Abstract

Pengawasan partisipatif merupakan inisiatif untuk melakukan kegiatan diluar lembaga pengawas untuk dapat memastikan berjalannya tahapan pelaksanaan pemilihan umum dengan mengumpulkan data dan informasi, kemudian menginventarisasi hasil kasus-kasus yang berkaitan dengan proses penyelenggaraan pemilihan umum yang dilakukan oleh kelompok atau organisasi masyarakat yang bersifat independen. Pemilihan Umum (Pemilu) itu sendiri merupakan landasan dasar berjalannya praktek demokrasi. Tujuan penelitian ini adalah untuk memahami pengawasan partisipatif dalam rangka upaya menjaga nilai-nilai demokrasi. Metode yang digunakan dalam penelitian ini adalah penelitian kualitatif. Peneliti melakukan observasi dan interview dengan para komisioner Badan Pengawas Pemilu (Bawaslu) Kota Salatiga dan masyarakat guna memahami gagasan, tujuan dan implementasi dari pengawasan partisipatif pada pemilu tahun 2019 di Kota Salatiga. Temuan penelitian ini mendapatkan bahwa pengawasan partisipatif dengan melibatkan masyarakat untuk turut serta dalam kegiatan pengawasan proses ke-pemilu-an merupakan hal yang relevan. Terobosan pengawasan partisipatif yang dilakukan Bawaslu Salatiga melalui beberapa program seperti pembentukan kampung pengawasan dan kampung anti politik uang. Pengawasan partisipatif pemilu memuat keseluruhan tujuan hukum seperti yang dikatakan Gustav Radbruch. Sementara dalam kajian ahkam al-sulthaniyah, pengawasan partisipatif memberikan kemaslahatan dalam proses pemilihan imamah.

Abstract

This article examines how two mainstream Indonesian newspapers—Kompas and Republika—construct competing discourses around the prospect of female royal leadership in the Yogyakarta Sultanate. Focusing on the 2015 succession controversy triggered by Sultan Hamengku Buwono X’s decision to open the throne to his eldest daughter, the study investigates how media narratives invoke Islamic law, royal tradition, and gendered authority. Using Norman Fairclough’s three-dimensional Critical Discourse Analysis, the article analyses news reports and opinion pieces published between March and May 2015 to uncover how linguistic choices, sources, and intertextual references are mobilised to legitimise or contest a woman’s claim to the throne. The findings show that Republika frames the issue through a conservative Sharia-based perspective, emphasising religious orthodoxy and patriarchal norms. On the other hand, Kompas adopts a more pluralist and constitutionalist framing that normalises female leadership as congruous with democratic and cultural change. The primary argument advanced in this article is that the core site of contention is not Islamic law per se, but the way Sharia is selectively interpreted and circulated through media discourse to support competing hegemonic projects concerning gender and authority. Theoretically, the study demonstrates that media discourse serves as a critical arena in which Sharia, gender authority, and cultural legitimacy are negotiated, thereby making an essential contribution to Islamic legal studies and critical media analysis.

Abstract

The rapid growth of accommodation businesses in the Dieng tourism area has not been accompanied by adequate compliance with business licensing regulations, despite the region’s promotion as a halal tourism destination. This condition raises significant legal, governance, and consumer protection issues, particularly in relation to the implementation of halal tourism principles. This study aims to examine accommodation licensing procedures and their practical implementation from a halal tourism perspective in Patakbanteng Village and Dieng Village, Kejajar District, Wonosobo Regency. The research adopts a qualitative field study design with an empirical juridical approach. Data were collected through in-depth interviews with accommodation business operators and relevant government officials, field observations, and documentation, and were analyzed using the interactive model of Miles and Huberman. The findings reveal that compliance with accommodation licensing requirements remains low, especially among small-scale businesses such as homestays and cabins. The main obstacles are not merely regulatory complexity but also limited legal literacy, administrative constraints, and the perception among business owners that licensing provides minimal direct benefits to business sustainability. From a halal tourism perspective, weak business legality undermines effective supervision of halal standards, safety, and comfort for Muslim tourists. This study concludes that business licensing constitutes a strategic legal instrument for strengthening halal tourism governance, ensuring legal certainty, consumer protection, and sustainable tourism development. Accordingly, enhanced government engagement through legal education, technical assistance, and consistent supervision is essential to improve licensing compliance in emerging halal tourism destinations.

Abstract

The integration of local traditions into Islamic marriage law presents a complex dynamic in Indonesia, particularly within the Samin community in Blora Regency, which firmly adheres to the tradition of weton calculation or “ilmu titen”. This study aims to analyze the legal standing of the weton tradition within the framework of Islamic law (‘urf) and to deconstruct its cultural meaning using Roland Barthes’ Semiotic Myth theory. Employing empirical legal research methods with a juridical-sociological approach, this qualitative study collected data through in-depth interviews, participatory observation, and documentation in Kediren Village, the historical center of Samin teachings. The results indicate that the weton tradition is systematically integrated into the Nyumuk, Nyuwito, and Paseksen marriage stages, where this calculation serves not as a fatalistic prediction, but as an instrument for psychological risk management and a form of cautious effort (ikhtiar). The study concludes that weton qualifies as ‘urf shahih (valid custom) as it has harmonized with the pillars of Islamic marriage without violating the principles of monotheistic faith (tauhid). Furthermore, as a semiotic myth, weton functions to naturalize cultural values into perceived natural truths, effectively maintaining the communal identity and social order of the Samin community amidst modernization
