Abstract

The rapid change of the times, especially in the field of digital technology, universities become catalysts that have an important role in supporting national research and technology. This is what then becomes a supporter in the national development process by creating an Increasingly superior Nation of Indonesia globally. This technology and information have a wide impact on human life, especially in the field of education to support the teaching and learning process to be more efficient and more effective. This educational technology also contributes to the learning skills of various communication media, as well as making it easier to present more concrete information data, especially in universities. Universities should be able to take advantage of technological advances to improve the management and teaching systems in college, it also aims to improve innovation and the quality of teaching, so universities also need to work with the academic community and industry players to be able to improve and create learning methods that will later improve the quality of graduates from universities. Universities must be able to print competitive and qualified human resources in order to be leaders and thinkers of a nation that can determine the development of their country in the future.

Abstract

Lerep village is one of the villages which is promoted as a tourism village according to Regent Decree No. 556/0424/2015 on the Establishment of a Tourism Village in Semarang Regency. The implementation is encouraged by Regulation of Lerep Village No. 4/2015 on the 2016 Working Plan of the Village Government. The development of a village as a tourism village brings positive and negative impacts. The positive impact is that the village can be more advanced and developed by utilizing its natural and cultural potential. The negative impact arising is that there is a significant development of the tourism locations, especially from outside parties. The negative impact that concerns society greatly is the allegation of irregularities or violation of spatial planning. The development will be carried out thoroughly to realize Lerep as a tourism village in terms of its human resources and the infrastructure supporting the tourism activities. The infrastructure development must be well-planned and able to optimize space use. The spatial planning must be able to provide safe, comfortable, productive, and sustainable space for all stakeholders. The realization of spatial planning is carried out by the central and regional governments by involving the society. Society plays a role in controlling space use based on functions and planning in order to realize Lerep tourism village which has awareness of spatial planning.

Abstract

This study aims to provide another alternative in resolving conflicts in Lerep Village which is called the District Court (Peradilan Desa). The village court aims to help resolve conflict problems in Lerep Village so that there is no accumulation of cases in the surrounding District Courts. Village justice is carried out by familial mediation between the person in dispute with the head of the local hamlet and the village head. The decisions given are in the form of suggestions from the hamlet head and village head which are not binding. District justice (Peradilan Desa) is a win-win solution to the conflict in Lerep Village. However, the implementation of this District court still has shortcomings. One of them is the district court does not yet have a reference for regulations in its implementation. Another deficiency is the lack of knowledge in the legal field of the parties acting as intermediaries, such as the hamlet head and village head. The research method used in this research is legal research, legal research is often referred to as doctrinal or normative. Normative legal research examines principles, numbers, concepts, rules, laws and regulations, research decisions, agreements and doctrines that are placed by law as a norm system by examining library studies. The conclusion in this study is that specific regulatory references are needed to regulate the running of village courts. And there must be training to provide basic knowledge to the parties concerned.

Abstract

Social justice concept has been clearly emphasized at Pancasila (the five fundamental values of Indonesia) as one of common values of Indonesia society. Pancasila also recognized as the philosophical grondslag which makes Pancasila as a reference of all Indonesian citizens and State Action, including in governance. The concept of social justice in Pancasila implies that any natural resource management that has the potential to prosper and affect the Indonesian people as a whole must be controlled by the State as well as used for the greatest prosperity of the people. This paper is intended to analyze, describe, and examine the Constitutional Court Decision concerning to social justice especially in terms of economic rights. This paper discusses various decisions of the Constitutional Court that are ultra petita. This paper illuminated and highlighted that in two Constitutional Court Decisions on Water Resources and the Decision on the Electricity Law and the Water Resources Law of the Constitutional Court in its decision to make an ultra petita decision by canceling the entire two laws, because that the article being tested is the heart of the law, thus seriously affecting the implementation of other articles in the law. Therefore, with the ultra petita decision, in the future, the Constitutional Court is expected to be more progressive and responsive in seeing the problems that occur, especially related to the basic economic needs of the Indonesian people. Because the Constitutional Court is the guardian of the constitution whose main function is to maintain Indonesia's highest legal order (constitution).

Abstract

Desa Lerep merupakan salat satu desa wisata yang terletak di lereng Gunung Ungaran, Kabupaten Semarang. Teragam paket wisata yang unik tanpa meninggalkan unsur lokal, salah satunya di bidang kesenian tradisional. Namun, keterlibatan generasi muda pada bidang ini masih tergolong minim. Hal ini dikarenakan kurangnya edukasi perihal kesenian tradisional karawitan tersebut. Oleh karena itu, tim KKN menawarkan solusi berupa program pelatihan karawitan dengan sasaran remaja karang taruna Desa Lerep.  Tujuan program ini adalah untuk mengenalkan dan melatih para remaja Desa Lerep terhadap kesenian karawitan, sehingga dapat diberdayakan dalam kegiatan-kegiatan pariwisata desa.  Metode yang digunakan adalah metode pengabdian dengan pendekatan Community Development dan Partisipatif. Tahapan yang digunakan adalah identifikasi masalah, penentuan tujuan, sosialisasi, pelaksanaan, dan evaluasi. Setelah diadakan pelatihan karawitan, karang taruna mulai berperan aktif dalam berbagai kegiatan pariwisata yang melibatkan bidang kesenian tradisional.

Abstract

A number of activities related to land acquisition for public interest use waqf. The principle of waqf is derived from Islamic Law in which wakif (the owner) donates waqf (in the form of land) to nazhir (the manager of the edified property) for worship purposes. The problems in this paper consist of whether there is a system regarding waqf land acquired for public interest, and how compensation and supervision are given regarding waqf land acquired for developing public interest. Using normative legal research with legislation and conceptual approach, this paper argues that acquisition of waqf land is regulated in Law No. 2/2012 on Land Acquisition for Developing Public Interest and Law No. 41/2004 on Waqf. it is regulated that compensation will be given to nazhir for waqf land acquired. It also regulates that the status of waqf land can be changed into non-waqf one for public interest through exchange mechanism. In order to provide legal certainty over waqf land acquired for public interest, legislation on land acquisition needs to be harmonized with legislation on waqf.

Abstract

AbstractForest management must consider the cultural values of society, aspirations and perceptions, and involve local communities in forest management in the presence of community-based forest management (PHBM). One of the areas that have the potential wealth of natural / forest resources is Kendal. Formulation of the problem, 1) forest management in Kendal?, 2) The role and participation in PHBM in Kendal?, 3) Barriers in PHBM in Kendal ?. This research is a kind of juridical empirical research. Engineering analysis was performed by descriptive analysis. Based on the results of the study, 1) Implementation of forest management in Kendal done involving the community, with the PHBM models, 2) The role and participation of the community with the establishment of the Institute of Forest Village Community (LMDH) / Forest Village Community Association (PMDH), 3) Barriers, less fast accessing information with a range of obstacles. Advice that can be given, among others, 1) Model Forest Management (PHBM) is considered effective. 2) Increasing community participation in the management of forest resources. 3) In order to overcome the obstacles of rural communities to be pro-active with each other to obtain information for the development of forest resource management. AbstrakPengelolaan hutan harus memperhatikan nilai-nilai budaya masyarakat, aspirasi dan persepsi masyarakat, dan melibatkan masyarakat setempat dalam pengelolaan hutan dengan adanya pengelolaan hutan berbasis masyarakat (PHBM). Salah satu daerah yang memiliki potensi kekayaan alam / sumber daya hutan adalah Kabupaten Kendal. Perumusan masalah, 1) Pengelolaan hutan di Kabupaten Kendal ?, 2) Peran dan partisipasi masyarakat dalam PHBM di Kabupaten Kendal ?, 3) Hambatan dalam PHBM di Kabupaten Kendal?. Penelitian ini adalah jenis penelitian yuridis empiris. Tekhnik analisis dilakukan secara deskriptif analisis. Berdasarkan hasil penelitian, 1) Pelaksanaan pengelolaan hutan di Kabupaten Kendal dilakukan mengikutsertakan masyarakat, dengan model PHBM, 2) Peran dan partisipasi masyarakat dengan pembentukan Lembaga Masyarakat Desa Hutan (LMDH) / Perkumpulan Masyarakat Desa Hutan (PMDH), 3) Hambatan, kurang cepat mengakses informasi dengan berbagai kendala. Saran yang bisa diberikan antara lain, 1) Model pengelolaan hutan bersama masyarakat (PHBM) dianggap efektif.2) Meningkatkan peran serta masyarakat dalam pengelolaan sumber daya hutan. 3) Untuk mengatasi hambatan masyarakat desa bersikap saling pro aktif untuk memperoleh informasi untuk pengembangan pengelolaan sumber daya hutan.

Abstract

Penguatan kapasitas aparatur pemerintahan desa untuk menyusun perencanaan desa terpadu menggunakan pendekatan kewilayahan sangat dibutuhkan untuk mendukung pengelolaan desa unggulan. Perencanaan desa terpadu ini akan diawali di Desa Jetis, dengan harapan dokumen tersebut dapat dijadikan referensi bagi seluruh desa di Bandungan, serta menjadi pedoman dalam menentukan kebijakan pengembangan desa unggulan. Model perencanaan partisipatif pembangunan desa dengan mempertimbangkan aspek-aspek tata ruang dan kewilayahan ini diharapkan dapat diimplementasikan untuk menyusun perencanaan yang dibuat di tingkat lokal secara strategis terintegrasi dengan rencana pengembangan antardesa, antardaerah dan pada tingkat yang lebih tinggi (nasional). Pengabdian ini menggunakan teknik pelatihan, pendampingan dan fasilitasi bagi aparat pemerintahan desa dan stakeholders di Desa Jetis Kec. Bandungan untuk menyusun dan mendokumentasikan perencanaan desa terpadu menggunakan pendekatan kewilayahan terkait dengan pemetaan komoditas unggulan. Langkah-langkah yang dibutuhkan adalah: (1)berbagi pengalaman proses pendokumentasian dan perencanaan desa; (2) diseminasi informasi pengelolaan kolaboratif di Desa Jetis; (3) menjaring komitmen semua pihak untuk bekerja bersama dalam perencanaan desa terpadu dan pengelolaannya dengan menggunakan pendekatan kewilayahan berbasis komoditas unggulan. Sebagai target dari kegiatan pelatihan ini adalah tersusunnya perencanaan pembangunan desa terpadu berbasis tata ruang dan kewilayahan terkait dengan pemetaan komoditas unggulan secara partisipatif dan terdokumentasikan dengan baik sekaligus memperkuat kapasitas aparat pemerintahan desa dalam kerangka: (a) melindungi dan memperluas ruang otonomi dan kebebasan masyarakat, (b) membatasi kekuasaan (kewenangan dan intervensi) pemerintah daerah dan pusat, serta melindungi hak-hak prakarsa masyarakat desa, (c) menjamin kekebasan masyarakat desa, (d) melindungi dan membela kelompok yang lemah di desa, (e) menjamin partisipasi dalam proses pengambilan keputusan antara lain, dengan memastikan bahwa masyarakat desa terwakili kepentingannya dalam BPD, dan (f) memfasilitasi perbaikan dan pengembangan kondisi sosial politik-ekonomi masyarakat desa. Untuk itu maka menjadi perlu dimilikinya kemampuan teknis dan pemahaman komperhensif mengenai perencanaan pembangunan desa terpadu berbasis tata ruang dan kewilayahan. Tentunya capaian target kegiatan Pelatihan ini sangatlah spesifik dan teknis yaitu kemampuan BPD dan Aparat desa menyusun dokumen Renstra partisipatif berbasis komoditas unggulan di Desa Jetis.

Abstract

Penataan ruang di suatu wilayah merupakan hal yang urgent untuk dilakukan. Setelah diundangkannya UU No. 26 Tahun 2007. Penataan ruang perlu dilakukan untuk dapat membuat perencanaan terhadap pemanfaatan ruang yang nyaman, berdaya guna sekaligus berhasil guna. Dalam penataan ruang yang baik, diperlukan pengaturan yang berupa perijinan. Dalam implementasinya, penataan ruang perlu partisipasi masyarakat, dengan kewajiban untuk mentaati pengurusan perijinan dalam penataan ruang. Salah satu ijin yang terkait dengan penataan ruang adalah Ijin Mendirikan Bangunan (IMB). Melalui pengurusan IMB saat masyarakat akan mendirikan maupun merenovasi bangunan, pemerintah kota dapat melakukan pendataan apakah di lokasi yang akan dibangun / direnovasi oleh masyarakat tersebut merupakan daerah yang bisa/boleh dibangun dan tidak bertentangan dengan rencana tata ruang pemerintah kota.
