Abstract

The formulation of effective and equitable public policies is one of the important aspects in ensuring the achievement of good governance objectives. In this context, the role of legal analysts in the Regional Office of the Ministry of Law and Human Rights (Kanwil Kemenkumham) has great significance. Legal analysts are responsible for ensuring that policies are not only in accordance with applicable legal norms, but are also fair, provide legal certainty, and respect human rights. Their main tasks include reviewing existing laws and regulations, identifying the potential legal impacts of proposed policies, and providing recommendations for policy improvements where necessary. In addition, legal analysts also play an important role in analyzing the possibility of legal uncertainty or regulatory conflicts that could harm society. Nevertheless, legal analysts are faced with various challenges, such as the complexity of overlapping regulations, rapid changes in social and political dynamics, and the need to accommodate different interests. Therefore, to improve policy effectiveness, capacity building and collaboration between various parties involved in policy-making are required, as well as continuous evaluation of policy implementation. Thus, the success of public policy is highly dependent on the ability of legal analysts to maintain a balance between compliance with the law and the fulfillment of community needs in a fair and responsive manner.

Abstract

This study addresses the legal responsibility of carriers for the loss or damage of goods during road transportation, as stipulated in Law Number 22 of 2009 concerning Traffic and Road Transportation (UU LLAJ). Article 193 of UU LLAJ obliges carriers to provide compensation for any loss incurred during transportation, except in cases of force majeure or third-party negligence. The study also explores the application of breach of contract (wanprestasi) and strict liability principles as the legal foundation for carrier accountability. However, the practical implementation of these regulations often faces challenges, including unclear contractual clauses on liability, difficulties in proving carrier negligence, and slow or inefficient dispute resolution mechanisms. To address these issues, the study proposes strategic measures such as regulatory revisions to clarify carrier liability boundaries, the establishment of standardized transportation contracts, enhanced legal education for stakeholders, strengthened non-litigation mechanisms like mediation and the Consumer Dispute Resolution Agency (BPSK), and the optimization of insurance to mitigate risks. These recommendations aim to foster a more efficient, reliable, and legally protective transportation system for all stakeholders involved.

Abstract

Corrections is one of the subsystems in criminal justice in Indonesia which carries out legal implementation in the field of treatment of prisoners, inmates and children. Corrections function in providing services, guidance, social guidance, care, security and supervision for inmates, without exception. This function is carried out based on the regulations that have been regulated in the statutory provisions. When inmates are placed in correctional institutions, they tend to experience changes in mental health caused by stress and depression as well as feelings of loneliness experienced by inmates. Therefore, correctional institutions have a role in restoring the mental health experienced by inmates. In carrying out its role, correctional institutions also experience obstacles which of course can have an impact on the implementation of the role of correctional institutions. This research uses deep research methods with descriptive qualitative methods. The results of the research that has been conducted show that correctional institutions have a role in restoring the mental health experienced by inmates. This can be seen from the programs carried out by correctional institutions to support the recovery of the mental health of inmates, although there are several obstacles, correctional institutions are still trying to carry out their role.

Abstract

Pengharmonisasian suatu peraturan berkaitan erat dengan hirarki dalam system perundang-undangan di Indonesia. Proses ini penting untuk menghindari ketidakserasian antara peraturan yang memiliki tingkat yang berbeda serta untuk menyelaraskan peraturan-peraturan yang setingkat tetapi tidak harmonis. Ketidakharmonisan suatu peraturan dapat mengakibatkan bertentangannya peraturan terhadap satu sama lain maupun terhadap peraturan yang lebih tinggi. Penelitian ini akan membahas mengenai peran perancang perundang-undangan kantor wilayah kemenkumham sumatera utara dalam mengharmonisasikan Rancangan Peraturan Daerah (Raperda) di Provinsi Sumatera Utara. Selain itu, penelitian ini juga akan menyoroti peran Pemerintah Daerah beserta badan legislatif daerah (DPRD) selaku instansi yang menyelenggarakan pemerintahan di daerah dalam mewujudkan kepastian hukum melalui pembentukan peraturan daerah.

Abstract

Land issues in Indonesia are an important issue that affects people’s lives, especially in the context of infrastrcture development. This study aims to analyze the form of compensation for the recovation of land rights for toll read construction and legal remedies that can be taken by land owners if compensation is not paid. The research method used is normative juridical with a qualitative approach, referring to the applicable laws and regulations, especially Lae No. 2 of 2012 and UUPA No. 5 of 1960. The results of the study show that the land acqusition proscess involves the stages of invertaarization, value determination, deliberation, compensation, and release of land rights. Compensation can be in the form of money, replacement land, resettlement, or shares. In the event of disagreement, the landowner has the right to file an objection to the District  Court and proceed to the Supreme Court if dissatisfied with the decision. This study emphaisizes the importance of legal protection for landowner in the process of land acquisition for the public interest.

Abstract

Life insurance is an agreement that binds the insurer and the insured to provide protection against risks that may occur, such as death. This study discussthe procedure for claiming life insurance and legal protection for consumers, especially heirs, in the context of Supreme Court Decision No. 241 PK/Pdt/2011. In the case, the claim filed by the heirs was rejected by PT. Sequis Life Insurance for reason that are considered invalid. This writing uses the normative juridical resaerch method, which is research conducted by researching literature and legal materials thar require secondary data as the main data. The study highlights the importance of a systematic claim procedure, which includes the collection of documents and the stages that must be followed. In addition, consumer legal protection is regulated in the Consumer Protection Act, which supports the rights of policyholders. The conclusion of the study shows that the rejection of claims that do not meet legal obligations can be detrimental to consumers, anf insurance companies must be in good faith and comply with applicable regulations to protect customer rights.

Abstract

To reduce differences between laws and regulations, the Regional Office of the Ministry of Law and Human Rights must be involved in the creation of regional regulations, both in terms of content and harmonization efforts. The extent to which the role of the Regional Office in the context of harmonization and factors is a research issue. Obstacles and how to build a consistent pattern of cooperation with the regional government sector. The research findings show that the Regional Office has actually participated in harmonization. However, there has been no significant participation in the creation of regional legislative initiatives. This is due to several things, including the problem of sectoral egos of the regional government, lack of infrastructure, and lack of support from the regional office. To ensure that the existence of legislative designers is recognized and considered, the regional office must be able to persuade the regional government directly. Based on the research findings, it can be concluded that the regional office plays an important role in carrying out the function of facilitating the creation of regional legal products, starting with the stages of plaining, preparation, and announcement of regional regulations.

Abstract

E-commerce has become one of the biggest innovations in the modern world of commerce. With the advancement of technology, e-commerce has brought about significant changes in the way business is conducted, allowing consumers to make purchases and transactions online. Although e-commerce offers many benefits, the debate on the pros and cons of e-commerce continues. This paper examines the pros and cons of e-commerce and the role of the Ministry of Law and Human Rights in these electronic transactions. On the pros side, e-commerce allows wider accessibility for consumers, allowing them to make purchases anytime and anywhere. It also provides an opportunity for small and medium-sized businesses to market their products without having to rely on a physical location. On the other hand, there are pros and cons related to the security of online transactions and consumer protection, as well as the impact of e-commerce on brick-and-mortar stores and the environment. This study highlights the fact that e-commerce poses complex pros and cons, the Ministry of Law and Human Rights provides assistance in addressing issues related to this and the many aspects that need to be considered. With this study, it is hoped that we can better understand the implications of e-commerce in everyday life, and find ways to maximize its benefits while minimizing its risks.

Abstract

Undang-Undang Nomor 5 Tahun 1960 tentang Peraturan Dasar Pokok-Pokok Agraria (UUPA) memuat peraturan yang berkaitan dengan kepemilikan tanah. Pasal 20 UUPA mengatur peralihan kepemilikan tanah kepada pihak ketiga melalui beberapa cara, termasuk pewarisan. Karena UUPA pada dasarnya mengatur bahwa hanya warga negara Indonesia yang dapat memiliki hak milik, posisi ini menjadi bermasalah jika salah satu ahli warisnya adalah orang asing yang memiliki warisan berupa tanah hak milik. Dalam konteks ini, penelitian ini berfokus pada peraturan perundang-undangan di Indonesia yang berkaitan dengan WNA yang mewarisi hak milik dan hak kepemilikannya. Dengan melihat norma-norma hukum dan teori-teori hukum, pendekatan penelitian kepustakaan hukum normatif digunakan untuk membahas hal ini. Menurut temuan jurnal tersebut, orang asing masih dapat mewarisi properti dari ahli waris warga negara Indonesia. Namun, dalam waktu satu tahun setelah pewaris mengubah kewarganegaraan mereka dan menjadi WNA, mereka harus mengalihkan haknya ke WNI lain, yang kemudian dapat mengajukan permohonan ke Badan Pertanahan Nasional untuk mengubah tanah warisan mereka menjadi hak pakai.

Abstract

Intellectual property rights violations are increasingly common in the digital age, resulting from the growth of digital content media. Low public awareness about the risks of access to illegal content is a major factor in intellectual property violations such as data theft, online trading of counterfeit goods. To solve this problem, the government and the general public must proactively increase law enforcement and educate the public on the importance of respecting intellectual property rights. The way digital technology protects intellectual property rights (IPR), has changed due to easier distribution and access to content on online platforms. Copyright infringement is on the rise, making current laws more difficult to enforce. This research aims to identify how the development of digital technology impacts copyright protection and to find the main problems faced by the Ministry of Law in enforcing the law against copyright infringement in the digital world. This research uses the normative juridical method, by analyzing legislation and conducting a literature review. The results of the analysis show that although digital technology provides people with new opportunities to build and spread work, it also poses problems for supervision and enforcement. To protect copyright in the digital age, the government and society need to take strategic actions to strengthen the legal framework and improve law enforcement capabilities to protect copyright. This is due to regulations that have not fully adjusted to the rapid changes in the digital world, as well as low public awareness of the importance of copyright protection.
