Abstract

Skin beauty is a primary need for women, and it caused the cosmetic market to increase significantly for domestic and foreign brands throughout the year. There has been abuse by irresponsible entrepreneurs by selling and producing skin care products that do not meet Indonesian Food and Drug Authority (BPOM) requirements. The focus of this review is to find out how the legal review of dangerous skincare users in the perspective of Islamic law and consumer protection act (Law of the Republic of Indonesia Number 8 Year 1999 concerning Consumer Protection). The research method used in this study is normative juridical research with statutory and conceptual approach. The results of the study show that Islam provides more protection for women and there are internal and external legal protections in Indonesia for skincare users.

Abstract

Bangsa yang besar adalah bangsa dengan kebanggaan bagi warisan budayanya. ekspresi budaya tradisional adalah yang paling penting atau paling diakui dasar untuk identitas budaya dan masyarakat. Negara sebagai manajer ekspresi budaya tradisional harus melindungi keberadaan ekspresi budaya tradisional dengan mempertimbangkan sebagai warisan budaya yang sangat berharga. Menghormati hak-hak masyarakat adat dan kepentingan sebagai pemilik ekspresi budaya tradisional dapat mendukung ekonomi nasional. Sebuah isu yang menarik terkait dengan peningkatan adalah ekonomi berbasis pengetahuan ekonomi nasional yang menyangkut dengan pemanfaatan sumber daya alam dan sumber daya warisan budaya intelektualitas oleh masyarakat adat sebagai penjaga sumber daya ini. Dalam dekade terakhir, ada kecenderungan memanfaatkan sumber daya ini tidak adil oleh negara-negara maju. masyarakat adat sebagai pemilik ekspresi budaya tradisional, oleh karena itu, harus dihargai dan bersyukur ketika ekspresi budaya tradisional mereka disalahgunakan oleh negara-negara lain.

Abstract

The explanation of Article 15 paragraph (3) provides a direction regarding the other forms of authority in question, one of the activities of which is certifying transactions with the concept of authentic creation through an electronic system. In contrast to the implementation of authentic making through an electronic system in Article 16 paragraph (1) letter m UUJN, which in essence the Notary must be physically present in front of several parties who have been determined to read and sign the deed, with formal requirements that must be met for the validity of a deed. An authentic deed is a derivative of Article 1868 of the Civil Code which is an explanation of the meaning of an Authentic Deed. So that between Article 15 paragraph (3) UUJN and Article 16 paragraph (1) letter m, there is a conflict of norms, therefore it is necessary to study further regarding the validity of an Authentic Deed based on the validity of making an authentic deed made in the concept of authentic making through an electronic system without any the physical presence of the Notary and the presenters. The focus of this jurnal research is the Notary's responsibility for making authentic deeds through an electronic system in terms of the validity of making authentic deeds, and the form of Notary's responsibility for making authentic deeds through electronic systems based on the validity of making authentic deeds.

Abstract

Introduction: The background of this research is that there are still many food products that have not been halal certified, even though the government through the Halal Product Guarantee Agency (BPJPH) has provided convenience in registering halal products online with free assistance. Especially in this metaverse era, where technology has developed rapidly so that the use of digital technology should be able to encourage development through the halal industry.Purposes of the Research: The purpose of this study, firstly, is to know and understand the meaning of halal in both Islamic law and the Civil Code. Second, understanding the halal industry in the metaverse era in terms of the theory of utilitarianism and Maqashid Sharia.Methods of the Research: This study uses a normative juridical method with a legal-statutory approach and a conceptual approach.Results of the Research: The results of this study are: First, that halal in Islamic Law and the Civil Code have different contexts, but have a similar meaning, namely referring to something that is permitted and not prohibited by law. Second, the halal industry based on utilitarianism has utility value both for business actors who register their food products, as well as for the general public as consumers. Furthermore, based on Maqashid Sharia, halal food is included in the category of protecting the soul (nafs) and protecting the mind (aql).

Abstract

Global climate change has become one of the most important issues facing the world today. Climate change can be defined as long-term changes in temperature and weather conditions. The main cause of climate change is the increase in Greenhouse Gas (GHG) emissions into the atmosphere due to various human activities, including industrial and transportation activities. To combat climate change, the international community has developed various agreements and frameworks, including the Kyoto Protocol, followed by the Paris Agreement, which aim to reduce GHG emissions globally. One of the instruments developed to reduce GHG emissions is carbon trading, also known as emissions trading. Carbon trading is a mechanism where companies or countries can buy or sell permits to emit GHGs, known as carbon credits or emission units, with the goal of effectively reducing emissions. Through carbon trading, countries or companies can reduce GHG emissions, helping other countries achieve their emission targets more economically. Indonesia, as a country with high GHG emissions, has a responsibility to reduce emissions in accordance with international commitments such as the Paris Agreement. Although steps have been taken, such as the development of renewable energy, regulations. This research uses a normative juridical legal research method with a conceptual approach and a statute approach. This study will also discuss the role of financial institutions and capital markets in carbon trading in Indonesia, the carbon trading system in Indonesia, and the differences in carbon trading mechanisms between Indonesia and other countries.

Abstract

The Financial Services Authority (OJK) has released a list of registered and licensed fintechs. The Investment Alert Task Force has taken firm action against illegal fintech lending that has the potential to break the law, along with the Indonesian National Police and the Ministry of Communication and Information. Privacy is violated when personal data are collected and shared. In the misuse of fintech lending consumer personal data, consumer rights are violated, and the loss is in the form of immaterial compensation. The legal implications are not only legal consequences with violations committed by the organizer, which result in the imposition of sanctions by the state. This normative legal research uses statutory, conceptual, and comparative approaches with a deductive-analytical method to explain the importance of regulating of personal data consumer protection on fintech lending operators.

Abstract

Basically, providing credit with or without collateral, a credit agreement is a principal agreement that contains about the parties, the object of the agreement between the creditor and the debtor, whose rights and obligations of the parties are even to strengthen the fulfillment of achievements, strengthened by a guarantee agreement that is useful if at the time of the debtor's default, the guarantee can be auctioned and the auction results can be used as the fulfillment of achievements. However, in the case of decision No. 21/Pdt.G.S/2019/PN Tte., even though it has met the requirements of the simple lawsuit requirements in relation to not making a guarantee agreement, there are obstacles in the execution of the object that is placed as collateral in the principal agreement. The purpose of this study is to review and find legal certainty of credit agreements without being accompanied by land guarantee agreements. Second, to examine and find the judge's ratio of the application for collateral confiscation that is not the property of the debtor. Third, to find the concept of related execution in decision No. 21/Pdt.G.S/2019/PN Tte. Ratio decidendi on the application for confiscation of collateral that does not belong to the debtor. The Judge considered that the application for bail confiscation was rejected based on the fact that the plaintiff had no intention that the defendant would move or transfer the object of the dispute and because the examination of this case was carried out based on a simple lawsuit that was limited by the time of the examination, the judge considered it quite reasonable if the petition number 4 of the lawsuit should be rejected. Regulation of the ratio decidendi of execution that supports Article 20 of the Law on the Rights of Dependents. The payment of a certain amount of money can be made by auction, the location of the real execution with the payment of a sum of money.

Abstract

This paper discusses the characteristics of financing agreements in digital credit services (paylater) and their legal protection for creditors. The research method uses a doctrinal with legislation  and conceptual approach. Sources of legal materials include primary and secondary legal materials. The analysis uses prescriptive logic and legal reasoning. The results show that the development of electronic-based payment systems has an effect on the creation of electronic money in a payment system that provides convenience, flexibility, and efficiency in transactions. Electronic-based transactions are growing rapidly along with the changing patterns of people's shopping from offline to online. Marketplace in its development creates financial technology, namely paylater. The paylater implementation is carried out with an online agreement contained in an electronic document using a computer network that is connected. Lenders and lenders are linked by the peer to peer lending (P2P) financial services. The characteristics of the financing agreement in the practice of digital credit services (paylater) are the same as conventional agreements which must meet the terms and elements of the agreement as stipulated in the Civil Code. However, in the paylater financing agreement, apart from the borrower and lender, parties are providing financial services to bring together lenders and loan recipients to enter into a lending and borrowing agreement, namely the marketplace, which is outlined in an electronic document. Legal protection for creditors in case of default can apply for dispute resolution through BPSK, Alternative Dispute Resolution Institutions, and District Courts.

Abstract

Penelitian ini bertujuan untuk mengetahui bentuk perlindungan hukum bagi nasabah BNI apabila terjadinya tindak card trapping yang menyebabkan kerugian. Penelitian ini menggunakan jenis penelitian yuridis normatif. Dalam penelitian hukum normatif berdasar pada hukum primer dan hukum sekunder, maksudnya ialah penelitian yang berkaitan dengan norma dan peraturan perundang-undangan. Pendekatan yang digunakan yaitu pendekatan perundang-undangan dan pendekatan konseptual. Hasil penelitian yaitu perlindungan hukum terhadap kasus card trapping yang mengakibatkan kerugian bagi nasabah bank ini tercantum dalam Undang-Undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen (UUPK) yang dapat dijadikan dasar hukum atas perlindungan hukum bagi nasabah selaku konsumen. Selain itu juga terdapat regulasi dari lembaga-lembaga perbankan yang memiliki kebijakan dalam mengatur secara spesifik mengenai perlindungan hukum bagi konsumen sektor jasa keuangan. Pada kasus card trapping yang terjadi pada Agus Wandira yang telah dirugikan atas tindakan yang dilakukan oleh lembaga perbankan berhak mendapatkan perlindungan hukum untuk mempertahankan hak-haknya. Pasal 4 Undang- Undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen (UUPK) menyatakan bahwa konsumen berhak atas kenyamanan, keamanan, dan keselamatan dalam mengkonsumsi barang dan/atau jasa dan juga hak untuk mendapatkan kompensasi, ganti rugi dan/atau penggantian apabila barang dan/atau jasa yang diterima tidak sesuai dengan perjanjian atau tidak sebagaimana mestinya.

Abstract

PeduliLindung is a contact tracing application initiated by the Government of Indonesia with the aim of tracking the Covid-19 Virus. However, in its implementation, there have been many criticisms and protests from the public regarding the insecurity of personal data protection in the PeduliLindung application. Moreover, until now Indonesia does not yet have a Personal Data Protection Law. This journal discusses how legal protection is for people who use the PeduliLindung application, as well as a comparison of Indonesian laws with other countries that have previously used contact tracing applications and have regulations regarding personal data. The research method used is literature study by studying journals and related laws.
