Abstract

In general, there are laws that provide protection to banks as lenders to obtain repayment of their debts when the debtor is in default, this is stated in Article 1131 of the Civil Code which reads: "All assets of the Debtor, whether movable or immovable, whether existing ones or those that will be in the future become dependents/guarantees. Debtor's assets, both movable and immovable, both present and future will become dependents/guarantee for their debts. One of the characteristics of the UUHT is that it is easy and certain to execute, which means executing the mortgage certificate. must be carried out but can still provide legal certainty for interested parties, in this case, the auction seller, auction buyer and auctioneer. Therefore, in carrying out executions based on parate execution, it must be able to provide convenience and legal certainty for all interested parties.

Abstract

The cancellation of a mudharabah financing deed that does not comply with sharia principles has major legal repercussions, such as cancellation of contracts and restitution of rights obtained by both parties. The Bank may be required to refund any payments or profits made from unauthorized transactions. Notary / PPAT plays a role in ensuring compliance with sharia principles and fair settlement. Suggestions for banks include improved vetting, staff training, information transparency, and ensuring compliance with sharia law. The debtor needs to understand the principles of sharia and abide by the agreement. Notaries must conduct careful document checks, consultation with sharia experts, and constant education on sharia principles. Thus, collaboration between banks, debtors, and notaries/PPAT is important to ensure compliance with sharia principles and fair settlement in such cases. Abstract

Agama Islam mengajarkan apabila kita melakukan kegiatan hutang-piutang maka kita harus segera melunasinya. Murabahah adalah suatu transaksi jual beli dengan mengungkapkan harga awal dan keuntungan yang disetujui oleh pihak terkait. Tujuan dari penelitian ini untuk mengetahui implikasi hukum nasabah wanprestasi dalam akad murabahah. Debitur dapat diancam sejumlah hukuman atau penalty sehubungan dengan kelalaiannya dalam akad murabahah. Berlaku juga akibat hukum yang diterima oleh pihak bank atau kreditur. Lebih berhati-hati dalam melakukan transaksi akad murabahah karena akad jual beli yang apabila tidak bisa membayar maka dapat dikatakan ingkar janji atau wanprestasi dan apabila terjadi maka akan dikenakan sanksi berupa ganti rugi.

Abstract

The decision to ratify PKPU peace (homologation) based on its regulations has permanent legal force (inkracht van geweijsde). The nature of permanent legal force is related to whether it can be executed or implemented immediately, so that this decision requires legal certainty by stating that the decision must have permanent legal force. Bankruptcy law regulates differently regarding the permanent legal force in PKPU decisions, the difference being that the permanent legal force does not apply to the entire substance of the case but only to the peace agreement agreement, which can be called limited permanent legal force. Regarding this specificity, the researcher wants to analyze it under the title "permanent legal force (inkracht van geweijsde) of PKPU peace in bankruptcy law". Abstract

AbstrakCovernote biasanya diminta oleh para pihak, dalam hal ini adalah bank selaku kreditur serta debitur untuk proses pencairan kredit. Pencairan kredit yang menjaminankan tanah dan memerlukan sertifikat hak tanggungan, umumnya lebih lama prosesnya disebabkan masih adanya proses pengecekan dari Badan Pertanahan Indonesia. Keberadaan covernote diibaratkan sebagai jaminan dari pihak notaris bahwa sertifikat hak tanggungan akan dipastikan selesai selagi bank mencairan dana kredit tersebut. Namun keberadaan covernote hanya sebatas surat keterangan dan bukan termasuk ke dalam akta autentik yang dibuat oleh Notaris, sehingga jika notaris gagal memenuhi apa yang tertera di covernote maka akan sangat merugikan bank selaku kreditur. Tulisan ini didasarkan pada penelitian yuridis normatif, yang mengacu pada literatur hukum menggunakan bahan hukum primer dan bahan hukum sekunder dengan pendekatan konseptual dan pendekatan perundang-undangan. AbstractCovernote are usually requested by the parties, in this case the bank as the creditor and debtor for the credit disbursement proses. Disbursement of credit that guarantees land and requires a mortgage certificate generally takes longer because there is still a checking process from the Indonesian Land Agency. The existence of a covernote is seen as a guarantee from the notary that the mortgage certificate will be guaranteed to be completed while the bank disburses the credit funds. However, the existence of the covernote is only limited to a statement and is not included in the authentic deed made by the notary, so that if the notary fails to fulfil what is stated on the covernote it will be very detrimental to the bank as the creditor. This paper is based on normative juridical research, which refers to legal literature using primary legal materials and secondary legal materials with a context approach and a statutory-regulatory approach.

Abstract

Skin beauty is a primary need for women, and it caused the cosmetic market to increase significantly for domestic and foreign brands throughout the year. There has been abuse by irresponsible entrepreneurs by selling and producing skin care products that do not meet Indonesian Food and Drug Authority (BPOM) requirements. The focus of this review is to find out how the legal review of dangerous skincare users in the perspective of Islamic law and consumer protection act (Law of the Republic of Indonesia Number 8 Year 1999 concerning Consumer Protection). The research method used in this study is normative juridical research with statutory and conceptual approach. The results of the study show that Islam provides more protection for women and there are internal and external legal protections in Indonesia for skincare users.

Abstract

Bangsa yang besar adalah bangsa dengan kebanggaan bagi warisan budayanya. ekspresi budaya tradisional adalah yang paling penting atau paling diakui dasar untuk identitas budaya dan masyarakat. Negara sebagai manajer ekspresi budaya tradisional harus melindungi keberadaan ekspresi budaya tradisional dengan mempertimbangkan sebagai warisan budaya yang sangat berharga. Menghormati hak-hak masyarakat adat dan kepentingan sebagai pemilik ekspresi budaya tradisional dapat mendukung ekonomi nasional. Sebuah isu yang menarik terkait dengan peningkatan adalah ekonomi berbasis pengetahuan ekonomi nasional yang menyangkut dengan pemanfaatan sumber daya alam dan sumber daya warisan budaya intelektualitas oleh masyarakat adat sebagai penjaga sumber daya ini. Dalam dekade terakhir, ada kecenderungan memanfaatkan sumber daya ini tidak adil oleh negara-negara maju. masyarakat adat sebagai pemilik ekspresi budaya tradisional, oleh karena itu, harus dihargai dan bersyukur ketika ekspresi budaya tradisional mereka disalahgunakan oleh negara-negara lain.

Abstract

The explanation of Article 15 paragraph (3) provides a direction regarding the other forms of authority in question, one of the activities of which is certifying transactions with the concept of authentic creation through an electronic system. In contrast to the implementation of authentic making through an electronic system in Article 16 paragraph (1) letter m UUJN, which in essence the Notary must be physically present in front of several parties who have been determined to read and sign the deed, with formal requirements that must be met for the validity of a deed. An authentic deed is a derivative of Article 1868 of the Civil Code which is an explanation of the meaning of an Authentic Deed. So that between Article 15 paragraph (3) UUJN and Article 16 paragraph (1) letter m, there is a conflict of norms, therefore it is necessary to study further regarding the validity of an Authentic Deed based on the validity of making an authentic deed made in the concept of authentic making through an electronic system without any the physical presence of the Notary and the presenters. The focus of this jurnal research is the Notary's responsibility for making authentic deeds through an electronic system in terms of the validity of making authentic deeds, and the form of Notary's responsibility for making authentic deeds through electronic systems based on the validity of making authentic deeds.

Abstract

Introduction: The background of this research is that there are still many food products that have not been halal certified, even though the government through the Halal Product Guarantee Agency (BPJPH) has provided convenience in registering halal products online with free assistance. Especially in this metaverse era, where technology has developed rapidly so that the use of digital technology should be able to encourage development through the halal industry.Purposes of the Research: The purpose of this study, firstly, is to know and understand the meaning of halal in both Islamic law and the Civil Code. Second, understanding the halal industry in the metaverse era in terms of the theory of utilitarianism and Maqashid Sharia.Methods of the Research: This study uses a normative juridical method with a legal-statutory approach and a conceptual approach.Results of the Research: The results of this study are: First, that halal in Islamic Law and the Civil Code have different contexts, but have a similar meaning, namely referring to something that is permitted and not prohibited by law. Second, the halal industry based on utilitarianism has utility value both for business actors who register their food products, as well as for the general public as consumers. Furthermore, based on Maqashid Sharia, halal food is included in the category of protecting the soul (nafs) and protecting the mind (aql).

Abstract

Global climate change has become one of the most important issues facing the world today. Climate change can be defined as long-term changes in temperature and weather conditions. The main cause of climate change is the increase in Greenhouse Gas (GHG) emissions into the atmosphere due to various human activities, including industrial and transportation activities. To combat climate change, the international community has developed various agreements and frameworks, including the Kyoto Protocol, followed by the Paris Agreement, which aim to reduce GHG emissions globally. One of the instruments developed to reduce GHG emissions is carbon trading, also known as emissions trading. Carbon trading is a mechanism where companies or countries can buy or sell permits to emit GHGs, known as carbon credits or emission units, with the goal of effectively reducing emissions. Through carbon trading, countries or companies can reduce GHG emissions, helping other countries achieve their emission targets more economically. Indonesia, as a country with high GHG emissions, has a responsibility to reduce emissions in accordance with international commitments such as the Paris Agreement. Although steps have been taken, such as the development of renewable energy, regulations. This research uses a normative juridical legal research method with a conceptual approach and a statute approach. This study will also discuss the role of financial institutions and capital markets in carbon trading in Indonesia, the carbon trading system in Indonesia, and the differences in carbon trading mechanisms between Indonesia and other countries.
