Abstract

Corruption is one of the crucial problems in Indonesia, and it has not been addressed. Corruption occurs in almost all lines and structures of government, from the executive and legislative to judiciary, from government at the central to regional levels. This research aims to examine social sanctions' regulation in eradicating corruption in Indonesia from a sociological perspective. Methodologically, this research is library research conducted using a qualitative approach. After analyzing field data using the sociology of law and the sociology of corruption, this research found that eradicating corruption through establishing social sanctions from a sociological perspective means exile or castration. Social sanctions in this context mean maximizing social structures and community institutions to control, prevent and take action. Both prevention and action are direct, for example, making them street sweepers, or indirect, but provide a long-term deterrent effect, for example, marking their identity card (KTP) with writing or a corruptor's stamp, revoking their political rights so they can no longer hold public office.

Abstract

Introduction: With the development of technology, people become easier in expressing themselves through social media. However, many people think that the Indonesian Government represses freedom of speech through the Electronic Information and Transactions (EIT) Law as the huge number of related cases keeps increasing, particularly on matters of criticizing the Government.Purposes of the Research: This article presents to discuss whether the Law does snatch the rights of citizens regarding freedom of speech as the Law essentially aims to protect such rights and shall not contradict the 1945 Constitution of the Republic of Indonesia stating that freedom of speech is a right for every citizen.Methods of the Research: By using normative legal research, this article examines legal principles and norms of related regulations. The authors analyze the situation faced by the Indonesian people in recent years through library research. The secondary data of literature was collected and reviewed focusing on the statutory approach along with the case approach.Results of the Research: The findings show that the EIT Law indeed draws controversy among Indonesian people due to the existence of several Articles under the Law that are contradictory to its purpose, namely protecting freedom of speech. By having ambiguousness and multiple interpretations of those several Articles, the Law leads to abuse of power by the Government. Therefore, it is reasonable for many people, as well as civil society organizations, to appeal to the Government to revise the Law and related regulations. It is on the grounds that such actions are necessary to enhance and enforce the protection of freedom of speech.

Abstract

Abstrak Korporasi memegang peranan penting dalam era globalisasi saat ini, termasuk peran korporasi dalam pembangunan dan pemanfaatan energi nuklir. Namun demikian, tidak jarang korporasi melakukan unfair business yang tidak hanya merugikan suatu negara dan konsumen, tetapi juga dapat dikategorikan sebagai tindak pidana sehingga perlu dimintakan pertanggungjawaban pidana. Artikel ini akan mengkaji permasalahan pertanggungjawaban pidana korporasi pada tindak pidana ketenaganukliran dihubungkan dengan pembaruan hukum pidana Indonesia. Metode Penelitian yang digunakan yaitu penelitian normatif atau doktriner dengan pendekatan konseptual (conceptual approach) dan perundang-undangan (statute approach). Temuan dalam penelitian ini menunjukkan terdapat kelemahan pengaturan pertanggungjawaban pidana korporasi dalam tindak pidana ketenaganukliran yang diatur dalam Undang-Undang Nomor 10 Tahun 1997. Kesimpulan dari penelitian ini pasca pembaruan Hukum Pidana Indonesia melalui Undang-Undang Nomor 1 Tahun 2023 tentang Kitab Undang-Undang Hukum Pidana, korporasi menjadi subjek tindak pidana dan dapat dimintakan pertanggungjawaban pada tindak pidana ketenaganukliran. Kata Kunci: Pertanggungjawaban Pidana Korporasi, Nuklir, Kitab Undang-Undang Hukum Pidana Indonesia

Abstract

Direct regional head elections (Pilkada) in Indonesia, implemented since 2005, have not fully guaranteed the realization of democracy due to the widespread practice of money politics. Money politics, involving the exchange of money or material goods for votes, undermines the integrity of elections and distorts democratic processes. This study aims to examine the regulation of prohibitions and sanctions related to money politics within the Election Law and to formulate a concept for criminal law reform regarding money politics in Pilkada. Using a normative juridical method with a qualitative approach, the research analyzes existing legal provisions, identifies gaps and ambiguities, particularly concerning Article 73 of the Election Law, and explores the scope of subjects covered by the regulation. The findings indicate that although legal reforms have been made several times, ambiguities and loopholes remain, especially the unclear explanation of Article 73 and limited subject coverage. Therefore, this study proposes reformulating the legal norms to clarify prohibitions, broaden the scope of subjects beyond just candidates and campaign teams, and introduce protections for whistleblowers. The results of this research are expected to serve as a reference for policymakers and stakeholders in improving the legal framework for elections to ensure democratic integrity and legal certainty.

Abstract

Murtigading Village, located in Sanden District, Bantul Regency, has achieved notable success in combating money politics in the village chief elections (Pilurdes), general elections, and regional elections. This study explores how the community of Murtigading mobilized a movement to counter money politics, identifies the key factors contributing to the movement’s success, and examines strategies to ensure the sustainability of this anti-money politics effort. Employing a qualitative descriptive approach, the research collected primary and secondary data through observations, literature review, and interviews with key movement initiators and members of the Bantul Regency Election Supervisory Committee (Bawaslu). The findings reveal that the anti-money politics movement in Murtigading significantly contributed to the reduction and eventual eradication of money politics practices in the village during the 2019 and 2020 elections. Two primary factors influenced this success: the presence of community leaders as catalysts and active community participation. To maintain the movement’s momentum, continuous promotion and internalization of anti-money politics values through political literacy and socialization are essential. This study highlights the critical role of community-driven initiatives in fostering clean electoral processes and strengthening democratic governance at the grassroots level.

Abstract

This study examined the delay in the passage of the Asset Forfeiture Bill in Indonesia, despite President Joko Widodo's (Jokowi) strong support. This study identifies several key factors influencing the legislative process, including internal political resistance in parliament, government priorities for economic development, and inconsistent policies. This study used qualitative approaches and thematic analysis to examine the legislative process's complex political, economic, and institutional contexts. The findings showed that the dynamics of political coalitions, the government's focus on infrastructure and foreign investment, governance challenges in ratifying the draft law included in the Prolegnas, and the COVID-19 pandemic are the main inhibiting factors. The study also emphasized the need to align national policies and laws with international legal standards, such as the 2003 United Nations Convention Against Corruption (UNCAC), to accelerate legal reform in the fight against corruption in Indonesia. This research provides important insights for policymakers and the public regarding legislative efforts during President Joko Widodo's administration to eradicate corruption through the legal framework of asset confiscation.

Abstract

The study examines tobacco control policies of Indonesia, national and international players, the role of political elite and social demography of smoking. The analysis explains the relation of national and international players associated with the tobacco industry, interest of local community, structural and political powers that limit the legislation on tobacco control. The current situation of smoking and tobacco use in the social system of Indonesia is alarming. Indonesia is the working ground of different multinational brands that have industries and production units of cigarettes. The economic perspectives of the tobacco industry involvement of government and political powers in this industry make it more complex. The study is based on qualitative sources that are evaluated for the tobacco industry and its implications on Indonesian society. The results provide a comprehensive overview of the tobacco industry and the role of different actors that can be regularized by imposing strict legislation. The study also provides recommendations to manage the tobacco industry that will guide the corrective path of reducing tobacco culture in the society.

Abstract

This article investigates the crisis of public trust in Indonesia’s Constitutional Court, triggered by a series of controversial decisions that suggest the practice of abusive judicial review. It focuses on three pivotal rulings, Decision No. 90/PUU-XXI/2023, that collectively reveal a pattern of judicial behavior aligned with executive interests, undermining judicial independence and constitutional integrity. Utilizing a normative legal research method with statute, conceptual, and analytical approaches, the study critically examines how judicial overreach, ethical breaches, and procedural irregularities have contributed to institutional decay. The findings indicated that the Constitutional Court has shifted from its role as a counter-majoritarian institution to a political instrument, eroding legal certainty and democratic accountability. The involvement of justices in conflicts of interest, particularly in election-related cases, has intensified public skepticism and revealed systemic weaknesses in judicial appointment and oversight mechanisms. This paper argued that such decisions constitute a form of “abusive judicial review” that threatens Indonesia’s constitutional democracy. To restore judicial legitimacy, structural reforms are imperative, emphasizing transparent judicial recruitment, permanent ethical oversight bodies, and stronger civil society engagement. The article concluded that without substantial reform, the erosion of public trust may further delegitimize the Court as a guardian of the Constitution.

Abstract

Coronavirus disease (COVID-19), caused by the SARS-CoV-2 virus, spread globally, with research indicating that prognosis severity can be assessed by thrombocyte and D-dimer levels; while, patient age serves as a mortality predictor. This study aimed to analyze the relationship between age with thrombocytes and D-dimer in COVID-19 patients. This cross-sectional study used laboratory testing samples from 667 COVID-19 patients at Hospital X in Jakarta, Indonesia, collected from August 2020 until May 2021. The data was collected using cluster random sampling and analyzed using descriptive statistics and the Chi square test (95% CI). Abstract

This study analyzes the duality of the provisions for imposing administrative sanctions or criminal sanctions for taxpayers who do not register themselves to be given an Taxpayer Identification Numbers or do not report their business to be confirmed as Taxable Persons for VAT Purposes, causing state losses because it can lead to legal uncertainty and injustice. This paper is a doctrinal research that analyzes primary and secondary sources of law with statutory, conceptual, and analytical approaches. The results of the research show that the Law on General Provisions and Procedures for Taxation already regulates administrative sanctions for taxpayers who do not register themselves to be given a Taxpayer Identification Number or do not report their business to be confirmed as a Taxable Persons for VAT Purposes, causing state losses, namely by granting a Taxpayer Identification Number and inauguration of a Taxable Persons for VAT Purposes as a position and issuing Notice of Tax Underpayment Assessment along with administrative sanctions. Based on the principles of establishing laws and regulations and the legal principles of hulprecht, una via, ultimum remedium, and nullum delictum, nulla poena, sine praevia lege poenali, because there are provisions for the imposition of administrative sanctions, for legal certainty and justice the provisions of Article 39 paragraph (1) letter a of the General Provisions and Tax Procedures Act should be abolished so that there is no duality in the imposition of sanctions for the same violation.
