Abstract

A In the implementation of the registration of land rights to former customary property, one of the documents needed in the registration is a Land Certificate issued by the Village Head. In terms of granting land certificates, sometimes problems arise in the community. Where the provision of the letter is not in accordance with the ownership or physical control of the former customary land controlled by the community. For example, the land area is not suitable and sometimes the letter is not given to people who are entitled to receive a land certificate, as proof of land ownership or control of land that was previously owned by adat. This study uses a type of empirical juridical research with a research location in Kabupaten Kupang, NTT, regarding the analysis of land certificates issued by the village head. The population and sample used purposive sampling technique with the types and sources of data obtained from primary data and secondary data. The technique of collecting Legal Materials uses Field Research. Furthermore, the collected legal materials are then analyzed qualitatively descriptively. Land Certificate issued by the Village Head The Village Head is a valid evidence. The Village Head is given a direct mandate by law to issue a Land Certificate in accordance with the location of the former customary land object owned by the community for various purposes, for example for registration of Property Rights certificates to the National Land Agency (BPN) according to Circular No. 9/SE /VI/2013 concerning Certificate of Ex-Indigenous Land. In addition, for the purpose of buying and selling land based on Government Regulation Number 24 of 1997 concerning Land Registration. As well as proof of the temporary ownership rights for the former customary land object if the community has not had time to register it with the National Land Agency. For the purpose of buying and selling or transferring rights to former customary land, the legal force of a land certificate issued by the Village Head, in the event that this land sale and purchase transaction is based on Government Regulation Number 24 of 1997 concerning Land Registration, will have more legal force if it is known by the The sub-district head as the official making the land deed, with a legal basis based on the Elucidation of Article 7 paragraph (2) and Article 39 paragraph (1) letter (b) number (1) and number (2) Government Regulation Number 24 of 1997 can be categorized as the basis for the rights proposed as completeness of the requirements for the application for land rights.

Abstract

Indonesia with its five pillars of Pancasila binds the State and its citizens to "Believe in Almighty" where the religious identity is the spirit of the State that must be respected. This is proven by the existence of Law No. 1/PNPS/1965 concerning the Prevention of Blasphemy that prohibits blasphemy, atheism, or any belief other than the religious identity recognized by the government and law. Article 156 (a) of the criminal code, known as the Criminal Code, also punishes "the dissemination of information aimed at inciting religious hatred or hostility" for five years in prison. In addition, the Information and Electronic Transaction Law (ITE) Law No. 11 of 2008, regulating criminal sanctions for libel, hate speech, and insulting certain religions/beliefs through electronic devices. On the other hand, the 1945 Constitution, as well as the Human Rights Act of 1999 and Law No. 12/2005 concerning Ratification of the ICCPR guarantees freedom of expression, religion, and belief. Criticism of religion is quite limited and support for atheism is definitely still banned in Indonesia. Therefore, this article yearns to explore the dynamics of law enforcement and defamation in Indonesia in national and international human rights regimes. Then, does the law on blasphemy have a legal basis in the Indonesian legal system, national and international human rights regimes, and the surrounding social values? This study compares the application of religious blasphemy laws in several regions in Indonesia and in several Southeast Asian countries.

Abstract

The book was written by Dr. Pradana Boy ZTF, a lecturer at Faculty of Islamic Studies Universitas Muhammadiyah Malang, and a prominent scholar of Muhammadiyah is derived from his dissertation at the National University of Singapore (NUS) in 2015. This book looks at fatwa in Indonesia during the fall of President Suharto (New Order) in 1998. It is about the exploration of three fatwa-making agencies namely Majelis Ulama Indonesia (Indonesian Council of Ulama), Lajnah Bahtsul Masail Nahdlatul Ulama (‘Bahtsul Masail’ means discussion of the problems), and Majelis Tarjih Muhammadiyah (‘Majelis Tarjih’ means ‘Assessment Council’).

Abstract

Korupsi adalah suatu kejahatan yang luar biasa dan bahkan dapat dikategorikan sebagai transnational organized crime. Di level nasional maupun internasional korupsi telah dikategorikan sebagai kejahatan yang amat serius. Kenyataan social di Indonesia dan dunia adalah masih banyak terjadi korupsi di negara Muslim atau di negara-negara berpenduduk Muslim mayoritas.  Termasuk di Indonesia.  Maka, tulisan ini mengkaji bagaimana korupsi dikaji sebagai suatu kejahatan (jarimah) dalam perspektif hukum Islam.  Penelitian dilakukan dengan mengoptimalkan data kepustakaan dan telaah data sekunder.  Penelitian ini menunjukkan bahwa tindak pidana korupsi ini tidak mendapat pembahasaan yang tunggal dalam hukum Islam,  namun diserupakan dengan tindakan pencurian, perampokan atau mengambil barang orang lain tanpa ijin.Kata Kunci : Korupsi, Kejahatan, dan Hukum Islam

Abstract

In the aftermath of Bali Bombing 12 October 2002, which is considered as the biggest terrorism attack ever in Indonesia,   the Indonesian government launched so called ‘war against terrorism’.  Laws on terrorism were soon enacted and applied retroactively.   Special Police to Combat Terrorism, namely Detachment of 88 was formed.  Special Agency to coordinate counterterrorism measures was soon established, namely Badan Nasional PenanggulanganTerorisme or National Agency for Terrorism Countermeasures.  Since early 2010’s it has conducted special program to combat terrorism namely deradicalization program while the Detachment of 88 has launched more massive manhunt for suspected terrorism all over Indonesia,  supported by Indonesian military.  Deradicalization program targets former terrorism suspects and former inmates.  Also, it targets schools, universities, and other academic institutions suspected as being an agent for radical ideology dissemination in Indonesia.  Both deradicalization program and massive manhunt have created problems.  At one side the Agency claimed that they have prevented terrorism, but on the other hand, they have victimized innocent people such as family of terrorist suspects and violated civil rights of former inmates.  In addition, by targeting specific academic institutions, the agency has been accused as arbitrarily labeling people as terrorist or future terrorist, which is a clear violation of human rights. This research, therefore, is a study of counter-terrorism, including deradicalization program in Indonesia. It tries to describe the dynamic of the program between the need of law enforcement in the name of law enforcement and its impact to human rights and civil liberty.  Keywords:  Deradicalization, Terrorism, Victimization, Indonesia, Human Rights

Abstract

Dalam menggalakkan program pendewasaan usia nikah dan keluarga berencana, BKKBN tidak dapat berjalan sendiri karena DPR sebagai lembaga perwakilan rakyat wajib memberikan dukungannya secara berkesinambungan. Di tingkat daerah, isu program Pendewasaan Usia Perkawinan dan Keluarga Berencana membutuhkan adanya perhatian khusus dari legislator dan partai politik. Pasalnya, program-program tersebut selama ini memiliki kesulitan mendapatkan penganggaran dari APBD. Padahal seperti yang telah dijelaskan di atas, isu mengenai kependudukan memiliki peran penting terhadap pembangunan daerah dan dalam konteks lebih luas, dalam pembangunan Indonesia. Isu mengenai program Pendewasaan Usia Perkawinan dan Keluarga Berencana akan menggambarkan bagaimana para calon legislatif dan partai politik mengerti dan memiliki rasa sensitif yang tinggi terhadap permasalahan yang terjadi di masyarkat, utamanya permasalahan mendasar mengenai kependudukan. Partai politik dan calon legislator harus mengerti bahwa masalah kependudukan merupakan kunci dasar bagi negara dalam arti luas untuk menjamin hak-hak warga negara dan menciptakan kesejahteraan masyarakat secara keseluruhan. Partai Politik di sisi lain berfungsi sebagai sarana pendidikan politik bagi anggota dan masyarakat luas agar menjadi warga negara Indonesia yang sadar akan hak dan kewajibannya dalam kehidupan bermasyarakat, berbangsa, dan bernegara. Artikel ini mendeskripsikan urgensi calon anggota legislatif dan partai politik untuk memahami dan mengarustamakan pendewasaan usia nikah dan keluarga berencana dalam program politiknya, dengan mengambil studi kasus di Kota Medan.

Abstract

Penelitian ini bertujuan untuk memberikan gambaran bagaimana kondisi pemenuhan dan perlindungan hak asasi penyandang disabilitas, khususnya terkait dengan hak ekonomi dan politik. Negara memegang peran penting dalam upaya perlindungan serta pemenuhan hak asasi penyandang disabilitas. Undang-undang Nomor 8 Tahun 2016 tentang Penyandang Disabilitas berikut berbagai peraturan perundangan lainnya yang mengakomodir kepentingan penyandang disabilitas kemudian hadir sebagai bukti pengakuan serta upaya negara dalam memberikan perlindungan bagi masyarakat penyandang disabilitas, namun pada kenyataannya berbagai peraturan perundang-undangan yang ada belum dapat dijalankan secara efektif. Penelitian ini diharapkan dapat menjadi referensi dalam merumuskan tindakan apa saja yang dapat dilakukan oleh negara untuk meningkatkan upaya perlindungan dan pemenuhan hak asasi penyandang disabilitas, khususnya ditinjau dari aspek hak ekonomi dan politik.

Abstract

Islamic law is a complete and comprehensive law which encompassess all human affairs either in civil or public affairs. Islamic international law or siyar is a branch of Islamic law which regulate international affairs is among the topic which is frequently forgotten in Islamic discourse both in Indonesia or or other countries. Also in Indonesia where Islamic Law have been existing for centuries but mostly in civil affairs. This paper, therefore, would like to explore and discuss the siyar, as islamic international law from historical perspective, legal perspective and its relation to secular international law in regards to humanitarian law, law of diplomacy and other aspects of international public law. At the end, this paper emphasizes the need to promote and develop siyar as an integral part of Islamic law into national laws of possible Muslim countries.

Abstract

This article is derived from research conducted by the authors in some provinces in Indonesia. The focus of the research is the administration of zakat (alms) by the state, in this case, is BAZNAS at various provinces in Indonesia in the aftermath of Law No. 23/ 2011 on Zakat Administration. The authors select two provinces where Muslim inhabitants are a minority, namely in North Sulawesi and East Nusa Tenggara (NTT) and three provinces where Muslims are majority namely in Aceh, West Nusa Tenggara, and Gorontalo. There is three focus of questions: 1. The practice of zakat administration by the BAZNAS; 2. The performance of BAZNAS; and 3. The practice of zakat administration by non-state actors in selected provinces. The findings of this research are: the performance of zakat administration is very dependent on the number of zakat administrators (amil) and zakat payer, the professionalism of BAZNAS and legislation support from the provincial government through a specific local ordinance on zakat.
