Abstract

Philanthropy which is a voluntary action aimed at enhancing social welfare, faces significant challenges related to the misuse of funds that can undermine public trust. Regulatory weaknesses, particularly Law No. 9 of 1961, demonstrate inadequacies in accommodating the developments of modern philanthropy, such as digital fundraising. Consumer protection in the context of Civil Law must encompass clear regulations regarding the rights and responsibilities between donors, managers, and beneficiaries, while Constitutional Law emphasizes the need for a robust constitutional framework to oversee philanthropic activities. Collaboration between the state, regulatory bodies, and civil society is crucial for creating a transparent and accountable system. The utilization of Indonesia's demographic and cultural potential, with the value of mutual assistance as a foundation, can support income redistribution and sustainable community empowerment, thereby ensuring that philanthropy effectively contributes to enhancing social welfare.

Abstract

Penelitian ini membahas transformasi tantangan hukum di era disrupsi menjadi instrumen penegakan hukum yang berkeadilan, dengan fokus pada strategi adaptasi dan inovasi di tengah perkembangan teknologi. Penelitian ini menemukan bahwa adaptasi terhadap teknologi tidak hanya meningkatkan efisiensi penegakan hukum tetapi juga memungkinkan terciptanya keadilan yang lebih inklusif. Transformasi tantangan hukum di era disrupsi menjadi instrumen penegakan hukum yang berkeadilan melalui strategi adaptasi dan inovasi di tengah perkembangan teknologi meliputi perkembangan teknologi yang sangat pesat sehingga menimbulkan berbagai permasalahan seperti kejahatan cyber crime, privasi dan keamanan data serta teknologi ai untuk menjawab itu semua hukum harus melakukan perubahan di berbagai sektor seperti perubahan terhadap regulasi undang-undang meningkatkan sumber daya penegak hukum dan melakukan riset di bidang hukum.

Abstract

Abstract The criminal justice system is a crucial component of maintaining order and justice in society. It plays a vital role in upholding the law, punishing offenders, and providing a sense of justice to victims. One of the primary instruments within the criminal justice system is punishment. In the context of punishment, life imprisonment stands as one of the most severe penalties that can be imposed by a court. This punishment is reserved for perpetrators of extremely serious crimes deemed worthy of a lifetime behind bars without the possibility of parole. This raises a fundamental question: what is the primary purpose of utilizing life imprisonment within the criminal justice system? This inquiry delves into the four pillars of sentencing: reformation, restraint, retribution, and deterrence. This study employs a normative juridical approach, relying on the analysis of secondary data. Secondary data encompasses information gathered through literature review, drawing upon sources such as laws, legal theories, jurisprudence, and previous research in the form of journals, theses, dissertations, and essays. The extracted data is then analyzed using a qualitative approach and presented in descriptive language. The research reveals that the provisions regarding life imprisonment in the new Criminal Code (Law No. 1/2023) and the old Criminal Code (WvS) exhibit no significant differences in terms of the penal provisions themselves. However, a notable distinction lies in the new Criminal Code's introduction of requirements for convicts to qualify for life imprisonment. Furthermore, the new Criminal Code outlines clearer sentencing objectives compared to the old Criminal Code. Keywords: life imprisonment, Criminal Code. Abstrak Sistem peradilan pidana merupakan komponen penting dalam menjaga ketertiban dan keadilan dalam masyarakat. Sistem ini memainkan peran penting dalam menegakkan hukum, menghukum pelanggar, dan memberikan rasa keadilan bagi para korban. Salah satu instrumen utama dalam sistem peradilan pidana adalah hukuman. Dalam konteks pemidanaan, hukuman penjara seumur hidup merupakan salah satu hukuman terberat yang dapat dijatuhkan oleh pengadilan. Hukuman ini diperuntukkan bagi pelaku kejahatan yang sangat serius yang dianggap layak untuk dipenjara seumur hidup tanpa kemungkinan pembebasan bersyarat. Hal ini menimbulkan pertanyaan mendasar: apa tujuan utama dari penggunaan hukuman penjara seumur hidup dalam sistem peradilan pidana? Penelitian ini menyelidiki empat pilar pemidanaan: reformasi, pengekangan, pembalasan, dan pencegahan. Penelitian ini menggunakan pendekatan yuridis normatif dengan mengandalkan analisis data sekunder. Data sekunder mencakup informasi yang dikumpulkan melalui studi kepustakaan, dengan menggunakan sumber-sumber seperti undang-undang, teori-teori hukum, yurisprudensi, dan penelitian terdahulu dalam bentuk jurnal, tesis, disertasi, dan esai. Data yang diperoleh kemudian dianalisis dengan menggunakan pendekatan kualitatif dan disajikan secara deskriptif. Hasil penelitian menunjukkan bahwa ketentuan mengenai pidana penjara seumur hidup dalam KUHP yang baru (UU No. 1 Tahun 2023) dan KUHP yang lama (WvS) tidak menunjukkan perbedaan yang signifikan dalam hal ketentuan pidana itu sendiri. Namun, perbedaan yang menonjol terletak pada pengenalan persyaratan bagi narapidana untuk memenuhi syarat untuk dijatuhi hukuman penjara seumur hidup dalam KUHP yang baru. Selain itu, KUHP yang baru juga menjabarkan tujuan pemidanaan yang lebih jelas dibandingkan dengan KUHP yang lama. Kata kunci: Penjara seumur hidup, KUHP.

Abstract

A clear national insight can guarantee the achievement of national interests, both internally and externally. This means that national insight provides a clear picture and direction for the nation's survival, as well as the future development of the nation and state. The organization of national and state life must proceed on the basis of mutual agreement, namely Pancasila, the 1945 Constitution, the Unitary State of the Republic of Indonesia (NKRI), and Bhinneka Tunggal Ika (Unity in Diversity). Indonesia's existence as a state based on the rule of law (rechtstaat) based on Pancasila and the 1945 Constitution requires the development of Pancasila ideology and national insight as instruments that serve as catalysts or drivers in strengthening national insight and spirit, love of the homeland, democracy, legal awareness, respect for diversity, and participation in building a Pancasila-based nation in Wonogiri, especially among intellectuals. In accordance with its function, the Pancasila Ideology and National Insight Development organizes national, democratic, legal, multicultural and citizenship education to support the realization of citizens who are aware of their rights and obligations, as well as intelligent, skilled and have character so that they can be relied upon to build the nation and the Unitary State of the Republic of Indonesia.

Abstract

This study analyzes the paradigmatic dilemma of Indonesia’s narcotics law: the necessity of strict prosecution against transnational syndicates versus the humanitarian crisis of prison overcrowding caused by the incarceration of addicts. Law Number 35 of 2009 concerning Narcotics embodies a philosophical dualism (retribution vs. rehabilitation), yet its implementation is dominated by a punitive orientation. The purpose of this research is to analyze the philosophical tension within Law 35/2009 and project the implications of its legislative synchronization with the restorative principles in the new Criminal Code (Law 1/2023). The method used is normative juridical with a prescriptive character, utilizing statutory, conceptual, and comparative approaches. The results conclude that the new Criminal Code risks significant failure in resolving the capacity crisis due to restrictions on alternative sanctions for crimes carrying penalties of over five years, which covers the majority of Narcotics cases. The codification attempt also potentially weakens the prosecution of transnational crimes due to the incomplete adoption of special investigation techniques. The primary recommendation is a firm legislative synchronization that separates jurisdiction: the new Criminal Code as lex generalis for minor users, and the Narcotics Law as a strengthened lex specialis to target dealers, supported by the implementation of factual decriminalization based on public health.

Abstract

This study explores the integration of customary law and government regulations in environmental protection, emphasizing the role of community perceptions in shaping effective legal frameworks. Marginal ecosystems, such as coastal areas, urban fringes, and sacred natural sites, often face vulnerability due to fragmented governance systems that fail to coordinate customary practices with formal legal structures. The research investigates how integrating local traditions and state regulations can enhance biodiversity conservation, improve community engagement, and ensure the long term sustainability of environmental management efforts. Findings reveal that when customary laws are formally recognized and incorporated into state regulations, they significantly enhance the legitimacy and effectiveness of conservation policies. Communities in regions like Bali, Indonesia, and Pacific Islands have shown that hybrid legal approaches, which respect traditional ecological knowledge, result in greater participation and trust in conservation activities. However, challenges such as administrative complexity, lack of standardized guidelines, and the need for adequate funding and support for community based governance hinder the full potential of this integration. The study highlights the importance of simplifying legal processes and fostering mutual understanding between customary practices and formal regulations to achieve successful ecosystem protection. This research emphasizes the need for policy reforms that ensure the inclusion of customary law in environmental governance frameworks, ultimately promoting a more inclusive, adaptive, and sustainable approach to managing marginal ecosystems.

Abstract

Tindak pidana pemerkosaan merupakan kejahatan serius yang sering menghadapi kendala pembuktian karena minimnya saksi mata. Penelitian ini bertujuan untuk menganalisis pelaksanaan, fungsi, dan kedudukan Visum et Repertum pada tahap penyidikan tindak pidana pemerkosaan di Polres Wonosobo. Penelitian ini menggunakan metode yuridis empiris dengan pendekatan deskriptif kualitatif. Pengumpulan data dilakukan melalui wawancara dengan penyidik Unit Pelayanan Perempuan dan Anak (PPA) Polres Wonosobo serta studi kepustakaan. Hasil penelitian menunjukkan bahwa Visum et Repertum berfungsi vital sebagai alat bukti permulaan dan petunjuk arah penyidikan (guiding evidence) untuk mengungkap kebenaran materiil. Pelaksanaan visum di Polres Wonosobo berjalan sesuai prosedur hukum yang berlaku, dimulai dari laporan polisi hingga penerbitan surat permintaan ke fasilitas medis. Namun, terdapat hambatan signifikan berupa keterlambatan pelaporan dan penolakan korban akibat trauma psikologis, yang berdampak pada degradasi bukti fisik. Disimpulkan bahwa Visum et Repertum memiliki kedudukan strategis sebagai alat bukti surat dan keterangan ahli yang sah menurut KUHAP untuk memperkuat keterangan korban dan menjamin kepastian hukum, meskipun efektivitasnya sangat bergantung pada kecepatan pelaporan dan sinergi antar instansi penegak hukum.

Abstract

Organic waste management remains a major challenge in many regions, including Kalibeber Village, Wonosobo Regency, where household organic waste is generally discarded without proper processing, resulting in accumulation at the Final Disposal Site (TPA). This community service program aimed to equip residents, particularly members of the PKK RT 05 RW 11 Munggang Bawah, with knowledge and skills in processing organic waste into compost. The implementation methods included needs assessment, socialization, training, and evaluation through pre-test and post-test. A total of 40 participants took part in the training, which was conducted through a combination of lectures, hands-on practice, and the provision of household composting equipment. The evaluation results indicated a significant improvement in participants’ knowledge, from 35–50% in the pre-test to 80–90% in the post-test. The highest improvement was observed in the understanding of the benefits of composting (50%) and the basic techniques of compost production (48%). These findings demonstrate that participatory-based training is effective in enhancing environmental literacy, strengthening practical skills in organic waste management, and fostering sustainable practices at the household level. Consequently, this program contributes to reducing the volume of waste disposed of at the TPA while supporting the creation of a cleaner, healthier, and more productive community environment.
