Abstract

This study aims to analyze the factors influencing the implementation of Regional Regulation of Gorontalo Regency Number 04 of 2014 concerning the Control of Livestock in Ilomata Village, Bilato District. This research employs an empirical legal method with a sociological juridical approach to examine law not only as written norms but also as a social practice within society. Data were collected through interviews with village officials, regional regulation enforcement officers, and livestock owners, as well as through documentation and literature studies. The collected data were analyzed qualitatively using Lawrence M. Friedman’s legal system theory and Soerjono Soekanto’s theory on factors influencing law enforcement. The results indicate that the implementation of the regional regulation has not been optimal. The influencing factors include legal substance, legal structure (law enforcement officers), facilities and infrastructure, community factors, and legal culture. Normatively, the regulation contains clear provisions; however, its implementation is hindered by inconsistent enforcement, limited supporting facilities, and low levels of public legal awareness. Legal culture and the lack of consistency among law enforcement officers are the most dominant factors affecting the effectiveness of the regulation’s implementation. Therefore, it is necessary to strengthen consistent law enforcement, improve supporting facilities, and undertake continuous efforts to build public legal awareness in a participatory manner.

Abstract

This study aims to examine the Enforcement of Criminal Law Against Corruption in the Provision of People's Business Credit Facilities in Bone Pantai and the Accountability of BRI Management in Corruption in the Provision of People's Business Credit Facilities in Bone Pantai. The type of research used is normative legal research and empirical legal research. Empirical normative research starts from primary/basic data, and is then linked to law enforcement and criminal liability in corruption crimes in KUR. The results of this study indicate that criminal law enforcement against corruption in the provision of people's business credit facilities in Bone Pantai has not been implemented optimally and efficiently due to several weaknesses and problems that are obstacles in eradicating corruption and the involvement of internal bank figures and related parties by carrying out the mode of corruption of People's Business Credit (KUR) at Bank Rakyat Indonesia (BRI) Bone Pantai Unit involving data engineering. The accountability of BRI management in corruption crimes in the provision of people's business credit facilities in Bone Pantai shows that state losses are accounted for by the legal subject or defendant and the accountability of BRI bank, namely the head of the unit and the credit manager. The implementation of business ethics is very important in the distribution of KUR to ensure that the funds distributed are right on target to eligible recipients. Therefore, it is necessary to increase transparency in decision-making and credit distribution and increase the capacity of law enforcement regarding the handling of corruption cases involving people's business credit facilities (KUR).

Abstract

This study aims to analyze the legal consequences of the Indonesian National Police’s non-compliance with Constitutional Court Decision No. 114/PUU-XXIII/2025 and to examine its implications for Indonesia’s constitutional system. The decision prohibits active members of the Indonesian National Police from holding civilian positions unless they resign or retire from police service. However, several provisions of Regulation of the Indonesian National Police No. 10 of 2025 are considered inconsistent with the Constitutional Court’s ruling, thereby creating a legal antinomy and uncertainty in its implementation. This study employs a normative legal research method using statutory and conceptual approaches. The analysis focuses on the hierarchy of laws and regulations, the final and binding nature of Constitutional Court decisions, and the constitutional limits of authority among state institutions. Legal materials were examined qualitatively through legal interpretation and systematic analysis. The results indicate that non-compliance with the Constitutional Court’s decision may constitute constitutional disobedience, weaken the supremacy of the Constitution, and create legal uncertainty regarding the appointment of active police officers to civilian positions. It also undermines the authority of the Constitutional Court and disrupts the checks and balances mechanism. The study concludes that regulatory harmonization, stricter institutional supervision, and an effective enforcement mechanism are required to ensure compliance with Constitutional Court decisions.

Abstract

Money politics remains a major challenge in the 2024 Regional Head Elections despite the existence of criminal and administrative sanctions. This study aims to analyze the effectiveness of legal sanctions in combating money politics in the 2024 Regional Head Elections in Bone Bolango Regency and North Gorontalo Regency and to identify the factors influencing their effectiveness. An empirical legal method with conceptual and sociological approaches was employed through interviews with the Election Supervisory Agency (Bawaslu) at the regency and provincial levels, supported by an analysis of Bawaslu Decision No. 01/Reg/L/TSM-PB/29.00/IV/2025. The findings reveal that the low effectiveness of legal sanctions results from the interaction of legal, law enforcement, facilities, community, and legal culture factors, particularly procedural limitations, weak inter-agency coordination, limited evidence and resources, and low public participation. The study concludes that the effectiveness of legal sanctions depends on the synergy of these five factors rather than solely on the severity of criminal penalties ABSTRAKPraktik politik uang pada Pilkada 2024 masih menjadi tantangan serius meskipun telah diatur melalui sanksi pidana dan administratif. Penelitian ini bertujuan menganalisis efektivitas penerapan sanksi hukum dalam penanggulangan politik uang pada Pilkada 2024 di Kabupaten Bone Bolango dan Kabupaten Gorontalo Utara serta mengidentifikasi faktor-faktor yang memengaruhinya. Penelitian menggunakan metode hukum empiris dengan pendekatan konseptual dan sosiologis melalui wawancara dengan Bawaslu Kabupaten Bone Bolango, Bawaslu Kabupaten Gorontalo Utara, Bawaslu Provinsi Gorontalo, serta analisis Putusan Bawaslu Provinsi Gorontalo Nomor 01/Reg/L/TSM-PB/29.00/IV/2025. Hasil penelitian menunjukkan bahwa rendahnya efektivitas penerapan sanksi hukum dipengaruhi oleh interaksi faktor hukum, penegak hukum, sarana dan prasarana, masyarakat, serta budaya hukum, dengan hambatan utama berupa keterbatasan prosedural, lemahnya koordinasi antarlembaga, keterbatasan pembuktian dan sumber daya, serta rendahnya partisipasi masyarakat. Penelitian menyimpulkan bahwa efektivitas sanksi hukum ditentukan oleh sinergi kelima faktor tersebut, bukan semata-mata oleh beratnya ancaman pidana.
