Abstract

The relativity in applying mitigating factors in corruption case verdicts often leads to legal uncertainty and inconsistency with the principles of substantive justice. This study aims to analyze how mitigating factors influence substantive justice by employing John Rawls’ theory of justice and to evaluate judicial legal reasoning through Neil MacCormick’s theory. Employing a normative juridical approach, this research conducts an in-depth analysis of legal literature and relevant theories. The results reveal that the variable application of mitigating factors may lead to inconsistencies between judicial rulings and the principles of substantive justice, especially when social impacts are overlooked. Moreover, the absence of structured standards leads to variations in judicial reasoning, causing public dissatisfaction with the judicial system. This study recommends the development of more stringent and measurable guidelines, as well as enhanced knowledge and training for judges to integrate substantive justice theories and legal reasoning into practice, thereby improving transparency, consistency, and the legitimacy of court rulings.

Abstract

Abstrak Objek dalam pembahasan jurnal ini berlokasi di kawasan wiasata alam sangeh yang mana di dalamnya terdapat berbagai habitat fauna dan flora, fauna yang terbanyak adalah Kera abu-abu (Macaca fascicularis) kurang lebih 600 ekor dan flora pohon pala di kawasan hutan wisata alam sangeh. Perlindungan Kawasan wisata alam sangeh melibatkan desa adat dalam melindungi dan mengelola kawasan wisata alam sangeh, baik itu melindungi habitat monyet dan satwa lainnya maupun fauna yang ada di kawasan hutan wisata alam sangeh, perlindungan kawasan hutan wisata berbasis adat di desa sangeh dapat dilihat berupa bentuk kearifan lokal berbentuk bangunan suci (pura), maupun adanya Tri Hita Karana di dalam aturan adat, peran adat dalam melindungi kawasan hutan wisata sangeh dapat dilihat pada awig-awig desa adat Sangeh serta dibentuknya kelembagaan sadar wisata oleh desa adat sangeh untuk mengelola dan melindungi kawasan hutan wisata sangeh. Kata Kunci: Perlindungan, Kawasan Hutan dan Desa Adat Abstract Objects in the discussion of this journal are in the area of natural tourism sangeh which in it there are various habitats of fauna and flora, the fauna is gray monkey (Macaca fascicularis) approximately 600 head and flora of nutmeg trees in the forest area of sangeh natural forest. Abstract

Maritime safety is a fundamental aspect of sea transportation activities that must be fulfilled by every ship operator and passenger. One of the key instruments in ensuring safety at sea is the use of life jackets, as stipulated in Article 1, Number 32 of Law Number 66 of 2024 concerning Shipping, which states that lifesaving equipment, including life jackets, constitutes mandatory safety gear that must be available, in good condition, and easily accessible to passengers. This study aims to determine the level of implementation of life jacket usage regulations at Sanur Port and to identify the factors that hinder their enforcement. The research employs a juridical-empirical method with a qualitative approach, involving interviews and observations with ship operators, passengers, and port officers. Secondary data were obtained through a literature review of relevant laws and maritime safety regulations. The findings indicate that the implementation level of life jacket usage regulations at Sanur Port remains suboptimal, as evidenced by passengers’ low awareness, weak supervision by officers, and the limited quantity and quality of available life jackets. Therefore, enhanced public awareness campaigns, stricter supervision, and stronger law enforcement are required to ensure that the application of Article 1, Number 32 of Law Number 66 of 2024 is effective in supporting maritime safety at Sanur Port.

Abstract

This study aims to analyze and formulate strategies for solving problems arising in the future towards the existence of natural attractions Pengempu Waterfall related to prevention of land use conversion in the tourist area of Pengempu Waterfall in the traditional village of Cau Belayu. Pengempu waterfall located in the area of Cau Belayu traditional village, Tabanan Regency, Bali Province is a new natural tourism area in the region. Besides having natural beauty that can be used as a tourist place, the Pengempu waterfall area is also a sacred area by Hindus to perform prayer activities, meditation and activities related to the spiritual. To preserve the existence of the Pengempu waterfall area so that it is not damaged by the negative impacts caused by tourism activities in the area, it is necessary to have customary law to protect the area of Pengempu waterfalls, because the existence of customary law by Balinese is very important for traditional life in Bali to organize the physical condition of the region and managing the social conditions of the community. The legal approach used in this study is an approach to the concept of legal pluralism. From the results of research that has been carried out, it was found that the existence of customary law to protect the area of Pengempu waterfall to touch the beliefs of the surrounding community in managing the Pengempu waterfall area to maintain the Pengempu waterfall area so that its sustainability has sufficiently dominant power.
