Abstract

The rapid growth of accommodation businesses in the Dieng tourism area has not been accompanied by adequate compliance with business licensing regulations, despite the region’s promotion as a halal tourism destination. This condition raises significant legal, governance, and consumer protection issues, particularly in relation to the implementation of halal tourism principles. This study aims to examine accommodation licensing procedures and their practical implementation from a halal tourism perspective in Patakbanteng Village and Dieng Village, Kejajar District, Wonosobo Regency. The research adopts a qualitative field study design with an empirical juridical approach. Data were collected through in-depth interviews with accommodation business operators and relevant government officials, field observations, and documentation, and were analyzed using the interactive model of Miles and Huberman. The findings reveal that compliance with accommodation licensing requirements remains low, especially among small-scale businesses such as homestays and cabins. The main obstacles are not merely regulatory complexity but also limited legal literacy, administrative constraints, and the perception among business owners that licensing provides minimal direct benefits to business sustainability. From a halal tourism perspective, weak business legality undermines effective supervision of halal standards, safety, and comfort for Muslim tourists. This study concludes that business licensing constitutes a strategic legal instrument for strengthening halal tourism governance, ensuring legal certainty, consumer protection, and sustainable tourism development. Accordingly, enhanced government engagement through legal education, technical assistance, and consistent supervision is essential to improve licensing compliance in emerging halal tourism destinations.

Abstract

The integration of local traditions into Islamic marriage law presents a complex dynamic in Indonesia, particularly within the Samin community in Blora Regency, which firmly adheres to the tradition of weton calculation or “ilmu titen”. This study aims to analyze the legal standing of the weton tradition within the framework of Islamic law (‘urf) and to deconstruct its cultural meaning using Roland Barthes’ Semiotic Myth theory. Employing empirical legal research methods with a juridical-sociological approach, this qualitative study collected data through in-depth interviews, participatory observation, and documentation in Kediren Village, the historical center of Samin teachings. The results indicate that the weton tradition is systematically integrated into the Nyumuk, Nyuwito, and Paseksen marriage stages, where this calculation serves not as a fatalistic prediction, but as an instrument for psychological risk management and a form of cautious effort (ikhtiar). The study concludes that weton qualifies as ‘urf shahih (valid custom) as it has harmonized with the pillars of Islamic marriage without violating the principles of monotheistic faith (tauhid). Furthermore, as a semiotic myth, weton functions to naturalize cultural values into perceived natural truths, effectively maintaining the communal identity and social order of the Samin community amidst modernization

Abstract

Debates surrounding arranged marriage in Muslim societies often focus on the ambiguous boundary between consent and coercion, particularly when marital practices involve familial authority, religious leadership, and cultures of collective obedience. This article examines arranged marriage practices at one of the oldest pesantren salaf (traditional Islamic boarding school) in Semarang Regency, Indonesia, by analyzing how marital consent is produced and negotiated within socio-religious relationships. Employing a socio-legal approach, this study draws on participatory observation and in-depth interviews with key informants directly involved in pesantren matchmaking and marriage practices. The findings reveal that arranged marriage within the pesantren functions not merely as a mechanism for family formation but also as a means of reproducing religious authority, patronage networks, and elite pesantren structures through endogamous marriage patterns, spouse selection criteria based on lineage (nasab) and religious competence, and cultures of obedience toward the kiai (Islamic religious leader) and parents. Marital consent is shaped through the internalization of barokah (divine blessing), deference to religious authority, and moral convictions regarding obedience as an integral component of santris’ (Islamic students) piety. At the same time, contemporary generations of santris increasingly negotiate these practices through reflexivity, personal preferences, and emotional considerations in spouse selection. This article argues that consent in pesantren arranged marriages cannot be understood dichotomously as either a fully autonomous choice or absolute coercion. Rather, it constitutes a form of negotiated religious consent while remaining subject to reflexive negotiation by contemporary santris. These findings contribute to broader debates on arranged marriage in Muslim societies and demonstrate that living Islamic law is continuously shaped through interactions among religious authority, local culture, and individual agency. [Perdebatan mengenai perjodohan dalam masyarakat Muslim sering kali berpusat pada batas yang ambigu antara persetujuan dan paksaan, terutama ketika praktik perkawinan melibatkan otoritas keluarga, tokoh agama, dan budaya kepatuhan kolektif. Artikel ini mengkaji praktik perjodohan di salah satu pesantren salaf tertua di Kabupaten Semarang, Indonesia, dengan menganalisis bagaimana persetujuan dalam perkawinan diproduksi dan dinegosiasikan dalam relasi sosial-keagamaan pesantren. Penelitian ini menggunakan pendekatan sosio-legal melalui observasi partisipatif dan wawancara mendalam terhadap sejumlah informan kunci yang terlibat langsung dalam praktik perjodohan dan perkawinan di pesantren. Temuan penelitian menunjukkan bahwa perjodohan di pesantren tidak hanya berfungsi sebagai mekanisme pembentukan keluarga, tetapi juga sebagai sarana reproduksi otoritas religius, jaringan patronase, dan struktur elite pesantren melalui pola perkawinan endogami, kriteria pemilihan pasangan berbasis nasab dan kapasitas keagamaan, serta budaya kepatuhan terhadap kiai dan orang tua. Persetujuan dalam perkawinan dibentuk melalui internalisasi nilai keberkahan, penghormatan terhadap otoritas religius, dan keyakinan moral mengenai pentingnya kepatuhan sebagai bagian dari etika kesalehan santri. Pada saat yang sama, generasi santri kontemporer mulai menegosiasikan praktik tersebut melalui refleksivitas, preferensi personal, dan pertimbangan emosional dalam memilih pasangan hidup. Artikel ini berargumen bahwa persetujuan dalam perjodohan di pesantren tidak dapat dipahami secara dikotomis sebagai pilihan individual yang sepenuhnya bebas ataupun sebagai bentuk pemaksaan absolut. Sebaliknya, persetujuan tersebut merupakan bentuk persetujuan agama yang tetap dinegosiasikan secara reflektif oleh generasi santri kontemporer. Abstract

The purpose of this study is to find out how the Tiktok shop live streaming hosting service remuneration system is based on the perspective of Michel Foucault's power relations theory and the ijarah contract. The type of research used is field research with qualitative methods and uses a descriptive analysis approach. Data collection techniques by way of observation and interviews. Data findings in the form of research facts that are logically and systematically outlined and then analyzed are used as conclusions from the research. The results of this study are the power relations that occur between the employees of the live streaming Tiktok shop host and the owner of the Gemaz Salatiga Shop in line with the power relations theory coined by Michel Foucault regarding power and knowledge. This is evidenced by the behavior and decisions that are applied by the owner of the Gemaz Salatiga Store to employees such as determining the work system, working time and determining the wage system. Then the analysis uses the ijarah contract, the Tiktok shop live streaming host fee system is included in the ijarah al-amal contract. Judging from the terms and pillars of the ijarah contract, the Tiktok shop live streaming host fee system has been fulfilled. However, the principle of fairness should be a reference for the rulers of live host streaming services.
