Abstract

This study aims to explain the legal regulation of electronic document forgery in Indonesia as well as the form of criminal liability in the case of electronic document forgery of PT Toyobo Japan. Forgery of electronic documents is regulated through the general provisions of the Criminal Code and special provisions in the Electronic Information and Transactions Law that provide a legal basis for the act of creating, altering, and distributing counterfeit digital documents. This study uses a normative juridical method with a legislative approach and a case approach, based on the analysis of primary and secondary legal materials. The results of the study showed that the perpetrators deliberately created fake email accounts and manipulated payment instruction documents to illegally divert funds. These acts meet the elements of intentionality, responsible ability, unauthorized access, and the creation of false electronic documents as stipulated in the Criminal Code and the ITE Law. Thus, the perpetrators can be held criminally responsible as the main perpetrator or participate based on the applicable legal provisions.

Abstract

The rapid advancement of digital technology has contributed to the increasing prevalence of online gambling in Indonesia, giving rise to significant social and legal challenges. This study examines the criminal liability of online gambling perpetrators based on Court Decision Number 100/Pid.Sus/2024/PN Sda and evaluates the appropriateness of the legal reasoning adopted by the court. This research employs a normative juridical method with a statutory and case approach by analyzing the Criminal Code (KUHP), the Information and Electronic Transactions Law (ITE Law), and relevant judicial decisions. The findings indicate that the judge correctly applied the constituent elements of the online gambling offense under Article 303 of the Criminal Code and Article 27 paragraph (2) in conjunction with Article 45 of the ITE Law, supported by electronic evidence and witness testimony. The decision affirms that active participants in online gambling activities may be held criminally liable under both the Criminal Code and the ITE Law. This study contributes theoretically by clarifying the construction and application of the lex specialis principle in online gambling cases and offers practical insights for law enforcement officials in assessing electronic evidence similar cases.

Abstract

Penimbunan anak Sungai di belawan oleh PT STTC menimbulkan dampak ekologis dan social. Penelitian ini bertujuan untuk menganalisis implikasi penimbunan terhadap lingkungan, terutama terhadap ekosistem perairan dan Masyarakat sekitar. Metode yang digunakan meliputi pengumpulan data sekunder dari dokumen terkait dan studi Pustaka. Hasil penelitian menunjukan bahwa penimbunan telah merusak kawasan hutan bakau dan hutan mangrove, semakin tinggi terjadinya banjir rob, serta terancam hilangnya matapencaharian Masyarakat. Penelitian ini merekomendasikan perlunya regulasi yang lebih ketat terhadap aktivitas oenimbunan dan Upaya rehabilitasi ekosistem Sungai untuk menjaga kelestarian lingkungan dan kesejahteraan Masyarakat.

Abstract

Desertion is a criminal offense that causes significant harm to multiple parties, particularly the perpetrator, their family, their military unit, and the state, which has invested substantial resources in their education and training. This study examines the following issues: how desertion committed by members of the Indonesian National Armed Forces (TNI) is regulated under applicable law; how the principles of military necessity are applied in adjudicating desertion cases involving TNI personnel; and how the ratio decision of military court judges is implemented in such cases, based on Decision No. 30-K/PM.I-02/AD/IV/2023 and Decision No. 34-K/PM.102/AD/IV/2023. This research employs a normative legal approach. The findings indicate that the legal framework governing desertion by TNI members is regulated under Article 87 paragraphs (2) and (3) of the Indonesian Military Criminal Code (KUHPM). Article 87 paragraph (2) provides that desertion committed during peacetime is punishable by imprisonment for a maximum of 2 years and 8 months, while paragraph (3) provides that desertion committed during wartime is punishable by imprisonment for a maximum of 8 years and 6 months. However, the KUHPM contains several terms that give rise to multiple interpretations, particularly regarding the concept of peacetime. The principle of military necessity in adjudicating desertion cases involving TNI members is inseparable from three fundamental principles: the principle of unity of command, the principle of command responsibility, and the principle of military necessity itself. These principles form the basis for examining desertion cases involving active TNI personnel. The ratio decidendi of military court judges in these cases, as reflected in Decision No. 30-K/PM.I-02/AD/IV/2023 and Decision No. 34-K/PM.I-02/AD/IV/2023, shows that the panel of judges found the defendants guilty of committing desertion on the grounds that they intentionally carried out the act and deliberately ceased performing their duties as military personnel, and that the acts were committed during peacetime
