Abstract

Lerep village is one of the villages which is promoted as a tourism village according to Regent Decree No. 556/0424/2015 on the Establishment of a Tourism Village in Semarang Regency. The implementation is encouraged by Regulation of Lerep Village No. 4/2015 on the 2016 Working Plan of the Village Government. The development of a village as a tourism village brings positive and negative impacts. The positive impact is that the village can be more advanced and developed by utilizing its natural and cultural potential. The negative impact arising is that there is a significant development of the tourism locations, especially from outside parties. The negative impact that concerns society greatly is the allegation of irregularities or violation of spatial planning. The development will be carried out thoroughly to realize Lerep as a tourism village in terms of its human resources and the infrastructure supporting the tourism activities. The infrastructure development must be well-planned and able to optimize space use. The spatial planning must be able to provide safe, comfortable, productive, and sustainable space for all stakeholders. The realization of spatial planning is carried out by the central and regional governments by involving the society. Society plays a role in controlling space use based on functions and planning in order to realize Lerep tourism village which has awareness of spatial planning.

Abstract

Comparing the disclosure of public information regarding the dissemination and publication to the public of newly enacted rules, setting Indonesia and the Netherlands as parameters is interesting as the legal cultures of both countries are intertwined and legal perspectives are constantly evolving. Despite differences in the rule of law, both countries have similar regulatory frameworks. This research uses a normative juridical writing method with a literature study to analyze the relationship between good governance and public information disclosure, including definitions, indicators, objectives, and important factors that influence the concept. The aim is to serve as a comparison parameter for a more efficient information disclosure mechanism. In Indonesia, the role of DPRDs is closely related to the issue of public information disclosure, as DPRDs have a dominant role in authority. Meanwhile, in the Netherlands, the local government takes the lead in setting regulations. Nonetheless, both countries emphasize the importance of checks and balances through the establishment of RvD and KIP, to oversee and integrate the aspirations of the community. The results of this study suggest that public information disclosure is important in both Indonesia and the Netherlands, as demonstrated by regulations that prioritize transparency, accountability, public participation, responsiveness, and the rule of law in governance. This commitment to openness aims to bridge the gap between public expectations and government actions. And in conclusion, the harmony between the process of forming regulations involving the DPRD as a representative of the people's voice and information disclosure is interrelated in public services towards the achievement of good governance.

Abstract

The Purpose of this research is to find a formula for harmonizing, consolidating, and refining the concept of draft laws. Harmonization activities are based on policy formulation (regulation system) and material harmonization (substance), with the aim of adjusting the existing national legal system to the new legal system, creating a harmonious law as a positive law (harmony of law). The plural nature of the places where harmonization, consolidation, and refinement of the concept of draft laws occur are the Indonesian House of Representatives (DPR) - Committee on Legislation (Baleg), the Government - Ministry of Law and Human Rights (Depkumham), and the Regional Representative Council (DPD) - Committee on Legislation and PPUU. This makes the practice of harmonization have different interpretations from each institution, which highlights the need for agreement among these institutions in determining standardization in harmonization, consolidation, and refinement of the concept of draft laws. Furthermore, an analysis is needed to determine the appropriate time for harmonization, consolidation, and refinement of the concept of draft laws, whether it should be done before submitting the bill as is currently done, or after discussions are completed, or both before and after. Therefore, it is necessary to investigate the effectiveness of the implementation of the activities of harmonizing, consolidating, and refining the concept of draft laws to minimize the filing of judicial reviews at the Constitutional Court.

Abstract

The increasing internet penetration in Indonesia has provided adolescents to expose pornographic content advertently. It inevitably includes other adverse impacts like fraud and violence, which begin with cyberspace. Also, cyberbullies on the internet have become a serious concern on how the government has anticipated it to prevent more practices in this cross-border experience. This study aimed to address the causes and impacts of online-based media on adolescents with the following preventive measures to reduce increasing cases of cyberbullying in Indonesia. This study used legal research in assessing the issue by sourcing primary data from statutory regulations and secondary data from academic resources. This study showed that cyberbullying continues to become an annoying issue among children, adolescents, and adults. The existing regulations provide insufficient protection preventing these practices because it does not specifically regulate its types and forms at defining cyberbullying. It suggested introducing a more specific regulation that outlines cyberbullying in ensuring the protection amidst the more borderless communication to prevent more adverse impacts on victims. Abstract

The good laws and regulations are in harmony with other laws and regulations. The disharmony of a statutory regulation with other regulations, both at the same level and at different levels, will cause a complex problem. As a result, these regulations can be canceled due to things that are contrary to constitution, laws and other regulations. This research is a qualitative research. The research method used is a combination of normative research supported by empirical field research data, namely research that uses information from research targets or subjects who are usually called informants or respondents through data collection instruments such as interviews and then combines it with data from library materials, especially those related to legal issues. Indonesia based on Law No. 12 of 2011 in conjunction with Law 15 of 2019 has determined a review system and monitoring in law formation, but the best practice from French regarding legislation reviews by independent institutions, called constitutional council and evaluation methods that implement by Australian with the sunset regulation and rescheduling culled methods provides a new perspective on the formation and evaluation in Indonesia, there will be consequences in adopting it either partially or completely that will be discussed in further research.

Abstract

Modernisasi sektor pertanahan yang diawali dengan penggunaan layanan pertanahan berbasis elektronik, khususnya digitalisasi sertifikat tanah, sudah tidak dapat dihindari lagi di Indonesia karena telah memasuki era digital. Dalam rangka meningkatkan ukuran akses masyarakat terhadap pelayanan publik dan kemudahan berusaha, Peraturan Menteri Agraria dan Tata Ruang/Kepala Badan Pertanahan Nasional No. 1 Tahun 2021 tentang Sertipikat Elektronik bertujuan untuk memodernisasi pendaftaran tanah melalui penyelenggaraan pelayanan pertanahan berbasis elektronik. Masalahnya adalah adanya hambatan dalam menciptakan skema yang memungkinkan pemegang sertifikat digital untuk melindungi tanah dan hak-hak hukum mereka. Dalam hal keamanan, sertifikat elektronik secara teknis lebih aman daripada sertifikat analog (manual). Dengan mengurangi kemungkinan pemalsuan sertifikat, menghentikan transaksi tanah ilegal seperti yang dilakukan oleh mafia tanah, dan menyederhanakan transaksi yang melibatkan bidang tanah, nilai tambah ini akan membantu pemegang sertifikat tanah elektronik.

Abstract

Reforma agraria merupakan kebijakan yang bertujuan untuk mengurangi ketimpangan kepemilikan dan penguasaan lahan di masyarakat pedesaan. Tujuan ini diharapkan dapat mendorong transformasi mobilitas sosial yang lebih merata serta meningkatkan kesejahteraan ekonomi dan sosial masyarakat desa. Reforma agraria tidak hanya berkaitan dengan redistribusi lahan, tetapi juga menyangkut peningkatan akses masyarakat terhadap sumber daya agraria yang lebih luas, seperti teknologi, modal, dan pasar. Penelitian ini menganalisis dampak reforma agraria terhadap mobilitas sosial dan ekonomi masyarakat desa, dengan memperhatikan aspek distribusi aset, peningkatan kapasitas masyarakat, serta partisipasi dalam proses ekonomi. Hasil penelitian menunjukkan bahwa reforma agraria dapat menjadi katalis dalam meningkatkan taraf hidup masyarakat desa, baik melalui peningkatan akses ekonomi maupun perubahan posisi sosial masyarakat. Dengan demikian, kebijakan reforma agraria yang inklusif dan berkelanjutan diharapkan dapat memperkuat kemandirian dan daya saing masyarakat desa di tingkat nasional.

Abstract

The discussion in this article departs from the issues about the continuity of work of outsourced workers who are trying to be protected by the principle of Transfer of Undertaking Protection of Employment. The articles were prepared non-doctrinally in order to address the issue by incorporating outsourced workers by using the interview method and the statute approach. As a result, the TUPE principle failed to provide protection to outsourced workers. Which failure results from the practice of terminating the work agreement when the contract of business cooperation ends. Furthermore, the protection of the continuity of work for outsourced workers is based only on the moral obligations of the new outsourcing company. Based on the causes of this failure, the development of labour law must impose legal obligations on new outsourcing companies by incorporating the TUPE clause into the contract of business cooperation between the outsourcing company and the user company.

Abstract

Dengan penekanan pada peran redistribusi tanah dalam menurunkan kesenjangan ekonomi, meningkatkan produktivitas, dan memberdayakan masyarakat pedesaan, penelitian ini berupaya untuk mengkaji bagaimana reforma agraria berdampak terhadap pembangunan ekonomi lokal di Indonesia. Di Indonesia, reforma agraria dipandang sebagai langkah yang diperhitungkan untuk mengatasi masalah ketimpangan kepemilikan lahan yang sudah berlangsung lama, khususnya di daerah pedesaan di mana mayoritas masyarakatnya bergantung pada pertanian sebagai sumber pendapatan utama mereka. Dengan redistribusi tanah yang lebih adil, Pemerintah ingin membuat masyarakat kecil menjadi lebih baik dan membuka peluang bisnis baru yang dapat meningkatkan perekonomian lokal. Namun, sejumlah permasalahan sering menghambat efektivitas program ini, termasuk kurangnya pengetahuan penerima manfaat tentang cara mengelola lahan secara berkelanjutan dan produktif, terbatasnya akses mereka terhadap sumber daya modal, dan tidak adanya infrastruktur pendukung.

Abstract

Penelitian ini membahas kebijakan reforma agraria di Brasil, Jepang, Zimbabwe, dan Indonesia untuk memahami pendekatan, hasil, dan tantangan dalam redistribusi lahan. Reforma agraria bertujuan mengatasi ketimpangan tanah dan meningkatkan kesejahteraan petani, tetapi pelaksanaannya dipengaruhi faktor sosial, ekonomi, dan politik. Brasil berupaya mengurangi ketimpangan melalui redistribusi lahan latifundia, namun terkendala resistensi pemilik tanah besar dan konflik sosial. Jepang berhasil menciptakan distribusi lahan adil pasca-Perang Dunia II dengan dukungan pemerintah, meningkatkan produktivitas pertanian. Di Zimbabwe, reforma agraria yang tergesa-gesa menyebabkan krisis ekonomi dan penurunan produktivitas. Indonesia menunjukkan kemajuan melalui program Perhutanan Sosial dan TORA, meski terhambat konflik lahan. Studi ini menyoroti pentingnya perencanaan matang, dukungan kebijakan, dan partisipasi masyarakat dalam reforma agraria untuk mencegah dampak negatif. Kesuksesan reforma agraria memerlukan pendekatan holistik, mencakup dukungan politik, kapasitas lokal, dan pengelolaan konflik.
