Abstract

Islamic teachings are very complete, its teachings regulate all human problems including the problems of wealth which must be alms. Nowadays the problem of debt is the hottest issue for the people of Indonesia. Many people whose lives are inseparable from debt. The debt is used for consumptive purposes, daily living expenses and the debt is used for productive purposes, for business purposes and so on. It causes problems when connected with alms problems. This issue makes the researcher interested in analyzing it with the research title: “Analysis of Islamic Law Regarding The Alms of wealth for indebted people”. The formulation of the problems: 1. How is the analysis of Islamic law regarding the alms of the wealth of the debtor? Is the person who has a debt oblige or not oblige to pay alms? 2. Which should take precedence between paying debt and paying alms?. This research aims to find out as clearly as possible about the alms of wealth of those who are in debt. And to find out about things that must take precedence between paying alms and paying debt. This research is normative research which is descriptive. Data Collection of library research used analysis qualitative data. Based on the data and analysis, it can be concluded that: First, the Analysis of Islamic Law concerning the alms of the wealth of the debtor. If the debt is used for consumptive purposes, he is not obliged to pay alms, because his life needs are not fulfilled, the person is classified as poor, he is not including the rich who are obliged to pay alms. If debt is used for productive purposes, whose person borrows money for business purposes, it is not to cover basic needs but loans are used to add wealth. After being paid the debt due, his wealth is still up to senisab, he is obliged to pay alms. Second, It takes precedence between paying debts and alms. If someone faces two obligations at the same time, paying debt and alms, then he must first pay the debt and then pay the alms. Ajaran Islam sangat lengkap, mengatur seluruh permasalahan manusia.juga mengatur masalah harta yang wajib dizakatkan. Masa kini masalah hutang merupakan persoalan terhangat bagi masyarakat Indonesia. Banyak orang yang hidupnya tidak terlepas dari hutang. Baik hutang itu digunakan untuk kepentingan konsumtif, untuk biaya hidup sehari-hari, maupun hutang itu digunakan untuk kepentingan produktif, untuk kepentingan bisnis dan sebagainya. Sehingga menimbulkan masalah jika dihubungkan dengan masalah zakat. Permasalahan inipenting untuk diteliti, membuat peneliti tertarik untukmenganalisisnya dengan judul penelitian: “Analisis Hukum Islam Tentang Zakat Harta Orang yang Berhutang”.  Rumusan masalahnya: 1. Bagaimanakah analisis hukum Islam tentang zakat harta orang yang berhutang ?Apakah orang yang mempunyai hutang wajib atau tidak wajib membayar zakat ?.  2. Mana yang harus didahulukan antara bayar hutang dengan membayar zakat ?. Penelitian ini bertujuan untuk mengetahui sejelas mungkin,  tentang zakat harta orang yang berhutang. Dan untuk mengetahui tentang hal yang harus didahulukan antara bayar zakat dan bayar hutang. Penelitian ini termasuk penelitian hukum normative, yang bersifat deskriptif. Pengumpulan data library research,  dengan sistem analisis data kualitatif.  Berdasarkan data dan analisis yang dilakukan, disimpulkan bahwa: Pertama, Analisis Hukum Islam tentang zakat harta orang yang berhutang. Jika hutangnya digunakan untuk kepentingan konsumtif, iatidak wajib membayar zakat, karena keperluan hidupnya saja tidak terpenuhi, orang tersebut tergolong miskin, tidak termasuk orang kaya yang wajib mengeluarkan zakat. Jika hutang digunakan untuk keperluan produktif, dimana orang meminjam uang untuk kepentingan bisnis, bukan untuk menutupi kebutuhan pokok tetapi pinjaman digunakan untuk menambah kekayaan. Setelah dibayar hutangnya yang jatuh tempo, hartanya masih sampai senisab dia wajib membayar zakat.  Kedua,Hal yang harus di dahulukan antara bayar hutang dengan zakat. Jika seseorang menghadapi dua kewajiban pada waktu yang bersamaan yaitu membayar hutang danzakat, maka terlebih dahuluia harus membayar hutang kemudian baru membayar zakatnya,Kata Kunci : Hukum Islam, Zakat, Orang yang berhutang. Abstract

Konsep negara hukum merupakan basic demand dari sebuah bangsa. Seluruh negara di dunia ini, tidak ada yang tidak mencantumkan dalam dasar negaranya, baik itu yang berbasis komunis, liberal, agama, kebangsaan maupun lainnya. Islam adalah suatu agama yang komprehensif; menyatukan pelbagai persoalan moril dan materil, serta mencakup pelbagai kegiatan manusia dalam kehidupan dunia dan akhirat. Istilah nomokrasi adalah pilihan yang paling tepat untuk dipergunakan dalam penyebutan “negara hukum”, versi syariat Islam, bukan “teokrasi”. Prinsip-prinsip nomokrasi Islam meliputi prinsip kekuasaan sebagai amanah, prinsip musyawarah, prinsip keadilan, prinsip persamaan, prinsip pengakuan dan perlindungan setiap hak-hak asasi manusia, prinsip peradilan yang bebas, prinsip perdamaian, prinsip kesejahteraan dan prinsip ketaatan rakyat. Negara hukum Pancasila berlandaskan pada nilai ketuhanan, kemanusiaan, integritas, musyawarah dan keadilan. Negara hukum Pancasila merupakan hasil dari hubungan konsepsi kombinatif; Islam, Barat dan Indonesia. Dengan demikian prinsip yang terdapat negara hukum Pancasila merupakan bagian dari nilai yang terdapat dalam nomokrasi Islam.

Abstract

ISLAM  : STATE,  POLITICS,  AND  DEMOCRACY.  Islam,  as a comprehensive religion, does not recognize the dichotomy between religion and the state, politics, and democracy. As a religion,  Islam possesses  universal  doctrines  on  the  matter  of state,  politics  and democracy  which  also  become  parts  of thead-din  al-Islami.  As  part of  the  phenomenon  of  civilization, culture and Islamic values are developed to be in tune with the social institutions affected by the situation  and the dynamics of space and time. histrorical  and socio-cultural  factors and socio- Muslims also have an effect on the analysis and understanding of the universal teachings. The emergence of differences in analysis of a variety of state and political issues is caused by such different interpretations (polyinterpretable) which, finally, influences the formulation  of political  thoughts  and practices  in contemporary Muslim countries. This article tries to open up minds that Islam is not merely a ritual religion which contains  a set of doctrines, but it also possesses a holistic, universal, and systematic   views toward worldly life.

Abstract

The interpretation of the Qur'an is often disputed. The terms of custom, culture and ideology is not one thing that descends from the sky. It is shaped by humans and socialized from one generation to other. Biological determinism has also reinforced the view. In such situations, the differences, discrimination, and injustice resulting from mistakes in understanding and interpreting the universal doctrine, create injustices against women, including the women’s rights and position in Lampung Sebatin customary law community. This article discusses the rights and position of women in Lampung Sebatin customary law community and the form of injustice for women in the society. The conclusion shows that, firstly, women's rights and position in Lampang Sebatin customary law community are far from fair principles. Not fair either in marriage law or inheritance law. Second, the form of injustice for women in indigenous communities of Lampung Sebatin, from gender analysis is marginalization, penomorduaan and labeling, violence, and excessive workload.

Abstract

Endogamous marriage is a union between tribes, ethnicities, and families in the same environment. Endogamous marriage in the family environment is a marriage between cousins and descendants who are the same or still have a family relationship between the two. Marriage or nayuh in the Saibatin community is carried out by people of the same tribe, one faith, and even some with close relatives. The meaning of close is marriage between third cousins and so on. With the development of the current era, the marriage system among clans or tribes has faded after a shift in social values. This study aims to analyze endogamous marriages in the Saibatin tribe according to the perspective of Islamic law. This research is field research with a descriptive-qualitative approach. The research subject comprises a married couple who have entered an endogamous marriage. The research location is in three villages from several sub-districts in West Lampung Regency. The results of the researcher's survey of respondents and correspondents show that endogamous marriages did not conflict with Islamic law. According to maqasid shari'ah, it is judged as permissible to be carried out as the law is daruriyat because it is to maintain religion, soul, mind, offspring, and property. According to urf, it is judged as shahih urf because it does not conflict with Islamic law and is based on taghayurul ahkam wal amkinah. Endogamous marriages are rare due to shifting social values in local customary law; as for the marriage law, it is mubah.

Abstract

The title of the article is HeForShe's Role in Palembang Society. She invites men of all ages as equal partners in building a women's rights movement and implementing a shared vision of gender equality that benefits all humanity. The campaign sought to actively involve men and boys in a movement initially conceived as "women's struggle by women. The first issue raised was the role of HeForShe's campaign in protecting women in Palembang society. Second is a review of Islamic law on HeForShe's role in protecting women. This type of research is research this termasuk todalam descriptive research qualitative meetup will research yan g digunwill examine the condition of scientific objects, dimana researcher As a key instrument, data collection techniques are carried out in combination, inductive data analysis and qualitative research results emphasize meaning rather than generalization. From the results of this study, it can be concluded that the achievement of gender equality through the HeForShe Campaign is realized through the role of HeForShe in Indonesia to support and achieve gender equality in the form of training, socialization, and education aimed at the community, workers, and students. One of the activities is raising awareness among men and women about the Sriwijaya Smart Women's Movement (GPCS). Women's protection is included in the Adz-Dzaruriyah maslahat, which is an effort to protect women; women need this protection to carry out their rights and obligations properly. The policy of maslahah must be in accordance with the objectives of Islamic Law; that is, it must not contradict the Qur'an and the Sunnah and must be in accordance with the purpose of Islamic Law, namely al-maqāṣid al-Syari’ah, according to researchers, to be appropriate and appropriate.

Abstract

Hukum waris yang berlaku di Indonesia sampai saat ini masih pluralistik, ada hukum waris Islam, hukum waris Barat dan hukum waris adat. Di Indonesia, ketiga sistem hukum waris itu, masih berlaku sampai sekarang. Salah satunya pembagian harta waris masyarakat adat lampung Saibatin menggunakan sistem kekerabatan patrilineal. Sistem Kekeluargaan patrilineal menarik keturunan menurut garis bapak, dimana kedudukan anak laki-laki lebih tinggi dibandingkan kedudukan anak perempuan, termasuk dalam kewarisan perempuan tidak dihitung sebagai ahli waris. Dalam kekeluargaan patrilineal, harta pusaka dari orangtuanya tidak dibagi dan dikuasai anak tertua. Sistem pewarisan semacam ini dalam hukum adat disebut sistem mayorat. Artinya hak pakai, hak mengolah dan memungut hasilnya dikuasai sepenuhnya oleh anak laki laki tertua, dilihat dari teori keadilan ini memunjukkan bahwa anak perempuan bagi masyarakat adat Saibatin diperlakukan tidak adil sebagai ahli waris. Penelitian ini bertujuan untuk menganalisis kedudukan anak perempuan dalam sistem kewarisan mayorat. Penelitian ini berbasis lapangan dengan teknik pengumpulan data melalui wawancara, observasi, dan dokumentasi. Hasil dari analisis permasalahan menyatakan bahwa dalam sistem kekerabatan patrilineal, anak perempuan apabila sudah menikah akan menjadi keluarga dari suaminya dan keluar dari kerbat orangtuanya. Sedangkan, ketidakadilan yang dikonstruksi dan dilanggengkan oleh tradisi tersebut menjadi hukum bagi masyarakat adat Lampung Saibatin

Abstract

The policy problem of enforcing traffic violations by children during the Covid-19 pandemic is important to discuss based on the impact on the safety of children and the safety of others. The safety impacts are both caused by the threat of accidents and the threat to safety due to the spread of Covid-19. Specifically, this study will address the policy problems of enforcing traffic violations against children during the Covid-19 pandemic in three aspects, namely positive legal aspects, Islamic law and legal culture. This research was conducted at the Tulang Bawang Police Resort by interviewing the traffic department and studying traffic violation documents. Data analysis uses an analytical normative approach based on positive legal theory, Islamic law and legal culture. Legally, the enforcement of traffic violations by children during the Covid-19 pandemic is based on policy regulations. Legally, the policy is positive in accordance with the provisions of the Government Administration Act. According to Islamic law, the policy contains dharuriyat matters and culturally the law of children and their parents as well as law enforcement officers to put forward a culture of obeying the law.

Abstract

The local government of Bandar Lampung City has enacted Regional Regulation Number 1 of 2018 on Community Harmony and Public Order with the aim of creating a peaceful and orderly environment, especially for the people of Bandar Lampung. The government faces numerous challenges in addressing societal issues, such as the presence of informal businesses or street vendors (PKL) that disrupt public order, comfort, and the city's aesthetics. These vendors use public spaces like sidewalks meant for pedestrians, parking areas, and roadside areas for their businesses, causing disorder, traffic congestion, and littering due to waste disposal. This research is descriptive in nature, using qualitative methods. The findings indicate that the government has not been able to establish firm policies for implementing sanctions and providing guidance to the community and street vendors to achieve benefits without causing harm to any party. Therefore, the effectiveness of implementing Regional Regulation Number 1 of 2018 on Community Harmony and Public Order in Bandar Lampung City can be observed as functioning well. From a siyāsah dusturiyyāh perspective, the government has not been able to formulate clear policies to achieve benefits without causing harm to any party, as explained in the fiqh principles that all matters concerning the Muslim community should lead to what is good.

Abstract

The subject of this study is based on article 149 letters (b) Compilation of Islamic law which reads: ex-husband must provide maintenance, maskan, and kiswah to ex-wife during the iddah, unless the ex-wife has been granted talaq bain or nusyuz and is not pregnant. There are two barriers for an ex-wife to earn a living during the period of iddah, namely because the wife is divorced ba'in and or because the ex-wife is nusyuz. In general, the wife filed for divorce in court because she could no longer stand her husband's treatment of her. As a result of the law, if the wife who filed for divorce sues the Court, then the panel of judges will issue a divorce. Unless the husband violates the talaq. In the context of the wife falling into the act of nusyuz, generally as a result of the treatment and conduct of the husband towards the wife. If this is returned to the sound of the law then it will be very felt the injustice received by the wife (ex-wife). This study seeks to find the answer from the formulation of the problem "Why is contra legem important for the judge in deciding the case (inconcritoplaintiff) divorce with the decision of talaq ba'in and or proven in court nusyus wife's arbitrary because of the husband treatment of his wife? Materials and data are obtained by methods library research, the nature of the research is normative research. The goal to be achieved is to provide an alternative solution in providing justice and legal protection to women (ex-wives) who do not get iddah alimony because of filing a lawsuit or nusyus with a theory approach contra legem. Positive law in practice is not sufficiently able to accommodate the legal facts revealed in the Court, in another narrative it can be said that positive law always lags behind social reality. So in the legal system in Indonesia, the judge's ijtihad to deviate and or find the law is accommodated by the principle of Contra legemin order to provide justice and benefits to the community seeking justice, the judge needs to do contra legem.Keywords: Contra Legem; Iddah Livelihood; Divorce Lawsuit; Judge's Decision
