Abstract

Banyaknya konflik di bidang pertanahan yang muncul ke permukaan dapat menimbulkan kesan bahwa tanah yang sering disebut sebagai sumber kemakmuran dan kesejahteraan rakyat seakan-akan telah beralih menjadi sumber pemicu timbulnya konflik dalam Masyarakat. Sesuai dengan uraian latar belakang di atas, dapat di rumuskan beberapa masalah antara lain: Bagaimana penerapan hukum tukar guling tanah adat dengan tanah perseorangan dan Bagaimana tanggung jawab perangkat desa dengan tukar guling tanah adat perorangan. Jenis penelitian yang digunakan pada penulisan skripsi ini adalah Ilmu Hukum Empiris metodologi penelitian Ilmu Empiris isu hukumnya adalah terjadi kesenjangan antara norma atau ketentuan peraturan perundang-undangan pelaksanaan praktek lapangan. Hasil dari penelitian ini adalah Penerapan hukum tukar guling tanah adat dengan tanah perseorangan melalui musyawarah. Musyawarah ini harus dilakukan secara terbuka, dengan melibatkan semua pihak yang berkepentingan. Tanggung jawab perangkat desa dengan tukar guling tanah adat perorangan tidak hanya terbatas pada aspek hukum, tetapi juga meliputi tanggung jawab sosial, administratif, moral, dan profesional.

Abstract

Legalitas Akta Notaris Berbasis Cyber Notary Sebagai Akta Otentik sebagai perkembangan dunia Teknologi Informasi dan Komunikasi (Information Comunication Technology) sebagai tuntutan terhadap peran notaris dalam menggunakan konsep cyber notary agar tercipta suatu pelayanan jasa yang cepat, tepat dan efesien, sehingga mampu mempercepat laju pertumbuhan ekonomi berdasarkan Undang-Undang Nomor 2 Tahun 2014 tentang Perubahan atas Undang-Undang Nomor 30 Tahun 2004 tentang Jabatan Notaris dan Undang- Undang Nomor 11 Tahun 2008 tentang Informasi dan Transaksi Elektronik, namun dalam keadaad dewasa ini Akta notaris yang menggunakan cyber notarytidak memiliki pembuktian yang sempurna layaknya akta otentik, hal tersebut karena akta notaris dengan menggunakan cyber notary tersebut tidak memenuhi syarat keotentikan suatu akta yang tertuang dalam Pasal 1868 KUHPerdata

Abstract

Pancasila, as the source of legal morality of Indonesia, is used as the primary benchmark by Judges of the Constitutional Court in providing decision. The paper at hand explains that the constitutional court decision Number 90/PUU-XXI/2023 has moral weaknesses related to legal behaviour derived from Pancasila, specifically, First: Constitutional Court Decision had led to conflict and arising different views that potentially might cause disruption to Indonesia nation entity. Second: Constitutional Court Decision does not fully align with the Wisdom in Deliberation principle contained in the Fourth Principle of Pancasila. Third: Constitutional Court Judgment does not satisfy the sense of justice for Indonesian People. This paper employs a normative research method with a conceptual approach and a value-based approach.

Abstract

This research discusses the issue of the existence of gubernatorial regulations Bali No. 1 of 2020 concerning the Governance of Balinese Fermented and/or Distilled Drinks, what is the Legal Certainty and Benefits. The aim of the research is to see to what extent the existence of Bali Gubernatorial Regulation No. 1 of 2020 can regulate the issue of governance of Balinese fermented and/or distilled drinks and whether this regulation can provide legal protection, legal certainty and benefits as expected. The problem that will be discussed is related to the Management of Balinese Fermented and/or Distilled Drinks Efficacy and Benefits for the people of Bali. Normative legal research methods with a statutory approach, historical approach, and conceptual approach. The research results show that the Governor based on his authority and function can issue Governor regulations, but materially, the substance regulated therein cannot conflict with the substance that has been regulated in the statutory regulations above. This study shows that the substances regulated in PERGUB1/2020 is contrary to the above regulations (PERPRES 74/2013) therefore, based on the principle of Lex Superior Derogat Legi Inferiori, Gubernatorial Regulation No. 1/2020 cannot normatively be enforced as a product of binding statutory regulations, thus its existence cannot provide legal protection and benefits for the community.

Abstract

Pada bulan Juni 2025 yang lalu, Israel melakukan serangan militer yang disebut sebagai serangan preventif untuk menghancurkan instalasi nuklir Iran dan mencegah Iran mengembangkan senjata nuklir, namun hingga saat ini masih belum ada bukti konkrit yang menyatakan bahwa Iran benar-benar membuat senjata nuklir tersebut. Dimana terdapat perjanjian Internasional yang mengatur terkait dasar tatanan program nuklir global yang bernama The Nuclear Non-Proliferation Treaty (NPT). Penelitian ini menggunakan metode socio-legal, dengan pendekatan kualitatif dan bersumber dari sumber kepustakaan, yang akan membahas bagaimana dinamika konflik antara Iran-Israel hingga implikasinya terhadap tatanan perjanjian NPT. Dapat disimpulkan, telah terjadinya asimetri kedaulatan nuklir antara Israel-Iran. Dimana kapabilitas nuklir milik Israel tidak dipertanyakan atau dipermasalahkan, serta, standar ganda telah terjadi dengan bebasnya negara-negara yang tidak menandatangani NPT, dimana Iran mendapat tekanan secara global akibat program nuklirnya. Hal demikian tentu saja akan menimbulkan efek domino proliferasi berupa erosi kepercayaan terhadap NPT. Sehingga negara-negara merasa tidak percaya lagi terhadap perjanjian nuklir tersebut, hingga berujung pada denunsiasi dan perpecahan rezim

Abstract

Desa Kedis, yang terletak di Kecamatan Busungbiu, Kabupaten Buleleng, Bali, memiliki kekayaan alam dan tradisi yang unik, termasuk sistem hukum adat yang diwariskan secara turun-temurun. Penelitian ini bertujuan untuk menganalisis Prasasti Jaka Tebel Kedis sebagai sumber hukum tertulis kuno yang berfungsi sebagai "kompas" atau tolok ukur bagi pemahaman dan implementasi aturan desa (awig-awig) di Desa Kedis. Metode penelitian yang digunakan adalah hukum normatif, dengan fokus pada analisis isi Prasasti Jaka Tebel Kedis sebagai bahan hukum primer, serta literatur hukum adat dan penelitian terkait sebagai bahan hukum sekunder. Hasil penelitian mengidentifikasi norma-norma hukum yang tercantum dalam prasasti, termasuk ketentuan mengenai kepemimpinan desa, pembagian tugas dalam upacara adat, dan tata cara pelaksanaan ritual keagamaan. Analisis komparatif antara norma dalam prasasti dan awig-awig modern Desa Kedis mengungkapkan adanya kesinambungan dan adaptasi nilai-nilai hukum seiring dengan perkembangan zaman. Penelitian ini menyimpulkan bahwa Prasasti Jaka Tebel Kedis tidak hanya merupakan catatan sejarah, tetapi juga mengandung prinsip-prinsip hukum mendasar yang relevan untuk memahami akar tradisi hukum adat Desa Kedis dan berpotensi untuk revitalisasi nilai-nilai luhur dalam menghadapi dinamika masyarakat kontemporer

Abstract

Indonesia’s COVlD-19 first cinfirmed case was found in March 2020 and continued to increase until September 2020. As the number of cases increased, the government applied a Large-Scale Social Restrictions Policy (PSBB) to help minimize additional cases. With the implementation of the UN policy by the government, many have lost income from various sectors whose livelihoods depend on their daily income. The disruption of economic activity due to the lockdown policy to contain the spread of the virus has led to the closure and bankruptcy among many companies, resulting in a massive reduction in the number of workers and layoffs, especially in the sectors most affected by the pandemic. Many workers who are laid off make people lose their source of livelihood, forcing them to be more creative in order to struggle. One of them is the improvised street merchants, where the car is used as a selling space, which helps people in terms of economic turnover. However, selling on the roadside without a permit is an offence. The municipal police (Satpol PP) need to discipline the street merchants since they violate the Regional Regulation No. 1/2015 concerning Public Order. This regulation has been violated by many merchants and thus, it needs to be brought back into order. Keywords:  Fostering, street merchants

Abstract

This research demonstrates that lawmaking in Indonesia prioritizes procedural compliance while confining public participation to a symbolic and ineffective function in achieving substantive moral legitimacy. This orientation obstructs the transition from procedural morality to substantive morality and weakens the relationship between law and morality, which remains susceptible to political interests and lacks a coherent normative foundation. This research aims to examine the participation deficit in Indonesian lawmaking and to reconstruct the integration of morality by bridging the gap between formal participation and substantive moral legitimacy. This research employs a normative juridical method through conceptual, statutory, and comparative approaches to analyze the structure and function of participatory mechanisms. The findings reveal that symbolic participation constitutes the principal weakness in Indonesian lawmaking, as institutions satisfy procedural requirements without ensuring that public participation shapes normative outcomes, thereby producing a gap between formal legality and moral legitimacy. Comparative analysis demonstrates that effective institutional design enables participation to function as a substantive mechanism that articulates and realizes public interests within the legal system. This research develops a three-layer framework. First, the material element ensures that participation reflects substantive public interests and societal values within legal norms. Second, the formal element ensures that participatory procedures operate effectively, inclusively, and systematically within the lawmaking process. Third, the obligation element requires institutions to process, respond to, and incorporate public input into binding legal outcomes. This research concludes that reconstructing participation as a determinative institutional mechanism aligns legal processes with substantive moral outcomes, strengthens public trust, and secures sustainable legal legitimacy in Indonesia.

Abstract

Tri Hita Karana in balinese customary law as a basis for the settlement of the village boundary conflict in bali is the title used in this reseacrh, to demonstrate that the philosophical Tri Hita Karana is an extraordinary thought to solve the problems of the Balinese people, especially to solve the problem of village boundaries in Bali. The technicalities of the philosophical Tri Hita Karana are Parhyangan, Pawongan, Palemahan, so that the Balinese only see three technicalities of Tri Hita Karana. The objectives of this study is to examine the real form of the concept of Tri Hita Karana in resolving village boundary conflicts, and to examine the role of Pekraman Village in implementing the Tri Hita Karana concept as the guardian of the life balance of the Krama/Villager of his village community. This research method uses normative methods, namely legal research that examines written law from various aspects. This research analysis used is the analytical approach to History (approach of Historical analysis). The results revealed that Balinese people in resolving their problems, especially related to village boundaries, must always hold on to the concrete steps of Tri Hita Karana, namely Parhyangan, Pawongan, and Palemahan to shape the behavior of Balinese people to bring about conflict resolution by means of family negotiations, and mutual respect and try to understand the problem by way of consensus agreement to achieve good together and create harmony.

Abstract

Judge’s an instrument of justice that are at the forefront in enforce the justice in society, but sometime the judge’s decision does not represent justice in society, because the judge’s in conducting the trial should follow existing the systems. Just as judge’s as adherent of the civil law system. In this paper describes the civil law system, started from Roman era, German, Francis, as well as elements of a definition of the civil law systems, and then discusses the judges in the civil law system, and discuss any weaknesses civil law2 judges in terms of implementing the trial in finding justice in society.
