Abstract

Intellectual property rights violations are increasingly common in the digital age, resulting from the growth of digital content media. Low public awareness about the risks of access to illegal content is a major factor in intellectual property violations such as data theft, online trading of counterfeit goods. To solve this problem, the government and the general public must proactively increase law enforcement and educate the public on the importance of respecting intellectual property rights. The way digital technology protects intellectual property rights (IPR), has changed due to easier distribution and access to content on online platforms. Copyright infringement is on the rise, making current laws more difficult to enforce. This research aims to identify how the development of digital technology impacts copyright protection and to find the main problems faced by the Ministry of Law in enforcing the law against copyright infringement in the digital world. This research uses the normative juridical method, by analyzing legislation and conducting a literature review. The results of the analysis show that although digital technology provides people with new opportunities to build and spread work, it also poses problems for supervision and enforcement. To protect copyright in the digital age, the government and society need to take strategic actions to strengthen the legal framework and improve law enforcement capabilities to protect copyright. This is due to regulations that have not fully adjusted to the rapid changes in the digital world, as well as low public awareness of the importance of copyright protection.

Abstract

This study analyzes juridically the appointment of Acting Regional Heads in regional head elections (Pilkada) held simultaneously in 2024 and its implications for the principles of democracy in Indonesia. In the context of simultaneous regional elections, the vacancy of the position of regional head caused by the term of office that ends before the implementation of the elections is filled by the Acting Regional Head based on the provisions of Article 201 paragraph (9), (10), and (11) of Law Number 10 of 2016 governing Regional Head Elections. Acting Heads are appointed from among officials with Middle high-leadership positions in the Governor, and Primary high-leadership in the Regent or Mayor. This research uses a normative juridical method with a doctrinal approach, namely analyzing relevant legislation, jurisprudence, and the views of legal experts. The analysis shows that the appointment of Acting Regional Head is a strategic policy needed to maintain the continuity of regional government. However, the appointment mechanism that is fully determined by the central government without community involvement has various implications for democratic principles, such as reduced public participation, reduced accountability of the process of filling positions, and the absence of direct accountability to the people. The implications of the results of the analysis and studies in this research can be input and consideration for policy makers to improve the legal framework governing the appointment of Acting heads, so as to strengthen democratic principles and maintain political and government stability at the provincial, district or city level.

Abstract

Electronic cigarettes are a development of traditional cigarettes that have switched to electronic form, although their safety is still a question. This research aims to analyze consumer protection for e-cigarettes that do not include information labels and health warnings on their packaging, and to evaluate the regulations governing health information on e-cigarettes in Indonesia. The data in this research was collected through library and field research methods. Literary research was carried out to obtain secondary data by studying various literature and relevant laws and regulations. The research methods used include a normative juridical approach, namely positive legal studies related to existing problems, as well as empirical juridical, which focuses on researching real conditions in society to identify and collect the necessary facts and data. The research results show that sellers who do not include the dangers of cigarettes to the body and e-cigarette liquids. This practice causes losses to consumers and also violates the provisions contained in Law Number 8 of 1999 concerning Consumer Protection and Government Regulation Number 109 of 2012 which regulates the safety of addictive substances in tobacco products.

Abstract

Pemerintah daerah merupakan perpanjangan tangan dari pemerintah pusat untuk menjalankan roda pemerintahan guna mencapai tujuan bernegara. Dalam mewujudkan pemerintahan daerah yang efektif dan harmonis diperlukan peraturan daerah yang sejalan dengan substansi materi, hak asasi manusia, kepentingan umum, dan tidak bertentangan dengan peraturan lain di atasnya. Terdapat bentuk hubungan komunikasi, konsultasi, dan klarifikasi Raperda yang diterapkan antara instansi pemerintah dengan aparat di daerah yang selama ini masih kurang efektif. Selain itu, optimalisasi yang minim dari peran Gubernur dan Anggota Dewan dalam membina dan mengawasi penyelenggaraan pemerintahan kabupaten/kota adalah salah satu faktor yang menjadikan Perda tidak memiliki substansi yang jelas dan sesuai dengan kemanfaatannya. Disharmonisasi antara pemerintah pusat dan pemerintah daerah juga merupakan faktor penting di mana langkah pembinaan yang dilakukan oleh instansi pusat kepada aparatur pemerintah daerah dalam penyusunan Perda masih dikatakan belum optimal dan merata serta tidak adanya kerangka acuan yang jelas bagi daerah mengenai tata laksana harmonisasi Raperda sebagai salah satu instrumen penting dalam rangka menjaga harmonisasi Perda dengan peraturan lainnya. UU No.12 Tahun 2011 telah memiliki rambu-rambu yang mengarahkan pada pentingnya harmonisasi PUU termasuk Perda.

Abstract

Increasing violence against children causes public dissatisfaction. Moreover, the crimes were committed by those closest to him. In this case, resolving this problem requires a restorative justice approach that reconciles family relationships between parties. The aim of this research is to determine the legal aspects of the restorative justice approach to acts of sexual abuse committed by minors against minors and the restorative justice approach to acts of sexual abuse committed by minors against minors. The aim of this research is to determine the restorative justice approach to acts of sexual abuse against minors committed by minors. The research method used by the author is qualitative. The conclusion drawn is the first. The restorative justice approach carried out by the Attorney General's Office of the Republic of Indonesia and the Indonesian District Court judiciary towards criminal acts of sexual abuse against minors committed by minors aims to support the families of victims and minors. perpetrator's family to provide family counseling. Second, the legal perspective of the restorative justice approach adopted by law enforcement officers is consistent with the values of social norms that apply in society. Because basically family values teach us to forgive each other.

Abstract

This article discusses legal protection in land sale and purchase agreements in Pangkalan Mansyur conducted informally (underhand) and without certificates. Legal protection is provided through agreement clauses and statutory provisions such as the Civil Code and the Basic Agrarian Law (UUPA). This article highlights the importance of land certificates as legal evidence of legal ownership and the legal risks that arise in transactions without certificates, including land disputes. A normative juridical approach evaluates how legal regulations protect parties in such transactions. In conclusion, land without certificates presents legal challenges, and legal protection must ensure fairness and legal certainty for all parties involved. Educational efforts and ease of land titling are also proposed to reduce the potential for future disputes.

Abstract

The responsibility of fathers for child maintenance in divorce is a crucial issue in family law in Indonesia, regulated by the Civil Code (KUHPerdata) and Law Number 1 of 1974 concerning Marriage. This journal aims to analyze the legal obligation of fathers in providing maintenance to children after divorce, as well as factors that affect their fulfillment. This study uses a normative juridical method with an analytical approach to relevant legal provisions and case studies from court decisions. The results of the study show that fathers have the responsibility to meet the basic needs of children, including food, clothing, shelter, and education, until the child reaches adulthood or can be independent. Despite clear legal provisions, in practice, many fathers do not fulfill their obligations for various reasons, such as difficult economic conditions and a lack of understanding of legal responsibility. The court has an important role in enforcing this maintenance obligation through a fair judgment and in accordance with the father's ability. The study also found that communication between ex-spouses and support from legal institutions is essential to ensure that children's rights are met. It is hoped that the results of this study can be a reference for policymakers and legal practitioners in an effort to improve the protection of children's rights after divorce.

Abstract

Law grows from community traditions which develop into customary law, providing the basis for justice and law enforcement in society. The aim of the law is to create peaceful and fair interactions, and to achieve this it must be respected and obeyed, which requires public awareness and involvement in law enforcement. Community legal awareness means understanding, obeying and complying with the law. In North Sumatra, the Ministry of Law and Human Rights plays an important role in fostering legal awareness through the "North Sumatra Thinking Concept: Awareness of Law and Human Rights." This concept begins with the formation of a Legally Aware Family (Kadarkum), which aims to increase the community's understanding and compliance with legal norms. Kadarkum is also supported by the Legal Awareness Village (DHS) initiative, which helps foster a legally aware society.

Abstract

Intellectual Property Rights (IPR) is a form of ownership of the results of individual thoughts and creativity that must be legally protected. Although various laws exist to protect IPR, such as the Law on Copyright, Patents, and Trademarks, adequate protection can only be realized if IPR is registered. The Ministry of Law and Human Rights (KemenKumHam) plays an important role in protecting IPR through the Directorate General of Intellectual Property Rights (DJKI) and the Regional Office of the Ministry of Law and Human Rights in each province. This study uses a normative juridical approach to examine the role of the Ministry of Law and Human Rights in protecting IPR, including guidance to the community, receipt of registration applications, implementation of law enforcement, communal intellectual property inventory, and socialization to increase public understanding of IPR. The study results show that the Regional Office of the Ministry of Law and Human Rights has a strategic function in increasing public awareness and understanding and providing the necessary legal protection for IPR owners in Indonesia. More intensive efforts in socialization and education to the public, especially for Micro, Small, and Medium Enterprises (MSMEs), are urgently needed to encourage IPR registration and prevent intellectual property violations.

Abstract

This study discusses the role of the Regional Office of the Ministry of Law and Human Rights (Kemkumham) in the supervision of notaries in Indonesia, which is regulated by Law number of notaries reaching 19 109 people, the Ministry of Law and Human Rights is committed to improving the quality of legal services through continuous coaching and supervision. The Notary Supervisory Council is a supervisory institution that ensures notaries carry out their duties through regulations and codes of ethics. This research also highlights the importance of establishing a Notary Legal Problem Investigation Team to handle public complaints efficiently. Through strict supervision, it is hoped that the professionalism of notaries can be maintained to provide optimal legal protection for people who use notary services.
