Abstract

Penelitian ini guna memahami penerapan prinsip yurisdiksi universal negara terhadap kejahatan perompakan atau pembajakan yang terjadi di laut lepas menurut hukum internasional berdasarkan tinjauan yuridis. Metode Penelitian yang digunakan dalam penelitian ini adalah metode yuridis normatif dan sumber data utama yang digunakan dalam penelitian ini adalah data sekunder. Penerapan prinsip yurisdiksi universal negara terhadap kejahatan perompakan atau piracy atau pembajakan menurut hukum internasional mulai dilakukan sejak awal abad ke-17. Penghukuman terhadap pembajakan di laut secara universal dan telah ditentukan oleh hukum internasional. Penerapan prinsip yurisdiksi universal untuk mengadili para perompak sebagai salah satu kewenangan setiap negara  ini telah diberikan oleh UNCLOS 1982. Implementasi atau penerapan prinsip yurisdiksi universal oleh negara Indonesia terhadap terjadinya kejahatan perompakan atau pembajakan atau piracy di laut lepas maupun di luar wilayah negara Indonesia telah diatur dalam Pasal 4 Kitab Undang-Undang Hukum Pidana atau KUHP yang kemudian dijabarkan lagi pada Pasal 438, Pasal 444 hingga Pasal 446 KUHP.Kata Kunci : Laut Lepas; Perompakan; Yurisdiksi Universal

Abstract

The level of corruption crimes that are committed in today's society is growing from year to year, and it is accompanied by other types of criminal activity, such as the concealment of assets that result from corruption in other countries. In order to eradicate a variety of crimes that have a transnational character, particularly corruption, one of the actions that can be made is to take assets that have been developed due to corruption in other countries. This can be done through Mutual Legal Assistance. Regulations about MLA have been enacted due to the passage of Law Number 1 of 2006, which discusses providing mutual assistance in criminal matters. Mutual Legal Assistance is considered to be the first stage of law enforcement, particularly in the process of recovering state assets that have been stolen as a result of corruption crimes. As a result, cooperation with other nations is required, such as the cooperation between Indonesia and Australia, which aims to return state assets that have been stolen due to corruption crimes hidden in Australia.

Abstract

Kejahatan sebagai fenomena sosial tidak hanya dilakukan oleh orang dewasa tetapi juga anak-anak. Upaya pencegahan diperlukan sebagai langkah preventif terjadinya kejahatan terutama kejahatan yang diatur dan diancam dengan pidana. Pencegahan ini dapat dilakukan di sekolah melalui pendidikan moral politik. Pendidikan moral politik memberi pemahaman anak mengenai kedudukannya sebagai warga negara yang terikat dengan hak dan kewajiban, termasuk hukuman atau sanksi pidana yang dapat dikenakan terhadapnya apabila anak berperilaku menyimpang dan melanggar hukum. Penelitian ini mambahas apa saja pidana yang dapat dikenakan terhadap anak dan upaya pencegahan yang dapat dilakukan melalui pengajaran di sekolah menengah.

Abstract

Tujuan penelitian ini adalah untuk (1) Mengetahui bentuk pilihan kata, kohesi dan koherensi serta unsur gramatikal yang muncul dalam wacana iklan operator seluler (AS vs XL). (2) Mengetahui makna kontekstual yang terdapat dalam pilihan kata. Sumber Data penelitian ini adalah Rekaman dan Informan. Teknik pengumpulan data adalah Teknik rekam, Teknik simak dan catat. Validitas data menggunakan teknik triangulasi. Yaitu: triangulasi teori, triangulasi data. Teknik Analisis menggunakan metode content analysis. Adapun penjelasannya sebagai berikut: Reduksi data, Penyajian data, yaitu mengelompokkan data yang sejenis. Terdapat makna kontekstual yang terkandung dalam pilihan kata wacana iklan berbahasa Indonesia dalam iklan operator seluler (XL vs Kartu AS), dan setiap bahasa yang disampaikan dalam slogan operator selular. Bahasa iklan meniru dari kompetitor yang mengunggulkan tarif telefon murah, yaitu XL. Operator XL sebelumnya menggunakan “Beneran murahnya. Nelpon Rp 25/menit dari menit pertama”. Koherensi antarkalimat dapat ditemui dalam wacana iklan ini. Kalimat-kalimat disajikan secara berurutan dan bertalian satu sama lain. Begitu pula bahasa yang disampaikan dalam iklan operator AS bahasa yang disajikan juga sangat persuasive.

Abstract

This research is motivated by cases of sexual violence in children have a serious impact on children, both directly and long-term. One form of legal protection for children to overcome sexual violence against children, the Government issued Perppu No. 1 of 2016 which was passed into UU No. 17 of 2016. This study aims to find out how the view of human rights in Indonesia and Islamic criminal law regarding chemical castration as an effort to overcome sexual violence in children. This research uses library research method using descriptive analysis approach. The result of this study is in human rights The implementation of chemical castration is an act of violence and is considered contrary to the 1945 Constitution, namely in Article 28 G paragraph 2 and Article 33 paragraph 1 of UU No. 39 of 1999 concerning Human Rights. Meanwhile, Islamic criminal law basically does not recognize castration. The punishment of chemical castration is ta'zir. This study concludes that from the perpetrator's side, this criminal conviction is clearly not in accordance with human rights. From the side of the child as a victim, of course, this chemical castration crime can be an appropriate crime. In Islamic penal law, chemical castration can be imposed if rape committed by the perpetrator is included in an act close to adultery.

Abstract

The development of information technology, especially the internet, has affected criminal law. One of the resulting impacts is the qualification of goods in the cyber era. The development of criminal law in the Netherlands, particularly the Criminal Code, related to information technology is progressive regarding the qualification of goods, including cases related to the interpretation of goods in cyberspace by the Supreme Court of the Netherlands. This article argues that Dutch criminal law has repeatedly extended the qualification of the meaning of goods related to cybercrime through the jurisprudence of the Supreme Court of the Netherlands. The expansion of the qualification of goods in Dutch criminal law contextually includes account balances, online gaming features, and credit. Indonesian jurisprudence has once expanded the scope of goods in deciding account balance cases. The extension of the qualification of goods, including computer data in the National Criminal Code, based on problematic decisions of the Arnhem High Court in the Netherlands, is contradictory to the spirit of national criminal law reform. Abstract

The government is trying to reform national law in the field of criminal law by drafting a Criminal Code Bill (RUU KUHP) to replace Wetboek van Strafrecht. The culmination of this preparation was the promulgation of the Criminal Code Bill on January 2, 2023, through Law No. 1 of 2023 concerning the Criminal Code (KUHP). However, there are not many articles that discuss the process and critical analysis of living law formulation as stated in the provisions of Article 2 of the Criminal Code and their explanations. The research method used was legal research with statute, historical, comparative legal, and conceptual approaches. The results of this research conclude that the living laws are formulated inconsistently in terms of scientific substance. In order to make this formulation can realize justice based on Pancasila, it can be achieved in several ways. First, there is a need to reinterpret living legal concepts by involving experts in customary law, legal anthropology, legal sociology, and interdisciplinary legal researchers. Second, redefining the meaning of law that lives within the body of the Criminal Code is not limited to customary law, especially the principle of legality, but also includes customary law and traditional laws in traditional societies. Third, formulating formal law/criminal procedural law as the enforcer of material criminal law/National Criminal Code by re-establishing and recognizing customary courts in the Indonesian criminal justice system whose application in society is to realize the fifth principle of social justice for all Indonesian people from Pancasila.

Abstract

This research was carried out with the aim of describing several things, namely (1) describing and explaining language errors from the use of capital letters in writing Reader's Letters in the 2023 edition of Hidayatullah Magazine, (2) describing and explaining language errors in writing words in Reader's Letters in the Magazine Hidayatullah 2023 edition, (3) describes and explains language errors in the use of punctuation marks in the Reader's Letter in the 2023 edition of Hidayatullah Magazine. This research uses a qualitative descriptive research design. The data for this research is in the form of Reader Letters in the 2023 edition of Suara Hidayatullah magazine. The method in this research is the observation method. This data was collected through observation. The data collection technique used was reading and note-taking. In collecting data, the researcher read the Reader's Letter and then observed language errors according to the spelling level, especially errors in the use of capital letters, errors in writing words, and errors in the use of punctuation marks. To maintain the validity of the data, data triangulation activities were carried out. Data analysis activities start from the data review stage, data identification and classification stage, and data evaluation stage.

Abstract

Desalinasi adalah proses penting untuk menghasilkan air tawar dari air asin. Mekanisme alat yang akan mengubah air asin menjadi air minum dapat dimanfaatkan untuk kebutuhan sehari-hari. Dengan menggunakan panci berukuran 20 cm sebagai tangki penampung air laut kompor listrik rice cooker sebagai pemanasnya. Tujuan dari penelitian ini adalah untuk mengetahui perbandingan distribusi suhu hasil simulasi dengan hasil eksperimen pada perpindahan panas volume air hot tank, dengan menggunakan metode simulasi Computational Fluid Dynamics (CFD) perangkat lunak Ansys Fluent digunakan untuk mensimulasikan distribusi panas hot tank dan metode eskperimen untuk memvalidasi hasil simulasi pada suhu air laut di dalam hot tank, yang merupakan komponen utama sistem desalinasi. Pada metode simulasi menunjukkan bahwa distribusi panas pada hot tank berkisar 356,15 Kelvin dalam waktu 1000 detik. Sedangkan untuk distribusi suhu pada air laut dengan volume 0,5 liter mencapai titik didih dalam waktu 760 detik, dan volume 0,75 liter membutuhkan waktu 950 detik. Hasil simulasi ini sejalan dengan hasil eksperimen, yang menunjukkan distribusi suhu pada air laut membutuhkan waktu titik didih sebesar 744 detik untuk volume 0,5 liter dan 978 detik untuk volume 0,75 liter. Dengan demikian, metode CFD Ansys terbukti efektif dalam memprediksi temperatur dan waktu yang diperlukan untuk mendidihkan air laut serta dalam merancang sistem pemanasan yang lebih efisien.

Abstract

There needs to be a realignment of arrangements regarding corporate criminal liability which concerns regulation of when a corporation is said to have committed a crime, who within the corporation can be held accountable and the provision of appropriate sanctions for corporations that commit crimes, so that there is alignment of rules that have an impact on achieving legal objectives. Based on this background, this study uses two problem formulations, the first is how to regulate corporate criminal responsibility in economic crimes and how to reform the law on corporate criminal responsibility in economic crimes in Indonesia? This research method uses a normative method that departs from differences in criminal liability arrangements for corporations that commit criminal acts under Indonesian law which will result in weak law enforcement against corporate crimes. The results of this study are first, Corporate Responsibility has been regulated in several laws and regulations in Indonesia, but each law and regulation that regulates corporate crime in terms of scope, definition and subject matter varies, therefore there is a need codification and harmonization. provisions regarding corporate crime in order to create legal certainty.
