It is hoped that rehabilitation of narcotics addicts can reduce narcotic problems. Assessment Arrangement and Implementation of Rehabilitation by the National Narcotics Agency of Badung Regency. The research method used in the assessment arrangement and the impact of assessment in narcotics crimes is an empirical method. The goal to be achieved in this study is to find out how effective the assessment of narcotics crimes in the National Narcotics Agency of Badung Regency. The results showed that the implementation of assessments at the Badung Regency National Narcotics Agency has not been effective because the judge's decision still has not used the results of the Recommendations of the Integrated Assessment Team in consideration of the determination of the verdict. Judges are still inclined to sentence prison confinement to defendants without considering sanctioning in the form of rehabilitation measures on the accused for recovery from narcotics snares.

Abstract

This study aims to analyze the legal provisions on land rights for foreign nationals in the Indonesian land law system and to examine the validity and legal consequences of nominee agreements in the control of land rights by foreign investors. The background of this study is based on the practice of using nominee agreements (borrowing names) by foreign nationals to control land in Indonesia, which legally contradicts the provisions of the Basic Agrarian Law (UUPA) which prohibits ownership of land rights by foreign parties. This study uses a normative legal research method with a legislative approach and a conceptual approach. The legal sources used include primary, secondary, and tertiary legal materials that are analyzed qualitatively. The results of the study indicate that the regulation of land rights for foreign nationals in the Indonesian legal system is limited to use rights, lease rights, or through certain legal entities such as Foreign Investment Limited Liability Companies (PT PMA). Meanwhile, the practice of nominee agreements is a form of legal smuggling that contradicts the basic principles of national agrarian law, so that the agreement can be declared null and void. In addition, this practice creates legal uncertainty and has the potential to harm the state and society because it obscures the status of land ownership. In conclusion, firm law enforcement and regulatory harmonization between agrarian and investment law are needed to ensure legal certainty and safeguard state sovereignty over land, without hindering foreign investment in Indonesia.

Abstract

This study investigates copyright protection in the digital transformation of Wayang Kulit as a traditional cultural expression within the Indonesian legal system. It specifically addresses the normative ambiguity surrounding the recognition of transformed works under Article 40(1)(n) of the Copyright Law. Employing a normative legal research design with statutory and conceptual approaches, the study critically examines whether digital reinterpretations such as animation, digital illustration, and interactive media, qualify as independently protected works. The analysis demonstrates that, although the law formally acknowledges transformative creations, it fails to provide clear criteria regarding the threshold of originality and the extent of permissible modification. This regulatory gap generates legal uncertainty in determining authorship, ownership, and the scope of protection, particularly when communal cultural elements intersect with individual creativity. The novelty of this research lies in its focused examination of Wayang Kulit as an intangible cultural heritage undergoing digital recontextualization, integrating doctrinal legal analysis with cultural considerations. The findings suggest that without clearer interpretative guidance and regulatory refinement, copyright law risks inadequately protecting both traditional cultural values and contemporary creative contributions. Accordingly, this study concludes that a more adaptive and coherent legal framework is required to balance communal rights and individual interests in the digital era. Future research should explore comparative legal models and develop context-sensitive approaches to governing cultural transformations in digital environments.

Abstract

Legal uncertainty surrounding hotel company acquisitions by foreign investors persists because corporate, investment, tourism, environmental, and land regulations remain fragmented and insufficiently coordinated. This study investigates the causes of regulatory inconsistency and proposes a harmonized legal framework capable of strengthening legal certainty while promoting sustainable tourism investment. A normative legal research design was employed using statutory, conceptual, and comparative approaches, supported by qualitative analysis of primary and secondary legal materials. The findings demonstrate that existing regulations primarily emphasize transactional legality and investment facilitation without adequately integrating sustainability principles into acquisition governance. As a result, overlapping authorities and disconnected legal provisions continue to weaken regulatory coherence and investor confidence. The principal novelty of this research lies in developing a harmonized regulatory model that integrates legal substance, institutional coordination, and legal culture throughout the pre-acquisition, approval, post-acquisition, and monitoring stages. This model offers a comprehensive governance framework that balances investment certainty with environmental protection, socio-cultural preservation, and sustainable tourism development. Future studies should empirically evaluate the implementation of this model across different jurisdictions and tourism destinations to assess its practical effectiveness. Overall, regulatory harmonization provides a strategic legal foundation for achieving coherent investment governance and sustainable tourism development.

Abstract

This study examines the enforcement of spatial planning law in regulating coastal setback utilization in Nusa Penida, Klungkung Regency, Bali, where rapid tourism development has intensified pressure on protected coastal zones. The research aims to assess the effectiveness of legal enforcement mechanisms in controlling coastal setbacks and to identify institutional and regulatory factors that hinder compliance. An empirical legal research design is adopted, integrating statutory, conceptual, and sociological approaches. Primary data were gathered through semi-structured interviews with local government officials and relevant stakeholders, while secondary data were obtained from legislation, regional spatial planning documents, and official records. Qualitative analysis was conducted by relating normative spatial planning provisions to observed enforcement practices in the study area. The findings indicate that coastal setback regulation has not been effectively implemented, largely due to the absence of detailed spatial planning instruments, limited supervisory capacity, and reliance on administrative discretion rather than clear technical standards. These conditions weaken legal certainty and constrain the consistent application of zoning rules and sanctions. The study concludes that the formulation of detailed spatial plans and the strengthening of enforcement mechanisms are critical to improving coastal setback governance and supporting sustainable coastal management in island tourism regions.

Abstract

The waste management issue in the Province of Bali led to the enactment of Governor Regulation of Bali Number 47 of 2019 concerning Source-Based Waste Management, which emphasizes waste segregation at the household level. This study aims to analyze the implementation of source-based waste segregation in Siangan Village, which has established a Reduce, Reuse, Recycle Waste Processing Facility (TPS3R), and to identify the inhibiting factors in its implementation. The research applies an empirical juridical method with statutory, conceptual, and socio-legal approaches. Data were collected through document studies and interviews with the Village Head, TPS3R management, and community members. The findings indicate that institutionally Siangan Village has provided adequate structural and infrastructural support, including the TPS3R facility, a scheduled collection system, and a legal basis through Village Regulation Number 7 of 2022. However, the effectiveness of implementation remains suboptimal due to systemic obstacles such as inconsistent supervision and limited human resources, as well as social constraints reflected in the lack of collective awareness and environmental legal culture. Therefore, optimizing implementation requires strengthening institutional governance and fostering sustainable community awareness.
