Abstract

The Republic of Indonesia recognizes and upholds human rights and basic human obligations. Rights that are inherent and cannot be separated from humans. It must be protected, respected and upheld for the sake of increasing human dignity, welfare, happiness, intelligence and justice. For this reason, the researcher raised the title Effectiveness of Handling Alleged Human Rights Violations at the Office of the Ministry of Law and Human Rights in North Sumatra. Handling of alleged human rights violations is carried out for every act carried out by a person or group, whether intentionally or unintentionally or by negligence which is unlawful. With the increasing number of alleged human rights violations, the North Sumatra Regional Office of the Ministry of Law and Human Rights provides policies related to public services in order to provide needs in accordance with statutory regulations for every citizen. The Sumatra Utara Regional Ministry of Law and Human Rights Office provides quality operational and handling services.

Abstract

Dinamika kebutuhan ketatanegaraan Republik Indonesia, khususnya setelah reformasi,mengalami perkembangan yang cukup pesat. Sejalan dengan hal tersebut, telah dilakukanperubahan demi perubahan terhadap sejumlah ketentuan dalam UUD 1945. Proses perubahanyang dilakukan terhadap UUD 1945 sebagai hukum dasar tertulis bagi Indonesia patutdimaknai sebagai upaya penyempurnaan aturan dasar kehidupan kenegaraan di tanah air.Namun demikian, dikaji dari substansi yang terkandung dalam UUD NRI Tahun 1945, modelpengaturan yang dilakukan justru berpotensi menghilangkan atau setidaknya mengurangihakikat UUD NRI Tahun 1945 itu sendiri sebagai hukum dasar tertulis. UUD NRI Tahun1945 sebagai hukum dasar tertulis pada hakikatnya hanya memuat aturan dasar atau pokokkehidupan kenegaraan, sedangkan aturan yang lebih rinci lazimnya dituangkan lebih lanjutdalam bentuk peraturan perundang-undangan di bawahnya. Namun faktanya, substansi yangterkandung dalam UUD NRI Tahun 1945, khususnya terkait Hak Asasi Manusia sudah sangatdetail serta hampir tidak lagi mencerminkan sebagai sebuah dokumen tertulis yang mengaturhal-hal pokok atau fundamental dan sangat mendasar mengenai kehidupan berbangsa danbernegara. Oleh sebab itu, sejumlah ketentuan dalam UUD NRI Tahun 1945 perlu dikaji ulangmenuju model pengaturan yang lebih mencerminkan hakikat pokoknya sebagai hukum dasartertulis, hukum yang memuat aturan dasar, pokok dan fundamental kehidupan berbangsa danbernegara.

Abstract

Era Society 5.0 menghadirkan tantangan dan peluang baru dalam pengelolaan kekayaan intelektual (KI) melalui pemanfaatan teknologi kecerdasan buatan (Artificial Intelligence/AI). Penelitian ini bertujuan untuk menganalisis bagaimana AI dapat membantu proses pengelolaan KI, dalam konteks digitalisasi yang semakin kompleks. Dengan menggunakan metode studi literatur, penelitian ini mengkaji berbagai sumber seperti jurnal ilmiah, buku, dan dokumen hukum untuk memahami peran AI dalam mendukung efisiensi dan efektivitas pengelolaan KI. Hasil kajian menunjukkan bahwa AI mampu mempercepat proses perlindungan KI dengan memanfaatkan algoritma cerdas untuk mengidentifikasi karya-karya yang mirip atau berpotensi melanggar hak eksklusif pencipta. Dalam aspek penegakan hukum, AI dapat digunakan untuk memantau aktivitas daring guna mencegah penyebaran produk ilegal yang melanggar hak cipta. Namun, penelitian ini juga menemukan tantangan signifikan, seperti risiko bias data yang dapat memengaruhi keadilan keputusan AI serta potensi pelanggaran privasi dalam pengumpulan data pelatihan. Penelitian ini menekankan pentingnya regulasi yang adaptif untuk mengakomodasi perkembangan teknologi AI dalam pengelolaan KI di era Society 5.0

Abstract

Adopting the authority of judicial review in the context of testing laws against the Constitution carried out by the Constitutional Court should be welcomed as positive progress for institutionalizing the authority of judicial review itself. In its implementation so far, the authority of judicial review has received serious attention, as evidenced by the number of laws submitted for review in the Constitutional Court. To streamline the authority to review regulations by the Constitutional Court, it is necessary to adopt a model of judicial preview authority, namely testing draft laws, so that when they are passed, they are no longer legally problematic. This research is normative juridical research using various literature materials as the main study. The results show that the idea of adopting the authority of judicial preview is urgently needed. It is based on the consideration that so many laws are problematic both in terms of content and formation process. On the other hand, the authority of the Constitutional Court is only limited to the authority of judicial review, making it less appropriate in the context of the efficiency of judicial review of laws. Given the urgency of the application of judicial preview authority by the Constitutional Court, it is necessary to consider efforts to amend the 1945 Constitution by adding the phrase “testing draft laws against the Constitution” in the article governing the authority of the Constitutional Court as practiced in other countries such as France.

Abstract

This normative legal research examines the constitutional guarantee of implementing the principle of independence by the Prosecutor’s Office of the Republic of Indonesia as an institution implementing state power in law enforcement. A previous study by Kindangen (2021) also discusses the independence of the Prosecutor’s Office, but from the perspective of prosecutorial authority. Unlike this previous study, this study examines the independence of the Prosecutor’s Office as an implementing agent of state power, particularly from the perspective of trias politica. In contrast, the previous study emphasised the Prosecutor’s Office. For foreign readers, this study provides a description and reference regarding the position of the Prosecutor’s Office of the Republic of Indonesia, which can be used for organising an independent Prosecutor’s Office in other countries. The study results show that although the Prosecutor’s Office is categorised as an implementing agent of state power in the legal field with the principle of independence, its existence is not explicitly regulated in the Constitution. Ideally, the provision of the principle of independence to the Prosecutor’s Office must be balanced with constitutional guarantees so that it is not easily intervened in by any institution, especially the executive or legislative bodies. Therefore, the position of the Prosecutor’s Office should also be used as part of the material content of the Constitution.

Abstract

Efforts to eradicate corruption have not been fully effective, especially after the implementation of regional autonomy, where corruption cases have increased significantly. This paper examines the key factors driving corruption in decentralized governance, particularly in Indonesia, and evaluates the effectiveness of legal policies implemented by the government. Using a normative juridical research approach with a descriptive-analytical method, this study identifies three major contributors to corruption under regional autonomy: excessive authority without adequate oversight, high political costs, and self-serving governance among regional officials. Despite the establishment of various anti-corruption regulations, the enforcement mechanisms remain inconsistent and ineffective. The paper argues that the success of anti-corruption policies requires not only legal reforms but also institutional commitment, ethical governance, and structural enforcement mechanisms. Legal politics should be directed toward strengthening monitoring systems, improving governance capacity, and ensuring strict legal enforcement to create a deterrent effect.

Abstract

A substitute notary is a temporary official appointed to perform the duties of a primary notary during their absence, such as during leave or illness. Under Law No. 2 of 2014 concerning the Notary Office, a substitute notary holds the authority to create authentic deeds and manage protocols, similar to a primary notary. However, exceeding this authority poses significant legal risks, potentially invalidating deeds and leading to serious legal consequences. This study examines the legal responsibilities of substitute notaries in ensuring the validity of deeds they produce, emphasizing the importance of adhering to their defined authority and professional ethical standards. It aims to analyze the implications of substitute notaries exceeding their authority in drafting deeds, particularly in terms of deed validity and legal accountability. Furthermore, the research highlights the necessity of limiting substitute notary authority and implementing strict supervision to uphold the integrity of notarial practices. Using a normative legal method (juridical-normative), the study analyzes laws and regulations through a literature review and qualitative analysis of primary, secondary, and tertiary legal sources. The findings reveal that the legal liability of substitute notaries for deeds made beyond their authority encompasses civil, criminal, and administrative aspects. Such actions can render deeds invalid and cause harm to the parties involved. This research contributes to the field by providing a comprehensive understanding of the legal and ethical boundaries that substitute notaries must respect, offering insights for policymakers to enhance regulatory frameworks and supervision mechanisms. It also serves as a reference for legal practitioners and scholars to identify preventive measures and solutions to mitigate the risks associated with notarial misconduct.

Abstract

Based on the results of the discussion above, it can be concluded that Law Number 32 of 2009 concerning Environmental Protection and Management is related to the Job Creation Law, namely Law Number 11 of 2020 concerning Job Creation where the Law has a positive impact on almost all existing laws and policies, because with the enactment of the Job Creation Law. Corporate legal responsibility for environmental pollution is regulated in Law Number 32 of 2009 concerning Environmental Protection and Management. In this framework, the active involvement of the government and the community plays an important role in the process of supervision and law enforcement against companies proven to have polluted. This research aims to enrich understanding of the extent to which the application of environmental law in Indonesia is effective, as well as to examine the potential for strengthening synergies between the government and society in realizing a healthy and sustainable environment. Corporate responsibility is not only limited to financial aspects, but also includes social and environmental dimensions. Therefore, companies are required to comply with applicable legal provisions and take concrete steps to prevent and reduce the negative impact of their business activities on the environment.

Abstract

This writing aims to delve into the legal responsibility in breach of contract disputes. Breach of contract refers to the inability of an individual or a party to fulfill obligations based on a prior agreement. In a breach of contract case, legal responsibility is an obligation imposed on a party as a form of accountability for the violation committed. This study also focuses on the basis of assessment used by law enforcers, namely the panel of judges, in deciding a breach of contract dispute involving the Department of Trade, which failed to fulfill its obligations to a contract worker in the construction of the Dakopamean Public Market, based on Decision Number 7/Pdt.G/2022/PN Tli, and the form of legal responsibility of the Department of Trade for the breach of contract in the construction project of the Dakopamean Public Market. This writing also emphasizes a normative legal research method of a descriptive nature, in which the results of the study will further examine the judges’ considerations in deciding a case, particularly in breach of contract matters.

Abstract

This paper examines the legal aspects of the use of standard digital contracts with respect to the protection of users' personal data and the control of their use. This research takes a normative approach. Standard terms are not prohibited, but the inclusion of exculpatory clauses is prohibited under Article 18 of the Consumer Protection Act. Digital practices recognize standard digital contracts related to personal data. Article 20 of the Personal Data Protection Law requires a valid legal basis for the processing of personal data. The legal basis is set out in a digital contract between the personal data controller and the personal data subject. The standard contract must contain all the things required by the Personal Data Protection Act. The personal data subject has the right to obtain information about the clarity of identity, the basis of legal interests, the purpose of requesting and using the personal data and the responsibility of the party requesting the personal data. Supervision of the use of digital standard agreements is carried out by the BPSK and the OJK after the digital standard agreements have been implemented by business entities. This form of supervision is less effective in maintaining the balance of the parties.
