Abstract

The presence of an imbalance in the partnership between sugar mills and sugarcane farmers under the agricultural land leasing system has an impact on national sugar productivity. This study was based on the speculative hypothesis that existing partnerships frequently harm sugarcane farmers. The goal of this study is to examine a type of partnership that occurs in sugar cane farming in Indonesia using a new method based on sharia economic law known as the mukharabah bil mudharabah contract. The research method employed in this study is normative-juridical, including statutory and conceptual methods. This research yielded findings in the form of a new concept that depicts the characteristics of sugarcane farmer partnerships based on the mukharabah bil mudharabah contract and provides policy input for the government regarding sugarcane farmer partnerships with financing institutions based on the mukharabah bil mudharabah contract. In relation to this, the researchers proposed the concept of a "mukharabah bil mudharabah" contract to replace the partnership concept that has been implemented thus far in the hope that it will not be detrimental to sugarcane farmers. Adanya ketidakseimbangan pada kerja sama kemitraan di antara pabrik gula dan petani tebu yang dilakukan dengan sistem sewa lahan pertanian mempengaruhi produktivitas gula nasional. Penelitian ini dilakukan dengan dasar hipotesa sementara bahwa kemitraan yang ada saat ini sering kali merugikan petani tebu. Objek penelitian ini adalah bentuk kemitraan yang terjadi pada pertanian tebu di Indonesia dengan metode baru berdasarkan konsep hukum ekonomi syariah yang dikenal dengan nama akad mukharabah bil mudharabah. Metode penelitian yang digunakan dalam penelitian ini yaitu yuridis normatif dengan pendekatan perundang-undangan dan pendekatan konseptual. Penelitian ini menghasilkan temuan berupa konsep baru yang menunjukkan karakteristik mengenai kemitraan petani tebu berdasar akad mukharabah bil mudharabah, dan masukan kebijakan bagi pemerintah terkait kemitraan petani tebu dengan lembaga pembiayaan dengan berdasar konsep akad mukharabah bil mudharabah. Terkait hal tersebut maka peneliti mengajukan konsep akad mukharabah bil mudharabah guna menggantikan konsep kemitraan yang selama ini dijalankan dengan harapan tidak merugikan petani tebu.

Abstract

Penelitian ini bertujuan untuk mengtahui dan menganalisis Degradasi Akta Akibat Kelalaian Notaris Dalam Penandatanganan Perjanjian Kredit Perbankan serta bertujuan untuk menganalisis konstruksi hukum ke depan terhadap penandatanganan akta perjanjian kredit perbankan agar memenuhi prinsip kepastian hukum. Metode penulisan yang digunakan dalam penelitian ini menggunakan metode penelitian yuridis normatif dengan menggunakan pendekatan perundang-undangan dan pendekatan konseptual. Penandatanganan suatu akta otentik dihadapan notaris merupakan suatu keharusan bagi notaris dan para pihak, karena pada praktiknya masih banyak dijumpai notaris yang tidak hadir dalam penandatangan perjanjian kredit. Akta yang tidak ditandatangani dihadapan notaris memiliki risiko bahwa akta tersebut dapat berubah menjadi akta dibawah tangan dan tidak memiliki kekuatan hukum yang kuat. This study aims to identify and analyze the Degradation of Deeds Due to Negligence by a Notary in Signing a Banking Credit Agreement and aims to analyze the future legal construction of the signing of a bank credit agreement deed in order to comply with the principle of legal certainty. The writing method used in this study uses a normative juridical research method using a statutory approach and a conceptual approach. The signing of an authentic deed before a notary is a must for the notary and the parties, because in practice there are still many notaries who are not present when signing the credit agreement. A deed that is not signed before a notary has a risk that the deed can turn into a private deed and does not have strong legal force.

Abstract

In the era of the Covid-19 Pandemic as a form of national disaster that must receive special attention, because the condition of the Covid-19 Pandemic greatly affects the health and economy of the community. The community's economy as a result of the Covid-19 pandemic, has an impact on finance companies where debtors have difficulty in paying debt obligations. The implementation of the responsibilities of financial institutions as institutions that collect public funds in carrying out their activities is regulated in the Financial Services Authority regulation Number 11/POJK.03/2020 concerning National Economic Stimulus as a Countercyclical Policy. Basically, by providing asset quality determination and concessions to debtors by means of credit restructuring is the best step. Thus, debtors whose credit is bad because of problems cannot pay off debts can be saved. The title of this article is the legal implications of non-performing loans in financing companies as a forum for collecting public funds which will later be channeled back to people who need funds. The purpose of this research is expected to increase knowledge of scientific works in the field of financing law, and is also expected to contribute ideas in terms of scientific development, especially in financing law.Keywords : Legal Implications, Non-Performing Loans, Financing Companies, Covid 19 Pandemic.

Abstract

Penyelesaian sengketa hak atas tanah di Pengadilan Negeri sebelum sampai pada pemeriksaan dengan agenda pembuktian, maka kepada para pihak berperkara akan dilakukan mediasi. Hakim, panitera dan juru sita bersama para pihak menuju lokasi objek yang diperiksa dan melakukan pemeriksaan. Yang dimintai keterangan  adalah pihak penggugat sesuai isi gugatannya. Rumusan masalah dalam penelitian ini adalah 1. Apakah pemeriksaan setempat terhadap objek sengketa tanah dalam perkara perdata telah memberikan kepastian hukum? 2. Apakah implikasi hukum dari pemeriksaan setempat terhadap suatu objek perkara perdata? 3. Bagaimana kepastian hukum dalam pengaturan ke depan pada pemeriksaan setempat terhadap objek tanah dalam perkara perdata. Hasil penelitian mengatakan Pemeriksaan setempat berdasarkan Pasal 153 HIR, Pasal 180 RBg, Pasal 211 – 214 Rv dan SEMA No. 7 tahun 2001 belum mengatur secara rinci mekanisme pemeriksaan setempat dilapangan. Pemeriksaan setempat masih rancu, apakah merupakan alat bukti yang memiliki kekuatan dalam pembuktian atau pemeriksaan setempat tidak termasuk sebagai kategori alat bukti.

Abstract

In general, there are laws that provide protection to banks as lenders to obtain repayment of their debts when the debtor is in default, this is stated in Article 1131 of the Civil Code which reads: "All assets of the Debtor, whether movable or immovable, whether existing ones or those that will be in the future become dependents/guarantees. Debtor's assets, both movable and immovable, both present and future will become dependents/guarantee for their debts. One of the characteristics of the UUHT is that it is easy and certain to execute, which means executing the mortgage certificate. must be carried out but can still provide legal certainty for interested parties, in this case, the auction seller, auction buyer and auctioneer. Therefore, in carrying out executions based on parate execution, it must be able to provide convenience and legal certainty for all interested parties.

Abstract

The cancellation of a mudharabah financing deed that does not comply with sharia principles has major legal repercussions, such as cancellation of contracts and restitution of rights obtained by both parties. The Bank may be required to refund any payments or profits made from unauthorized transactions. Notary / PPAT plays a role in ensuring compliance with sharia principles and fair settlement. Suggestions for banks include improved vetting, staff training, information transparency, and ensuring compliance with sharia law. The debtor needs to understand the principles of sharia and abide by the agreement. Notaries must conduct careful document checks, consultation with sharia experts, and constant education on sharia principles. Thus, collaboration between banks, debtors, and notaries/PPAT is important to ensure compliance with sharia principles and fair settlement in such cases. Abstract

Agama Islam mengajarkan apabila kita melakukan kegiatan hutang-piutang maka kita harus segera melunasinya. Murabahah adalah suatu transaksi jual beli dengan mengungkapkan harga awal dan keuntungan yang disetujui oleh pihak terkait. Tujuan dari penelitian ini untuk mengetahui implikasi hukum nasabah wanprestasi dalam akad murabahah. Debitur dapat diancam sejumlah hukuman atau penalty sehubungan dengan kelalaiannya dalam akad murabahah. Berlaku juga akibat hukum yang diterima oleh pihak bank atau kreditur. Lebih berhati-hati dalam melakukan transaksi akad murabahah karena akad jual beli yang apabila tidak bisa membayar maka dapat dikatakan ingkar janji atau wanprestasi dan apabila terjadi maka akan dikenakan sanksi berupa ganti rugi.

Abstract

Yayasan Peduli Anak Cacat (YPAC) Malang is a non-profit organization that aims to provide services to children with disabilities. This community service program in partnership with YPAC Malang aims to improve the inclusion of the disabled workforce in the YPAC Malang environment through various efforts, including skills training, socialization, and the creation of a Special Employment Contract. The research method used in this service program uses a PAR (Participatory Action Research) based approach. Through the involvement of YPAC Malang partners, companies, academics, and government, this program aims to provide legal protection, equality, and employment opportunities for people with disabilities. Although faced with various challenges, such as limited company partners and labor classification mismatches, this program is expected to have a significant positive impact on people with disabilities and society as a whole.

Abstract

The decision to ratify PKPU peace (homologation) based on its regulations has permanent legal force (inkracht van geweijsde). The nature of permanent legal force is related to whether it can be executed or implemented immediately, so that this decision requires legal certainty by stating that the decision must have permanent legal force. Bankruptcy law regulates differently regarding the permanent legal force in PKPU decisions, the difference being that the permanent legal force does not apply to the entire substance of the case but only to the peace agreement agreement, which can be called limited permanent legal force. Regarding this specificity, the researcher wants to analyze it under the title "permanent legal force (inkracht van geweijsde) of PKPU peace in bankruptcy law". Abstract

AbstrakCovernote biasanya diminta oleh para pihak, dalam hal ini adalah bank selaku kreditur serta debitur untuk proses pencairan kredit. Pencairan kredit yang menjaminankan tanah dan memerlukan sertifikat hak tanggungan, umumnya lebih lama prosesnya disebabkan masih adanya proses pengecekan dari Badan Pertanahan Indonesia. Keberadaan covernote diibaratkan sebagai jaminan dari pihak notaris bahwa sertifikat hak tanggungan akan dipastikan selesai selagi bank mencairan dana kredit tersebut. Namun keberadaan covernote hanya sebatas surat keterangan dan bukan termasuk ke dalam akta autentik yang dibuat oleh Notaris, sehingga jika notaris gagal memenuhi apa yang tertera di covernote maka akan sangat merugikan bank selaku kreditur. Tulisan ini didasarkan pada penelitian yuridis normatif, yang mengacu pada literatur hukum menggunakan bahan hukum primer dan bahan hukum sekunder dengan pendekatan konseptual dan pendekatan perundang-undangan. AbstractCovernote are usually requested by the parties, in this case the bank as the creditor and debtor for the credit disbursement proses. Disbursement of credit that guarantees land and requires a mortgage certificate generally takes longer because there is still a checking process from the Indonesian Land Agency. The existence of a covernote is seen as a guarantee from the notary that the mortgage certificate will be guaranteed to be completed while the bank disburses the credit funds. However, the existence of the covernote is only limited to a statement and is not included in the authentic deed made by the notary, so that if the notary fails to fulfil what is stated on the covernote it will be very detrimental to the bank as the creditor. This paper is based on normative juridical research, which refers to legal literature using primary legal materials and secondary legal materials with a context approach and a statutory-regulatory approach.
