Abstract

Pemerintah daerah merupakan perpanjangan tangan dari pemerintah pusat untuk menjalankan rodal pemerintahan guna mencapai tujuan bernegara. Dalaml mewujudkan pemerintahan daerah yangl efektif dan harmonis diperlukan peraturan daerah yang sejalan dengan substansil materi, hak asasi manusia, kepentingan umum dan tidak bertentangan dengan peraturan lain diatasnya. Terdapat bentuk hubungan komunikasi, konsultasi,klarifikasi Raperdal yang diterapkanl antara instansi Pemerintah dengan aparat didaerah yang selama ini masih kurang efektif, selainl itu optimalisasi yang miniml dari peran Gubernur dan Anggota Dewan dalam membinal dan mengawasi penyelenggaraan pemerintahan kabupaten/kota adalah salahl satu faktor yang menjadikan Perda tidak memiliki substansi yang jelas dan sesuai dengan kemanfaatannya. Disharmonisasi antarapemerintah pusat dan pemerintah daerah juga merupakan faktor penting di mana langkah pembinaan yangl dilakukan olehl instansi pusat kepada aparatur pemerintah daerahl dalam penyusunan Perda masihl dikatakan belum optimal danl merata sertal tidak adanya kerangka acuan yang jelasl bagi daerah mengenai tatal laksana harmonisasi Raperda sebagail salah satul instrumen pentingl dalam rangkal menjaga harmonisasi Perda denganlPeraturan lainnya. UU No.12 Tahunl 2011 telah memiliki rambul-rambu yang mengarahkan padal pentingnya harmonisasil PUU termasukl Perda. Abstract

The use of narcotics, psychotropic substances and other addictive substances has a huge impact if misused. However, on the other hand, these substances can provide benefits for the development of science and the treatment of disease if used according to the instructions of the authorities. Therefore, this scientific legal work discusses two main things: first, how the legal regulations relate to intermediaries in the sale and purchase of class I non-plant narcotics according to positive law, and second, how to apply criminal law to these perpetrators. This research uses a normative method with a statutory approach. Eradicating narcotics faces very complex obstacles, ranging from internal and external factors of perpetrators to the involvement of law enforcement officers in abuse. As a solution, the government needs to optimize the role of society to increase supervision and legal awareness, revise narcotics laws, and tighten supervision of the morality of law enforcement officers.

Abstract

The application of restorative justice in resolving minor crimes is increasingly receiving attention in Indonesia as a more humane alternative to the traditional criminal justice system. Resolving minor crimes using a restorative justice approach can be carried out if the conditions are met, such as the perpetrator admitting his actions and showing deep regret, and the victim or his family is willing to forgive. Apart from that, the community also supports deliberation, especially if the act is classified as a minor crime. If these conditions are met, law enforcement officials such as the police can use a restorative justice approach through mediation during the investigation process. The research method used is qualitative with a normative approach where the purpose of this research is to create balance in society. The use of traditional institutions in various regions also greatly supports the implementation of restorative justice, because this model is considered to be in accordance with the values of justice that have long been recognized and implemented in Indonesian society. Thus, restorative justice can be a more inclusive and just solution in resolving minor crimes in Indonesia.

Abstract

Law No. 8 of 1999 on Consumer Protection (UUPK) regulates consumer protection in Indonesia. This study aims to analyze the legal protection provided to consumers who suffer losses from purchasing products with fake barcodes, which can confuse consumers regarding regulations related to E-commerce transactions. Online business operators are required to ensure the authenticity, quality, and safety of products. The primary focus of this research is how consumers who incur losses from purchasing products with fake barcodes are legally protected. According to the Consumer Protection Law (UUPK), consumers are entitled to receive goods that match the information promised by the business operator and are entitled to compensation for any loss incurred. Consumers may suffer both material and immaterial losses, such as damaged goods, financial loss, and health risks. Additionally, business operators involved in barcode forgery may face administrative and criminal sanctions. Therefore, the UUPK provides a firm legal foundation to protect consumers' rights in cases involving products with fake barcodes.

Abstract

Legal accountability in corruption crimes is a legal consequence or liability that must be borne by the perpetrators of corruption crimes due to the losses they have caused. In the context of Indonesian law, corruption crimes are clearly regulated in Law Number 31 of 1999 concerning Corruption Crimes as amended by Law Number 20 of 2001 on the Eradication of Corruption Crimes (UU PTPK). In this writing, the author focuses on the forms of criminal liability in corruption crimes and acts against the law within corruption crimes, particularly in the case study of decision number 44/Pid.Sus-TPK/2024/PN Mdn. This study emphasizes a normative legal research method with a descriptive approach, where the research results aim to further examine the judicial considerations in deciding a case, particularly corruption cases.

Abstract

A substitute notary is a temporary official appointed to perform the duties of a primary notary during their absence, such as during leave or illness. Under Law No. 2 of 2014 concerning the Notary Office, a substitute notary holds the authority to create authentic deeds and manage protocols, similar to a primary notary. However, exceeding this authority poses significant legal risks, potentially invalidating deeds and leading to serious legal consequences. This study examines the legal responsibilities of substitute notaries in ensuring the validity of deeds they produce, emphasizing the importance of adhering to their defined authority and professional ethical standards. It aims to analyze the implications of substitute notaries exceeding their authority in drafting deeds, particularly in terms of deed validity and legal accountability. Furthermore, the research highlights the necessity of limiting substitute notary authority and implementing strict supervision to uphold the integrity of notarial practices. Using a normative legal method (juridical-normative), the study analyzes laws and regulations through a literature review and qualitative analysis of primary, secondary, and tertiary legal sources. The findings reveal that the legal liability of substitute notaries for deeds made beyond their authority encompasses civil, criminal, and administrative aspects. Such actions can render deeds invalid and cause harm to the parties involved. This research contributes to the field by providing a comprehensive understanding of the legal and ethical boundaries that substitute notaries must respect, offering insights for policymakers to enhance regulatory frameworks and supervision mechanisms. It also serves as a reference for legal practitioners and scholars to identify preventive measures and solutions to mitigate the risks associated with notarial misconduct.

Abstract

Road transportation plays a strategic role in supporting national logistics but often faces challenges related to the loss of goods during transit. This study aims to examine the legal liability of carriers under Law Number 22 of 2009 on Road Traffic and Transportation (UU LLAJ) and evaluate legal mechanisms available for service users in resolving disputes over lost goods. The study focuses on the application of civil liability principles and the obstacles encountered in practice.This research employs a normative juridical approach, utilizing secondary data from legislation, legal documents, and scholarly literature. The analysis reveals that Article 193 of UU LLAJ stipulates the carrier's obligation to compensate for lost goods, except in cases of  force majeure or third-party negligence. However, practical challenges include difficulties in proving carrier negligence and ambiguities in the extent of legal liability, leading to legal uncertainty for service users.The study recommends strengthening regulations to clarify carrier responsibilities, optimizing dispute resolution mechanisms through the Consumer Dispute Resolution Agency (BPSK), and increasing legal awareness among business operators and consumers. These findings are expected to contribute to the development of a safer, more efficient, and reliable transportation system in Indonesia.

Abstract

This study aims to analyze the legal position of the Special Envoy of the President in the field of fostering young people and art workers based on the perspective of Indonesian constitutional law. The existence of the position of Special Envoy of the President in the Indonesian constitutional structure, especially in the context of empowering the younger generation and strengthening the creative industry, raises juridical questions regarding its legal basis, authority, and accountability. Using a normative juridical legal research method with a statutory approach, this research examines Presidential Decree Number 76/M of 2024 which regulates the appointment of special envoys of the President in the 2024-2029 period, as well as the relevance of these regulations within the framework of Indonesian constitutional law. The results show that although the special envoy of the President has a strategic role in supporting the development of young talents and the creative industry sector, the position lacks a clear and specific legal basis, which can lead to problems in terms of accountability and transparency. Therefore, this study recommends the need for the drafting of firmer regulations regarding the position, duties, and authority of special envoys, as well as strengthening supervision and coordination mechanisms with relevant ministries or institutions. This is expected to increase the effectiveness and contribution of special envoys to the progress of the Indonesian nation, especially in the development of the creative economy.

Abstract

Corporate human trafficking crimes represent a serious issue involving human rights violations in Indonesia and other countries. Although Indonesia has regulated this crime through Law No. 21 of 2007 on the Eradication of Human Trafficking (PTPPO), the enforcement of laws against human trafficking still faces significant challenges. This study aims to analyze the legal responsibility of corporations as subjects of law in human trafficking crimes and to understand the mechanisms of penalization against corporations involved in such crimes. The research method used is normative juridical with a literature study approach, gathering data from primary sources such as regulations and secondary sources including books, journals, and relevant literature. Data analysis is conducted deductively, beginning with fundamental legal principles applied to the phenomenon of human trafficking crimes. The study's findings show that corporations can be held collectively criminally liable if the crime is committed by their members acting on behalf of and in the interest of the corporation. The PTPPO law expands legal accountability for corporations to ensure more effective prevention and deliver justice for victims. Penalties that can be imposed on corporations include fines, imprisonment, and other social sanctions, focusing on direct, indirect, and leadership responsibilities. This study concludes that the implementation of criminal liability against corporations aims to encourage ethical corporate behavior, protect human rights, and strengthen global efforts to combat human trafficking.
