Abstract

Komitmen Pemerintah dalam memberikan perlindungan terhadap Pekerja Migran Indonesia (PMI) salah satunya melalui program jaminan sosial. Program Jaminan Sosial mulai diterapkan di Indonesia sejak tahun 2004 dengan berlakunya UU No 40 Tahun 2004 tentang Sistem Jaminan Sosial Nasional. Pada tahun 2018, diterbitkan peraturan yang khusus mengatur jaminan sosial untuk para pekerja migran Indonesia yaitu Peraturan Menteri Ketenagakerjaan No 18 Tahun 2018 tentang Jaminan Sosial Pekerja Migran Indonesia. Dalam pelaksanaannya, Permenaker tersebut belum menjawab kesenjangan antara kebutuhan dan layanan yang PMI dapatkan. Permasalahan terbesar adalah mengenai tata kelola dalam implementasi jaminan sosial pekerja migran Indonesia. Pada Februari 2023 terbitlah Peraturan Menteri Ketenagakerjaan Nomor 4 Tahun 2023 sebagai pengganti atas Permenaker Nomor 18 Tahun 2018 tentang Jaminan Sosial Pekerja Migran Indonesia. Permenaker No 4 Tahun 2023 ini diyakini lebih komprehensif dalam memberikan perlindungan kepada Pekerja Migran Indonesia mulai dari sebelum, selama, hingga setelah bekerja. Jurnal ini akan memaparkan penerapan Peraturan Menteri Ketenagakerjaan Nomor 4 Tahun 2023 terhadap perlindungan jaminan sosial Pekerja Migran Indonesia.

Abstract

Citizenship is an obligation to recognize, protect, and fulfill human rights for a state governed by the Rule of Law. The government has a responsibility outlined in the principles or principles or general principles of good governance (Algemene beginselen van behoorlijk bestuur) to serve the public (public service) of the people as Indonesian citizens. The government has obligations set out in the Law—Citizenship Law to consider regarding not repatriating and revoking the Citizenship of ex-ISIS Indonesian citizens. Government policy, in this case, is fundamental because every policy that is decided must be under existing regulations and the principles of Good Governance so that the government can protect ex-ISIS Indonesian citizens in fulfilling their citizenship rights. The problem in writing this Law is how the government's participation (in this case, the application of the principles of Good Governance) in protecting Indonesian citizens of ex-ISIS and what factors cause ex-ISIS to lose their Citizenship under applicable regulations in Indonesia. This research employs a normative research approach with a literature study. The analysis technique uses descriptive qualitative analysis with primary legal materials of statutory rules, secondary legal materials of scientific books, journals, articles, and tertiary legal materials. The conclusion is that the protection of ex-ISIS under Law Number 12 of 2006 concerning Citizenship and government participation in Law Number 30 of 2014 concerning Government Administration.

Abstract

According to the perspective of Islamic economic law, the realization of SDGs in Indonesia can be achieved through the halal industry in the form of halal MSMEs which may affect the achievement of SDGs, especially the first, second and third goals, namely, eliminating poverty which can be realized through halal SMEs, reducing hunger with halal products, and good health and welfare based on halal and tayyib principles that is also profit oriented and community oriented which can reach more people. This article discusses the legal perspective of micro and small enterprises (MSMEs) as a supporting system for the halal industry in fulfilling sustainable development goals in Indonesia.This study is a normative legal study, that is legal research conducted by examining secondary legal materials or library materials.Micro, small and medium enterprises (MSMEs) as a support system for the halal industry in fulfilling sustainable development goals in Indonesia are clearly very important. One of the achievements in the SDGs in the economic sector is welfare and equity. The success of the equitable distribution of certified MSE products in Indonesia will help improve the visibility of halal products, making it easier for consumers to find. This will have an impact on the Indonesian economy, especially in influencing GDP growth from the halal product consumption sector. MSMEs can help realize the SDGs goals. Collaboration between MSMEs and various institutions in the halal industry is very important for the development of MSMEs in Indonesia. Perspektif hukum ekonomi Islam berpendapat bahwa industri halal, yang terdiri dari UMKM halal, dapat membantu mencapai SDGs di Indonesia, terutama tujuan kesatu, kedua, dan ketiga, yaitu menghapus kemiskinan yang dapat dicapai melalui UMKM halal, mengurangi kelaparan dengan produk halal, dan memberikan kesehatan dan kesejahteraan yang baik dan thoyyib yang berbasis halal dan thoyyib. Selain itu, industri halal harus berorientasi pada keuntungan dan berorientasi sosial sehingga dapat menghasilkan industri yang menguntungkan Artikel ini akan membahas bagaimana hukum usaha mikro dan kecil (UMK) berfungsi sebagai sistem yang mendukung industri halal dalam mencapai tujuan pembangunan berkelanjutan di Indonesia.Penelitian hukum normatif, yang meneliti bahan hukum sekunder atau pustaka, adalah jenis penelitian yang digunakan. Usaha mikro, kecil dan menengah (UMKM) adalah sistem pendukung industri halal dalam pemenuhan sustainable development goals di Indonesia yang sangat krusial. Kesejahteraan dan pemerataan kesejahteraan adalah salah satu tujuan dari SDGs. Berhasilnya sertifikasi produk UMK secara merata di Indonesia akan membantu memeratakan produk halal, membuatnya lebih mudah diakses oleh pelanggan. Hal ini akan berdampak pada ekonomi Indonesia terutama dalam hal jumlah uang yang dihasilkan oleh industri yang memasarkan produk halal. Tujuan SDG dapat diwujudkan oleh UMKM. Untuk mengembangkan UMKM di Indonesia, kolaborasi antar kelembagaan dalam industri halal sangat penting.

Abstract

Victims and perpetrators of crime still experience different treatment in Indonesia. These differences are expressed in statutory regulations and national law enforcement practices. The same is true for victims of terrorism. Attention to suspects or perpetrators of terrorism is much greater than to victims. Moreover, in many cases of terrorism, the perpetrator and victim do not know each other. The rights of victims internationally are written down in various international legal products. There are two large groups of victims' rights: procedural and service rights. This article discusses the procedural rights of victims of terrorism, specifically in the aspect of fulfilling and protecting victims' impact statements. The research approach is qualitative, and data collection is carried out by reviewing literature and studying legislation by comparing the fulfillment and protection of the rights of victims' impact statements in other countries. The findings from this research are that the rights of victims of terrorism regarding victim impact statements have not been specifically regulated in Indonesian law. This is reflected in the trial process and in the words of surviving victims of terrorism. Then, the suggestion from these findings is that the need for justice for victims and their families related to procedural rights, specifically the right to victims' impact statements, needs to be regulated explicitly in Indonesian law and applied in everyday criminal justice practice.

Abstract

The entire responsibility for all children in Indonesia lies with the government, and it extends to all children in Indonesia, not only those who are Indonesian nationals but also includes children who are refugees from foreign countries. One of the fundamental rights regulated by the laws and the Convention on the Rights of the Child ratified by Indonesia is the right to receive appropriate education (formal, non-formal, and informal education). This research aims to analyze the implementation of formal education fulfillment for refugee children in Batam City, especially those accommodated at Hotel Kolekta. Therefore, the research questions are as follows: 1) How effective is the fulfillment of the right to formal education for refugee children in Batam City? 2) What challenges do refugee children in Batam City face in obtaining the right to formal education? 3) What are the solutions for the fulfillment of the right to formal education for refugee children in Batam City? This research utilizes the empirical legal research method with a sociological approach, and it is analyzed qualitatively using the Effectiveness of Law Theory by Soerjono Soekanto as an analytical tool. The research findings indicate that the five factors in the theory are not yet effective due to legal factors related to specific technical implementation regulations for the fulfillment of the right to formal education for refugee children being absent. The ineffectiveness of law enforcement is due to the weak coordination among relevant parties, especially the Education Agency of Batam City, UNHCR, IOM, and schools in Batam. The facility factor is also ineffective due to the limited facilities in enhancing the Indonesian language skills of refugee children, resulting in a low interest in attending school and continuing formal education (Community Factor). Different cultures influence the social interaction of refugee children with the community of Batam City (Cultural Factor), causing a slow improvement in Indonesian language proficiency, which is the language of instruction in formal education in Batam City.

Abstract

Indonesia is a Muslim-majority country that requires the state’s ability to protect Muslim populations’ religious practices. Muslims are obliged to eat halal food and beverages. Muslims may now easily purchase halal goods because of Law Number 8 of 1999 and Law Number 33 of 2014, which guarantees the authenticity of halal products. Muslims make up a sizable and potentially influential market segment, making this legislation even more crucial. The Law Number 6 of 2023 on Job Creation has revised many laws, including the Law Number 33 of 2014. Nevertheless, this rule was short-lived. Micro and small enterprises may get free halal certification with a business statement under the previous regulations. This free certification aims to let Muslim customers get halal items faster and more efficiently. This study aims to determine the impact on the field with the enactment of Law Number 6 of 2023 on implementing halal certification for micro and small businesses to protect Muslim consumers. This study used secondary data and employed normative legal methodologies. It reveals that halal certificates are defined differently in different regulations. The inconsistent definitions affect micro and small businesses' halal certification and halal certificates’ validity period. Customers' trust in small stores and other small enterprises may rise or fall indefinitely, depending on the prospect of validity.

Abstract

The main issues raised are 1.) How is gambling regulated in Islamic law? 2.) How do maisir/gambling regulations compare in the Aceh Qanun and national law? This research uses a type of normative legal research which is descriptive analytical in nature using secondary data obtained through literature study and the data is processed qualitatively using deductive logical conclusions. The author's conclusion is that 1.) The regulation of gambling or Maisir in Islamic law is found in the Al-Quran, Surah Al-Baqarah verse 219 and Surah Al-Ma'idah verses 90-91. Supported by Ahmad, Laits, Ishak, and other adherents of the Shafi'i madzab, it is prohibited to be caned more than ten times if the sanction for the crime committed does not reach the sanction for adultery or theft does not reach the provisions for cutting off one's hand. 2.) The most striking thing in the comparison of the Aceh Qanun and National Law is the sanctions. In the regulation of the Aceh Qanun the criminal sanction for gambling is public caning, while the sanction for gambling in the National Law is imprisonment

Abstract

Currently, the crime of rape is rampant and has received considerable attention from the public. The crime of rape often brings difficulties, both in the stage of investigation, prosecution, and at the stage of imposing a verdict during the settlement of the case. Rape is an act in which a person commits violence or threat of violence to force a woman who is not his wife to have sex with him, as in the case of Decision Number 390/Pid.B/2021/PN Smn, the unnamed perpetrator committed the crime of rape against awoman who was in a state of helplessness or unconsciousness whose punishment was imposed based on Article 285 of the Criminal Code, The main problem is how the crime of rape in theory and its regulationin Indonesia, and whether the application of Article 285 of the Criminal Code to the perpetrator of rape against a woman in a helpless state is appropriate. This research is a normative research that is descriptive analysis, and the data used is secondary data, and data collection is done by literature study.The results concluded that the perpetrator's actions were a type of "exploitation rape", and the victim was a "pure victim", namely a victim who had never had contact with the perpetrator before the rape.The perpetrator's actions also fulfill the elements of Article 285 of the Criminal Code, the perpetrator's actions more fulfill the elements of Article 286 of the Criminal Code.

Abstract

As one of the countries with the highest population in the world, Indonesia has an uneven population density in each region. This condition encouraged the creation of a transmigration policy to create an equal distribution of population density, which has been carried out since the Dutch East Indies colonial period. The transmigration policy transfers the population from areas with high population density to regions with low population density, equipped with land ownership, public facilities, and agricultural capital goods. The transmigration target area has a local population that has been settled for a long time, so there is interaction between the local population and transmigrants as immigrants. This interaction creates new forms of culture in accommodation and assimilation between the cultures of the local population and migrants. However, this interaction does not always positively impact the relationship between the local population and transmigrants because of the local community's resistance to transmigrants as migrants who are considered to pose a threat to the existence of the local population. The problem will be studied in this research using the socio-legal research method with North Bengkulu Regency as the object of research location to understand the pattern of interaction between residents and transmigrants and its impact on cultural formation through field observations to transmigration areas in North Bengkulu Regency and interviews with residents and transmigrants. This research employs Social Integration Theory of Emile Durkheim and the Cultural Transplant theory of Garett Jones. Based on field data and analysis that has been conducted, the relationship between residents and transmigrants runs harmoniously without any conflict between residents while relatively maintaining their respective cultures. However, some habits of transmigrant communities are followed by residents, and there is disappointment among local communities due to the relocation of public facilities after the transmigration policy. Abstract

Employment is one of many important aspect in the area of human rights protection. Indonesia’s citizens have the right to work and a decent livelihood, including people with disabilities. As one of the efforts to enhance opportunities to improve the welfare of persons with disabilities, Indonesian Law Number 8 of 2016 on Persons with Disabilities was formulated, which contains various arrangements regarding the rights of persons with disabilities and the State’s obligations to fulfill those rights. This study aimed to provide an overview of these regulation’s fulfillment, especially that related to equal employment opportunities for persons with disabilities, with a particular focus on the banking industry within SOEs. This study employs a non-doctrinal, descriptive-analytical approach to analyze Law No. 8/2016 on Persons with Disabilities, focusing on Article 53(1) regarding workforce representation in state-owned enterprises. Data is gathered through literature reviews and stakeholder interviews, using qualitative analysis to evaluate legal norms and provide a comprehensive understanding of the legal context. The finding revealed that the state plays a crucial regulatory role in protecting the rights of persons with disabilities, yet the implementation of Article 53(1) of Law No. 8/2016 has been inadequate, resulting in less than 0.5% representation in BUMN banks against the mandated 2%. To improve compliance, both the state and companies must prioritize recruitment and create inclusive opportunities for persons with disabilities.
