Abstract

Panglima Laot has been felt in Aceh since the era of Sultan Iskandar Muda and is still known today. Panglima Laot is not part of the Aceh government but is recognized as Aceh's cultural heritage. Later, Panglima Laot was also regulated in the Aceh Qanun as the living law in Aceh. Culturally, it can be said that the Marine Commander is the leader of the fishermen in Aceh, whose job is to coordinate the fishermen, maintain maritime security according to their respective territories, and conserve Aceh's marine environment. This article examines the existence of Panglima Laot in Aceh in this contemporary era. With an emphasis on their role in upholding customary law in Aceh waters. The data was obtained through field research in Aceh and library data studies. The findings from this study are that Panglima Laot in Aceh still exists and plays a significant role in upholding customary law in Aceh waters. Coexist in harmony with national law and other legal systems that live in Aceh.

Abstract

This study examines the reconstruction of criminal law provisions governing the protection of victims in trademark infringement cases in Indonesia. The current legal framework, as stipulated in Law No. 20 of 2016 concerning Trademarks and Geographical Indications, still relies on a complaint-based offense (requiring a complaint from the aggrieved party), which limits law enforcement's proactive role and undermines the effectiveness of criminal sanctions. Through a comparative legal approach and a theoretical analysis grounded in legal certainty, proportionality, and restorative justice, this research highlights the need for systemic reform. The proposed reconstruction includes five key elements: (1) reclassifying trademark infringement from a complaint-based offense into a public criminal act, (2) implementing proportional and tiered criminal sanctions, (3) incorporating restitution as a mandatory additional penalty, (4) strengthening institutional capacity and inter-agency coordination, and (5) revising Law No. 20 of 2016 to align with international best practices. A comparative analysis of France, Singapore, and Malaysia demonstrates that integrating restitution and proactive enforcement mechanisms enhances justice for victims and strengthens the deterrent function of criminal law. This reconstruction aims to transform Indonesia’s trademark protection system into one that is more effective, fair, and adaptive to the challenges of global and digital trade ensuring both punitive and restorative justice for victims of trademark infringement in Indonesia.

Abstract

This article addresses a timely and important issue: terrorism recruitment and disengagement in the digital era. It explores the intricate dynamics of social networks and peer contagion and their role in processes of recruitment and disengagement in terrorism activities in Indonesia. It emphasizes on how close relations and peers significantly influence young individual behavior, often facilitated through digital spaces; social media, encrypted chat groups, and other content-sharing platforms, and explores potential avenues for prevention and disengagement. The research is based on in-depth interviews with 20 former inmates convicted of acts of terrorism between 2023 and 2025 in the greater Jakarta and west Java region, Indonesia. The finding highlights that social networks serve as critical outreach platforms, especially for the young people, for disseminating extremist ideologies, sharing biased information and propaganda content, and serve to promote recruitment for violent activities. It demonstrates how communication and information sharing via digital spaces platforms plays a crucial role in shaping the processes that lead young individuals towards violent ideologies and practices. In addition, we observed that on one hand peer influence plays a pivotal role in enabling recruitment but on the other hand for prevention and disengagement efforts; although, antisocial and violent behavior spreads more readily than prosocial behavior among peers. Analysis indicate that a clear understanding of the structure of these social networks and their dynamics, as well as the mechanisms of peer contagion is essential for developing effective preventive strategies and targeted interventions. Importantly, these findings have broader practical implications, which not only provides insights of contextual complexities of recruitment and disengagement that could inform future research , but also for policymakers and practitioners who could translate this knowledge into policies and develop interventions that strengthen protective social ties, foster trust and support among peers, and guide the responsible use of digital spaces in Indonesia, and beyond. Ultimately, this study recommends revising the terrorism law in Indonesia regarding digital literacy and responsible supervision of digital space to prevent the spread of radicalism through digital space.

Abstract

The Articles of Association of the Foundation in its rules can be changed except regarding the purpose and objectives of the foundation. Amendments to the foundation’s articles of association are carried out with the application submission procedures. They are regulated in Article 15 to Article 23 of Law Number 16 of 2001 concerning foundations. The foundation’s founder is one of the parties that plays an important role in every action. Moreover, Article 28 paragraph 4 of the Foundation Law states that if the Foundation for any reason no longer has a Trustee, no later than within 30 (thirty) days from the date of vacancy, the Management members and Supervisory members must hold a joint meeting to appoint a Trustee by taking into account the provisions referred to in paragraph (3). Such an event requires the role of a Notary to make a Deed of Minutes of the Meeting to record the changes in the deed to replace the management in the deed of amendment or adjustment of the foundation.

Abstract

Seringkali akibat hukum dari perkawinan khususnya perkawinan campuran yang mana para pihak mendapatkan halangan untuk melakukan perbuatan hukum terutama untuk memiliki hak atas tanah di Indonesia dikarenakan terjadinya pembulatan harta Bersama dengan warga negara asing dimana peraturan perundang-undangan mengenai pertanahan di Indonesia menganut asas Nasionalisme. Undang-Undang Nomor 5 Tahun 1960 tentan Peraturan Dasar Pokok-Pokok Agraria mengatur mengenai subyek hukum yang dapat boleh memiliki hak atas tanah di Indonesia. Untuk Hak Milik, Hak Guna Bangunan dan Hak Guna Usaha hanya dapat dimiliki oleh Warga Negara Indonesia, sedangkan dalam perkawinan campuran apabila suami/isteri yang berkewarganegaraan Indonesia memiliki hak atas tanah tersebut, maka pasangannya yang berkewarganegaraan asing turut pula menjadi pemilik karena masuk dalam harta bersama. Persoalan ini timbul bagi para pihak perkawinan campuran sehingga penulis menggunakan metode penelitian pendekatan yuridis normatif dimana bersumber dari bahan-bahan hukum sekunder untuk memahami hukum sebagai perangkat peraturan atau norma positif di dalam perundang-undangan yang berlaku.

Abstract

As one of the countries with the highest population in the world, Indonesia has an uneven population density in each region. This condition encouraged the creation of a transmigration policy to create an equal distribution of population density, which has been carried out since the Dutch East Indies colonial period. The transmigration policy transfers the population from areas with high population density to regions with low population density, equipped with land ownership, public facilities, and agricultural capital goods. The transmigration target area has a local population that has been settled for a long time, so there is interaction between the local population and transmigrants as immigrants. This interaction creates new forms of culture in accommodation and assimilation between the cultures of the local population and migrants. However, this interaction does not always positively impact the relationship between the local population and transmigrants because of the local community's resistance to transmigrants as migrants who are considered to pose a threat to the existence of the local population. The problem will be studied in this research using the socio-legal research method with North Bengkulu Regency as the object of research location to understand the pattern of interaction between residents and transmigrants and its impact on cultural formation through field observations to transmigration areas in North Bengkulu Regency and interviews with residents and transmigrants. This research employs Social Integration Theory of Emile Durkheim and the Cultural Transplant theory of Garett Jones. Based on field data and analysis that has been conducted, the relationship between residents and transmigrants runs harmoniously without any conflict between residents while relatively maintaining their respective cultures. However, some habits of transmigrant communities are followed by residents, and there is disappointment among local communities due to the relocation of public facilities after the transmigration policy.
