Abstract

Protection of personal data in the digital era is increasingly becoming a challenge, especially in protecting children's data. Children who easily access social media and do not fully understand the dangers of spreading personal data will become easy targets for criminals. Moreover, now parents also often either intentionally or unintentionally share children's data on social media. This study evaluates the urgency of implementing specific protection for children’s personal data and identifies the limitations of the current regulations regarding the protection and processing of these data. Additionally, we highlight the inadequacy of protection for children’s personal data in Indonesia’s laws. This study proposes an expanded limitation to protect and process children’s personal data. The legal method in this study adopts a descriptive analytical approach using normative doctrinal methods and employs statute and comparative approaches with General Data Protection Regulation and Children’s Online Privacy Protection Act of 1998 in order to address the issue regarding personal data protection for children. The study concludes with a recommendation to amend the Personal Data Protection Law No. 27/2002 and promotes the protection for children’s data privacy.

Abstract

This study examines flood prediction in Jakarta, Indonesia, a pressing concern due to its significant implications for public safety and urban management. Machine Learning (ML) presents promising methodologies for accurately forecasting floods by leveraging weather data. However, flood prediction in Jakarta remains challenging due to the city’s highly variable weather patterns, including fluctuations in rainfall, humidity, temperature, and wind characteristics. Existing methods often struggle with these complexities, as they rely on traditional ML models such as K-Nearest Neighbors (KNN), which may not capture certain patterns or provide high accuracy and robustness. Therefore, this study proposes three ML methods—Logistic Regression (LR), LightGBM, and XGBoost—to predict floods accurately. Five performance metrics (i.e., accuracy, area under the curve (AUC), precision, recall, and F1-score) were used to measure and compare the accuracy of the algorithms. The proposed method consists of three main processes. The first process involves data preprocessing and evaluation using 14 different ML models. In the second process, additional feature engineering is applied to improve the quality of the data. Finally, the third process combines the previous steps with oversampling techniques and cross-validation methods. This structured approach aims to enhance the overall performance of the analysis. The experimental results show that Process 3 significantly improves performance compared to Processes 1 and 2. The model predicts floods with an accuracy score of 93.82% for LR, 96.67% for XGBoost, and 96.81% for LightGBM, respectively. Thus, the proposed model offers a solution for operational decision-making in flood risk management, including flood mitigation planning.

Abstract

In line with the progress of the global economy, especially in Indonesia, it is recognized that a digitalization and modernization era has taken place, which continues to evolve and never ceases. This necessitates cooperatives to strengthen themselves to be healthier, self-reliant, modern, strong, and competitive, in accordance with cooperative principles, enabling them to play a role as a "pillar of the national economy." In April 2022, the Minister of Cooperatives and Small and Medium Enterprises Regulation on Cooperatives with a Multi-Party Model Number 8 of 2021, hereinafter referred to as "Permenkop UKM KMP," came into effect on October 21, 2021. In other countries, the Multi-Party Model Cooperatives, referred to as "KMP," have been commonly used for various business purposes. For example, they have been established in the United Kingdom since 1870, in the United States since the 1990s, in Italy since 1991, in Canada since 1997, in Portugal since 1998, and in France since 2001. Firdaus Putra, the Chairman of the Indonesian Consortium For Cooperative Innovation (ICCI), mentioned in a webinar on the dissemination of Minister of Cooperatives and SMEs Regulation No. 8 of 2021 concerning Multi-Party Model Cooperatives, that Italy is the best-practice example of KMP globally, with approximately 14,000 KMPs as of today. However, with the issuance of Permenkop UKM KMP in Indonesia, the history of Permenkop UKM KMP began only in 2022, making it a relatively new terminology in Indonesia. The issuance of Minister of Cooperatives and SMEs Regulation Number 8 of 2021 on Cooperatives with a Multi-Party Model raises several questions about the reasons behind the introduction of this new regulation. For instance, is the regulation solely implemented as a UUCK (Job Creation Law) enforcement measure, given the mention of the need for cooperatives to support job creation, even though it is not explicitly explained which type of cooperatives are referred to in the UUCK.

Abstract

An individual company is obliged to modify its legal status to a Capital Partnership Company if it is considered as no longer applies for Micro and Small Enterprises (UMK) / MSEs criteria. However, there are no provisions regarding the consequences if it is not made. It leads to unclear legal entity status and the responsibilities of individual companies which do not meet the standards of the Micro and Small Enterprises (UMK). This study aims to (1) analyze Individual Companies legal entity status which does not apply the UMK standards, and (2) analyze the legal implications of Individual Companies which no longer meet the UMK criteria. This study used normative juridical research method with a statutory approach and analysis of legal concepts. The results show that individual legal entity status of companies which do not meet the UMK criteria has not been rigidly regulated in the Job Creation Law or its regulations. However, individual companies which do not meet the UMK criteria are considered as no longer meet the legal entity requirements which are regulated in the Job Creation Law. Therefore, de jure, Individual Company legal entity status is no longer a legal entity, but de facto it is still registered as a legal entity. In addition, the legal implication is considered as the loss of the limited liability of the Individual Company.

Abstract

This study is motivated by the incompleteness of the norms in Article 88 Paragraph (2) of Minister of Finance Regulation No. 122 of 2023 regarding the exception of the 5 working days time limit from the auction for heirs of individual voluntary auction buyers. The aims of this study are to analyze the urgency of establishing time limit exclusion arrangements for the heirs of individual voluntary auction buyers for immovable property. Furthermore, this study was of a normative juridical type using a statute approach and conceptual approach. The results of this study shows that upon death, rights and obligations transfer to heirs. So that the heirs must settle auction payments within 5 working days and pay BPHTB. Thus, necessary to add a clause to Article 88 Paragraph (2) of Minister of Finance Regulation No. 122 of 2023 ensures legal certainty and justice for heirs of individual voluntary auction buyers.

Abstract

Non-performing loans (NPLs) strain creditor-debtor relationships, jeopardizing economic stability. Traditional dispute resolution methods are costly, time-consuming, and often fail to meet the needs of both parties. This paper introduces a novel, efficiency-based approach to NPL dispute resolution, grounded in economic analysis of law. By optimizing resource allocation, it minimizes transaction costs and resolution time, benefiting both creditors and debtors. Using a qualitative and normative methodology, the study explores the application of efficiency principles in Indonesia. The findings highlight that an efficient dispute resolution paradigm can enhance outcomes, foster trust in the banking system, and provide economic benefits. The paper advocates for legal reforms to promote mediation and arbitration, ensuring faster, cost-effective, and sustainable solutions to NPL disputes.

Abstract

Mawdu’i commentary is a method of Quranic interpretation that analyzes a specific surah or gathers verses with similar themes under one topic. This study employs a mawdu’i approach to examine the meaning of hanif in the Qur’an, focusing on verses that explicitly contain the word without including its derivations. The objective is to determine the criteria of the hanif religion practiced by Prophet Ibrahim while comparing interpretations from Meccan and Medinan period verses. Additionally, this research explores scholarly perspectives to contextualize the concept of hanif in Islamic theology. Using a qualitative mawdu’i approach, this study integrates linguistic, theological, and historical analyses. Its novelty lies in the contextual comparison of Quranic revelations, offering a dynamic interpretation of hanif. The findings reveal five key characteristics of the hanif religion: an inclination toward monotheism, sincerity in worship, belief in all messengers of Allah, orientation toward the Kaaba and Hajj, and a strong commitment to affirming Allah’s Oneness. This research highlights the Quranic legitimacy of Islam as the continuation of Ibrahim’s millah, distinguishing it from Jewish and Christian claims. By providing a structured thematic analysis, this study enhances the understanding of hanif and its relevance in contemporary Islamic thought. It emphasizes hanif as a foundational principle of monotheism, guiding Muslims in faith and devotion to Allah.
