Abstract

A correctional institution is the final institution for the implementation of criminal justice which provides guidance to people who have committed a crime with the aim of changing the bad behavior of prisoners so that they can be accepted again in the midst of society outside and trying to protect prisoners from committing crimes again. In carrying out rehabilitation for criminals who are in prison, prisoners will have their rights fulfilled in accordance with the law that regulates them. Apart from that, they also have obligations that must be carried out while carrying out their prison term. However, there are many obstacles that make the process of coaching criminals less than optimal in its implementation, for example the lack of officers and experts, obstacles to infrastructure, and obstacles from the community and obstacles that come from the prisoners themselves who often put up resistance to the guard officers. So it is still often found that prisoners repeat crimes again because correctional institutions are not optimal in providing guidance.

Abstract

The criminal justice process in Indonesia plays a crucial role in law enforcement, with the Public Prosecutor (JPU) acting as the key actor in prosecuting criminal offenders. This study aims to examine the functions and responsibilities of the JPU at the Binjai District Attorney's Office, as well as the challenges they face in the criminal justice process. Using a normative legal research approach, the analysis focuses on the role of the JPU from the investigation phase to the implementation of verdicts, along with challenges such as limited human resources, budget constraints, societal pressures, and legal complexities. The findings of this study indicate that although the JPU carries significant responsibility in ensuring justice, these challenges may hinder the effectiveness of their duties. This research recommends the development of technology-based training programs, enhanced inter-agency cooperation, and the implementation of management information systems to support the performance of the JPU. It is hoped that these measures will help the JPU at the Binjai District Attorney's Office perform their duties more effectively, thus fostering a fair and transparent judicial system.

Abstract

This study discusses the role of immigration in efforts to prevent the Crime of Human Trafficking (TPPO) in Indonesia, considering the increasingly complex human trafficking networks involving cross-border movement. The background of this study is based on the high number of TPPO cases in Indonesia, which requires comprehensive action from various parties, including immigration as the frontline in border control. This study uses a normative legal research method, with a qualitative approach through literature studies, laws and regulations, and other secondary data to understand the role of immigration in preventing TPPO. The results of the study indicate that the Directorate General of Immigration plays an important role in identifying and preventing human trafficking practices through several main steps: border control, travel document checks, TPPO mode detection, and international cooperation. In addition, immigration is also involved in educating the public and prospective migrant workers about the dangers of TPPO and providing protection for victims who are found. The conclusion of this study emphasizes that although the role of immigration is very significant, efforts to prevent TPPO require cross-institutional collaboration and capacity building in various lines to achieve higher effectiveness in overcoming human trafficking.

Abstract

Increasing violence against children causes public dissatisfaction. Moreover, the crimes were committed by those closest to him. In this case, resolving this problem requires a restorative justice approach that reconciles family relationships between parties. The aim of this research is to determine the legal aspects of the restorative justice approach to acts of sexual abuse committed by minors against minors and the restorative justice approach to acts of sexual abuse committed by minors against minors. The aim of this research is to determine the restorative justice approach to acts of sexual abuse against minors committed by minors. The research method used by the author is qualitative. The conclusion drawn is the first. The restorative justice approach carried out by the Attorney General's Office of the Republic of Indonesia and the Indonesian District Court judiciary towards criminal acts of sexual abuse against minors committed by minors aims to support the families of victims and minors. perpetrator's family to provide family counseling. Second, the legal perspective of the restorative justice approach adopted by law enforcement officers is consistent with the values of social norms that apply in society. Because basically family values teach us to forgive each other.

Abstract

Immigration is related to the traffic of people entering or leaving Indonesian territory and its supervision to maintain state sovereignty. Immigration functions include providing immigration services, law enforcement, and maintaining the security and comfort of the country, while contributing to the development of community welfare. With the increase in crimes involving fake identities or misuse of other people's identities, immigration must be stricter in checking travel documents used by Indonesian citizens and foreign nationals when entering and leaving Indonesian territory. Therefore, immigration introduced a new passport design and implemented the use of electronic passports. The research method used in this research is a descriptive qualitative method. The research results show that changes in passport design can increase state sovereignty and security, because the new design is difficult to imitate. This can be seen from the materials used in making the new passports as well as the designs that highlight elements of Indonesian culture. Applying for an electronic passport does require higher costs than a regular passport, but offers advantages that conventional passports do not have, including a better level of security. Using an electronic passport also makes it easier for the holder to undergo immigration service administration because this passport uses a biometric system that only needs to be scanned.

Abstract

In Indonesia's correctional system, correctional institutions play a vital role, particularly in educating offenders, including juvenile offenders. Juvenile offenders are individuals under 17 years of age or those who do not yet possess an ID card, commonly referred to as children. Since children are in their developmental stage and are vulnerable to environmental influences that may worsen their psychosocial condition, rehabilitation often poses significant challenges for them. Therefore, correctional institutions are responsible for providing training that encompasses rehabilitation, social reintegration, and punishment. In this context, the rehabilitation process aims to fulfill the rights of children in correctional facilities, including access to formal and non-formal education, life skills training, and psychological counseling. The objective of this training is to equip children with the necessary skills to reintegrate into society after serving their sentence. Moreover, correctional institutions also play a role in fostering a sense of responsibility and self-esteem in juvenile offenders, enabling them to become active and positive members of society. The purpose of this study is to examine how correctional institutions contribute to the rehabilitation of juvenile offenders and the challenges faced in implementing rehabilitation programs that align with children's rights. The research findings reveal that, despite efforts by correctional institutions to implement various rehabilitation programs, such as education, skills training, and psychological counseling, there is still much to be improved.

Abstract

Murder is an inhumane criminal act and can be considered a heinous act, as it takes another person's life, whether done instantly or with prior planning. In the investigation process of a murder case, a specific procedure is required to uncover the incident, namely an autopsy. An autopsy is the examination of a deceased body, deemed to have died unnaturally, by performing surgical procedures to determine the cause of death, estimate the time of death, identify unidentified bodies, uncover the perpetrator, and more. The findings from the autopsy are compiled into a written report prepared by a forensic doctor, known as visum et repertum. Before drafting the visum et repertum, the forensic doctor takes an oath to ensure that the contents of the report can be held accountable. This report will later be used in court as evidence to support other evidence related to the murder.

Abstract

The purpose of writing this journal is to understand the role of immigration regarding those who misuse residence permits in Indonesia as a permanent visit location. In this case, it can be understood that such misuse of residence permits is not allowed by the immigration authorities because it can be detrimental to the country. Therefore, the role of immigration includes the task of supervising foreign nationals (WNA) who visit. In this regard, immigration can play an important role by having very strict regulations so that mistakes or disturbances cannot occur in the area. Strict actions can be taken against those who cause disturbances in accordance with the established regulations.

Abstract

This research examines the strengthening of the position of the Honorary Council of Election Organisers (DKPP) in the Indonesian constitutional system, focusing on the enforcement of the code of ethics after the 2024 elections. Through normative research methods and literature studies, the research found that DKPP has worked quite effectively so far and needs to be developed and maintained. DKPP has proven to be an independent institution with final and binding decisions, having an equal position with the KPU and Bawaslu in the system of checks and balances. The study reveals the urgency of transforming DKPP into an Election Court, which requires the 5th amendment of the 1945 Constitution to include DKPP in the judicial power according to article 24. Despite facing institutional, regulatory and operational challenges, the study concludes that strengthening DKPP requires a comprehensive approach and multi-stakeholder support to realise more effective and sustainable code of ethics enforcement in the Indonesian constitutional system.Keywords: DKPP, Election Code of Ethics,Constitutional System, Election Court, Election Organiser, 1945 Constitutional Amendmentio.

Abstract

Harmonisasi peraturan daerah merupakan proses yang penting untuk memastikan bahwa peraturan lokal tidak bertentangan dengan kebijakan dan peraturan nasional. Fokus penelitian ini adalah peran Kantor Wilayah Kementerian Hukum dan HAM Sumatera Utara dalam harmonisasi Peraturan Daerah Kota Gunung Sitoli Nomor 12 Tahun 2012 tentang Rencana Tata Ruang Wilayah (RTRW). Penelitian ini menyelidiki dokumen melalui pendekatan kualitatif deskriptif untuk memberikan gambaran mendalam tentang proses harmonisasi, masalah yang dihadapi, dan dampak dari pelaksanaan kebijakan. Hasil penelitian menunjukkan bahwa Kantor Wilayah Kemenkumham Sumatera Utara memainkan peran kunci dalam memastikan keselarasan Perda RTRW dengan peraturan nasional. Proses harmonisasi melibatkan tinjauan substansi dan teknis, penyusunan rekomendasi, serta koordinasi antara pemerintah daerah dan instansi terkait. Namun, penelitian juga mengidentifikasi berbagai kendala seperti keterbatasan sumber daya dan perbedaan interpretasi teknis yang mempengaruhi efektivitas harmonisasi. Evaluasi efektivitas menunjukkan bahwa proses harmonisasi berhasil meningkatkan kesesuaian Perda RTRW dengan kebijakan nasional, meskipun beberapa penyesuaian minor diperlukan. Dampak positif dari harmonisasi ini termasuk peningkatan koordinasi antara instansi pemerintah dan dasar hukum yang lebih kuat untuk pelaksanaan RTRW. Rekomendasi dari penelitian ini mencakup perbaikan dalam proses harmonisasi dan penyesuaian kebijakan untuk mengatasi tantangan implementasi yang diidentifikasi. Penelitian ini diharapkan dapat meningkatkan pemahaman mekanisme harmonisasi peraturan serta meningkatkan efektivitas kebijakan tata ruang di Kota Gunung Sitoli melalui peran strategis Kantor Wilayah Kemenkumham.
