Abstract

The custom of Palai Ngandi (elopement) that occurs in East Sumba, East Nusa Tenggara is a social gap because couples who elope do not notify the woman's parents to marry. The purpose of this study is to analyze the recognition of the Palai Ngandi custom in East Sumba and the legal consequences of implementing the Palai Ngandi in Law Number 1 of 1974 in conjunction with Law Number 16 of 2019. The method used in this study is empirical research with a statutory approach, the customary law approach, the concept approach, the legal sociological approach and the case approach. The technique of collecting legal materials is carried out by observation and conducting a literature review to obtain primary and secondary legal materials which are then analyzed using descriptive analysis techniques. The results of the study show that there are still many Palai Ngandi customs in Pandawai District, East Sumba Regency. The Palai Ngandi custom which is a form of this gap has caused several consequences for the perpetrators and the parents of both parties which are resolved by existing customs in the community so that a good middle point can be found between the two parties who carry out Palai Ngandi.

Abstract

The main component of implementing regional autonomy is the activity of exploring more of the potential that exists in the region, especially taxes. The Revenue Service Unit (UPT) of Karangasem Regency is required to strive for achieving targets and increasing income in a sustainable manner to support the increase in Regional Original Income. The purposes of this study are to analyze the implementation of motor vehicle tax collection at SAMSAT Karangasem district and the supporting and inhibitor factors in the implementation of motor vehicle tax payments at Samsat Karangasem district. The research method used is an empirical legal research method with a statutory, a conceptual and a sociological approach. The technique of collecting legal materials is done by field observation through interviews. The sources of legal materials used are primary legal materials and secondary legal materials. Data analysis in this study used a qualitative descriptive analysis method. The results of the study indicate that the Bali Provincial Retribution in Karangasem Regency starts from the registration, determination and payment stage based on the Bali Provincial Regulation No. 1 of 2011 concerning Regional Regulations (PERDA) on Regional Taxes. Supporting factors, namely adequate human resources, administrative processes with a computerized system, the existence of mobile SAMSAT. Inhibiting Factors in the Implementation of Motor Vehicle Tax Payments at SAMSAT Karangasem Regency, namely the lack of awareness of taxpayers, incomplete taxpayer data, transfer of motorized vehicles without being renamed, owners changing places of residence.

Abstract

Indonesian people, especially Balinese, often do business on land in various ways, including buying and selling land. The first formal certificate of ownership should clearly define rights and obligations, provide legal certainty, and be useful in the event of a dispute over the purchased land. The purposes of this study are to explain the process of buying and selling land in plots of land and the strength of the deed of the official who made the land deed. The method applied in this research is the Law-Based Survey with a statutory approach and a conceptual approach. Data collection techniques were carried out by field observations in the form of interviews. Sources of legal materials used are primary and secondary sources of legal materials. The data analysis technique used descriptive qualitative analysis method. The results show that if an authentic deed made by PPAT does not meet the requirements as an authentic deed, then the authentic deed is accredited as a private deed. If there is a problem and the certificate for certain plots of land has not been issued, the Land Office will wait until there is a final and binding decision from the Court regarding the status of the land in question and will continue to delay the process of land certification for the plots concerned. If you want to buy land, of course you have to investigate material requirements, property status, letters or other important documents, of course there should be no dispute.

Abstract

There are many types of drugs circulating in Indonesia, including drugs containing the active substance dextromethorphane in the form of cough medicine. The active substance dextromethorphane is very easy to get everywhere, the price is also very affordable and also legal. However, if the active substance dextromethorphane is consumed in excess, it will cause effects on the body in the form of euphoria, hallucinations, paranoia, aggressive behavior, damage to internal organs and can also cause death. Tujuan penelitian ini adalah untuk menganalisis pengaturan zat aktif dekstrometorfan dan membahas upaya penanggulangan terhadap zat aktif dekstrometorfan. Metode yang digunakan adalah metode yuridis normatif. Dengan menggunakan pendekatan penerapan dan pendekatan konseptual. Bahan hukum yang digunakan yakni bahan hukum primer, sekunder dan teriser. Bahan hukum primer, yaitu sumber hukum yang bersifat autoritatif, bahan hukum sekunder yang berasal dari buku-buku dan jurnal hukum yang relevan dengan kasus penelitian, sedangkan Bahan hukum tersier adalah bahan hukum penunjang seperti kamus hukum, kamus umum, ensiklopedia, dan sumber internet. Teknik pengumpulan data menggunakan tekni mencatat dan mendokumentasi. Hasil penelitian ini menunjukan bahwa belum ada aturan yang mengatur mengenai zat aktif dextromethorphane maupun aturan mengenainya, maka untuk mencegah diperlukannya tindakan penjualan zat aktif dextromethorphane dan pembeliannya wajib menggunakan resep dokter. Abstract

The Minister's decision caused the assimilation of up to 167 people in the head of the family in Indonesia. The public considers that the steps that have been taken by the government are not sufficient to reduce the spread of Covid-19, the community is of the opinion that inmates can live better and more comfortably in prisons if they carry out social distancing programs (physical distancing) together with complete control mechanisms. Not only that, public concern and anxiety will increase if prisoners who receive the Assimilation Rights Program repeat their crimes. The aims of this research are to discuss the requirements and factors that are used as the basis for the release of prisoners in Kerobokan Prison and what obstacles arise in the Implementation of Assimilation in Rutan IIA Kerobokan. This research method is empirical research using a sociological juridical approach. There are 3 sources of research material, namely primary, secondary and tertiary sources. The techniques used to collect data are library study techniques and interview techniques. The results of this study explain that in the implementation of the assimilation permit at the Class IIA Kerobokan Prison, this has been stated in the Regulation of the Minister of Law and Human Rights based on the Minister of Law and Human Rights Number 10 of 2020 and amended in the Minister of Law and Human Rights Number 32 of 2020 concerning Terms and Conditions The method of granting has been refined to become digestion, probation, no early leave, and pre-compulsory leave for applications and children in avoiding and controlling the covid19 pandemic, as well as obstacles encountered, one of which was having passed half the penalty time.

Abstract

he outbreak of the 2019 Coronavirus Disease that entered Indonesia which can be overcome by giving vaccines to the Indonesian people who meet the criteria according to the applicable law. However, the government requires the vaccination to be applied to all Indonesian citizens, even those with a history of disease, the government should guarantee the rights of everyone with the consent and without the slightest coercion in the voluntary vaccination process. This study aims to reveal criminal sanctions against medical personnel who force the implementation of the COVID-19 vaccine for people who have a history of illness. This study uses a normative juridical method by using a statutory problem approach. The sources of legal materials used are primary legal sources and secondary legal sources. The collected legal materials were analyzed systematically with descriptive presentation. Based on the results of the existing analysis, this study reveals that medical personnel who provide vaccines to people who have a history of illness can be said to have committed serious negligence which resulted in the recipient of the Health Service being seriously injured, the punishment for the maximum 3 (three) years in prison, even if it causes death, will be sentenced to 5 years. (five) years in accordance with the provisions of the Law of the Republic of Indonesia Number 36 of 2014 concerning Health Worker.

Abstract

This study aims to analyze the "Criminal Accountability of Corruption Actors in Grants for Beef Procurement Grants". Legal issues arising from this study include: How is the arrangement of grants and their relationship with criminal acts of corruption, as well as criminal liability for perpetrators of corruption in the procurement of cattle (Decision Number 1/PPid. Sus-TPK/2019/PN Dps). The research method used in this research is normative legal research with statutory, conceptual and case approaches. Based on the results of this study, it can be concluded several things: 1) Grant arrangements are regulated in Article 1666, 1682 and 1682 of the Civil Code; 2) The relationship between grants and corruption related to grants is a wet field that is used by individuals to commit corruption. 3) Based on Decision Number 1 / Pid.Sus-TPK / 2019 / PN Dps, the defendant is proven to have violated Article 3 in conjunction with Article 18 of Law Number 31 of 1999 concerning Eradication of Corruption Crimes in conjunction with Law Number 20 of 2002. Form of criminal liability the perpetrators of corruption in the form of imprisonment for 2 (two) years and 4 (four) months minus the temporary detention period and based on orders so that the defendant remains in custody and a fine of Rp 50,000,000 (fifty million rupiah) subsidair 2 (two) a month of confinement, and is charged to pay a replacement money of Rp 127,350,000 (one hundred twenty seven million three hundred fifty thousand rupiah). The advice that can be given to the reader is through education and exemplary attitude from the leader who becomes the main spear as a reflection of the government towards the next generation. For further researchers who will examine the crime of corruption in order to dig deeper about how the government plays a role in efforts to prevent corruption

Abstract

The issuance of Law Number 5 of 1960 concerning Basic Regulations on Agrarian Principles on September 24, 1960, then abolished the old agrarian law. The purpose of this study is to analyze the implementation of land pawns in the Ubung village, Jonggat sub-district and find out the inhibiting factors of the implementation of agricultural land pawns in Ubung Village, Jonggat District, Central Lombok Regency, West Nusa Tenggara based on Law No. 56 Prp of 1960. The method in this study is Empirical research methods and problem approaches using legal sociology. The results showed that the agricultural land pawn given by the pawnbroker and the pawn recipient was not in accordance with the law. Agricultural pawn in the community of Ubung Village, Jonggat Subdistrict, Central Lombok Regency is not in line with the agricultural land pawning regulated in Law Number 56 Prp of 1960. Factors that inhibit the implementation of agricultural pawn in Ubung Village, Jonggat Subdistrict, Central Lombok Regency NTB based on article 7 paragraph (1) and paragraph (2) of Law Number 56 Prp of 1960 ineffective are a) there has been no socialization of Law Number 56 prp of 1960 governing the problem of pawning agricultural land in Ubung Village, Jonggat District, Central Lombok Regency, NTB from the authorities. b) The culture of Ubung Village, Jonggat Subdistrict, Central Lombok Regency, NTB, which considers the provisions of Law Number 56 prp of 1960 to be incompatible with the customs contained in their environment.

Abstract

Narcotics transaction or narcotics distribution, especially in correctional institutions has been very widespread; this is the impact of the loss of control of the existing system. This condition has an impact on the formation of a negative view of the community on the implementation of law enforcement, especially in the prison environment. So the problem under study is how to regulate sanctions related to narcotics transactions that occur within prison and how enforcement against inmates conducting drug transactions in prison law. By using the empirical normative legal research method (mix method) whit primary data sourced from Class II Penitentiary Kerobokan. The results of the study showed that the regulation of sanctions for prisoners who carry out narcotics transactions in prisons, namely the threat of capital punishment, life imprisonment, maximum imprisonment of 20 years and a minimum of 5 years. Whereas law enforcement in correctional institutions, namely severe disciplinary penalties, entered into a register, handed down register F, all prisoners’ rights will be lost, and passed on to the competent authority. The government in this case is the Ministry of Law and Human Rights should always collaborate with the National Narcotics Agency by visiting prisons regularly or allegedly as a place for narcotics transactions or distribution. Then with regard to legislation products that are already in force it should be noted again.

Abstract

Cellular Telephone is a communication tool that can connect people with others who are obstructed by distance and time. Its use is now a priority for most people. The level of traffic accidents caused by drivers who drive their vehicles while using the telephone is also increasing. In connection with the above it will be discussed regarding the regulation of the use of cellular telephone while driving as well as law enforcement for motorists who violate the use of cellular telephone while driving. In this paper the method used is a normative legal method which uses legal material collection techniques in the form of study documents and uses primary legal material sources such as legislation and secondary legal materials such as legal books which are then poured descriptively to get final conclusions. Then regarding the conclusions of the results of this study namely violations of the use of cellular telephones have explained that in driving there is no concentration to cause an accident and even to cause death then threatened with imprisonment and fines as regulated in Law No. 22 of 2009 concerning Past Road Traffic and Transportation. For law enforcement efforts to prevent the use of cellular telephones it is necessary to understand the community from adolescents to adults of the dangers and impacts of using cellular telephones when driving. So that safety can be created in driving with other public road users.
