Abstract

AbstractThe research objective is to find out and understand the use of the right of immediate pursuit of foreign ships that violate the Indonesian sea territory; and know and understand the limits of Indonesia's authority in the use of the right of immediate pursuit in its territorial waters. The problem is how to use the right of immediate pursuit of foreign ships that violate Indonesia's maritime territory. And what about the limits of Indonesia's authority in the use of immediate pursuit rights in its territorial waters? The research method used is empirical legal research methods. The results of the research on the use of the right of immediate pursuit of foreign ships that violate the territorial sea of Indonesia include several things that must be considered, namely the chase must be carried out by the competent authority of the coastal State and have sufficient reasons and are convincing that the foreign ship has violated the law in waters of the jurisdiction of the coastal State. The pursuit must begin when a foreign ship or one of its partners is in inland waters, archipelagic waters, territorial seas, auxiliary routes or exclusive economic zones. The pursuit can only continue outside the territorial seas, outside the auxiliary routes or outside the exclusive economic zone if the pursuit is continuous and uninterrupted. The pursuit may only begin after giving a stop sign from a distance that the foreign ship can see or hear. The right of pursuit must be stopped as soon as the ship being chased has entered the sea of the territory of the third party. The limit of Indonesia's authority in the use of the right to immediate pursuit in its territorial waters, Indonesia can take actions, starting with a signal, for example with a sound sign or a flag signal or an optical light, not paying attention to the signal, then it may be followed by warning shots. the first shot with a blank bullet is also ignored, followed by the shot with a live bullet, provided that when shooting, the shot must be directed in front of the prow of the ship being chased. If you take a fight that endangers the patrol boat or the lives of people, balanced violence can be carried out, if possible avoiding casualties. The immediate chase is stopped if the foreign ship enters the territorial waters of another State.Key words: right of immediate pursuit; foreign ships; useAbstrakTujuan penelitian untuk mengetahui dan memahami penggunaan hak pengejaran segera terhadap kapal-kapal asing yang melanggar wilayah laut Indonesia; dan mengetahui dan memahami batas kewenangan Indonesia dalam penggunaan hak pengejaran segera di wilayah perairannya. Permasalahan yaitu bagaimana penggunaan hak pengejaran segera terhadap kapal-kapal asing yang melanggar wilayah laut Indonesia. Dan bagaimana batas kewenangan Indonesia dalam penggunaan hak pengejaran segera di wilayah perairannya. Metode penelitian yang dipergunakan metode penelitian hukum empiris. Hasil penelitian penggunaan hak pengejaran segera terhadap kapal asing yang melanggar wilayah laut Indonesia, mencakup ada beberapa hal yang harus diperhatikan, yaitu pengejaran harus dilakukan oleh pihak yang berwenang dari Negara pantai dan mempunyai alasan yang cukup serta meyakinkan bahwa kapal asing tersebut telah melakukan pelanggaran hukum di perairan yurisdiksi Negara pantai. Pengejaran itu harus dimulai ketika kapal asing atau salah satu sekocinya ada di perairan pedalaman, perairan kepulauan, laut teritorial, jalur tambahan atau zona ekonomi eksklusif. Pengejaran itu hanya dapat dilanjutkan di luar laut wilayah, di luar jalur tambahan atau di luar zona ekonomi eksklusif bila pengejaran itu terus menerus dan tidak terputus. Pengejaran hanya boleh dimulai setelah memberi suatu tanda berhenti dari suatu jarak yang dapat dilihat atau didengar oleh kapal asing tersebut. Hak pengejaran itu harus dihentikan sesaat kapal yang dikejar itu telah memasuki laut wilayah Negara pihak ketiga. Batas kewenangan Indonesia dalam penggunaan hak pengejaran segera di wilayah perairannya, Indonesia dapat melakukan tindakan-tindakan, diawali harus dilakukan dengan memberi tanda isyarat, misalnya dengan tanda suara atau isyarat bendera atau lampu optis, tidak diperhatikannya tanda isyarat, baru boleh dilanjutkan dengan tembakan peringatan, tembakan pertama dengan peluru hampa, juga tidak diindahkan dilanjutkan dengan tembakan dengan peluru tajam, dengan ketentuan bahwa waktu menembak, tembakan harus diarahkan di depan haluan kapal yang dikejar. Apabila melakukan perlawanan yang membahayakan kapal patroli atau jiwa orang, dapat dilakukan tindakan kekerasan yang seimbang, jika memungkinkan menghindari adanya korban jiwa. Pengejaran segera itu dihentikan apabila kapal asing tersebut memasuki wilayah perairan Negara lain.

Abstract

Undang-Undang Nomor 6 Tahun 2014 tentang Desa menegaskan, setiap desa di seluruh Indonesia mendapat alokasi dana dari Anggaran Pendapatan dan Belanja Negara. Dana tersebut digunakan untuk pembangunan yang berbasis desa. Total dana yang dialokasikan tersebut mencapai 10% dari dana perimbangan yang diterima Kabupaten/ Kota dalam Anggaran Pendapatan dan Belanja Daerah setelah dikurangi Dana Alokasi Khusus. Secara teoritis penelitian ini bertujuan untuk mengetahui peranan Undang- Undang Desa sebagai sarana pembaharuan masyarakat. Mochtar Kusumaatmadja melihat perubahan sikap terhadap perundang-undangan yang menampakkan keseimbangan antara keinginan untuk mengadakan pembaharuan hukum melalui perundang-undangan dan kesadaran diperhatikannya pula nilai-nilai dan kenyataan yang hidup dalam masyarakat. Undang-Undang Desa menjadi landasan dan bagian dari pembaharuan pola pikir, pola tindak masyarakat desa. Undang-Undang Desa seyogianya juga merupakan instrumen untuk membangun kehidupan baru desa yang mandiri, demokratis, dan sejahtera.

Abstract

Environmental law enforcement in Indonesia, particularly under Law No. 32 of 2009 on Environmental Protection and Management, faces persistent challenges in applying the principle of ultimum remedium—treating criminal sanctions as a last resort. This study aims to evaluate the effectiveness of non-criminal sanctions, namely administrative and civil measures, as prerequisites to criminal enforcement in environmental cases. Using a normative juridical method and descriptive-analytical approach, the research analyzes statutory regulations, judicial decisions, and enforcement practices in pollution cases, including hazardous and toxic waste violations. The findings reveal that administrative and civil sanctions remain weak due to limited supervision, lengthy civil procedures, and inadequate compensation mechanisms. Additionally, poor institutional coordination and limited enforcement capacity hinder the transition to criminal sanctions. Community involvement is also underutilized in supporting legal accountability. The study concludes that a more structured three-layered enforcement approach—integrating administrative, civil, and criminal mechanisms—is needed to uphold environmental justice. Strengthening institutional capacity and aligning reparative and retributive principles are essential to ensure the ultimum remedium principle operates effectively. These findings contribute to legal reform efforts and the development of sustainable environmental governance in Indonesia.

Abstract

This paper examined the articulation of the interests of regional community through the authority of members of the Regional Representative Council (DPD) to see the extent of the functions and authorities of people representative officials in realizing the public interest of the regional people. This paper utilized conceptual approach and statutory approach to the law because of its normative type in nature. Therefore, the required data were in form of articles of the law regulating the authority of members of the Regional Representatives Council (DPD) as well as the interests of the society in the region. In addition, data from bibliography were also collected, such as results of scientific studies relevant to the object of study in the present study to compare theories leading to meet conclusions to be drawn. The results show that the articulation of the interests of regional community within the scope of the authority of the DPD is still very limited because it is at the theoretical level, instead of practical. The DPD should have taken strategic steps in helping to succeed the interests of the regional community of developemnts.

Abstract

Abstrak Tujuan dari penelitian ini adalah untuk mengetahui tugas dan fungsi majelis pengawas daerah dalam menyelenggarakan pengawasan, pemeriksaan, dan penjatuhan sanksi terhadap notaris. Permasalahan yang dibahas pada penelitian ini adalah Tugas dan fungsi Notaris sebagai pengabdi masyarakat menjalankan sebagian tugas Negara dan karena itu sangat penting bagi para notaris di dalam memangku jabatannya untuk memberi pelayanan kepada masyarakat dan demi kepentingan masyarakat. Adapun hasil dari penelitian ini menyatakan bahwa Majelis Pengawas Notaris dapat melakukan tugas dan fungsinya secara berjenjang atau tidak berjenjang. Dalam kaitannya dengan penjatuhan sanksi, pemeriksaan dilakukan secara berjenjang, dimulai dari MPD, MPW, dan MPP, namun penjatuhan sanksi berupa peringatan lisan atau tertulis merupakan kewenangan dari MPW yang sifatnya final, dan penjatuhan sanksi berupa pemberhentian merupakan kewenangan dari MPP, dan Menteri Hukum dan HAM RI yang akan mengeluarkan Surat Keputusan pemberhentian. Kata Kunci: Notaris, Majelis pengawasan notaris Abstract The aims of this research is to know duty and function of regional supervisory board in conducting supervision, examination, and imposition of sanction against notary. The problems discussed in this research are the tasks and functions of the Notary as a servant of the community to carry out some of the tasks of the State and therefore it is very important for the notary in holding their positions to provide services to the public and for the benefit of society. The results of this study states that the Supervisory Board of Notaries can perform tasks and functions in stages or not tiered. In relation to the imposition of sanctions, the examination shall be conducted in stages, starting with the MPD, MPW and MPP, but the sanction of oral or written warning shall be the authority of the MPW which is final, and the imposition of sanctions in the form of termination shall be the authority of MPP, Human Rights which will issue a Decision Letter of dismissal. Abstract

Prior to the 1990s, there was no agency that managed Batur tourism objects and resources. In 2017 a tourism area management body was formed, but at that time its authority was limited to the imposition of levies for tourists visiting the Geopark tourism area. It is not clear which agency has the authority to organize tourism areas, so a problem arises: The agency authorized to organize tourism areas and the factors that affect the arrangement of tourism areas. This research aims as evaluation materials in arrangement the Batur Unesco Global Geopark Tourism Area in Bangli Regency The research method used is empirical legal research. The analysis techniques that will be used are Legal-Content Analysis and Futuristic Analysis. This legal research aims to analyze the problem, namely the agency authorized to organize the Batur UNESCO Global Geopark tourism area in Bangli Regency. The authority of the management body is limited only in collecting fees, whereas for a significant increase, the authority of the agency is not only to collect tourist fees, but also to organize the area to increase its tourist attractiveness. The results of the discussion of the regulation of the authority for structuring tourism areas are the Bali KSDA and the Bangli Regional Government, as well as the not yet implemented regional arrangement based on natural preservation, community empowerment, and environmental economic progress. Meanwhile, the conclusions and suggestions are that the Management Agency has not yet been authorized to organize tourism areas. Factors that influence the structuring of the tourism area are the substance of the Bangli regional regulation, concerning households, local law enforcers, and the legal culture of the local community. Suggestions that the tourism area management body should be changed to Perumda. Law enforcement must have synergy between the Bangli Regional Government and the Bali BKSDA.

Abstract

The purpose of this study was to analyze the justification for the involvement of Traditional Villages in the implementation of the prevention and control of the Covid 19 Pandemic in Yang Api Village and Peninjoan Village. The Bali Provincial Government synergizes activities to prevent the transmission of the Corona Virus (Covid-19) by involving Indigenous Villages in Bali. The implementation of policies such as PPKM in traditional villages cannot be carried out alone by the government but requires cooperation with various parties, including the community, health workers and security officers. In general, Babinkamtibmas are security officers in the village. However, in Bali, every traditional village has a pecalang as a traditional security officer based on traditional local wisdom. The local government through the Decree on the formation of the Customary Village-based Mutual Assistance Task Force has provided space for indigenous village communities to independently handle the Covid-19 pandemic faced by the Fire and Peninjoan Traditional Villages. With the provision of this space, the Covid-19 Gotong Royong Task Force can handle the ongoing pandemic on its own, starting from education, socialization, prevention and even handling. In addition, traditional villages also receive support from the Village Service so that they can coordinate with each other. The maintenance of conduciveness in the village is carried out well, with the synergy of traditional villages with official villages in handling Covid-19. The involvement of elements of the Traditional Village (pecalang) in a pandemic emergency situation is indeed possible and does not become a serious problem because what is put forward is the principle of benefit for humanity. Meanwhile, the success rate of involving traditional pecalang in Yang Api and Peninjoan Villages has worked well, although in August there was a surge in people infected with Covid 19, but it was more due to the many traditional events in the village, and not because of the negligence of the Covid task force in synergizing its main functions. The positive performance of the involvement of traditional villages in pandemic prevention needs to be continued in the future for activities that benefit the indigenous village community.

Abstract

With the rapid development of information technology, the types of Narcotics are increasing, one of which is Alpha Propylaminopenthiophenone, which is a new type of Narcotics that is not yet contained in statutory regulations, so there is a void in norms. Propylaminonepenthiophenone) can be held criminally responsible? 2. What are the arrangements for new types of narcotics users such as Alpha Propylaminonpentionefenone in the future? The use of the method in this study is a type of normative legal research with a statutory regulatory approach, the source of data is through legislation which includes Law Number 35 of 2009 and the purpose of this study is to determine criminal liability for users of a new type of narcotics (alpha propylaminopenthiophenone). in Indonesia. The results of the study can be explained that Alpha Propylamininpenthiophenone has not been regulated in Indonesian Legislation and Users of these substances cannot be held criminally responsible because the Indonesian legal system adheres to the principle of legality, so with regard to this it is necessary to regulate (Alpha Propylaminonpenthiophenone) so that users can be held criminally responsible and should reform the Narcotics Law which states that all substances containing narcotic substances are considered narcotics.

Abstract

Along with technological developments, there are a lot of facilities available in cyberspace. The development of this technology can also provide opportunities for criminals, especially crimes in cyberspace. Cybercrime is a new form or dimension of a crime that is currently receiving a lot of attention from the international community. One type of cybercrime is hacking. Based on this background, this research was conducted with the aim of describing law enforcement against criminal acts of hacking and the efforts to deal with cybercrime. This research was conducted using normative legal research methods and statutory approaches. The results of this study showed that law enforcement against criminal acts of hacking is regulated in Law Number 19 of 2016 amending Law Number 11 of 2008 concerning Electronic Information and Transactions. The perpetrator will be given criminal sanctions in the form of imprisonment and fines for violations in the field of hacking. In addition, efforts to eradicate cybercrime refers to the Law on Information and Electronic Transactions which is carried out with preventive and repressive measures. Therefore, the criminal act of hacking which is included in the realm of cybercrime has been regulated in Article 30 paragraph (1), (2) and (3) of the ITE Law, while the punishment is regulated in Article 46 paragraph (1), (2), and ( 3) of the ITE Law. In this regard, the government has taken various countermeasures in the form of preventive and repressive measures.

Abstract

The Regional Revenue Agency / Pasedahan Agung Badung Regency is a regional apparatus organization that has the main objective and function of managing regional revenue as a source of regional financing in implementing regional development. This study aims to analyze the implementation procedures and determine the effectiveness of the implementation of the Badung Regency Regulation Number 2 of 2016 concerning the Local Tax Online System. This study uses an empirical method. There are 2 forms of data used, namely primary and secondary, namely collected through interviews. The results showed that the procedures for implementing the online system of local taxes for taxpayers to report their taxes through the Revenue Agency web and the installation of recording devices for monitoring business transactions on taxpayers. The implementation of the Local Tax Online System can be said to be effective as seen from the increase in online tax reporting and the increase in the installation of business transaction monitoring tools for taxpayers and the increase in PAD Taxes. The juridical and non-juridical constraints are the taxpayers who refuse to install a recording device for monitoring taxpayers' business transactions. Therefore, through this research, the Regional Revenue / Pasedahan Agency is expected to increase the socialization of understanding and reinforce the sanctions in the Badung Regency Regional Regulation Number 2 of 2016 concerning the Online Regional Tax System
