you look at the contents of decision number 448/Pdt.G/2018/PA. But where the judge imposes child custody on a father, after analysis that the judge does not only refer to the applicable laws and regulations, but the judge has the authority to assess, analyze and decide under the facts presented in court and prioritize the interests and welfare of children.

Abstract

This study investigates the impact of providing restitution on child victims of pornographic video distribution, utilizing empirical legal methods and case-based analysis. The study explores the implementation of restitution for children under Article 7A of Indonesia's Law No. 31/2014 on Witness and Victim Protection and Government Regulation No. 43/2017 on Restitution for Child Victims of Criminal Acts. The research identifies factors influencing the restitution process, including a lack of legal understanding among children, parents, and families of both perpetrators and victims, as well as challenges arising from government regulations on restitution. Restitution, governed by legal frameworks, is recognized as insufficient to eliminate the crime or case resolution. Challenges in restitution fulfillment also stem from the absence of a Witness and Victim Protection Agency, leading to delays in awaiting decisions and assessments from the Central LPSK. Economic capacity and the perpetrator's willingness further impact the restitution process

Abstract

This study aims to determine the effect of providing restitution on child victims of the distribution of pornographic videos. This research uses empirical legal methods and is based on cases that occur, then analyzed descriptively. The results of the study that the implementation of Restitution of Children as Victims of the Distribution of Pornographic Videos based on Article 7A of the Law of the Republic of Indonesia Number 31 of 2014 concerning the Protection of Witnesses and Victims and PP No.  43 of 2017 concerning the Implementation of Restitution for Children Victims of Criminal Acts. Factors Affecting the Provision of Restitution to Child Victims Distribution of Pornographic Videos, where children and parents or families of both perpetrators and victims do not understand the law, and the existence of Government Regulations (PP) regarding the provision of restitution that must be received by victims. Restitution is certainly not to remove the crime and the process of solving a case. The problem that affects the fulfillment of restitution is also due to the absence of the Witness and Victim Protection Agency so it must wait for the decision and the results of the Central LPSK assessment. In addition, it is also determined by the economic ability and the will of the perpetrator.

Abstract

This study aims to determine the police's efforts in tackling the crime of child abuse, and to find out the factors that hinder the police in handling cases of child abuse in the jurisdiction of the Bone Bolango Police. The type of research used is empirical research with a case approach. The results of the study show that the police's efforts to deal with criminal acts of child molestation are carried out through preventive and repressive efforts. Preventive efforts are anticipating sexual immorality by providing legal counseling, the negative effects of promiscuity among students, and carrying out raids or patrols to ensure a sense of security in society. Abstract

This study aims to examine and analyze the implementation of the electronic land registration system at the National Land Agency (BPN) Office of Gorontalo City, as well as the forms of legal protection provided to land rights holders in the event of errors in the system. This research adopts a normative-empirical legal approach, utilizing statutory, conceptual, and case study methods. Primary data were obtained from the Gorontalo City BPN Office, while secondary data were sourced from legislation, literature, and relevant research findings. All data were analyzed using a descriptive-qualitative method. The findings indicate that the implementation of the electronic land registration system in Gorontalo City has generally been in accordance with the applicable regulations, although it still faces various challenges from both the public and the internal operations of the BPN. The registration process continues to adhere to the fundamental principles and objectives of land registration. Legal protection for land rights holders is provided optimally through a correction mechanism in cases of errors in physical or juridical data, referring to the land register stored at the land office. Furthermore, the security features of electronic certificates are considered adequate, difficult to forge, and capable of preventing overlaps or duplication of certificates.
