Abstract

The criminal act of terrorism is a serious crime and an extraordinary crime which has an adverse impact on the sovereignty of the state and the security of the citizens' livelihood. The responsibility of the state in protecting all citizens is an obligation mandated in the constitution (1945 Constitution). Law Number 5 of 2018 is a legal umbrella in carrying out law enforcement efforts, countermeasures and measures to prevent criminal acts of terrorism. The government plays an active role in taking strategic steps to tackle and prevent criminal acts of terrorism by revising Law no. 15 of 2003 became Law Number 5 of 2018, forming the Special Anti-Terror Special Detachment 88 Task Force, as well as the National Counterterrorism Agency (BNPT). The community also plays an active role in efforts to prevent criminal acts of terrorism by having high awareness of the law, increasing knowledge and awareness of the dangers of terrorism, so that they can carry out early detection of potential terrorism and report things that are considered suspicious in the surrounding environment to the authorities.

Abstract

Perjanjian internasional merupakan salah satu bentuk keterikatan Indonesia dalam ekosistem hukum internasional. Untuk mengimplementasikan suatu perjanjian internasional sebagai bagian dari hukum nasional, diperlukan proses ratifikasi yang menetapkan perjanjian tersebut sebagai Undang-Undang. Penelitian ini mengkaji model ratifikasi Perjanjian Indonesia-Singapura tentang Flight Information Region (FIR) Tahun 2022 dari perspektif ilmu perundang-undangan, serta mengevaluasi dampaknya dalam dimensi politik hukum dan teknis penerbangan. Pendekatan yang digunakan adalah penelitian yuridis normatif. Hasil penelitian menunjukkan bahwa, sesuai Pasal 10 juncto Pasal 11 Undang-Undang Nomor 24 Tahun 2000 tentang Perjanjian Internasional dan Undang-Undang Nomor 1 Tahun 2009 tentang Penerbangan, ratifikasi perjanjian ini harus dilakukan melalui Undang-Undang, bukan Peraturan Presiden.

Abstract

The philosophy of libraries serves as an essential conceptual foundation for the development and management of libraries as information institutions. This paper discusses the evolution of the library concept within the framework of Undang-Undang Nomor 43 Tahun 2007, as well as the core principles underlying library philosophy, such as open access, intellectual freedom, and information literacy. Through a historical approach and theoretical analysis, this paper identifies the role of libraries as agents of social change and cultural preservation, highlighting the challenges and future prospects in the digital age. The main findings indicate that modern libraries are not only centers for information storage but also collaborative learning and innovative spaces that facilitate social transformation. The conclusions emphasize the importance of maintaining the fundamental values of libraries, in accordance with the mandate of Undang-Undang Nomor 43 Tahun 2007, amidst technological advancements and societal dynamics.

Abstract

Technology itself is a human creation that was created with the aim of making it easier and helping humans in this case solve a fundamental problem in society. However, the development of technology is also not free from negative impacts. The birth of law to control air pollution resulting from the use of coal was clearly visible when the British government took steps to create "The Smoke Abatement Act". ecosystem. In international law itself, rules regarding the use of technology have been implemented, where this law was born out of human awareness of the magnitude of the impact of changes in the environment due to technology.

Abstract

Food and drug arrangement is scattered in several statutory regulations. As the community grows both nationally and internationally, the problems relating to the production, circulation and use of medicinal and food commodities continue to evolve. The country is obliged to safeguard and protect the people of Indonesia, one of which is guaranteed availability of medicines and food that is safe, quality and has benefits. Research Method: This research is a normative, prescriptive study. The research approach includes a regulatory approach of Act No. 36 year 2009 on health and conceptual. Findings: The results of the analysis of the philosophical, sociological and juridical aspects show that to tackle the illegal food and drug distribution needed by BPOM. Conclusion: Based on this, it is important to do the renewal of supervision and law enforcement arrangements on the distribution of drug and illegal food by BPOM through the revision or establishment of statutory regulations.

Abstract

The level of corruption crimes that are committed in today's society is growing from year to year, and it is accompanied by other types of criminal activity, such as the concealment of assets that result from corruption in other countries. In order to eradicate a variety of crimes that have a transnational character, particularly corruption, one of the actions that can be made is to take assets that have been developed due to corruption in other countries. This can be done through Mutual Legal Assistance. Regulations about MLA have been enacted due to the passage of Law Number 1 of 2006, which discusses providing mutual assistance in criminal matters. Mutual Legal Assistance is considered to be the first stage of law enforcement, particularly in the process of recovering state assets that have been stolen as a result of corruption crimes. As a result, cooperation with other nations is required, such as the cooperation between Indonesia and Australia, which aims to return state assets that have been stolen due to corruption crimes hidden in Australia.

Abstract

An essential principle of international law, Pacta Sunt Servanda asserts that all treaties are to be faithfully upheld by all governments. This research addresses the critical problem of how this fundamental principle can be effectively implemented in international criminal law enforcement, particularly given the persistent challenges of state compliance, jurisdictional limitations, and barriers to international cooperation. The research objectives are twofold: (1) to analyze the fundamental position of Pacta Sunt Servanda principles within the framework of international agreements, and (2) to examine the relationship between Pacta Sunt Servanda principles and the application of international criminal law. This study employs a qualitative normative juridical approach with comprehensive document analysis, examining landmark treaties including the 1948 Genocide Convention, the 1949 Geneva Conventions, and the 1998 Rome Statute. The results demonstrate that while Pacta Sunt Servanda serves as the cornerstone of international legal stability, its implementation faces significant obstacles, including state non-compliance, jurisdictional disputes, and political interference. The analysis reveals that successful enforcement requires robust institutional frameworks, as evidenced by cases from the International Criminal Court (ICC) and the International Criminal Tribunal for the Former Yugoslavia (ICTY). The principle's effectiveness varies considerably across different international criminal law contexts, with compliance rates influenced by political, economic, and sovereignty considerations. The implications of this research emphasize that addressing implementation challenges requires enhanced multilateral commitment and strengthened international cooperation mechanisms. The study concludes that while Pacta Sunt Servanda remains fundamental to international justice, ensuring justice for victims of international crimes demands systematic reforms in state compliance monitoring.

Abstract

This study aims to find out the "gap" and "solution" regarding Indonesian territorial law using a case study of the Sipadan-Ligitan dispute between Indonesia and Malaysia. This later became a lesson for Indonesia to revise the country's territorial law, which is the aim of this research. Using qualitative analysis research methods with literature studies, it was found that until the last law regarding territoriality, namely Law Number 43 of 2008, there was no map image of Indonesia's territory which could be strong evidence of how Indonesia's territory should be, coupled with evidence in In the field there is no strong evidence that Indonesia has managed the two islands in historical records. Thus, the urgency to revise Indonesia's territorial law is needed to prevent similar incidents such as the Sipadan-Ligitan dispute from happening again in the future. Due to the existence of strong legal facts coupled with a strong legal basis regarding territoriality it will be very helpful in resolving territorial disputes such as Sipadan-Ligitan, so that events do not repeat where they lost the argument that led to the International Court of Justice then winning Malaysia based on the principle of effectiveness through evidence of activity administered by Malaysia. Penelitian ini bertujuan untuk mengetahui “celah” dan “solusi” mengenai hukum kewilayahan Indonesia menggunakan studi kasus sengketa Sipadan-Ligitan antara Indonesia dengan Malaysia. Hal ini kemudian menjadi pelajaran berharga bagi Indonesia untuk melakukan revisi undang-undang wilayah negara, yang menjadi tujuan penelitian ini. Menggunakan metode penelitian analisis kualitatif dengan studi literatur, ditemukan bahwa hingga di dalam undang-undang terakhir mengenai kewilayahan yaitu Undang-Undang Nomor 43 Tahun 2008, tidak tercantum gambar peta wilayah Indonesia yang dapat menjadi bukti kuat bagaimana wilayah Indonesia yang seharusnya, ditambah dengan bukti di lapangan tidak terdapat suatu bukti yang kuat bahwa Indonesia telah mengelola kedua pulau tersebut dalam catatan historis. Urgensi untuk merevisi undang-undang wilayah negara Indonesia diperlukan untuk mencegah kejadian serupa seperti sengketa Sipadan-Ligitan terjadi lagi di masa depan. Adanya fakta hukum yang kuat ditambah dengan dasar hukum yang kuat mengenai kewilayahan akan sangat membantu dalam menyelesaikan sengketa wilayah seperti Sipadan-Ligitan, hingga jangan sampai terulang peristiwa dimana kalah dalam argumentasi yang menyebabkan International Court of Justice kemudian memenangkan Malaysia berdasarkan prinsip efektivitas melalui bukti kegiatan administratif yang dilakukan Malaysia.

Abstract

The purpose of this study is to find out cases of violations of genocide crimes against humanity committed by China against ethnic Uighurs and how the law enforcement of the 1998 Rome Statute against China as a non-state party. Human rights are inherently inseparable from the history of human life. Crimes against humanity committed by the state occurred in the Xinjiang region due to China's strike hard campaign policy against the ethnic Uighur community. However, China is not a ratifying country of the 1998 Rome Statute, which causes the International Criminal Court (ICC) to be unable to assert its jurisdiction. This research uses a normative juridical approach with an element of novelty in the form of an analysis of the application of the jurisdiction of the ICC to non-state parties. The result of the research is that there are other rules in the 1998 Rome Statute that allow the ICC  to have jurisdiction over non-state parties. The real challenge lies in law enforcement because China is a member of the UNSC which has the power to use the veto right which can cancel decisions, provisions, draft regulations and laws or resolutions. It is necessary to review the rules because it does not rule out the possibility that UNSC countries can commit similar crimes in the future. Tujuan penelitian ini untuk mengetahui kasus pelanggaran kejahatan kemanusiaan genosida yang dilakukan oleh Tiongkok terhadap etnis Uighur dan bagaimana penegakan hukum dari Statuta Roma 1998 terhadap Tiongkok sebagai negara non-state parties. Hak asasi manusia memiliki sifat inherent tidak dapat dipisahkan dari sejarah kehidupan manusia. Peristiwa kejahatan kemanusiaan yang dilakukan oleh negara terjadi di wilayah Xinjiang dari adanya kebijakan strike hard campaign yang dilakukan Tiongkok terhadap masyarakat etnis Uighur. Namun Tiongkok tidak termasuk negara peratifikasi Statuta Roma 1998 yang menyebabkan International Criminal Court (ICC) tidak dapat menyatakan yuridiksi nya. Penelitian ini menggunakan metode pendekatan yuridis normatif dengan unsur kebaharuan berupa analisa dari penerapan yuridiksi International criminal court (ICC) terhadap non-statets parties. Hasil dari penelitian terdapat aturan lain didalam Statuta Roma 1998 yang memungkinkan ICC memiliki yuridiksi terhadap non-state parties. Tantangan sesungguhnya terletak didalam penegakan hukum dikarenakan Tiongkok merupakan anggota DK-PBB yang memiliki power dalam penggunaan hak veto yang dapat membatalkan keputusan, ketetapan, rancangan peraturan dan undang-undang atau resolusi. Abstract

Penelitian ini bertujuan untuk mengidentifikasi dan mengklasifikasikan variasi argot dalam komunitas Stand Up Comedy Indonesia berdasarkan bentuk morfologis dan asal bahasanya. Data diperoleh dari berbagai platform media sosial komunitas Stand Up Indo, yang kemudian dianalisis menggunakan pendekatan deskriptif kualitatif. Hasil penelitian menunjukkan bahwa sebagian besar argot yang digunakan merupakan kata dasar yang berasal dari bahasa Inggris (KDA) sebanyak 20 item, dibandingkan dengan delapan kata dasar dari bahasa Indonesia (KDB). Selain itu, ditemukan enam kata turunan berbahasa Indonesia dan tiga kata turunan campuran. Dalam kategori frasa, terdapat 21 frasa argot berbahasa Inggris, dua frasa berbahasa Indonesia, dan dua frasa campuran. Sedangkan argot berbentuk klausa merupakan kategori yang paling sedikit ditemukan, yakni dua klausa campuran. Temuan ini menunjukkan dominasi leksikon bahasa Inggris dalam komunitas ini, seiring dengan pengaruh kuat budaya asal Stand Up Comedy yang berasal dari Amerika. Namun, munculnya bentuk-bentuk argot lokal dan campuran menunjukkan proses adaptasi linguistik dan hibriditas bahasa dalam ranah budaya populer urban di Indonesia. Kata kunci: argot, stand up comedy, komunitas
