Abstract

Fenomena microtrend dalam industri fashion telah mendorong terjadinya fenomena knock-off, yaitu peniruan desain secara masif tanpa izin. Penelitian ini bertujuan menganalisis urgensi perlindungan hukum desain fashion di Indonesia serta membandingkannya dengan sistem di UK . Metode yang digunakan Adalah penelitian yuridis normatif dengan pendekatan  perundang-undangan dan komparatif. Hasil penelitian menunjukkan regulasi di Indonesia masih terbatas pada Undang-Undang Desain Industri dan Hak Cipta yang belum adaptif terhadap tren yang berkembang cepat. Proses pendaftaran yang Panjang, syarat kebaharuan absolut, serta ketiadaan proses perlindungan otomatis menimbulkan celah hukum bagi praktik knock-off. Sebaliknya, UK lebih responsif melalui Unregistered Design Right dan Supplementary Unregistered Design memberikan perlindungan otomatis hingga tiga tahun, sesuai karakteristik tren mode yang berumur pendek. Oleh karena itu, Indonesia perlu mengadopsi perlindungan pada desain tak terdaftar, menyederhanakan prosedur, serta memperkuat kesadaran dan penegakan hukum. Kata Kunci: desain fashion, microtrend, knock-off, kekayaan intelektual. ABSTRACT The Microtrend phenomenon in the fashion industry has accelerated knock-off practices, such as unauthorized imitation of designs, particularly harming unregistered works. This study aims to analyze the urgency of legal protection for fashion designs in Indonesia and compare it with the UK system. The research applies a normative juridical method using statutory and comparative approaches. Research shows that Indonesia’s regulation is limited to the Industrial Design Law and Copyright Law, which are not fully adaptive to fast-changing trends. Lengthy registration processes, the requirement of absolute novelty, and the absence of automatic protection create loopholes for knock-off practices. In contrast, the UK provides a more responsive system through the Unregistered Design Right and Supplementary Unregistered Design, granting automatic protection for up to three years, which is suitable for short-lived fashion trends. Thus, Indonesia should reform its regulations by adopting unregistered protection, simplifying registration procedures, and strengthening awareness and enforcement. Abstract

Coup de grâce is a practice that has been deeply ingrained throughout military history. Although this practice has been prohibited by various conventions, violations still occur because of differences in views between soldiers and legal scholars. The purpose of this study is to analyze and examine the practice of euthanasia or coup de grâce that occurs on the battlefield during armed conflict, based on the principle of humanity from the perspective of International Humanitarian Law. This study employs the normative legal research method with statute and conceptual approaches. The result of this study shows that coup de grâce cannot be justified in the eyes of International Humanitarian Law even with the knowledge that it is done based on mercy towards an excessively injured combatant, remembering the principle of humanity and differentiation as the basis of International Humanitarian Law. Therefore, coup de grâce  can be classified without a doubt as a war crime.
