Abstract

The conception of state of law holds the principles of human rights protection and independent as well as unbiased justice in its implementation. The Constitutional Court has a significant role in reviewing constitutionality under the constitution as stipulated in Article 24C paragraph (1) of the Constitution. The Constitutional Court's functions result in final, binding decisions. Judges play a crucial role in implementing impartiality and upholding laws in society. This notion corresponds to Article 5 paragraph (1) of the Law of Judicial Power and the theory of progressive law which view that laws are established for human life. The objectives of this article is: (i) pinpoint the functions of the Constitutional Court in reviewing the Law of Civil Administration; and (ii) uncover the implications of the Constitutional Court Decision Number 97/PUU-XIV/2016. The writer used a normative legal research. The results indicate that (i) in reviewing the Law of Civil Administration the Constitutional Court serves its functions as a constitutional guard, constitutional interpreter, human rights protector, and democracy protector. First, in reviewing a quo law the judges’ considerations are based on the 1945 Constitution as the realization of upholding the constitution. Second, as a constitutional interpreter, the judges interpret religions and beliefs are an integral entity. Third, granting the request of reviewing a quo law is considered as a concrete manifestation of fulfilling and protecting human rights, in this case native-faith followers. Fourth, the request granted provides a clear pathway for acknowledging the identity of native-faith followers so that they can freely practise their faith. (ii) The decision of a quo has massive implications for society and leads to the establishment of laws as a tool of social engineering. Recognizing native-faith followers in civil administration establishes a new norm, ensuring their rights are implemented and fulfilled. Abstract

Law as a means of realizing prosperity, its existence is so crucial in a democratic legal state. This cruciality makes the formation of laws which specifically can be called laws become a matter of concern. Therefore, the principles of nomocracy and democracy are accommodated in the Law on the Formation of Legislation. However, legislative practice that is not in accordance with normative ideas is a prevalence. One of them is the Job Creation Law, the creation of which has resulted in social delegitimization. This writing aims to analyze the problems of the Job Creation Law in the perspective of forming laws and democratic rule of law. The method used is normative juridical with literature study data sources, laws and regulations, and expert opinions. The formation of the Job Creation Law was not lawful and there was minimal public participation. The poor legislative system is shown by the existence of a Government Regulation in Lieu of Law on Job Creation which was later enacted into a law. This illustrates the pattern of non-compliance by the legislators and the form of ignoring the Constitutional Court Decision Number 91/PUU-XVIII/2020.

Abstract

AbstrakPeraturan perundang-undangan yang baik adalah yang harmonis dengan peraturan perundang-undangan lainnya. Ketidakharmonisan antara peraturan perundang-undangan dengan peraturan lain pada tingkat yang sama atau pada tingkat yang berbeda akan menimbulkan masalah yang kompleks. Salah satu contoh kontroversi dalam Revisi Undang-Undang Pemberantasan tindak pidana korupsi (KPK) yang banyak terjadi penolakan oleh berbagai kalangan. dalam pembentukan ataupun Peninjauan Kembali sebuah undang-undang yaitu memperhatikan aspirasi dan kebutuhan hukum masyarakat. Tulisan ini menganalisa mengenai pembentukan Peraturan Perundang-Undang di Indonesia dalam mewujudkan Peraturan perundang-undangan yang Sistematis, Harmonis, Terpadu. Metode yang dipergunakan dalam penelitian ini adalah gabungan dari penelitian normatif yang didukung dengan data - data empiris penelitian lapangan (field research). Pendekatan menekankan pada pencarian norma-norma yang terkandung dalam ketentuan peraturan perundang-undangan dan teori-teori hukum yang ada, serta menggunakan pendekatan konsep (conceptual approach).Hasil pembahasan, bahwa Pengakuan terhadap hukum yang dibuat merupakan suatu hal yang amat penting sehingga setiap tahapan pembuatan peraturan perundang-undangan harus sebaik mungkin di setiap tahap. Salah satu aspek yang berpengaruh yaitu transparansi dan akuntabel yang tercermin dalam melibatkan partisipasi publik/konsultasi publik dalam setiap tahapannya. Sehingga sangat “urgent” jika pemantauan dan peninjauan sangat penting terhadap suatu UU yang telah dibentuk agar publik dapat melakukan judicial review dan juga legislative review.   Kata kunci: pembentukan peraturan perundangan; judicial review; legislatif review

Abstract

This research analyzes the judicial implications of the Constitutional Court’s rulings on structured, systematic, and massive (TSM) violations in Indonesian elections, and their impact on democratic integrity. Using a socio-legal approach, it combines legal analysis with social science perspectives to examine how the Court interprets and applies TSM principles within a broader socio-political context. The study finds that while the Constitutional Court plays a pivotal role in upholding electoral integrity and safeguarding democratic values, significant challenges remain. Chief among these is the difficulty of proving TSM violations, which are often entangled with powerful political interests. These challenges can weaken public trust, hinder accountability, and contribute to a democratic deficit. The study concludes that more robust judicial mechanisms and clearer evidentiary standards are needed to ensure fair adjudication and strengthen Indonesia’s democratic institutions.

Abstract

Digital transformation has emerged as a crucial component of Indonesia’s national development strategy, recognized for its capacity to stimulate economic growth, enhance public services, and improve social welfare. However, the current approach tends to be technocratic, often overlooking vital legal, institutional, and justice-related issues. This study critically assesses examine the adequacy and coherence of Indonesia’s legal and institutional frameworks governing digital transformation to promote inclusive economic growth and social welfare. It identifies regulatory and institutional gaps and recommends strategic reforms for equitable digital governance. Employing a socio-legal methodology that merges doctrinal legal analysis with interdisciplinary insights from political science, economics, and sociology, this research evaluates key legal instruments and institutional practices, alongside global best practices, to determine Indonesia’s readiness for digital transformation. The findings indicate that Indonesia’s progress is hampered by fragmented and reactive legal frameworks, notable regulatory gaps—particularly in data protection and labor rights within the gig economy—and weak institutional coordination. These issues lead to policy inconsistencies, implementation delays, and the exacerbation of existing inequalities. To address these challenges, this study advocates for a systemic reconfiguration of digital governance grounded in democratic principles and inclusive participation. It proposes six strategic pillars: infrastructure, digital human capital, business climate and cybersecurity, research and innovation, funding and investment, and robust legal-regulatory frameworks, to ensure a just and sustainable digital transition.

Abstract

The Job Creation Law (Law No. 11 of 2020) as a national strategic policy has sparked controversy, particularly concerning the protection of land rights for indigenous peoples and vulnerable groups. This research is grounded in the concern that the law shifts the orientation of agrarian policy from a social justice paradigm toward investment acceleration, potentially neglecting constitutional community rights. This study aims to critically examine the Job Creation Law and assess the relevance of international legal principles—especially Free, Prior, and Informed Consent (FPIC) under the United Nations Declaration on the Rights of Indigenous Peoples (UNDRIP)—in safeguarding land rights in Indonesia. Using a library research method and a critical-juridical approach, this study analyzes national legal provisions, international norms, and comparative agrarian regulations in other countries. The findings indicate that the Job Creation Law does not sufficiently incorporate the FPIC principle, weakening the bargaining power of indigenous and local communities in land acquisition for national projects. Furthermore, the lack of an independent oversight mechanism and an effective agrarian dispute resolution system undermines legal protection. Comparative analysis highlights the need to recognize collective rights and community participation. In conclusion, the law should be revised and harmonized with international legal standards to strengthen community rights through inclusive mechanisms and independent institutions

Abstract

This study aims to provide another alternative in resolving conflicts in Lerep Village which is called the District Court (Peradilan Desa). The village court aims to help resolve conflict problems in Lerep Village so that there is no accumulation of cases in the surrounding District Courts. Village justice is carried out by familial mediation between the person in dispute with the head of the local hamlet and the village head. The decisions given are in the form of suggestions from the hamlet head and village head which are not binding. District justice (Peradilan Desa) is a win-win solution to the conflict in Lerep Village. However, the implementation of this District court still has shortcomings. One of them is the district court does not yet have a reference for regulations in its implementation. Another deficiency is the lack of knowledge in the legal field of the parties acting as intermediaries, such as the hamlet head and village head. The research method used in this research is legal research, legal research is often referred to as doctrinal or normative. Normative legal research examines principles, numbers, concepts, rules, laws and regulations, research decisions, agreements and doctrines that are placed by law as a norm system by examining library studies. The conclusion in this study is that specific regulatory references are needed to regulate the running of village courts. And there must be training to provide basic knowledge to the parties concerned.

Abstract

In the midst of Indonesia's ongoing wave of development, agrarian conflicts that manifest in land grabbing have become increasingly prominent, despite frequently lacking clear legal justification. This study critically examines the role of law in facilitating and grabbing and interrogates the mechanism through which legal frameworks come to serve such a function. It addresses a significant gap in the scholarly discourse concerningthe legal dimensions of land dispossession. Employing a non-doctrinal approach, this research draws upon an extensive literature studies, regulatory analysis, and judicial decision reviews. The findings reveal that land grabbing in Indonesia is not merely driven by informal practices or extralegal coercion. Rather, it is frequently facilitated through legal instruments, most notably within the framework of National Strategic Projects (PSN). These projects demonstrate how the law is mobilized to legitimize dispossession, masking structural violence behind the veneer of legality. In this context, the emancipatory vision of Indonesian agrarian law faces systemic erosion. Rather than fading passively, it is actively dismantled under the influence of neoliberal imperatives embedded in post-1997 policy reforms. Ultimately, this study shows that law is not a neutral arbiter in agrarian conflict, but a powerful tool of accumulation by dispossession.

Abstract

Land tenure conflicts in protected forest areas are one of the most complex agrarian issues that remain unresolved to this day. This phenomenon occurs due to the imbalance between the state's legal claims through forestry policies and the socio-economic realities of communities that have long lived and worked on land within forest areas. One concrete case is found in the Protected Forest Area Register 45B Pekon Sukapura, West Lampung Regency. The community in this area faces legal uncertainty, criminalisation, and limited economic and social access due to the lack of legal recognition of their existence. This study aims to formulate an integrative conflict resolution model, taking into account the legal, social, and ecological dimensions in a holistic and contextual manner. This study uses a legal-sociological approach with descriptive-qualitative methods. Data was collected through in-depth interviews with the head of the land office, village chief, traditional leaders, and community members, as well as through document analysis of regulations, institutional reports, and academic studies. Analysis was conducted thematically, linking findings to Rawls' theory of social justice and Chambliss & Seidman's theory of how law works. The results of the study indicate that conflict resolution in the Register 45B area requires an integrative policy model, namely a model that combines the legalisation of community rights through TORA-based agrarian reform mechanisms, active community participation to achieve social justice, and efforts to maintain the ecological protection function of the area. This integrative model is expected to serve as an applicable policy framework for resolving agrarian conflicts in protected forest areas in a fair, sustainable, and inclusive manner.

Abstract

The environment is a fundamental right of every citizen, as enshrined in Article 28H of the 1945 Constitution of the Republic of Indonesia. However, the enactment of Law No. 6 of 2023, which ratifies Government Regulation in Lieu of Law (Perppu) No. 2 of 2022 concerning Job Creation, has amended several crucial provisions in Law No. 32 of 2009 on Environmental Protection and Management. This study aims to analyze the impact of these amendments and deletions on environmental governance mechanisms. Using a normative juridical approach and literature-based research, the study qualitatively analyzes changes to key articles. The results show that amendments to Articles 24, 25(c), and 26 narrow public participation in the Environmental Impact Assessment (EIA/AMDAL) process. The deletion of Articles 36, 38, and 40 weakens legal oversight over environmentally impactful businesses/activities. Moreover, the revision of Article 88 undermines the principle of strict liability. These findings indicate policy shift toward accelerating investment at the expense of environmental governance, potentially weakening supervision and law enforcement mechanisms. It is concluded that changes brought by the Job Creation Law create imbalance between economic development and environmental sustainability, while also risking the neglect of the public's right to healthy and safe environment.
